L.-33004/99 सी.जी.-डी.एल.-अ.-15032024-253078 CG-DxLx-xEG-I1D5H0x3x2x0 24-253078 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 197] नई दिल्ली, िुक्रवार, माचध 15, 2024/फाल्ग नु 25, 1945 No. 197] NEW DELHI, FRIDAY, MARCH 15, 2024/PHALGUNA 25, 1945 वाजणज्य और उद्योग मत्रं ालय (उद्योग सवं धनध और आतं ररक व्यापार जवभाग) अजधसचू ना नई दिल्ली, 15 माच,ध 2024 सा.का.जन. 211(अ).— िबदक पेटेंट जनयम, 2003 म ें और संिोधन करन े के जलए, पेटेंट अजधजनयम, 1970 (1970 का 39) की धारा 159 की उप धारा (3) की अपेक्षा के अनुसार, कजतपय जनयमों के मसौि े को, वाजणज्य और मंत्रालय (उद्योग संवधधन और आंतररक व्यापार जवभाग) भारत सरकार की अजधसूचना संख्या सा.का.जन. 619 (अ) दिनांक 23 अगस्ट्त, 2023 के द्वारा भारत के रािपत्र, असाधारण, भाग II, खण्ड 3, उप-खण्ड (i) म ें प्रकाजित दकया गया था, जिसके माध्यम स,े इससे प्रभाजवत होने वाल े सभी संभाजवत व्यजियों से आपजियां और सुझाव आमंजत्रत दकए गए थे। और, िबदक, उि अजधसूचना की प्रजतयां आम लोगों को 23 अगस्ट्त, 2023 को उपलब्ध करा िी गईं थीं। और, िबदक, उि मसौिा जनयमों के संबंध म ें आम लोगों स े प्राप्त आपजियों और सुझावों पर जवजधवत रूप स े केंद्र सरकार द्वारा जवचार दकया गया ह।ै अतः अब, पेटेंट अजधजनयम, 1970 की धारा 159 (1970 का 39) द्वारा प्रिि िजियों का प्रयोग करते हुए, केंद्र सरकार एतद्वारा पेटेंट जनयम, 2003 म ेंऔर संिोधन करन े के जलए जनम्नजलजखत जनयम बनाती ह,ै नामतः - 1. (1) इन जनयमों को पेटेंट (संिोधन) जनयम, 2024 कहा िाएगा। (2) ये जनयम आजधकाररक रािपत्र म ें इनके प्रकािन की तारीख स े प्रभावी होंगे। 2018 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. पेटेंट जनयम, 2003 म,ें जिसे इसके बाि उक्त जनयम कहा गया ह,ै जनयम 12 म,ें - (i) उप जनयम (2) म,ें ‘ऐसी फाइललंग की तारीख स े छ: माह’ िब् िों को ‘जनयम 24ख के उप जनयम (3) अथवा जनयम 24ग के उप जनयम (8) के तहत आपजि का प्रथम जववरण िारी दकए िान े की तारीख स े तीन माह’ िब् िों से प्रजतस्ट् थाजपत दकया िाएगा। (ii) उप जनयम खडं (3) के जलए, जनम् नजलजखत उप जनयमों को प्रजतस्ट् थाजपत दकया िाएगा, नामत:- ‘3. जनयंत्रक, भारत के बाहर दकसी ििे म ें फाइल दकए गए आवेिन स े संबंजधत िानकारी पर जवचार करन े के जलए, पहुचं वाल े और उपलब्ध डाटाबेस का इस्ट् तेमाल कर सकता; 4. जनयंत्रक, धारा 8 की उप-धारा (2) के तहत , जलजखत म ें िि ध दकए िाने वाले कारणों के जलए, जनयंत्रक द्वारा ऐसी सूचना मांगन े की तारीख स े िो माह के भीतर, आवेिक को प्रपत्र 3 म ें नया जववरण और घोषणापत्र प्रस्ट्त ुत करने का जनिेि ि ेसकता ह।ै 5. जनयमों म ें कुछ भी जनजहत होने के बाविूि, जनयंत्रक प्रपत्र 4 म ें अनरु ोध दकए िाने पर 3 माह की अवजध के जलए प्रपत्र 3 की फाइललंग म ें जवलंब को माफ कर सकता ह ैअथवा समय को बढा सकता ह।ै ’ 3. उक्त जनयम के जनयम 13 म ें उप-जनयम (2) के पश् चात,् जनम्न जलजखत उप जनयम को िाजमल दकया िाएगा, नामत: - ‘(2क) कोई पेटेंट आवेिक, यदि वह चाह े तो, अनंजतम अथवा संपूण ध जवजनिेि म ें उजल्लजखत आजवष्क ारों अथवा धारा 16 के अंतगतध आग े आविे न फाइल करने सजहत, धारा 16 के तहत एक या अजधक भाग के रूप म ें आग े आवेिन िायर कर सकता ह।ै ’ 4. उक्त जनयमों के जनयम 24ख म,ें- (क) उप-जनयम (1) म,ें (i) ‘अड़तालीस महीने’ िब् ि िहा ं भी आया हो, उसे ‘इकतीस महीने’ िब् ि स ेप्रजतस्ट्थ ाजपत दकया िाएगा। (ii) उप-जनयम (1) म,ें खंड (v) के बाि जनम्न जलजखत खंड को िाजमल दकया िाएगा, नामत:- ‘(vi) पेटेंट (संिोधन) जनयम, 2024 के लागू होन े स े पहल,े िायर दकए गए आवेिन के संबंध म,ें इस उप-जनयम म ें कुछ भी जनजहत होन े के बाविूि, धारा 11ख की उप-धारा (1) के तहत िांच का अनुरोध पेटेंट (संिोधन) जनयम, 2024 के लाग ू होने स ेपहल े इस उप जनयम के तहत जवजनर्िष्ध ट अवजध होगी।’ (ख) उप-जनयम (6) म,ें ‘उप-जनयम (5) म ें जवजनर्िष्ध ट ’ िब् िों, कोष्ठ कों और अंकों को ‘इसम ें जवजनर्िष्ध ट ’ िब् िों स े प्रजतस्ट् थाजपत दकया िाएगा। 5. मूल जनयम के जनयम 24ग म,ें उप-जनयम (11) म,ें ‘उप-जनयम (10) म ें जवजनर्िष्टध ’ िब् िों, कोष्ठ कों और अंकों को ‘इसम ें जवजनर्िष्ध ट ’ िब् िों स े प्रजतस्ट् थाजपत दकया िाएगा। 6. उक्त जनयमों म,ें जनयम 29 के बाि, जनम्न जलजखत जनयम को िाजमल दकया िाएगा, नामत: - ‘29क. ररयायत अवजध – धारा 31 के तहत जवजनर्िष्टध अवजध प्राप् त करने के जलए प्रथम अनुसूची म ें जवजनर्िष्टध िुल्क सजहत प्रपत्र 31 म ेंआवेिन िायर दकया िाएगा।’ 7. उक्त जनयमों म,ें जनयम 55 म:ें (क) उप-जनयम (3) को जनम्नजलजखत उप जनयम स े प्रजतस्ट्थाजपत दकया िाएगा, नामतः – “(3) अभ्यावेिन पर जवचार करते हुए यदि जनयंत्रक संतष्टु ह ैदक - (क) यदि अभ्यावेिन म ें प्रथम िष्टृ या मामला नहीं बनता ह,ै तो वह जवरोधकताध को तिनुसार सूजचत करेगा, और - (i) िब तक जवरोधकताध इस मामले म ें सुनवाई का अनुरोध नहीं करता ह,ै तब तक जनयंत्रक ऐसी अजधसूचना की तारीख स े एक माह के भीतर अभ्यावेिन स े इनकार करन े के आधारों को ररकॉडध करत े हुए एक स्ट्पष्ट आिेि पाररत करेगा।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (ii) यदि जवरोधकताध सुनवाई के जलए अनरु ोध करता ह,ै तो जनयंत्रक, जवरोधकताध को सुनवाई का अवसर िेने के बाि, सुनवाई की तारीख स े एक माह के भीतर एक स्ट्पष्ट आिेि पाररत करेगा, जिसम ें अभ्यावेिन को अस्ट्वीकार करने या प्रथम िष्ृ ट या स्ट्वीकार करने के आधार को ििध दकया िाएगा तथा आवेिक को तिनुसार सूजचत दकया िाएगा।” (ख) अभ् यावेिन में प्रथम िष्ृ ट या मामला बनन े पर, जनयंत्रक अभ् यावेिन प्राप् त होन े की तारीख स े एक माह के भीतर अपने कारणों को ििध करते हुए आििे पाररत करेगा और आवेिक को तद्नुसार सूजचत करेगा। (ख) उप-जनयम (4) म,ें िब्ि ‘तीन महीने’ को िब्ि ‘िो महीने’ स े प्रजतस्ट्थाजपत दकया िाएगा; और (ग) उप-जनयम (5) के बाि जनम्न जलजखत उप जनयमों को िाजमल दकया िाएगा, नामत: - “(5क) जनयम 62 के उप-जनयम (2) स े (4) म ें जवजनर्िष्ध ट प्रदक्रया, िहां तक संभव हो सके, इस जनयम के तहत सुनवाई की प्रदक्रया पर लागू होगी। (5ख) ऐसा पेटेंट आवेिन, जिसके जलए जवरोध का अभ्यावेिन िायर दकया गया ह ै तथा जनयम 3 के तहत जनयंत्रक द्वारा नोरटस िारी दकया गया ह,ै उसकी जनयम 24ग के अनुसार िांच की िाएगी।” 8. उक्त जनयमों के जनयम 56 म,ें उप-जनयम (4) म ें ‘तीन महीने’ िब् ि को ‘िो महीने’ िब् ि स े प्रजतस्ट् थाजपत दकया िाएगा। 9. उक्त जनयमों के जनयम 70 के बाि, जनम्नजलजखत जनयम िाजमल दकया िाएगा, नामतः- '70क. आजवष्कारकता ध का प्रमाणपत्र - (1) जनयंत्रक लाग ू पेटेंट के संबंध म ें दकसी आजवष्कारक को, प्रथम अनुसूची म ें जवजनर्िष्टध िल्ु क के साथ प्रपत्र-8क म ें आजवष्कारक द्वारा दकए गए अनरु ोध पर, आजवष्कारकताध का प्रमाणपत्र िारी कर सकेगा। (2) जनयंत्रक, दकसी आजवष्कारक के अनरु ोध पर, प्रथम अनुसचू ी म ें जवजनर्िष्टध िुल्क के साथ प्रपत्र-8क म,ें प्रवृि पेटेंट के संबंध म ें आजवष्कारक को आजवष्कारकताध का प्रमाणपत्र की प्रजतजलजप िारी कर सकेगा और इस अनुरोध म ें उन पररजस्ट्थजतयों का एक जववरण होगा, जिन पररजस्ट्थजतयों म ें आजवष्कारकताध का मलू प्रमाण पत्र खो गया हो, नष्ट हो गया हो, क्षजतग्रस्ट्त हो गया हो या प्रस्ट्तुत नहीं दकया िा सकता। 10. उक्त जनयमों के जनयम 80 म,ें उप-जनयम (3) को जनम्न जलजखत उप-जनयम स े प्रजतस्ट् थाजपत दकया िाएगा, नामत: - ‘(3) िो वषध अथवा उससे अजधक की अवजध के जलए िये वार्षधक नवीकरण िल्ु क का अजग्रम भगु तान दकया िा सकता ह;ै बिते दक िहां कम स ेकम 4 वषध की अवजध के जलए इलेक्र ॉजनक तरीके स ेनवीकरण िुल् क के जलए अजग्रम भुगतान दकया गया ह,ै वहा,ं ऐसे भुगतान पर िल्ु क म ें िस प्रजतित की कटौती लागू होगी।’ 11. उक्त जनयमों के जनयम 110 म,ें उप-जनयम (2) म,ें- क) ‘पेटेंट अजधजनयम और जनयम’ िब् िों को ‘पेटेंट अजधजनयम, 1970 (1970 का 39), पेटेंट जनयम, 2003, जडिाइन अजधजनयम, 2000 (2000 का 16) और जड िाइन जनयम, 2001’ स े प्रजतस्ट्थ ाजपत दकया िाएगा। ख) ‘पेटेंट जविेषताए’ं िब् िों को ‘पेटेंट जविेषताए,ं जडिाइन जविेषताए’ं िब् िों स े प्रजतस्ट् थाजपत दकया िाएगा। 12. उक्त जनयमों के जनयम 131 म,ें उप-जनयम (2) को जनम्न जलजखत उप-जनयम स े प्रजतस्ट् थाजपत दकया िाएगा, नामत:- ‘(2) उप-जनयम (1) म ें संिर्भधत जववरण तीन जवत् त वषों की प्रत् यके अवजध के संबंध म ें एक बार प्रस्ट्त ुत दकए िाएंगे, जिसकी िुरुआत उस जवत् त वषध के तुरंत बाि िुरू होने वाले जवत् त वषध स े होगी जिसम ें पेटेंट प्रिान दकया गया था, तथा य ेजववरण ऐसी प्रत् यके अवजध की समाजप्त के छ: माह के भीतर प्रस्ट् तुत दकए िाएंगे: बिते दक जनयंत्रक, प्रपत्र 4 म ें अनुरोध दकए िाने पर तीन माह तक की अवजध के जलए ऐस े जववरण को िायर करने म ेंहुए जवलंब को क्षमा कर सकता ह ैअथवा समय को बढा सकता ह।ै ’4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 13. उक्त जनयमों के जनयम 137 को उप जनयम (1) जलखा िाएगा और उप जनयम (1) को यह संख् या िेन े के बाि जनम्नजलजखत उप जनयम को िाजमल दकया िाएगा, नामत:- (2) उप-जनयम (1) म ें जनजहत प्रावधान जनम्न जलजखत स े संबंजधत मामलों के जलए लागू नहीं होंग-े (i) जनयम 12 के उप- जनयम (5) के तहत समय के जवस्ट्तार या िेरी की माफी; (ii) जनयम 20 का उप-जनयम (4) के खंड (i) और जनयम 20 का उप-जनयम (6); (iii) जनयम 21; (iv) जनयम 24ख का उप-जनयम (1), (5) और (6); (v) जनयम 24ग का उप-जनयम (10) और (11); (vi) जनयम 55 का उपजनयम (4); (vii) जनयम 80 का उपजनयम (1क); (viii) जनयम 130 का उपजनयम (1) और (2); (ix) जनयम 131 का उपजनयम (2)”। 14. उक्त जनयमों के जनयम 138 को जनम्नजलजखत जनयम स े प्रजतस्ट्थाजपत दकया िाएगा, नामत: - ‘138. जनधारध रत समय-सीमा को बढान े अथवा जवलबं को माफ करन े की िजि- इन जनयमों म ें कुछ भी जनजहत होन े के बाविूि, प्रपत्र 4 म ें अनरु ोध करने पर, दकसी काय ध को करन े अथवा इनके तहत कोई कायधवाही करने के जलए जनधाधररत समय-सीमा को जनयंत्रक द्वारा 6 माह की अवजध तक बढाया िा सकता ह ै अथवा जवलंब को माफ दकया िा सकता ह ै िहा ं ऐसा अनुरोध छ: माह की उक्त अवजध समाप्त होने स ेपूवध दकया गया हो। बिते दक ऐसा अनुरोध छ: माह की जनधाधररत अवजध के भीतर एक स े अजधक बार दकया िा सकता ह।ै 15. उक्त जनयमों म ेंपहली अनसु ूची के सारणी-1 के जलए, जनम्नजलजखत सारणी प्रजतस्ट्थाजपत की िाएगी, नामत:- सारणी-1 प्रजवजष्ट जिस पर संिये है संबद्ध ई-फाइललंग के जलए वास्ट्तजवक रूप में फाइल करने संख्या प्रपत्र के जलए संख्या व्यजि (व्यजियों) अन्य, अकेले व्यजि अन्य, अकेले अथवा स्ट्टाटधअप (व्यजियों) या व्यजि या व्यजि (अप्स ) अथवा अथवा (व्यजियों) (व्यजियों) छोटी स्ट्टाटधअप अथवा स्ट्टाटध- अथवा स्ट्टाटध- कंपनी/(यों) (अप्स ) अथवा अप (अप्स ) अप (अप्स ) अथवा िैजक्षक छोटी कंपनी अथवा छोटी अथवा छोटी संस्ट्थान(नों) के /(यों) अथवा कंपनी/(यों) कंपनी /(यों) जलए िैजक्षक अथवा िैजक्षक अथवा िैजक्षक संस्ट्थान संस्ट्थान संस्ट्थान (नों) के जलए (नों) के जलए (नों) के जलए 1 2 3 4 5 6 7 रुपए रुपए रुपए रुपए 1. अनंजतम या पूणध जवजिष्टताओं के साथ धारा 1 1600 8000 1750 8800 7, 54* और 135 और जनयम 20(1) के प्रत्येक अलग प्रत्येक अलग प्रत्येक अलग प्रत्येक अलग अधीन दकसी पेटेंट के जलए आवेिन पर - वरीयता के जलए वरीयता के वरीयता के वरीयता के 1600 के गुणि में ज लए 8000 के जलए 1750 के जलए 8800 के गुणि में गुणि में गुणि में (i) 30 के अजतररि प्रत्येक जववरण पन्ने के (i) 160 (i) 800 (i) 180 (i) 880 जलए, जनयम (9) के उप जनयम (3) के अधीन न्यूजक्लयोटाइड और/या अमीनो अम्ल के अनुसूची क्रम को छोड़कर; AND, WHEREAS, copies of the said notification were made available to the public on the 23st August, 2023; AND, WHEREAS, the objections and suggestions received from the public in respect of the said draft rules have been duly considered by the Central Government; NOW, THEREFORE, in exercise of the powers conferred by section 159 of the Patents Act, 1970 (39 of 1970), the Central Government hereby makes the following rules further to amend the Patents Rules, 2003, namely: - 1. (1) These rules may be called the Patents (Amendment) Rules, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Patents Rules, 2003, hereinafter referred to as the said rules, in rule 12, - (i) in sub-rule (2), for the words ‘six months from the date of such filing’, the words ‘three months from the date of issuance of first statement of objections under sub-rule (3) of rule 24B or sub-rule (8) of rule 24C’ shall be substituted; (ii) for sub-rule (3), the following sub-rule shall be substituted, namely: - “3. The Controller may, use accessible and available databases, for considering the information relating to applications filed in a country outside India. 4. The Controller may, under sub-section (2) of section 8, for reasons to be recorded in writing, direct the applicant to furnish a fresh statement and undertaking in Form 3 within two months from the date of such communication by the Controller. 5. Notwithstanding anything contained in these rules, the Controller may condone the delay or extend the time for filing Form 3 for a period up to three months upon a request made in Form 4.”. 3. In rule 13 after sub-rule (2) of the said rules, the following sub-rule shall be inserted, namely, - “(2A) A patent applicant may, if he so desires, file one or more further applications under section 16, including in respect of an invention disclosed in the provisional or complete specification or a further application filed under section 16.”. 4. In rule 24B of the said rules, - (a) in sub-rule (1), - (i) for the words ‘forty-eight months’, wherever they occur, the words ‘thirty-one months’ shall be substituted; (ii) in sub-rule (1), after clause (v), the following clause shall be inserted, namely, - ‘(vi) Notwithstanding anything contained in this sub-rule, in respect of an application filed before commencement of the Patents (Amendment) Rules, 2024, the period for making request for examination under sub-section (1) of section 11B shall be the period specified under this sub-rule before the commencement of the Patents (Amendment) Rules, 2024.’; (b) in sub-rule (6), for the words, brackets and figure ‘specified under sub-rule (5)’, the words ‘specified herein’ shall be substituted. 5. In rule 24C of the said rules, in sub-rule (11), for the words, brackets and figure ‘specified under sub-rule (10)’, the words ‘specified herein’ shall be substituted. 6. In the said rules, after rule 29, the following rule shall be inserted, namely, -[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 23 “29A. Grace period. - An application to avail the period specified under section 31 shall be filed in Form 31, along with the fees specified in the First Schedule.”. 7. In the said rules, in rule 55: (A) for sub-rule (3), the following sub-rule shall be substituted, namely, - “(3) On consideration of the representation if the Controller is satisfied that, - (a) no prima facie case is made out in the representation, he shall notify the opponent accordingly, and - (i) unless the opponent requests to be heard in the matter, the Controller shall, within one month from the date of such notification, pass an order recording the grounds for refusal of the representation; (ii) if opponent requests for a hearing, the Controller shall, after giving the opponent an opportunity of being heard, pass an order within one month from the date of hearing, recording his reasons for refusal or prima facie acceptance of the representation and the applicant shall be notified accordingly. (b) a prima facie case is made out in the representation, the Controller shall, within one month of receiving the representation, pass an order recording his reasons and notify the applicant accordingly. (B) in sub-rule (4) for the word ‘three months’, the word ‘two months’ shall be substituted; (C) after sub-rule (5), the following sub-rules shall be inserted namely: - “(5A.) The procedure specified in sub-rules (2) to (4) of rule 62 shall, as far as may be, apply to the procedure for hearing under this rule. (5B) An application for a patent, in which a representation for opposition has been filed and notice has been issued by the Controller under rule 3, shall be examined in accordance with rule 24C.”. 8. In rule 56 of the said rules, in sub-rule (4), for the word ‘three months, the word ‘two months’ shall be substituted. 9. After rule 70 of the said rules, the following rule shall be inserted, namely: - ‘70A. Certificate of inventorship. - (1) The Controller may issue a certificate of inventorship to an inventor in respect of a patent in force, on a request made by the inventor in Form-8A along with fee specified in the First Schedule. (2) The Controller may issue a duplicate certificate of inventorship to an inventor in respect of a patent in force on a request made by the inventor in Form-8A along with the fee specified in the First Schedule and such request shall contain a statement setting out the circumstances in which the original certificate of inventorship was lost, destroyed, damaged or cannot be produced.’. 10. In rule 80 of the said rules, for sub-rule (3), the following sub-rule shall be substituted, namely: - “(3) The annual renewal fees payable in respect of two or more years may be paid in advance: Provided that where the renewal fees is paid in advance through electronic mode for a period of at least 4 years, a ten per cent reduction in fee shall be applicable for such renewal.”. 11. In rule 110 of the said rules, in sub-rule (2): - a) for the words ‘Patents Act and Rules’, the words ‘The Patents Act, 1970 (39 of 1970), The Patents Rules, 2003, The Designs Act, 2000 (16 0f 2000) and The Designs Rules, 2001’ shall be substituted; b) for the words ‘patent specifications’, the words ‘patent specifications, design specifications’ shall be substituted. 12. In rule 131 of the said rules, for sub-rule (2), the following sub-rule shall be substituted, namely,- “(2) The statements referred to in sub-rule (1) shall be furnished once in respect of every period of three financial year, starting from the financial year commencing immediately after the financial year in which the patent was granted, and shall be furnished within six months from the expiry of each such period.
