## Report on Land Acquisition for National Highway 9 (NH9) Expansion in Maharashtra
**1. Executive Summary:**
This report analyzes a notification issued by the Ministry of Road Transport and Highways, Government of India, regarding land acquisition for the building, widening, four-laning, maintenance, management, and operation of National Highway 9 (NH9) in the state of Maharashtra. This is not a new policy but rather a declaration to acquire specific land parcels after due process. The notification declares that the specified land will vest absolutely in the Central Government, free from all encumbrances, and details the affected land parcels in the Osmanabad district. The key finding is the finalization of the land acquisition process for this segment of NH9 to facilitate its expansion.
**2. Introduction:**
This report aims to provide stakeholders with a comprehensive overview of the notification S.O. 5838(E) issued on December 13, 2022, by the Ministry of Road Transport and Highways, concerning land acquisition for NH9 in Maharashtra. The analysis is based solely on the information provided within the notification.
**3. Policy Overview:**
This notification is issued under subsection 1 of section 3D of the National Highway Act, 1956 (48 of 1956). The core objective, inferred from the text, is to acquire land for the building, widening, four-laning, maintenance, management, and operation of NH9. This notification represents the final stage of the acquisition process.
**4. Background and Rationale:**
This notification comes after the initial intention to acquire the land was published (S.O. 727 E dated 16022022). Objections were received, considered, and disallowed. The Competent Authority submitted its report to the Central Government. The rationale for this notification is to formally acquire the necessary land for the stated improvements to NH9, removing any legal impediments.
**5. Key Provisions / Changes:**
This notification officially declares that the land specified in the schedule will be acquired for the project purpose, the NH9 improvements. Upon publication in the Official Gazette, the land vests absolutely in the Central Government, free from all encumbrances. The notification includes a schedule detailing the specific land parcels to be acquired. The schedule lists the survey number, type of land (private, agriculture, resident), area in hectares, and the name of the land owner/interested person. The land falls within the stretch of Land from Km. 269800 to Km. 348800 Maharashtra Section of the NH9 New National Highway. 65 in the state of MAHARASHTRA. Specific affected villages are Dalimb, Jakekur, Talmod, Turori, Itkal and Jalkot.
**6. Target Audience and Stakeholders:**
The primary target audience and stakeholders are:
* Landowners and interested parties listed in the Schedule.
* Residents and businesses in the Osmanabad district, particularly those near NH9, who may experience disruptions during the road work but will ultimately benefit from improved infrastructure.
* The construction companies involved in the NH9 expansion project.
* The Osmanabad district administration.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Ministry of Road Transport and Highways is the primary responsible agency. The Competent Authority (as referenced in the text) is responsible for submitting the report to the Central Government. The Osmanabad district administration is likely involved in the on-the-ground implementation of the land acquisition.
* **Timelines/Procedures:** The notification states that the land vests in the Central Government upon publication in the Official Gazette. Further timelines for compensation, relocation (if applicable), and the commencement of construction activities are not specified in this document.
**8. Expected Outcomes / Impact of Changes:**
The intended outcome is to facilitate the building, widening, four-laning, maintenance, management, and operation of NH9. The likely impact includes:
* Improved transportation infrastructure in the region.
* Increased efficiency of traffic flow.
* Potential economic benefits due to improved connectivity.
* Displacement and resettlement of landowners, with compensation as per applicable laws.
* Temporary disruptions during the construction phase.
**9. Conclusion:**
The notification issued by the Ministry of Road Transport and Highways signifies the final step in the land acquisition process for a specific segment of NH9 in Maharashtra. This is a crucial step towards improving the highway infrastructure, with expected benefits for transportation and economic activity in the region. The affected landowners are directly impacted and entitled to compensation as per the National Highway Act, 1956. This document demonstrates the government proceeding after addressing objections regarding land acquisition for infrastructure development.
