L.-33004/99 सी.जी.-डी.एल.-अ.-16072025-264712 xxxGIDHxxx CG-DLxx-ExG-I1D6E0x7x2x0 25-264712 असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 3170] नई दिल्ली, बुधिार, िुलाई 16, 2025/आषाढ़ 25, 1947 No. 3170] NEW DELHI, WEDNESDAY, JULY 16, 2025/ASHADHA 25, 1947 कोयला मत्रं ालय अजधसचू ना नई दिल्ली, 16 िुलाई, 2025 का.आ. 3240(अ).— कोयला धारक क्षत्रे (अिजन और जिकास) अजधजनयम 1957 (1957 का 20) (जिसे इसम ें इसके पिचात उक्त अजधजनयम कहा गया ह)ै की धारा 9 की उपधारा (1) के अधीन िारी, भारत के रािपत्र, असाधारण, भाग 2, खण्ड 3 उप-खण्ड (ii), तारीख 27 निंबर 2024 म ें भारत सरकार के कोयला मंत्रालय की अजधसूचना संखयांक का.आ. 5079(अ), तारीख 27 निंबर 2024 के प्रकािन पर उक्त अजधसूचना स े सलं ग्न अनुसूची म ें िर्णजत भूजम म ें और ऐसी भूजम (जिस ेइसम ेंइसके पिचात उक्त भूजम कहा गया ह)ै , में और उस पर के सभी अजधकार, उक्त अजधजनयम की धारा 10 की उपधारा (1) के अधीन, सभी जिल् लगं मों स े मक्तु होकर, आत्यंजतक रूप स े केन्द्रीय सरकार म े जनजहत हो गए ह;ैं और, केन्द्रीय सरकार का यह समाधान हो गया ह ै दक सेंरल कोलफील््स जलजमटेड, जिला रााँची, झारखडं (जिस े इसम ें इसके पश्चात सरकारी कंपनी कहा गया ह)ै , ऐस े जनबंधनों और ितों का जिन्द्ह ें केन्द्रीय सरकार इस जनजमत्त अजधरोजपत करना उजचत समझे, अनुपालन करने के जलए सहमत ह;ै 4740 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अतः अब, केन्द्रीय सरकार, उक्त अजधजनयम की धारा 11 की उपधारा (1) द्वारा प्रित िजक्तयों का प्रयोग करत े हुए, यह जनिेि िते ी ह ै दक इस प्रकार जनजहत भूजम 1193.19 एकड़ (लगभग) या 482.87 हक्े टेयर (लगभग) माप िाली भूजम म ें और उक्त भूजम म ेंया उस पर के सभी अजधकार तारीख 27 निंबर 2024 स ेकेन्द्रीय सरकार म ेंइस प्रकार जनजहत बने रहन ेके बिाय, जनम्नजलजखत जनबन्द्धनों और ितों के अधीन रहत े हुए, सरकारी कंपनी म ेंजनजहत हो िाएंगे, अर्ातज :

I. सरकारी कंपनी, उक्त अजधजनयम और अन्द्य सुसंगत जिजधयों के उपबंधों के अधीन यर्ा अिधाररत प्रजतकर, ब्याि, क्षजतयों आदि और िैसी ही मिों की बाबत सभी संिाय करेगी;

II. उक्त अजधजनयम की धारा 14 के अधीन अजधकरण का गठन दकया िाएगा, जिसमें ित ज(i) के अधीन सरकारी कंपनी द्वारा संिेय रकमों का अिधारण करन े के प्रयोिनों के जलए, और ऐसे दकसी अजधकरण और उक्त अजधकरण की सहायता करने के जलए जनयुक्त व्यजक्तयों के संबंध में उपगत सभी व्यय, सरकारी कंपनी द्वारा िहन दकए िाएंगे, और इसी प्रकार जनजहत उक्त भूजम म ें या उस पर के अजधकारों के जलए या उनके संबंध म ें अपील आदि सभी जिजधक कायजिाजहयों की बाबत उपगत, सभी व्यय भी, सरकारी कंपनी द्वारा िहन दकए िाएगं े;

III. सरकारी कंपनी, केन्द्रीय सरकार या उसके पिाजधकाररयों की, ऐसे दकसी अन्द्य व्यय के संबंध म ेंक्षजतपूर्तज करेगी, िो इस प्रकार जनजहत उक्त भूजम म ें या उस पर के अजधकारों के बारे म,ें केन्द्रीय सरकार या उसके पिाजधकाररयों द्वारा या उनके जिरूद्ध दकन्द्हीं कायिज ाजहयों के संबंध म ेंआिश्यक हो;

IV. सरकारी कंपनी को, केन्द्रीय सरकार के पूिज अनुमोिन के जबना, उक्त भूजम और उसके अजधकारों को दकसी अन्द्य व्यजक्त को अन्द्तरण करन े की िजक्त नहीं होगी; और V. सरकारी कंपनी, ऐसे जनिेिों और ितों का पालन करेगी, िो केन्द्रीय सरकार द्वारा, िब कभी आिश्यक हो, उक्त भूजम के जिजिष्ट क्षेत्रों के जलए दिए िाए ं या अजधरोजपत दकए िाएं। [फा. सं. 43015/5/2021-एलएआईआर] भबानी प्रसाि पजत, संयक्ु त सजचि MINISTRY OF COAL

NOTIFICATION New Delhi, the 16th July, 2025 S.O. 3240(E).—Whereas on the publication of the notification of the Government of India in the Ministry of Coal, number S.O. 5079 (E), dated the 27th November, 2024 in the Gazette of India, Extraordinary, Part II, Section 3, Sub-Section (ii), dated the 27th November, 2024, issued under sub-section (1) of section 9 of the Coal Bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act), the land and all rights in or over the land described in the Schedule appended to the said notification (hereinafter referred to as the said land) are vested absolutely in the Central Government free from all encumbrances under sub-section (1) of section 10 of the said Act;

And whereas the Central Government is satisfied that the Central Coalfields Limited, Ranchi, Jharkhand (hereinafter referred to as the Government company) is willing to comply with such terms and conditions as the Central Government thinks fit to impose in this behalf;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 11 of the said Act, the Central Government hereby directs that the said land measuring 1193.19 acres (approximately) or 482.87 hectares

(approximately) and all rights in or over the said land so vested, shall with effect from 27th November, 2024, instead of continuing to so vest in the Central Government shall vest in the Government company, subject to the following terms and conditions, namely:-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 i. the Government company shall make all payments in respect of compensation, interest, damages and the like, as determined under the provisions of the said Act and other relevant laws;

ii. a Tribunal shall be constituted under section 14 of the said Act, for the purpose of determining the amounts payable by the Government company under condition (i) and all expenditure incurred in connection with any such tribunal and persons appointed to assist the Tribunal shall be borne by the Government company and similarly, all expenditure incurred in respect of all legal proceedings like appeals, etc., for or in connection with the rights, in or over the said land so vested, shall also be borne by the Government company;

iii. the Government company shall indemnify the Central Government and its officials against any other expenditure that may be necessary in connection with any proceedings by or against the Central Government or its officials, regarding the rights in or over the said land so vested;

iv. the Government company shall have no power to transfer the said land and the rights to any other persons without the prior approval of the Central Government; and v. the Government company shall abide by such directions and conditions as may be given or imposed by the Central Government for particular areas of the said land, as and when necessary.
