2023 सा.का.जन. 812(ऄ).—जििेष प्रकोष्ठ । चूंदक ऄधोहस्ट्ताक्षरी आसे व्यिहाररक मानत े ह ैं दक रा०रा०क्ष०े ददल्ली म ें सािवजजनक जिनोद के स्ट्थान रर सािवजजनक जिनोद प्रदिवन (जसनेमा के ऄलािा) को लाआसेंस देने के जलए ददल्ली पलजलस ऄजधजनयम, 1978 की ऄनच्ल छेद 28 के तहत जनयम बनाए जान े चाजहए। रर चूंदक ऄधोहस्ट्ताक्षरी संतष्टल ह ै दक पररजस्ट्थजतयााँ मौजूद ह,ैं जो यह अिश्यक बनाती ह ैं दक ऐसे जनयम को तलरंत लाग ूदकया जाना चाजहए। रर ऄब आसजलए, ददल्ली के ईपराज्यपाल की पूिव मंजरू ी के साथ रर ऄनच्ल छेद 28 के खंड (1) (x) ि (y) के तहत ददल्ली पलजलस ऄजधजनयम, 1978 के प्रािधान द्वारा प्रदत्त िजिय का प्रयोग करते हुए, ऄधोहस्ट्ताक्षरी जनम्नजलजखत जिजनयम बनाते ह।ैं सािजव जनक जिनोद रर सािजव जनक जिनोद प्रदिनव (जसनमे ा के ऄलािा) के स्ट्थान को लाआससें देन ेके जलए मसौदा जिजनयम, 2023 सचू ी 1. ऄध्याय-I संजक्षप्त िीषकव , जिस्ट्तार, प्रारंभ रर पररभाषाए ाँ 2. ऄध्याय-II सािजव जनक जिनोद के स्ट्थान के जलए लाआससें 3. ऄध्याय-III सािजव जनक जिनोद प्रदिनव के जलए लाआससें 6906 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 4. ऄध्याय -II िल्ल क, सामान्य ित ेंरर छूट 5. ऄध्याय -I जनषधे , ऄस्ट्िीकरण, जनलबं न, जनरस्ट्तीकरण, खडं न रर ऄपील। जिजनयम ऄध्याय: I 1. संजक्षप्त िीषकव ,जिस्ट्तार रर प्रारंभ- (1) आन जनयम को "सािवजजनक जिनोद के स्ट्थान रर सािवजजनक जिनोद प्रदिवन (जसनेमा के ऄलािा) को लाआसेंस देने के जलए जिजनयम,2023” कहा जाएगा। (2) आन्ह ें जसनेमा के ऄलािा प्रदिवन के जलए समस्ट्त रा०रा०क्षे० ददल्ली तक जिस्ट्ताररत दकया जाएगा। (3) य े भारत के राजपत्र म ेंप्रकािन की जतजथ स ेलाग ू ह गे। 2. पररभाषा: (1) 'ऄजधजनयम' का ऄथ व ददल्ली पलजलस ऄजधजनयम 1978 ह।ै (2) 'ऄपीलीय प्राजधकारी' का ऄथव ह,ै ददल्ली के प्रिासक/ईपराज्यपाल या पलजलस अयलि, जैसा भी मामला हो, जैसा दक जिजनयम म ें जनधावररत दकया गया ह।ै (3) 'अयिल ' का ऄथ व राष्ट्रीय राजधानी क्षत्रे ददल्ली के पलजलस अयलि स े ह,ै जैसा दक ददल्ली पलजलस ऄजधजनयम, 1978 म ेंपररभाजषत दकया गया ह।ै (4) 'जसनमे ा' का ऄथ व ह ै िह स्ट्थान जहां जसनेमैटोग्राफ ऄजधजनयम के तहत पररभाजषत जसनेमैटोग्राफ के माध्यम स े प्रदिवन दकया जाता ह।ै (5) 'ईपयिल क्षत्रे ’ का मतलब िह क्षत्रे ह ै जहां सािवजजनक जिनोद प्रदिवन की व्यिस्ट्था ईस क्षेत्र की की िांजत रर जस्ट्थरता को जबना कोइ परेिानी या खतरा पहुचाँ ाए की जा सके। (6) 'ईपयिल स्ट्थान’ का ऄथ वह ैसािवजजनक जिनोद के स्ट्थान के संचालन रर सािवजजनक जिनोद प्रदिवन के संचालन के जलए पयावप्त जििाल स्ट्थान जजसम ें पार्ककग की सलजिधा हो (लागू नीजत के ऄनलसार, जो यातायात के सामान्य प्रिाह को बाजधत नहीं करता ह ै एिम ् क्षेत्र के जनिाजसय के जलए जोजखम, खतरा, क्षजत या परेिानी का कारण नहीं बनता ह।ै (7) 'फ्लोर िो’ का ऄथ व ह ै ऄजधजनयम के तहत संबंजधत जनयम के ऄंतगवत डांससग हॉल अदद सजहत, पंजीकृत/लाआसेंस प्राप्त भोजनालय के भीतर दकसी ऄन्य रूप म ें कोइ भी सािवजजनक जिनोद प्रदिवन जजसम ें आलेक्रॉजनक/जडजजटल/लेजर िो/होलोग्रादफक प्रोजेक्िन/िचलवऄल प्रदिवन िाजमल ह।ै (8) 'लाआससें ी’ का ऄथ व ह ैआन जिजनयम के तहत लाआसेंस रखन े िाला व्यजि। (9) 'लाआससें सग प्राजधकारी’ का ऄथव ह ैपलजलस अयिल या पलजलस अयलि द्वारा नाजमत कोइ ऄन्य ऄजधकारी। (10) 'स्ट्थापना हते ल लाआससें ' का ऄथव ह ै सािवजजनक जिनोद के स्ट्थायी स्ट्थान के जनमावण के ईद्देश्य स े लाआसेंससग प्राजधकारी द्वारा जारी दकया गया लाआसेंस। (11) 'सचं ालन हते ललाआससें ’ का ऄथव आन जिजनयम के ऄनलसार सािवजजनक जिनोद के स्ट्थायी स्ट्थान के संचालन या िैध प्रदिवन के जलए लाआसेंससग प्राजधकारी द्वारा जारी दकया गया लाआसेंस। (12) 'मले ा 'का ऄथ व ह ै सािवजजनक सभा का स्ट्थान जहां जिनोद, याजं त्रक या जिद्यलत ईपकरण का ईपयोग करके जॉय राआड, मेरी-गो-राईंड अदद का अयोजन करना। (13) 'अयोजक' का ऄथ व रर आसम ें कोइ भी िह व्यजि िाजमल ह ैजो सािवजजनक जिनोद प्रदिवन के प्रबंधन हते ल दकसी संगठन/समूह/व्यजि के प्रमोटर, प्रबंधक, सजचि या ईनके द्वारा जिजधित ऄजधकृत/जनयलि कोइ व्यजि हो।[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3 (14) 'सािवजजनक जिनोद का स्ट्थान 'का ऄथ व ददल्ली पलजलस ऄजधजनयम- 1978 के ऄनलच्छेद 2 के खंड (के) के तहत पररभाजषत स्ट्थान ह।ै (15) 'प्रदिनव ’ का ऄथ व जसनेमा के ऄलािा सगं ीत ,गायन ,नृत्य ,या खेल या दकसी ऄन्य मनोरंजन ,जिनोद या मनोरंजन की कोइ भी गजतजिजध ह।ै (16) 'स्ट्थान’ का ऄथव ददल्ली पलजलस ऄजधजनय-1978 के ऄनलच्छेद 2 के खंड (ज)े म ें पररभाजषत स्ट्थान स े ह।ै (17) 'सािजव जनक जिनोद का स्ट्थान’ का ऄथव ददल्ली पलजलस ऄजधजनयम-1978 के ऄनलच्छेद 2 के खडं (एल) के तहत पररभाजषत कोइ भी स्ट्थान ह।ै (18) 'सािवजजनक जिनोद का स्ट्थायी स्ट्थान’ का ऄथ व प्रदिवन के जलए ईपयोग की जान े िाली कोइ आमारत या स्ट्थायी संरचना ह।ै (19) 'सािवजजनक जिनोद का ऄस्ट्थायी स्ट्थान’ का ऄथ व ह ै प्रदिवन के जलए ईपयोग दकया जान े िाला कोइ तंब,ू छतरी, बाडे, बूथ या हटान े योग्य संरचना। (20) 'सािवजजनक जिनोद का खलल ा स्ट्थान’ का ऄथव ह ैप्रदिनव के जलए ईपयोग दकया जाने िाला कोइ भी खलला क्षेत्र। (21) 'ईपयिल व्यजि' का ऄथव ईस व्यजि से ह ैजो / जजसका : (ए) एक िैध ऄनलबंध जनष्पाददत करने के जलए सक्षम ह ैरर, (बी) जजसके पूिव चररत्र को पलजलस क्लीयरेंस सर्टटफीकेट (पीसीसी) के माध्यम से प्रमाजणत दकया गया ह ै (ए) यदद अिेदक ददल्ली का जनिासी ह ै तो ददल्ली पलजलस पीसीसी पोटवल के माध्यम से या (बी) यदद िह ददल्ली के बाहर का जनिासी ह ै तो संबंजधत राज्य/केंद्र िाजसत प्रदेि के सम्बंजधत सक्षम ऄजधकारी के माध्यम से रर (सी) जो ऄन्यथा ऄनलपयलि व्यजि नहीं ह ैरर सािवजजनक जिनोद का स्ट्थान संचाजलत करन े या सािवजजनक जिनोद का प्रदिवन करन े की क्षमता रखता ह।ै ऄध्याय:II 3. सािजव जनक जिनोद के स्ट्थान के जलए लाआससें : (1) कोइ भी व्यजि राष्ट्रीय राजधानी क्षेत्र ददल्ली म ें सािवजजनक जिनोद के ऐसे स्ट्थान के संबंध म ें आन जिजनयम में ददए गए प्रािधान के ऄलािा सािवजजनक जिनोद के दकसी स्ट्थान का संचालन या रखरखाि नहीं करेगा। सािवजजनक जिनोद के स्ट्थान तीन प्रकार के ह ग े ऄथावत (1) स्ट्थायी, (2) ऄस्ट्थायी रर (3) सािवजजनक जिनोद के खलले स्ट्थान। (2) लाआससें प्रदान करन े के जलए अिदे न- (ए) सािवजजनक जिनोद के स्ट्थान स्ट्थाजपत/संचाजलत करन े के जलए लाआसेंस के जलए अिेदन करते समय प्रत्येक व्यजि को लाआसेंससग जडिीजन के ऑनलाआन पोटवल पर ईपलब्ध जनधावररत अिेदन पत्र (फॉमव-ए) म ें जििरण प्रस्ट्तलत करना होगा। (बी) ईपराज्यपाल, ददल्ली की पूिव मंजूरी स े समय-समय पर पलजलस अयलि द्वारा जनर्ददष्ट अिदे न का गरै - िापसी योग्य प्रसंस्ट्करण िल्ल क अिेदन जमा करन े के समय अिेदक द्वारा ऑनलाआन जमा दकया जाएगा। (सी) सािवजजनक जिनोद का स्ट्थान स्ट्थाजपत करन े के जलए लाआसेंस के जलए अिेदन करन े िाले प्रत्येक व्यजि को लाआसेंससग जडजिजन के पोटवल पर ईजल्लजखत सभी अिश्यक सलपाठ्य दस्ट्तािेज़ ऄपलोड करन े ह गे। पलजलस अयलि या कोइ ऄन्य ऄजधकारी जजसे आस संबंध में ईनके द्वारा प्रत्यायोजजत/प्राजधकृत दकया गया ह,ै यह अकलन करेगा दक अिेदक रर लाआसेंस के जलए प्रस्ट्ताजित पररसर जनम्नजलजखत ितों को पूरा करते ह:ैं - (i) अिेदक ईपयलि ह,ै (ii) िह क्षत्रे जहां जिनोद का ऐसा स्ट्थान खोला जाना ह,ै प्रस्ट्ताजित ईद्देश्य के जलए ‘ईपयलि क्षत्रे ’ ह।ै4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (iii) जजस स्ट्थान को सािवजजनक जिनोद के स्ट्थान के रूप म ें ईपयोग करने का प्रस्ट्ताि ह ै िह ईस ईद्देश्य के जलए ‘ईपयलि स्ट्थान’ ह ै जजसके जलए आसका ईपयोग दकया जाना प्रस्ट्ताजित ह।ै (3) सािजव जनक जिनोद के स्ट्थायी स्ट्थान के जलए लाआससें : (ए) स्ट्थापना हते ललाआससें प्राजप्त : (i) कोइ भी व्यजि जो सािवजजनक जिनोद के स्ट्थायी स्ट्थान के रूप में ईपयोग करने के जलए एक स्ट्थायी भिन या संरचना बनाना चाहता ह ै ,ईसे भिन/संरचना का जनमावण िरूल करने रर आस े स्ट्थाजपत करने स ेपहले लाआसेंससग प्राजधकरण स ेलाआसेंस प्राप्त करना होगा। पूिविती जनयम के तहत पहले स े ही प्राप्त एनओसी को ितवमान जिजनयम के तहत स्ट्थाजपत करने के जलए लाआसेंस के रूप म ें माना जाएगा। (ii) स्ट्थापना हते ललाआससें के जलए प्रत्येक अिेदन जनम्नजलजखत दस्ट्तािेज के साथ होना चाजहए: (ए) प्रधान दस्ट्तािज़े (लाआसेंससग जडिीजन द्वारा प्राप्त दकए जाएाँगे) (i) स्ट्थानीय पलजलस रर यातायात स े स्ट्थान ईपयलिता ररपोटव। (ii) नागररक जनकाय के भिन जिभाग स े एनओसी। (बी) ईप-प्रधान दस्ट्तािजे (अिेदक द्वारा लाआसेंससग जडिीजन के पोटवल पर ऄपलोड दकए जाएाँग)े (i) संबंजधत नागररक जनकाय के भिन जिभाग द्वारा जारी भिन योजना। (ii) अिेदक की पहचान का प्रमाण (अधार/मतदाता पहचान पत्र/पैन/पासपोट/व ड्राआसिग लाआसेंस)। (iii) अिेदक के पत े का प्रमाण (अधार/मतदाता पहचान पत्र/पासपोट/व जबजली जबल/लडैं लाआन टेलीफोन जबल/दकराया/लीज डीड/संपजत्त स्ट्िाजमत्ि)। (iv) अिेदक के पक्ष मे पार्टनरव जिप फमव या प्राआिेट जलजमटेड या पजब्लक जलजमटेड कंपनी के मामले मे जनदेिक मडं ल के प्रस्ट्ताि के मामले म ेप्राजधकरण प्रमाण पत्र। (v) कंपनी के मामल े मे जनगमन प्रमाण पत्र रर साझेदारी फमव के मामले मे साझेदारी जिलेख । (vi) यदद अिेदक ददल्ली का जनिासी ह,ै तो ददल्ली पलजलस द्वारा पीसीसी पोटवल के माध्यम स े जारी िैध पलजलस क्लीयरेंस सर्टटदफकेट (पीसीसी), यदद अिदे क ददल्ली के बाहर का जनिासी ह,ै तो संबंजधत राज्य/केंद्रिाजसत प्रदिे प्राजधकरण द्वारा जारी िैध पलजलस क्लीयरेंस सर्टटदफकेट (पीसीसी) (vii) स्ट्िाजमत्ि का प्रमाण (iii) स्ट्थापना हते ल लाआसेंस जारी होने की जतजथ स े तीन साल की ऄिजध के जलए िैध होगा। (iv) अिेदक लाआसेंससग प्राजधकारी द्वारा जारी दकए गए स्ट्थान स्ट्थाजपत करने के लाआसेंस की िैधता ऄिजध के भीतर संबंजधत जिभाग के मौजूदा जनयम रर जिजनयम के ऄनलसार जिजभन्न प्राजधकरण स े जनमावण के जलए अिश्यक ऄनलमजत/एनओसी ,जडजाआन/योजना ऄनलमोदन प्राप्त करने के ऄधीन सािवजजनक जिनोद स्ट्थल का जनमावण करेगा। अिेदक को मौजूदा कानून के ऄनलसार संबंजधत एजेंजसय स े भिन ,ऄजि सलरक्षा, पयाविरण, सरं चनात्मक रर जिद्यलत सरल क्षा, अपदा प्रबंधन (महामारी सजहत) रर ऄन्य सलरक्षा पहललओं के सबं ंध में अिश्यक ऄनापजत्त प्रमाण पत्र, ऄनलपालनाएाँ (जहां भी लाग ू हो) प्राप्त करनी होगी । (बी) सचं ालन हते ल लाआससें देना: (i) सािवजाजनक जिनोद के स्ट्थान के संचालन हते ल लाआसेंस के जलए अिेदन करने िाल े प्रत्येक व्यजि को लाआसेंससग जडिीजन के ऑनलाआन पोटलव पर ईपलब्ध जनधारव रत अिेदन पत्र (फॉम-व ए) म ें जििरण प्रस्ट्तलत करना होगा। ऐसे प्रत्येक अिेदन के साथ जनम्नजलजखत दस्ट्तािेज संलि ह ग:े[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 5 (ए) प्रधान दस्ट्तािज़े (लाआसेंससग जडिीजन द्वारा प्राप्त दकए जाएाँगे) (i) नगरपाजलका/स्ट्थानीय प्राजधकाररय द्वारा जारी हल्े थ रेड लाआसेंस। (ii) यदद अिेदक ददल्ली का जनिासी ह,ै तो ददल्ली पलजलस द्वारा पीसीसी पोटवल के माध्यम स े जारी िैध पलजलस क्लीयरेंस सर्टटदफकेट) पीसीसी ,(यदद अिेदक ददल्ली के बाहर का जनिासी ह,ै तो संबंजधत राज्य/केंद्रिाजसत प्रदिे प्राजधकरण द्वारा जारी िैध पलजलस क्लीयरेंस सर्टटदफकेट (पीसीसी)। (बी) ईप-प्रधान दस्ट्तािजे (अिेदक द्वारा लाआसेंससग जडिीजन के पोटवल पर ऄपलोड दकए जाएाँगे) (i) सािवजजनक जिनोद स्ट्थल के स्ट्िाजमत्ि/दकरायेदारी का प्रमाण। (ii) भिन योजना (iii) 30 ददन की ररकॉर्डडग सलजिधा िैध िार्तषक रखरखाि ऄनलबधं (एएमसी) के साथ सीसीटीिी लगान े के संबंजधत दस्ट्तािेज़। (iv) सािवजजनक जिनोद के स्ट्थान रर सािवजजनक जिनोद प्रदिवन (जसनेमा के ऄलािा) को लाआससें के जलए जिजनयम, 2023 के तहत अिेदक द्वारा 100 रुपय े के गरै -न्याजयक स्ट्टांप पेपर पर एक िपथपत्र प्रस्ट्ततल दकया जाना ह ै(फॉम-व सी) (ii) स्ट्िास्ट््य, ऄजि सलरक्षा, पयाविरण मानदंड , संरचनात्मक रर जिद्यलत सलरक्षा, अपदा प्रबंधन (महामारी सजहत), ऄन्य सलरक्षा पहललओं ऄथिा ऄन्य कानून म ें से सम्बंजधत प्रमाण पत्र / ऄनापजत्त प्रमाण पत्र/ऄनपल ालनाएं (जहां भी लाग ूहो) सम्बंजधत एजेंजसय के कानून , जनयम रर ईपजनयम द्वारा िाजसत ह गे। (iii) लाआसेंससग प्राजधकारी लाआसेंस देन े स े पहल े या बाद म ें सािजव जनक जिनोद के स्ट्थान का जनरीक्षण कर सकता ह।ै लाआसेंससग प्राजधकारी ऄपने दकसी भी ऄधीनस्ट्थ पलजलस ऄजधकारी को, जो ईप-जनरीक्षक पद स े नीच े का न हो, ऐसे जनरीक्षण करन े के जलए प्राजधकृत कर सकता ह।ै (iv) संचालन का लाआसेंस ददल्ली पजल लस ऄजधजनयम की धारा 28 के तहत व्यजि के नाम पर जारी दकया जाएगा जैसा दक नागररक जनकाय द्वारा जारी हल्े थ रेड लाआसेंस म ें दिावया गया ह।ै (v) यदद दकसी अिेदक के पास “ राष्ट्रीय राजधानी क्षत्रे ददल्ली म ें सािवजजनक मनोरंजन के स्ट्थान चलान े हते ल जिजनयम -2023” के तहत जारी सािवजजनक मनोरंजन हते ल लाआसेंस ह ै या “ददल्ली भोजनालय पंजीकरण जिजनयम 2023” के तहत जारी पंजीकरण प्रमाण पत्र ह,ै तो िह ईि पररसर में सािवजजनक जिनोद प्रदिवन अयोजजत करना चाहता ह ैईसे आसके जलए सािवजजनक जिनोद लाआसेंस का एक स्ट्थायी स्ट्थान प्राप्त करना होगा रर पोटलव पर जनम्नजलजखत दस्ट्तािेज जमा करन ेह गे: (ए) प्रधान दस्ट्तािज़े (लाआसेंससग जडजिजन द्वारा प्राप्त दकए जाएाँगे) (i) आस संबंध म ेंनगरपाजलका/स्ट्थानीय प्राजधकाररय द्वारा जारी हल्े थ रेड लाआसेंस। (बी) ईप-प्रधान दस्ट्तािजे (अिेदक द्वारा लाआसेंससग प्रभाग के पोटलव पर ऄपलोड दकए जाएाँगे) (i) सािवजजनक जिनोद के स्ट्थान रर सािवजजनक जिनोद प्रदिवन (जसनेमा के ऄलािा) को लाआसेंस के जलए जिजनयम, 2023 के तहत अिेदक द्वारा 100 रुपय े के गैर-न्याजयक स्ट्टांप पेपर पर एक िपथपत्र प्रस्ट्ततल दकया जाना ह ै। (फॉम-व सी) (ii) भोजनालय/सािवजजनक जिनोद के स्ट्थान म ें फ़्लोर िो के जलए प्रदिवन लाआसेंस प्रदान करन े के जलए अिेदन पर कारविाइ करन े के जलए सामान्य अिेदन पत्र में संबंजधत जिजनयम के ऄतं गवत भोजनालय के पंजीकरण प्रमाणपत्र/लाआसेंस के ऄनलदान/निीनीकरण के जलए पहले स े बताए गए के ऄलािा प्रदिवन लाआसेंस (डांससग हॉल म ें फ़्लोर िो) प्रदान करन े के जलए जनम्नजलजखत ऄजतररि दस्ट्तािेज की अिश्यकता होगी।  डांस फ्लोर, मंच रर बैठने की जगह के अकार रर स्ट्थान को दिावन े िाला साआट प्लान,  ऄजधकतम क्षमता6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (iii) लाआसेंस की िैधता सािवजजनक जिनोद स्ट्थल के लाआसेंस या पजं ीकरण प्रमाणपत्र की िैधता के साथ समाप्त होगी। (सी) लाआससें का निीनीकरण: - (i) सािवजजनक जिनोद के स्ट्थान के जलए लाआसेंस के निीनीकरण के जलए अिश्यक दस्ट्तािेज के साथ एक ऑनलाआन अिेदन (फॉम-व डी) लाआसेंस की िैधता की समाजप्त की जतजथ स े 60 ददन पहले लाआसेंससग जडिीजन के पोटलव पर ऑनलाआन दकया जाएगा। जनम्नजलजखत दस्ट्तािेज की प्राजप्त पर ऐस े प्राजधकारी द्वारा लाआसेंस का निीनीकरण दकया जाएगा: (ए) प्रधान दस्ट्तािज़े (लाआससें सग प्रभाग द्वारा प्राप्त दकए जान ेिाल)े (i) नागररक जनकाय द्वारा जारी िधै हल्े थ रेड लाआसेंस। (ii) स्ट्थानीय पलजलस रर यातायात स े स्ट्थान ईपयलिता ररपोटव। (iii) यदद अिेदक ददल्ली का जनिासी ह,ै तो ददल्ली पलजलस द्वारा पीसीसी पोटवल के माध्यम स े जारी िैध पलजलस क्लीयरेंस सर्टटदफकेट (पीसीसी), यदद अिेदक ददल्ली के बाहर का जनिासी है, तो संबंजधत राज्य/केंद्रिाजसत प्रदिे प्राजधकारी द्वारा जारी िधै पलजलस क्लीयरेंस सर्टटदफकेट (पीसीसी) (बी) ईप -प्रधान दस्ट्तािज़े (अिेदक द्वारा लाआसेंससग आकाइ के पोटवल पर ऄपलोड दकए जाने ह)ैं (i) सािवजजनक जिनोद के स्ट्थान रर सािवजजनक जिनोद प्रदिवन (जसनेमा के ऄलािा) को लाआसेंस के जलए जिजनयम, 2023 के तहत अिेदक द्वारा 100 रुपय ेके गरै -न्याजयक स्ट्टांप पेपर पर एक िपथपत्र प्रस्ट्तलत दकया जाना ह ै। (फॉम-व सी) (ii) स्ट्िास्ट््य, ऄजि सलरक्षा, पयाविरण मानदडं , सरं चनात्मक रर जिद्यलत सलरक्षा, अपदा प्रबंधन (महामारी सजहत), ऄन्य सलरक्षा पहललओं या ऄन्यथा जैसा संबंजधत कानून म ें अिश्यक हो, के संबंध म ें प्रमाण पत्र / ऄनापजत्त प्रमाण पत्र / ऄनलपालन (जहां भी लागू हो) मौजूदा कानून ,जनयम रर ईपजनयम के ऄनलसार संबंजधत एजेंजसयां द्वारा िाजसत ह गे। ( डी) लाआससें की िधै ता: लाआसेंस तीसरे जित्तीय िष व के 31 माच व को समाप्त होन े िाली ऄजधकतम तीन िषों की ऄिजध के जलए िैध होगा । (ई) लाआससें का स्ट्थानातं रण: (i) लाआसेंस हस्ट्तांतरणीय या अबंटन योग्य नहीं होगा ऄजपत ल केिल ईस व्यजि के जलए व्यजिगत होगा जजसे यह प्रदान दकया गया ह।ै (ii) यदद कोइ लाआसेंसधारी ऄपना व्यिसाय दकसी ऄन्य व्यजि को स्ट्थानांतररत करता ह ै या सौंपता ह ै या दकसी ऄन्य व्यजि के साथ एक समझौता करता ह,ै जजसम ें व्यिसाय का संचालन या जनयत्रं ण छोडना िाजमल ह,ै तो ईसे ददया गया लाआसेंस ऐसे लेनदेन की जतजथ स े समाप्त हो जाएगा। (iii)हालााँदक, लाआसेंसधारी की मृत्य/ल ऄक्षमता/पागलपन की जस्ट्थजत म,ें ईसके कानूनी ईत्तराजधकारी लाआसेंसधारी की मृत्य ल की जतजथ स े एक महीन े के भीतर पलजलस अयलि या ईनके द्वारा ऄजधकृत दकसी ऄन्य ऄजधकारी को ऑनलाआन अिेदन कर सकते ह,ैं लाआसेंस की िषे ऄिजध के जलए लाआसेंस का लाभ पान े के जलए रर अयिल या आस संबंध म ें ईनके द्वारा ऄजधकृत कोइ ऄन्य ऄजधकारी आन जिजनयम के प्रािधान को ध्यान म ेंरखत े हुए अिेदन पर जनणवय ल ेसकते ह।ैं (एफ) नाम पररितनव : कोइ भी व्यजि जजसके पास सािवजजनक जिनोद के स्ट्थान को सचं ाजलत करन े का लाआसेंस ह ै ,िह प्रजतष्ठान के नाम म ें कोइ बदलाि नहीं करेगा या ऄपने पररसर का ईपयोग ईन सेिाओं के ईद्देश्य स े नहीं करेगा जो ददए गए लाआसेंस के ऄनलसार ऄजधकृत नहीं ह।ैं यदद लाआसेंसधारी प्रजतष्ठान का नाम बदलना चाहता ह ै या दकसी ऄन्य प्रकार की जिनोद सेिाए ं प्रदान करना चाहता ह,ै तो लाआसेंसधारी को पलजलस अयिल या आस संबंध म ें[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 7 ईनके द्वारा ऄजधकृत दकसी ऄन्य ऄजधकारी के समक्ष मौजूदा लाआसेंस पर नए समथनव के जलए ऑनलाआन अिेदन करना होगा। (जी) प्रत्येक लाआसेंसधारी हर समय ऄपने अजधकाररक कतव्यव के जनिवहन के जलए िहा ं प्रिेि करन े िाले दकसी भी पलजलस ऄजधकारी को ऐसे स्ट्थान पर जबना दकसी बाधा के प्रिेि की ऄनलमजत देगा। (एच) कोइ भी लाआसेंसधारी दकसी भी ऐसे प्रदिनव की ऄनलमजत नहीं देगा जब तक दक आस ईद्देश्य के जलए िैध प्रदिनव लाआसेंस प्राप्त नहीं दकया गया हो । (4) सािजव जनक जिनोद के ऄस्ट्थायी या खलल े स्ट्थान हते ललाआससें : (ए) लाआसेंस प्रदान करना : (i) लाआसेंससग जडिीजन के ऑनलाआन पोटलव पर ईपलब्ध अिेदन पत्र (फॉम-व इ) म ें जििरण प्रस्ट्ततल करना होगा। ऐसे प्रत्येक अिेदन के साथ जनम्नजलजखत दस्ट्तािेज सलं ि ह गे: (ए) प्रधान दस्ट्तािेज़: (लाआसेंससग प्रभाग द्वारा प्राप्त दकए जाएाँगे) (i) नगरपाजलका/स्ट्थानीय प्राजधकाररय द्वारा जारी हल्े थ रेड लाआसेंस। (ii) स्ट्थानीय पलजलस रर यातायात से क्षत्रे ईपयलिता ररपोटव। (iii) यदद अिेदक ददल्ली का जनिासी ह ै तो ददल्ली पलजलस द्वारा पीसीसी पोटवल के माध्यम स े जारी िैध पलजलस क्लीयरेंस सर्टटदफकेट (पीसीसी), यदद अिेदक ददल्ली के बाहर का जनिासी ह,ै तो संबंजधत राज्य/केंद्रिाजसत प्रदिे प्राजधकरण द्वारा जारी िधै पलजलस क्लीयरेंस सर्टटदफकेट (पीसीसी) (ए) ईप-प्रधान दस्ट्तािज़े : (अिेदक द्वारा लाआसेंससग प्रभाग के पोटवल पर ऄपलोड दकए जाएाँगे) (i) अिेदक की पहचान का प्रमाण (अधार/मतदाता पहचान पत्र/पैन/पासपोट/वड्राआसिग लाआसेंस)। (ii) अिेदक के पते का प्रमाण (अधार/मतदाता पहचान पत्र/पासपोट/व जबजली जबल/लडैं लाआन टेलीफोन जबल/दकराया/लीज डीड/संपजत्त स्ट्िाजमत्ि)। (iii) 30 ददन की ररकॉर्डडग सलजिधा िैध िार्तषक रखरखाि ऄनलबधं (एएमसी) के साथ सीसीटीिी लगान े के संबंजधत दस्ट्तािेज़। (iv) भूजम स्ट्िाजमत्ि एजेंसी स े बलककग जस्ट्लप/सािवजजनक जिनोद स्ट्थल के स्ट्िाजमत्ि/दकरायेदारी का प्रमाण। (v) सािवजजनक जिनोद के स्ट्थान रर सािवजजनक जिनोद प्रदिवन (जसनेमा के ऄलािा) को लाआससें के जलए जिजनयम, 2023 के तहत अिेदक द्वारा 100 रुपय े के गैर-न्याजयक स्ट्टांप पपे र पर एक िपथपत्र प्रस्ट्ततल दकया जाना ह ै। (फॉम-व सी) (ii) दस्ट्तािेजो ि एनओसी/ऄनलमजत/स्ट्िीकृजत की प्राजप्त पर लाआसेंससग प्राजधकारी ऐसे जनयम ि ितो पर अिेदक को सािजवजनक जिनोद के स्ट्थान के जलए लाआसेंस प्रदान करेगा तथा ऐसे प्रजतबंधो के ऄधीन ह ग े जो लाआसेंससग प्राजधकारी जनधारव रत कर सकते है। (iii) स्ट्िास्ट््य, ऄजि सलरक्षा, पयाविरण मानदडं , संरचनात्मक रर जिद्यलत सलरक्षा, अपदा प्रबधं न (महामारी सजहत), ऄन्य सरल क्षा पहललओं ऄथिा ऄन्य जैसा संबंजधत कानून म ें से सम्बंजधत प्रमाण पत्र / ऄनापजत्त प्रमाण पत्र/ऄनपल ालनाए ं (जहां भी लाग ू हो) सम्बंजधत एजेंजसय से काननू , जनयम रर ईपजनयम द्वारा िाजसत ह गे। (iv) लाआसेंससग प्राजधकारी लाआसेंस देने स े पहले या बाद म ें सािजव जनक जिनोद के स्ट्थान का जनरीक्षण कर सकता ह।ै लाआसेंससग प्राजधकारी ऄपने दकसी भी ऄधीनस्ट्थ पलजलस ऄजधकारी को जो ईप-जनरीक्षक पद स े नीच े का न हो, ऐस ेजनरीक्षण करने के जलए प्राजधकृत कर सकता ह।ै (बी) िैधता : लाआसेंस ईस भूजम की जनरंतर बलककग की ऄिजध के जलए िैध होगा जहां ऄस्ट्थायी संरचना का जनमावण दकया जाना ह ैबिते दक िह तीन िषों से ऄजधक न हो ।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] ऄध्याय- III 4. प्रदिनव हते ललाआससें : (1) कोइ भी व्यजि तब तक कोइ प्रदिवन नहीं करेगा जब तक दक ईसने ऐसा प्रदिवन करने के जलए लाआसेंससग प्राजधकारी स े प्रदिवन हते ल लाआसेंस प्राप्त नहीं कर जलया हो। प्रदिवन के जलए तीन प्रकार के लाआसेंस ह गे यानी स्ट्थायी ,ऄस्ट्थायी या खलल े स्ट्थान पर सािवजजनक जिनोद का प्रदिवन । (2) लाआसेंस लने े के जलए अिेदन: (ए) सािवजजनक जिनोद के स्ट्थान पर प्रदिवन लाआसेंस के जलए अिेदन करन े िाल े प्रत्येक व्यजि को लाआसेंससग जडिीजन के ऑनलाआन पोटवल पर ईपलब्ध अिेदन(फॉम-व ए) म ेंजििरण प्रस्ट्तलत करना होगा। (बी) ईपराज्यपाल ,ददल्ली की पूिव मंजूरी स ेसमय-समय पर पजल लस अयिल द्वारा जनर्ददष्ट अिेदन का गैर-िापसी योग्य प्रसंस्ट्करण िल्ल क अिेदन जमा करने के समय अिेदक द्वारा ऑनलाआन जमा दकया जाएगा। (सी) सािवजजनक जिनोद स्ट्थल पर प्रदिवन के लाआसेंस के जलए अिेदन करने िाल े प्रत्येक व्यजि को लाआसेंससग प्रभाग के पोटवल पर ईजल्लजखत सभी अिश्यक दस्ट्तािेज ऄपलोड करन े ह गे। पलजलस अयलि या आस संबंध म ें ईनके द्वारा ऄजधकृत कोइ ऄन्य ऄजधकारी यह अकलन करेगा दक अिेदक रर लाआसेंस के जलए प्रस्ट्ताजित प्रदिवन जनम्नजलजखत को परू ा करते ह ैं:- (i) अिेदक ईपयलि ह,ै (ii) यह दक प्रदिवन सािवजजनक व्यिस्ट्था, नैजतकता, िालीनता पर प्रजतकूल प्रभाि नहीं डालता ह ै या अम जनता के जहत म ेंह।ै (3) सािजव जनक जिनोद के स्ट्थायी स्ट्थान पर प्रदिनव हते ल लाआसेंस (ए) लाआसेंस प्रदान करना: आस संबंध म ें एक अिेदन जनम्नजलजखत दस्ट्तािेज के साथ ऑनलाआन जमा दकया जाएगा: i. सािवजजनक जिनोद के स्ट्थायी स्ट्थान स े बलककग पची । ii. अिेदक की पहचान का प्रमाण (अधार/मतदाता पहचान पत्र/पैन/पासपोट/वड्राआसिग लाआसेंस)। iii. अिेदक के पत े का प्रमाण (अधार/मतदाता पहचान पत्र/पासपोट/व जबजली जबल/लडैं लाआन टेलीफोन जबल/दकराया/लीज डीड/संपजत्त स्ट्िाजमत्ि)। iv. अिेदक के पक्ष म ेंअयोजक द्वारा नामांकन/प्राजधकरण। v. सािवजजनक जिनोद के स्ट्थान रर सािवजजनक जिनोद प्रदिवन (जसनेमा के ऄलािा) को लाआसेंस के जलए जिजनयम, 2023 के तहत अिेदक द्वारा 100 रुपय े के गैर-न्याजयक स्ट्टांप पेपर पर एक िपथपत्र प्रस्ट्ततल दकया जाना ह ै। (फॉम-व सी) vi. यदद अिेदक ददल्ली का जनिासी ह,ै तो ददल्ली पलजलस द्वारा पीसीसी पोटवल के माध्यम से जारी िैध पलजलस क्लीयरेंस सर्टटदफकेट (पीसीसी), यदद अिेदक ददल्ली के बाहर का जनिासी ह,ै तो संबंजधत राज्य/केंद्र िाजसत प्रदेि प्राजधकरण द्वारा जारी िधै पलजलस क्लीयरेंस सर्टटदफकेट (पीसीसी)। (बी) लाआसेंस की िैधता :ऐसे लाआसेंस की िैधता केिल ईस ऄिजध के जलए होगी जजसके दौरान एक जििेष सािवजजनक जिनोद प्रदिवन अयोजजत दकया जाना प्रस्ट्ताजित ह।ै हालााँदक ,िीजडयो गेम पालवर रर जिनोद पाकव संचाजलत करन े के जलए सािवजजनक जिनोद प्रदिनव लाआसेंस तीसरे जित्तीय िषव के 31 माच व को समाप्त होने िाली तीन साल की ऄिजध के जलए ददया या निीनीकृत दकया जा सकता ह।ै (4) सािजव जनक जिनोद के ऄस्ट्थायी या खलल ेस्ट्थान हते ललाआससें (ए) प्रदिवन स े कम स े कम 10 ददन पहले लाआसेंससग जडिीजन के ऑनलाआन पोटलव पर ईपलब्ध अिेदन (फॉम-व जी) म ें जििरण प्रस्ट्तलत करना होगा।[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 9 (बी) ईपराज्यपाल ,ददल्ली की पूिव मंजूरी स े समय-समय पर पलजलस अयलि द्वारा जनर्ददष्ट अिेदन का गैर- िापसी योग्य प्रसंस्ट्करण िल्ल क अिेदन जमा करन े के समय अिेदक द्वारा ऑनलाआन जमा दकया जाएगा। (5) ऐस ेप्रत्येक अिेदन के साथ जनम्नजलजखत दस्ट्तािेज संलि ह गे: (ए) प्रधान दस्ट्तािेज़ (लाआसेंससग प्रभाग द्वारा प्राप्त दकए जाएाँगे) (i) स्ट्थानीय पलजलस रर यातायात पलजलस से क्षत्रे ईपयलिता ररपोट व(एएसअर)। (ii) यदद अिेदक ददल्ली का जनिासी ह,ै तो ददल्ली पलजलस द्वारा पीसीसी पोटवल के माध्यम स े जारी िैध पलजलस क्लीयरेंस सर्टटदफकेट (पीसीसी), यदद अिेदक ददल्ली के बाहर का जनिासी ह,ै तो संबंजधत राज्य/केंद्रिाजसत प्रदिे प्राजधकरण द्वारा जारी िधै पलजलस क्लीयरेंस सर्टटदफकेट (पीसीसी)। (बी) ईप – प्रधान दस्ट्तािेज़ (अिेदक द्वारा लाआसेंससग प्रभाग के पोटवल पर दकए जाएाँगे) (i) भूजम स्ट्िाजमत्ि एजेंसी/सािवजजनक जिनोद के स्ट्थायी स्ट्थान स ेबलककग पची। (ii) अिेदक की पहचान का प्रमाण (अधार/मतदाता पहचान पत्र/पैन/पासपोटव /ड्राआसिग लाआसेंस)। (iii) अिेदक के पत े का प्रमाण (अधार/मतदाता पहचान पत्र/पासपोटव/जबजली जबल/लडैं लाआन टेलीफोन जबल/दकराया/लीज डीड/संपजत्त स्ट्िाजमत्ि(। (iv) अिेदक के पक्ष म ेंअयोजक द्वारा नामांकन/प्राजधकरण। (v) 30 ददन की ररकॉर्डडग सलजिधा िैध िार्तषक रखरखाि ऄनलबधं (एएमसी) के साथ सीसीटीिी लगान े के संबंजधत दस्ट्तािेज़। (vi) सािवजजनक जिनोद के स्ट्थान रर सािवजजनक जिनोद प्रदिवन (जसनेमा के ऄलािा) को लाआससें के जलए जिजनयम, 2023 के तहत अिेदक द्वारा 100 रुपय े के गरै -न्याजयक स्ट्टांप पेपर पर एक िपथपत्र प्रस्ट्तलत दकया जाना ह ै। (फॉम-व सी) (सी) स्ट्िास्ट््य, ऄजि सलरक्षा, पयाविरण मानदंड , संरचनात्मक रर जिद्यलत सलरक्षा, अपदा प्रबंधन (महामारी सजहत), ऄन्य सलरक्षा पहलओंल ऄथिा ऄन्य जैसा संबंजधत कानून म ें स े सम्बंजधत प्रमाण पत्र / ऄनापजत्त प्रमाण पत्र/ऄनपल ालनाए ं (जहां भी लाग ू हो) सम्बंजधत एजेंजसय से कानून , जनयम रर ईपजनयम द्वारा िाजसत ह गे। (डी) लाआसेंस म ें सामान्य जििरण के साथ प्रदिवन के प्रत्येक अआटम का िीषवक रर प्रदिनव की जिजिष्ट ऄिजध रर जतजथ भी बताइ जाएगी। ऄध्याय- II 5. िल्ल क, सामान्य ित ेंरर छूट। (1) लाआसेंससग प्राजधकारी को ददल्ली पलजलस ऄजधजनयम 1978-के ऄनलच्छेद (x) (1) 28 रर (y) के प्रािधान के ऄनलसार लाआसेंस दने े/निीनीकरण करन े से मना करन े या रद्द करन े का ऄजधकार होगा। (2) लाआसेंसधारी सक्षम प्राजधकारी द्वारा जारी दकए गए लाआसेंस की प्रजत को जिनोद प्रदिनव स्ट्थान के ररसेप्िन पर एक प्रमलख स्ट्थान पर प्रदर्तित करेगा। (3) आन जिजनयम के तहत प्रदिवन लाआसेंस रखने िाला कोइ भी व्यजि ऄनलजचत भाषा, ऄिोभनीय पोिाक, नृत्य, चाल या हािभाि की ऄभद्रता, अपजत्तजनक व्यजित्ि या प्रजतजनजधत्ि को बढािा नहीं देगा, जजससे राजद्रोह या ऄसंतोष की भािना भडकन े की संभािना हो, दगं ा या िांजत भगं होने की संभािना हो या जिजभन्न िगों, धमों या दकसी व्यजि के बीच ित्रलतापूणव भािनाओं को ईत्तेजजत करना, जंगली जानिर के साथ दकसी प्रदिवन या खेल का खतरनाक प्रदिवन या प्रदिनव करना, जसिाय आसके दक यह सकवस म ें प्रदिनव का एक अआटम ह ै जो जनयम द्वारा िाजसत होगा। प्रदिनव या खेल जजसम ें दिवक या जनता के जलए जोजखम, क्षजत या खतरा िाजमल हो या कोइ भी प्रदिवन जो लाआसेंस के ऄंतगतव नहीं अता हो, की ऄनलमजत नहीं दी जाएगी।10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (4) सािवजजनक जिनोद स्ट्थान रर प्रदिवन के लाआसेंस देने/निीनीकरण करन/े डलजप्लकेट लाआसेंस के जलए िलल्क प्रिासक/ईपराज्यपाल, ददल्ली की पूिव मंजरू ी के साथ समय-समय पर पलजलस अयिल द्वारा जनर्ददष्ट दकया जाएगा। (5) सािवजजनक जिनोद के दकसी भी स्ट्थान पर धूम्रपान की ऄनलमजत नहीं दी जाएगी। ईसम'ें धूम्रपान जनषेध 'का जचन्ह प्रमलखता स ेप्रदर्तित दकया जाना चाजहए। (6) लाआसेंसधारी सािवजजनक जिनोद के स्ट्थान के दकसी भी जहस्ट्स े म ें आन जिजनयम के तहत जारी दकए गए लाआसेंस म ेंऄजधकृत ऄजधकतम संख्या स े ऄजधक लोग को प्रििे की ऄनलमजत नहीं दगे ा। (7) लाआसेंसधारी, लाआसेंससग प्राजधकारी द्वारा नाजमत ऄजधकाररय या ऄपन े अजधकाररक कतवव्य के जनिवहन करने हते ल पलजलस ऄजधकारी या कानूनी रूप स े ऄजधकृत ऄन्य ऄजधकाररय को हर समय सािवजजनक जिनोद के स्ट्थान पर ऄबाजधत पहुचं प्रदान करेगा। (8) आन जिजनयम के तहत ददया गया लाआसेंस हस्ट्तांतररत नहीं जा सकेगा, बजल्क केिल ईस व्यजि के व्यजिगत लाभ के जलए होगा ,जजसे यह प्रदान दकया गया ह ैरर लाआसेंसधारी की मृत्य लपर, आन जिजनयम के प्रािधान के ऄधीन, लाआसेंस रद्द माना जाएगा। (9) िस्त्र ऄजधजनयम के प्रािधान के ऄजतररि दकसी भी व्यजि को सािवजजनक जिनोद के स्ट्थान पर हजथयार ल े जाने की ऄनलमजत नहीं ह।ै (10) 18 िष व स े कम अय ल का कोइ भी व्यजि आन जिजनयम के तहत कोइ भी लाआसेंस प्राप्त करन े या रखन े का हकदार नहीं होगा। (11) संबंजधत ऄजधकाररय की पूिव मंजूरी के जबना लाआसेंस प्राप्त स्ट्थान के लेअईट, जडजाआन रर संरचना म ें कोइ बदलाि नहीं दकया जाएगा। (12) ददल्ली जसनेमैटोग्राफ जनयम 2008 के तहत जसनेमैटोग्राफ प्रदिवन के जलए लाआसेंस प्राप्त आमारत को आन जिजनयम के प्रयोजन के जलए सािवजजनक जिनोद का स्ट्थायी स्ट्थान माना जाएगा। (13) ऄध्याय III के प्रािधान जनम्नजलजखत प्रदिवन पर लाग ू नहीं ह ग,े ऄथावत:् पूजा स्ट्थल पर धार्तमक सभा (2) स्ट्कूल/कॉलेज द्वारा ऄपन े पररसर म ें अयोजजत कायवक्रम (3) जिजभन्न ऄजधजनयम के तहत कानूनी रूप स े जिश्वजिद्यालय की जििेष सभाए ाँ (7)प्रदिनव जजसके जलए ददल्ली जसनेमैटोग्राफ जनयम 2008 ,के तहत लाआसेंस की अिश्यकता होती ह।ै (14) लाआसेंसधारी या अयोजक पररचालन घंट के दौरान सािवजजनक जिनोद के स्ट्थान पर ईपलब्ध रहगें े। (15) दकसी महामारी/बीमारी/संक्रामक रोग/ऄप्रत्याजित जस्ट्थजत म ेंलाआसेंसधारी को महामारी/बीमारी/संक्रामक रोग/ऄप्रत्याजित जस्ट्थजत स े जनबटने के जलए राष्ट्रीय अपदा प्रबधं न, जजला अपदा प्रबंधन प्राजधकरण तथा ऄन्य सरकारी एजेंजसय द्वारा रोकथाम से संबंजधत अिश्यक सभी जनदेि /अदेि का पालन करना होगा। (16) सािवजजनक जिनोद के प्रत्येक लाआसेंस प्राप्त स्ट्थान पर प्राथजमक ईपचारकी सलजिधा असानी से ईपलब्ध होगी। (17) प्रत्येक लाआसेंसधारी ऐस े स्ट्थान पर या ईसके असपास भीडभाड को रोकन े के जलए पयावप्त कदम ईठाएगा रर दकसी भी गडबडी या मानि जीिन ऄगं को चोट पहुचं ाने िाली घटना , ऄिैध गजतजिजध या ईसकी संभािना की जस्ट्थजत म ें,पलजलस को तत्काल जानकारी दगे ा। (18) यदद कोइ लाआसेंसधारी जानबूझकर कलख्यात बरल े चररत्र िाले व्यजिय को ऐसे स्ट्थान पर जमलन े या रहने की ऄनलमजत देता ह ैया दकसी ऄिैध गजतजिजध म ेंिाजमल होता ह ैया ऄनलमजत देता ह,ै तो पलजलस अयलि या आस संबंध म ें ईनके द्वारा ऄजधकृत दकसी ऄन्य ऄजधकारी के पास ऄपन े जििेक स े आन जिजनयम के तहत ददए गए लाआसेंस को रद्द करन े या ऐसी ऄिजध के जलए जनलंजबत करने , जजसका समय िह जनर्ददष्ट कर सकता ह,ै की िजि होगी। जजस व्यजि को पलजलस अयलि या आस संबंध म ें ईनके द्वारा ऄजधकृत दकसी ऄन्य ऄजधकारी द्वारा ऐसा जनदेि जारी दकया जाता ह,ै िह तरल ंत ऐसे जनदेि का पालन करेगा।[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 11 (19) प्रत्येक लाआसेंसधारी, जैस े ही िह सािवजजनक जिनोद के लाआसेंस प्राप्त स्ट्थान को बंद या संचाजलत करना बंद कर देता ह,ै जजसके संबंध म ें आन जिजनयम के तहत लाआसेंस ददया गया ह,ै िह आसकी सूचना पलजलस अयलि या आस संबंध म ें ईनके द्वारा ऄजधकृत दकसी ऄन्य ऄजधकारी को लाआसेंससग प्राजधकारी द्वारा अग े की अिश्यक कारविाइ के जलए देगा। (20) ध्िजन स्ट्तर रर प्रदिवन घंट के जनयम आस प्रकार ह:ै (ए) सािजव जनक जिनोद प्रदिनव का समय-: (i) सािवजजनक जिनोद के स्ट्थायी स्ट्थान पर सािवजजनक प्रदिनव का समय राजत्र 12.30 बज े तक होगा। (ii) ध्िजन प्रदषू ण (जिजनयमन रर जनयंत्रण) जनयम 2000 के प्रािधान के ऄनलसार सािवजजनक जिनोद के ऄस्ट्थायी/खलल े स्ट्थान पर सािवजजनक प्रदिवन का समय रात 10.00 बज े तक होगा। (iii) जििेष धार्तमक/ईत्सि/सांस्ट्कृजतक ऄिसर पर ऐस े सािवजजनक प्रदिवन के दौरान सािवजजनक जिनोद प्रदिवन रर संगीत तथा ऄन्य ध्िजनिधवक िाद्ययंत्र बजाने का समय, एक कैलडें र िषव के दौरान कलल जमलाकर 15 ददन स े ऄजधक नहीं बढाया जा सकता। जजसकी ऄनलमजत माननीय ईपराज्यपाल, ददल्ली द्वारा प्रत्येक ऄिसर पर आस संबंध म ें पाररत अदेि के माध्यम से दी जाएगी। (iv) सभी भोजनालय रर सािवजजनक जिनोद के स्ट्थान ,जजनके पास जिनोद के स्ट्थायी स्ट्थान के जलए लाआसेंस ह,ै म ें प्रदिनव का समय संबंजधत जनयम म ें ऐसे भोजनालय या सािवजजनक जिनोद के स्ट्थान के जलए संबंजधत पंजीकरण प्रमाणपत्र/लाआसेंस म ें जनधावररत पररचालन समय के ऄनलसार होगा। (बी) ध्िजन स्ट्तर: अयोजजत दकए जान े िाल े सभी सािवजजनक जिनोद प्रदिवन के जलए, बजाइ जान े िाली ध्िजन का स्ट्तर 'ध्िजन प्रदषू ण (जिजनयमन रर जनयंत्रण) जनयम, 2000' के प्रािधान रर/या समय-समय पर िैध सक्षम प्राजधकारी द्वारा जारी ददिाजनदेि के ऄनलसार होगा। (21) अिेदन की जतजथ स े एक िषव पहले जारी दकया गया पलजलस क्लीयरेंस सर्टटदफकेट (पीसीसी) िैध माना जाएगा। ऄध्याय- I 6. जनषधे , ऄस्ट्िीकरण, जनलबं न, जनरस्ट्तीकरण, खडं न रर ऄपील। (1) जनषधे , रद्दीकरण रर जनलबं न (ए) लाआससें देन े स े मना करना : - पलजलस अयलि या दकसी ऄन्य ऄजधकारी को, जजसे आस संबंध म ें ईनके द्वारा प्रत्यायोजजत/प्राजधकृत दकया गया ह,ै सािवजजनक जिनोद के स्ट्थान के जलए लाआसेंस देन े स े आनकार करने का जििेकाजधकार होगा यदद ऐसा स्ट्थान जिजनयम म ेंईजल्लजखत अिश्यकताओं को पूरा नहीं करता ह।ै (बी) निीनीकरण स े आनकार :- पलजलस अयिल या कोइ ऄन्य ऄजधकारी, जजसे आस संबंध म ें ईनके द्वारा प्रत्यायोजजत/ऄजधकृत दकया गया ह ै ,लाआसेंस को निीनीकृत करने स े आनकार कर सकता ह,ै यदद लाआसेंसधारी न े गलत िपथपत्र प्रस्ट्तलत दकया ह ै या लाआसेंस प्राप्त पररसर ने लाआसेंस के जनयम रर ितों का ईल्लघं न दकया ह ै या क्षत्रे की स्ट्थानीय पलजलस न े लाआसेंस प्राजधकारी को जलजखत रूप स े सूजचत कर ददया ह ै ,जजससे िह लाआसेंस रखने के जलए ऄनलपयिल हो गया ह।ै (सी) जनरस्ट्तीकरण एि ं जनलबं न: - (i) यातायात को जिजनयजमत करन े रर सािवजजनक स्ट्थान पर व्यिस्ट्था रखन े अदद के मामल े म,ें पलजलस अयलि या आस संबंध म ें ईनके द्वारा ऄजधकृत दकसी ऄन्य ऄजधकारी के पास दकसी भी समय आन जिजनयम के तहत ददए गए लाआसेंस को जनरस्ट्त करने या, ऐसी ऄिजध के जलए जो िह जनर्ददष्ट करे, जनलंजबत करन े रर सािवजजनक जिनोद के स्ट्थान के लाआससें धारी को ईस स्ट्थान को स्ट्थायी या ऄस्ट्थायी रूप स े बंद करने का जनदेि दने े की िजि होगी। (ii) लाआसेंससग प्राजधकारी ईस े सलनिाइ का ऄिसर देन े के बाद जलजखत रूप म ें ऐसा अदेि देकर लाआसेंस रर ईसके संचालन को स्ट्थायी या ऄस्ट्थायी रूप स े जनरस्ट्त या जनलंजबत कर सकता ह।ै12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (iii) यदद पलजलस अयिल या आस संबंध म ें ईनके द्वारा प्राजधकृत कोइ ऄन्य ऄजधकारी ऐसी पूछताछ के बाद संतलष्ट ह ै जैसा िह ईजचत समझे दक लाआसेंसधारी, लाआसेंस जारी रखने के जलए ईपयिल व्यजि नहीं ह ै या असपास के क्षत्रे म ें दकसी भी बाधा ,ऄसलजिधा को रोकन े के जलए ईपयलि व्यजि नहीं ह ै या ऐसे स्ट्थान पर ऄिांजत को रोकने के जलए दकसी भी समय आन जिजनयम के तहत ददए गए लाआससें को जनरस्ट्त करन े या ऐसी ऄिजध के जलए जनलंजबत करन े के जलए सिि होगा रर लाआसेंसधारी को ईस स्ट्थान को स्ट्थायी या ऄस्ट्थायी रूप से बंद करने का जनदिे द े सकता ह।ै (iv) यदद पलजलस अयलि या आस संबंध म ें ईनके द्वारा ऄजधकृत ऄन्य ऄजधकारी संतलष्ट ह ैं दक लाआसेंसधारी न े लाआसेंस के दकसी भी जनयम/ितव का ईल्लंघन दकया ह,ै तो ईनके पास दकसी भी समय आन जिजनयम के तहत ददए गए ऄपन े लाआसेंस को जनरस्ट्त करन े या ऐसी ऄिजध के जलए जनलंजबत करन े की िजि होगी जो िह जनर्ददष्ट कर सकता ह ै रर लाआसेंसधारी को ईस स्ट्थान को स्ट्थायी या ऄस्ट्थायी रूप स े बंद करन े का जनदेि दे सकता ह।ै (2) आन जिजनयम के तहत ददया गया कोइ भी लाआसेंस तब तक जनरस्ट्त नहीं दकया जाएगा जब तक दक लाआसेंस धारक को कारण बताने का ईजचत ऄिसर नहीं ददया जाता दक यह लाआसेंस क्य जनरस्ट्त नहीं दकया जाना चाजहए। बिते दक कारण बतान े का ऐसा कोइ ऄिसर अिश्यक नहीं होगा जब लाआसेंस को आन जिजनयम में स े दकसी के, ऄथिा ईसके तहत दकसी अदेि के, ऄथिा लाआसेंस की दकसी ितव के ईल्लघं न के जलए लाआसेंस धारक के जखलाफ जांच लंजबत होने तक ऄस्ट्थायी रूप से जनलंजबत कर ददया गया हो । (3) ऄन्य एजजें सय द्वारा जनलबं न/जनरस्ट्तीकरण/रद्द करना /सचं ालन पर रोक /ऄजभयोजन: ऄन्य एजेंजसय द्वारा प्रासंजगक कानून के तहत प्रदान दकये गए लाआसेंस/ऄनापजत्त प्रमाण पत्र के दकसी भी ईल्लघं न पर जनलंबन/जनरस्ट्तीकरण/रद्द करना /संचालन पर रोक /ऄजभयोजन जैसी कारविाइ ईनके द्वारा लाग ू ईनस े संबंजधत ऄजधजनयम /जनयम /जिजनयम के ऄनलसार की जाएगी। संबंजधत एजजें सयां ऄपन े संबंजधत ऄजधजनयम /जनयम /जिजनयम के ऄनलसार ऐसे जनलंबन/जनरस्ट्तीकरण/रद्द करना/संचालन पर रोक / ऄजभयोजन अदिे के जनष्पादन के जलए परू ी तरह जजम्मेदार ह गी। (4) जनदेि जारी करन े की िजि: पलजलस अयिल /लाआसेंससग प्राजधकारी लाआसेंसधारी द्वारा ऄनलपालन दकए जाने िाले पररचालन सम्बन्धी जनदेि/ितें समय-समय पर जारी करेंगे। (5) अिेदक की जजम्मेदाररयां :संबंजधत ऄजधकाररय रर िैधाजनक जनकाय स े अिश्यक एनओसी/ऄनलमजतयां/ ऄनलपालन अदद प्राप्त करने की पूणव जजम्मेदारी अिेदक पर होगी। (6) ऄन्य एजेंजसय की जजम्मेदाररयां :स्ट्िास्ट््य, ऄजि सलरक्षा, पयाविरण मानदडं ,सरं चनात्मक रर जिद्यलत सलरक्षा रर ऄन्य सरल क्षा पहलओंल के संबंध म ें प्रमाण पत्र/एनओसी/ऄनपल ालन (जहां भी लाग ू हो) संबंजधत सरकारी एजेंजसय द्वारा ईनके ऄजधजनयम /जनयम /ईपजनयम के ऄनलसार जारी दकए जाएगं े। (7) सािवजजनक जिनोद स्ट्थल का लाआसेंसधारी यह सलजनजित करेगा दक कोइ भी सािवजजनक जिनोद प्रदिवन तब तक अयोजजत नहीं दकया जाएगा जब तक दक सक्षम प्राजधकारी स े अिश्यक सािवजजनक प्रदिवन लाआसेंस प्राप्त न कर जलया गया हो। यह सलजनजित करना लाआसेंसधारी ,अयोजक या ऄजधकृत नामांदकत व्यजिय की सामूजहक जजम्मेदारी होगी दक प्रदिवन के दौरान लाआसेंस के सभी जनयम रर ितों का ऄक्षरिः पालन दकया जाए। आन प्रािधान के ईल्लघं न के मामल े म,ें सािवजजनक जिनोद लाआसेंसधारी स्ट्थान के लाइसेंसी रर अयोजक को संयिल रूप स ेजजम्मेदार ठहराया जाएगा रर कानून के ऄनलसार मलकदमा चलाया जाएगा। (8) ऄपील- (ए) आन जिजनयम के प्रािधान के तहत लाआसेंस देन े या निीनीकृत करने स े आंकार करने या लाआसेंस जनरस्ट्त करने िाले पलजलस अयिल द्वारा ऄजधकृत ऄजधकारी के अदिे स े व्यजथत कोइ भी व्यजि, ऐस े अदेि के संचार की जतजथ स े 30 ददन के भीतर पलजलस अयलि ददल्ली के पास ऄपील कर सकता ह।ै[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 13 (बी) ईप-जिजनयम (1) या जिजनयम के प्रािधान के तहत लाआसेंस देने या निीनीकृत करन े से आंकार करन े या लाआसेंस जनरस्ट्त करन े िाले पलजलस अयलि के अदेि स े व्यजथत कोइ भी व्यजि ऐसे अदिे की सूचना जमलन े की जतजथ स े 30 ददन के भीतर प्रिासक/ईप – राज्यपाल , ददल्ली को ऄपील कर सकता ह।ै (9) जिजनयम की समीक्षा-: बदली हुइ पररजस्ट्थजतय के ऄनरूल प लाने के जलए, आन जिजनयम की समय-समय पर रर कम स े कम दो साल म ें एक बार समीक्षा की जाएगी। (10) जनरस्ट्तीकरण रर सग्रं ह- (1) जजस जतजथ को जिजनयम लाग ल होते ह ैं , ईसके तत्काल प्रभाि से , 29 ददसंबर 1980 को जारी ऄजधसूचना जनरस्ट्त हो जाएगं ी। (2) ऐसे दकसी भी जनरस्ट्तीकरण के बािजूद,यदद ऐसा कलछ भी दकया जाता ह ै या कोइ करिाइ की जाती ह ै या दकया जाना माना जाता ह ै या ईप-जनयम (1) द्वारा जनरस्ट्त ऄजधसूचना के तहत कोइ लाआसेंस प्रदान दकया जाता ह,ै जहााँ तक य े आन जिजनयम या ददल्ली पलजलस ऄजधजनयम , 1978 के ऄसंगत नहीं ह,ै तो आस े आन जिजनयम के Short title, extent and commencement – (1) These regulations shall be called "The Regulation for Licensing Places of Public Amusement and Public Amusement Performances (other than Cinema),2023‖. (2) These shall extend to the whole of the NCT of Delhi for Performances other than cinema. (3) These shall come into force from the date of their publication in the Gazette of India. 2. Definition: (1) ‗Act’ means the Delhi Police Act, 1978. (2) ‘Appellate Authority’ means the Administrator/ Lieutenant Governor of Delhi or the Commissioner of Police, Delhi, as the case may be, as provided in the regulation. (3) ‗Commissioner’ means the Commissioner of Police of National Capital Territory of Delhi, as defined in the Delhi Police Act, 1978. (4) ‗Cinema’ means any place where an exhibition by means of Cinematograph as defined as such under Cinematograph Act is given. (5) ‗Fit Locality‘ means the area where Place of Public Amusement Performance can be arranged without causing any disturbance or threat to peace and tranquility of the area. (6) ‗Fit Place' means a place of spacious enough for operation of place of Public Amusement and conduct of public Amusement performance having facilities of parking (as per applicable policy) which does not obstruct normal flow of traffic or cause risk, danger, damage or annoyance to the residents of the locality. (7) ‗Floor Show’ means any Public Amusement Performance including electronic/digital/lasershow/ holographic projection/ virtual performance in any other form within registered/licensed Eating House including dancing hall etc. as provided under concerned regulations under the Act. (8) ‘Licensee’ means a person holding a license under these regulations. (9) ‘Licensing Authority’ means Commissioner of Police or any officer so designated by the Commissioner of Police, Delhi on his behalf. (10) ‘License to Establish’ means license issued by Licensing Authority for the purpose of construction of a permanent place of public amusement. (11) ‘License to Operate’ means license issued by Licensing Authority for the operation of permanent place of public amusement for valid performances as per these regulations. (12) ‘Melas’ means a place of public gathering where performances of amusement, joyrides using mechanical or electrical device, merry-go-round, etc. may be organized. (13) ‘Organiser’ means and includes any person who is promoter, manager, secretary or any person duly authorized/engaged by an organization/group/ Individual for management of a public amusement performance. (14) ‘Place of Public Amusement’ means a place as defined under section-2 (k) of the Delhi Police Act-1978. (15) ‗Performance’ means any activities of music, singing, dancing, or game or any other amusement, diversion or recreation other than cinema. (16) ‗Place‘ means a place as defined in section 2(j) of the Act. (17) ‗Place of Public Entertainment’ means any place as defined under Section-2 (l)of the Delhi Police Act- 1978. (18) ‘Permanent Place of Public Amusement’ means any building or permanent structure used for performance. (19) ‘Temporary Place of Public Amusement’ means any tent, canopy, enclosures, booth or removable structure used for performance. (20) ‘Open place of Public Amusement’ means any open area,used for performance.[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 15 (21) 'Suitable Person' means a person who is - (a) Competent to execute a valid contract and (b ) has clear antecedent to be certified through Police Clearance Certificate (PCC) issued by (A) Delhi Police through PCC portal in case applicant is a resident of Delhi or (B) concerned state/UT authority in case applicant is a resident of outside Delhi. (c) is otherwise not an unsuitable person and has capacity to operate a place of Public Amusement or conduct Performance of Public Amusement. CHAPTER II: 3. License for Place of Public Amusement: (1) No person shall operate or maintain a place of public amusement in the National Capital Territory of Delhi except as provided in these regulations, in respect of such place of Public Amusement. There shall be three types of places of Public Amusement i.e. (1) permanent, (2) temporary and (3) open places of public amusement. (2) Application for the Grant of License- (a) Every person at the time of making application for a License to establish/operate a Place of Public Amusement shall furnish particulars in the prescribed application form(Form-A) available on online Portal of Licensing Division. (b) A non-refundable processing fee of application as specified by the Commissioner of Police from time to time with prior approval of Lt. Governor, Delhi shall be deposited online by the applicant at the time of submission of application. (c) Every person applying for a License to establish a Place of Public Amusement shall upload all the required legible documents mentioned on the Portal of the Licensing Division. The Commissioner of Police or any other officer who has been delegated/ authorized by him in this behalf shall assess that the applicant and the proposed premises for License fulfills following condition: - (i) The applicant is suitable, (ii) The locality where such place of Amusement is to be opened is fit locality for the purpose proposed. (iii) The place proposed to be used as a Place of Public Amusement is fit place for the purpose for which it is proposed to be used. (3) License for Permanent Place of Public Amusement: (a) Grant of License to Establish: (i) Any person desiring to put up a permanent building or structure to be used as permanent place of Public Amusements shall obtain a license to establish from Licensing Authority before commencing the construction of building/structure and to establish it. NOC already obtained under the erstwhile regulations shall be treated as License to establish under the present regulation. (ii) Each such application for License to establish shall be accompanied by the following documents: (a) Primary Documents (To be obtained by Licensing Division) (i) Area Suitability Reports from Local Police and Traffic. (ii) NOCs from Building Department of the Civic bodies. (b) Secondary Documents (to be uploaded by the applicant on the portal of Licensing Division) (i) Sanctioned building plan issued by the Building department of concerned Civic bodies. (ii) Proof of Identity of applicant (Aadhar/Voter ID Card/PAN/Passport/Driving License). (iii) Proof of Address of applicant (Aadhar/Voter ID Card/Passport/Electricity Bill/ Landline Telephone Bill/Rent/Lease Deed/Property Ownership).16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (iv) Board Resolution by the partnership firm/company in favour of applicant in case of partnership/company. (v) Certificate of incorporation in case of company and partnership deed in case of partnership firm. (vi) In case the applicant is resident of Delhi, valid Police Clearance Certificate (PCC) issued by Delhi Police through PCC portal, in case applicant is a resident of outside Delhi, then Police Clearance Certificate (PCC) issued by concerned state/UT authority (vii) Proof of ownership (iii) The License to establish will be valid for a period of three years from the date of issue of such license. (iv) The applicant will construct the place of Public Amusements subject to obtaining necessary permissions/NOCs, design/plan approval for construction from the various authorities as per extant rules and regulations of the concerned departments within the validity period of the License to establish issued by the Licensing Authority. The applicant will obtain required NOCs, compliance (wherever applicable) with respect to Building, Fire Safety, Environment, Structural and Electrical safety, Disaster preparedness (including pandemic) and other safety aspects from respective agencies as per extant laws. (b) Grant of license to operate: (i) Every person applying for a License to operate for a Place of Public Amusement shall furnish particulars in the prescribed application form (Form-A) available on online Portal of Licensing Division. Each such application shall be accompanied by the following documents: (a) Primary Documents (to be obtained by Licensing Division) (i) Health Trade License issued by the Municipal/Local Authorities. (ii) In case the applicant is resident of Delhi, valid Police Clearance Certificate (PCC) issued by Delhi Police through PCC portal, in case applicant is a resident of outside Delhi, then Police Clearance Certificate (PCC) issued by concerned state/UT authority. (b) Secondary Documents (to be uploaded by the applicant on the portal of Licensing Division) (i) Proof of ownership/tenancy of the place of Public Amusements. (ii) Building Plan. (iii) Invoice of installation of CCTV with 30 days recording and valid Annual Maintenance Contract for at least one year(AMC). (iv) An undertaking to be submitted by applicant under the Regulations for Licensing Places of Public Amusement and Public Amusement Performances (other than Cinema), 2023 on the non-judicial stamp paper worth Rs.100. (Form-C) (ii) The Certificates/No objection certificates/compliances (wherever applicable) with respect to Health, Fire Safety, Environmental norms, structural and Electrical safety, disaster management (including pandemic), other safety aspects or otherwise as required in respective laws, shall be governed by the respective Agencies as per the extant laws, rules and bye-laws. (iii) The Licensing Authority may inspect the place of Public Amusements before or after the grant of license. The Licensing Authority may authorize any of his subordinate police officer not below the rank of Sub-Inspector to undertake such inspections. (iv) License to operate will be issued under section 28 of Delhi Police Act in the name of the person as reflected in Health Trade License issued by Civic bodies. (v) In case, an applicant is holding a license for public entertainment issued under the Regulations for Keeping Places of Public Entertainment in the National Capital Territory of Delhior Registration Certificate issued under Regulations for Delhi Eating Houses Registration Regulations, wishes to hold public amusement performances in the said premises, he shall have to obtain a permanent place of public amusement license for the same and submit the following documents on the Portal: (a) Primary Documents (to be obtained by Licensing Authority) (i) Health Trade License issued by the Municipal/Local Authorities in this regard.[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 17 (b) Secondary Documents (to be uploaded by the applicant on the portal of Licensing Division) (i) An undertaking to be submitted by applicant under the Regulations for Licensing Places of Public Amusement and Public Amusement Performances (other than Cinema), 2023 on the non-judicial stamp paper worth Rs.100. (Form- C) (ii) For processing the application for grant of Performance license for Floor shows in an Eating House/ places of Public Entertainment the following additional documents will be required for grant of Performance license (floor show in a dancing hall) other than already indicated in the common application form for grant/renewal of Registration Certificate/license of eating house under respective regulations.  Site Plan indicating size and location of dance floor, platform and the sitting area,  Maximum occupancy. (iii) The validity of license will be co-terminus with the validity of license of place of Public Entertainment or registration certificate. (c ) Renewal of License: - (i) An online application on (Form-D)for renewal of license for place of public amusement accompanied with the requisite documents shall be made online on the portal of Licensing Division,60 days before the date of expiry of the validity of the license. The license shall be renewed by such authority on receipt of the following documents: (a) Primary Documents (to be obtained by Licensing Division) (i) Valid Health Trade License issued by the Civic bodies. (ii) Area Suitability Reports from Local Police and Traffic. (iii) In case the applicant is resident of Delhi, valid Police Clearance Certificate (PCC) issued by Delhi Police through PCC portal, in case applicant is a resident of outside Delhi, then Police Clearance Certificate (PCC) issued by concerned state/UT authority (b) Secondary Documents (to be uploaded by the applicant on the portal of Licensing unit) An undertaking to be submitted by applicant under the Regulations for Licensing Places of Public Amusement and Public Amusement Performances (other than Cinema), 2023 on the non- judicial stamp paper worth Rs.100(Form-C). (ii) The Certificates/No objection certificates/compliances (wherever applicable) with respect to Health, Fire Safety, Environmental norms, structural and Electrical safety, disaster management (including pandemic), other safety aspects or otherwise as required in respective laws, shall be governed by the respective Agencies as per the extant laws, rules and bye-laws. (d )Validity of license: The license shall be valid for a maximum period of three years ending on 31st day of the March of the third financial year. (e) Transfer of License: (i) A license granted under these Regulations shall not be transferable or assignable but shall be personal for the person only to whom it is granted. (ii) If a licensee transfers or assigns his business to any other person or enters into an agreement with another person, involving his giving up the conduct or control over the business, the license granted to him shall stand terminated from the date of such transaction. (iii) However, in the case of death /incapacitation/lunacy of the licensee, his/herlegal heirs may make an application online within one month from the date of death of licensee, to the Commissioner of Police or any other officer authorized by him in this behalf, to have the benefit of the license for the remaining period of the license and the Commissioner or any other officer authorized by him in this behalf may decide the application having regard to the provisions of these Regulation. (f) Change of name: No person who holds a license to operate a Place of Public Amusement shall make any change in the name of establishment or use his premise(s) for the purpose of services which is not authorized as per license granted. If the licensee desires to change the name of the establishment or provide any other kind18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] of entertainment services, licensee shall apply for fresh endorsement on the existing license online before Commissioner of Police or any other officer authorized by him in this behalf. (g) Every licensee shall at all times ―allow free access to such place to any police officer entering the same in the discharge of his official duty. (h) No licensee shall allow any performance to be held unless valid performance license has been obtained for the purpose. (4) License for temporary or open place of Public Amusement: (a) Grant of License: (i) Every person applying for a License for temporary Place of Public Amusement shall furnish particulars in the application form (Form-E) available on online portal of Licensing Division. Each such application shall be accompanied by the following documents : (a) Primary documents: (To be obtained by Licensing Division) (i) Health Trade License issued by the Municipal/Local Authorities. (ii) Area Suitability Reports from Local Police and Traffic. (iii) In case the applicant is resident of Delhi, valid Police Clearance Certificate (PCC) issued by Delhi Police through PCC portal, in case applicant is a resident of outside Delhi, then Police Clearance Certificate (PCC) issued by concerned state/UT authority (a) Secondary documents: (to be uploaded by the applicant on the portal of Licensing Division) (i) Proof of Identity of applicant (Aadhar/Voter ID Card/PAN/Passport/Driving License). (ii) Proof of Address of applicant (Aadhar/Voter ID Card/Passport/Electricity Bill/Landline Telephone Bill/Rent/Lease Deed/Property Ownership). (iii) Invoice of installation of CCTV up to 30 days recording. (iv) Booking Slip from land owning agency/Proof of ownership/tenancy of the place of Public Amusements. (v) An undertaking to be submitted by applicant under the Regulations for Licensing Places of Public Amusement and Public Amusement Performances (other than Cinema), 2023 (Form-C). (ii) Licensing Authority on receipt of documents and NOCs/Permissions/Sanctions shall grant the license for place of public amusement to the applicant on such terms and conditions and subject to such restrictions as the Licensing Authority may determine. The Place of Public Amusement License shall be subject to such additions and alterations as may be deemed necessary by the Licensing Authority. (iii) The Certificates/No objection certificates/compliances (wherever applicable) with respect to Health, Fire Safety, Environmental norms, structural and Electrical safety, disaster management (including pandemic), other safety aspects or otherwise as required in respective laws, shall be governed by the respective Agencies as per the extant laws, rules and bye-laws. (iv) The Licensing Authority may inspect the place of Public Amusements before or after the grant of license. The Licensing Authority may authorize any of his subordinate police officer not below the rank of Sub-Inspector to undertake such inspections. (b) Validity: The license shall be valid for the period of continuous booking of the land where temporary structure is to be constructed subject to a maximum of three years. CHAPTER-III 4. License for Performance: (1) No person shall conduct any performance unless he has obtained a performance license from the Licensing Authority to hold such performance. There shall be three types of licenses for Performances i.e. at permanent, temporary or open places of public amusement. (2) Application for Grant of License: (a) Every person applying for performance license at a place of public amusement shall furnish particulars in the application (Form-F) available on online portal of Licensing Division.[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 19 (b) A non-refundable processing fee of application as specified by the Commissioner of Police from time to time with prior approval of Lt. Governor, Delhi shall be deposited online by the applicant at the time of submission of application. (c) Every person applying for a License of performance at Place of Public Amusement shall upload all the required documents mentioned on the Portal of the Licensing Division. The Commissioner of Police or any other officer authorized by him in this behalf shall assess that the applicant and the proposed performance for License fulfills following: - (i) The applicant is suitable, (ii) That the performance does not adversely impact public order, morality, decency or is in the interest of general public. (3) License at Permanent Place of public amusement (a) Grant of License: An application in this regard shall be made online along with the following documents: i. Booking slip from permanent place of Public amusement. ii. Proof of Identity of applicant (Aadhar/Voter ID Card/PAN/Passport/Driving License). iii. Proof of Address of applicant (Aadhar/Voter ID Card/Passport/Electricity Bill/Landline Telephone Bill/Rent/Lease Deed/Property Ownership). iv. Nomination/authorization by the Organizer in favour of applicant. v. An undertaking to be submitted by applicant under the Regulations for Licensing Places of Public Amusement and Public Amusement Performances (other than Cinema), 2023 on the non-judicial stamp paper worth Rs.100/-. vi. In case the applicant is resident of Delhi, valid Police Clearance Certificate (PCC) issued by Delhi Police through PCC portal, in case applicant is a resident of outside Delhi, then Police Clearance Certificate (PCC) issued by concerned state/UT authority. (b) Validity of License: The validity of such license shall be only for the period during which a particular Public Amusement Performance is proposed to be held. However, Public Amusement Performance license to operate a Video Games Parlor and Amusement Park may be granted or renewed for a period of three years ending on 31stday of March of the third financial year. (4) License at temporary or open Place of Public Amusement (a) Every person applying for performance license at temporary place of public amusement shall furnish particulars in the application (Form-G) available on online portal ofLicensing Division at least 10 days before the performance. (b) A non-refundable processing fee of application as specified by the Commissioner of Police from time to time with prior approval of Lt. Governor, Delhi shall be deposited online by the applicant at the time of submission of application. (5) Each such application shall be accompanied by the following documents: (a) Primary Documents (To be obtained by Licensing Division) (i) Area Suitability Report(ASR) from local Police and Traffic Police. (ii) In case the applicant is resident of Delhi, valid Police Clearance Certificate (PCC) issued by Delhi Police through PCC portal, in case applicant is a resident of outside Delhi, then Police Clearance Certificate (PCC) issued by concerned state/UT authority. (b) Secondary Documents (to be uploaded by the applicant on the portalof Licensing Division) (i) Booking slip from land owning agency/Permanent Place of Public Amusement. (ii) Proof of Identity of applicant (Aadhar/Voter ID Card/PAN/Passport/Driving License). (iii) Proof of Address of applicant (Aadhar/Voter ID Card/Passport/Electricity Bill/Landline Telephone Bill/Rent/Lease Deed/Property Ownership). (iv) Nomination/authorization by the Organizer in favour of applicant.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (v) Invoice of installation of CCTV with 30 days recording facility. (vi) An undertaking to be submitted by applicant under the Regulations for Licensing Places of Public Amusement and Public Amusement Performances (other than Cinema), 2023 on the non-judicial stamp paper worth Rs.100/-. (c) The Certificates/No objection certificates/compliances (wherever applicable) with respect to Health, Fire Safety, Environmental norms, structural and Electrical safety, disaster management (including pandemic), other safety aspects or otherwise as required in respective laws, shall be governed by the respective Agencies as per the extant laws, rules and bye-laws. (d) The license shall state the title of each item of the performance with general description and specific period & date of performance as well. CHAPTER-IV 5. Fees, General Conditions and Exemptions. (1) The Licensing Authority will have the right to refuse to grant/renew or cancel a license as per provisions of section 28 (1) (x) & (y) of Delhi Police Act-1978. (2) The licensee shall display the copy of the license issued by the Competent Authority at a prominent place at reception of the licensed place (3) No person holding a performance license under these regulations shall promote impropriety of language, indecency of dress, dance, movement or gesture, offensive personation or representation, likely to excite feeling of sedition or discontent, likely to cause riot or breach of peace, to promote or excite hostile feelings between different classes, religion or any individual, dangerous exhibition or display of a performance or game, with wild beasts, except in so far as it is an item of performance in a circus which shall be governed by regulations. Performance or game involving risk, damage or danger to the audience or public or any performance which does not cover under the License shall not be allowed. (4) Fees for the grant/renewal/duplicate license of Place of Public Amusements License and Performance License shall be as specified by the Commissioner of Police from time to time with prior approval of Administrator/Lieutenant Governor, Delhi. (5) Smoking shall not be allowed at any place of public amusement. ‗No Smoking‘ sign should be prominently displayed in the same. (6) No licensee shall admit to any part of the place of public amusement, greater number of person than the maximum number authorized in the license issued under these Regulations to be accommodated in such part. (7) The licensee shall give free access to the place of Public Amusement at all hours to the officers nominated by the Licensing Authority or a Police Officer in discharge of his official duties or other officers legally authorized on this behalf. (8) License granted under these regulations shall not be transferred but shall be for event of personal benefit only of the person to whom it is granted and on the death of the Licensee, license shall be, subject to the provisions of these regulations, deemed to be revoked. (9) No person is allowed to carry arms in the Place of Public Amusements subject to the provisions of the Arms Act. (10) No person under 18 years of age shall be entitled to obtain or hold any license under these regulations. (11) No alteration of lay out, design and structure of licensed place shall be made without the prior sanction of concerned authorities. (12) Buildings licensed under the Delhi Cinematograph Rules-2008, for cinematograph performance shall be deemed to be considered as permanent place of public amusement for the purpose of these regulations. (13) The provisions of Chapter III shall not apply to the following performance namely: (1) Religious gathering at place of worship (2) Events organized by School/College within their premise (3) General Body meetings of legally recognized bodies under various statutes (4) Book launch events (5) Cremation, Death anniversary, marriage, birthday, wedding anniversaries (6) Special gatherings of educational institutions recognized by Govt. or Universities (7) Performances for which a license is required under the Delhi Cinematograph Rules, 2008.[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 21 (14) Licensee or organizer shall be available in the place of Public Amusements during operational hours. (15) During an epidemic/pandemic/infectious disease/unforeseen situation, licensee shall strictly comply with all instructions/ directions and restrictions, as may be issued from time to time, by the National Disaster Management Authority (NDMA), District Disaster Management Authority (DDMA) and other Government Agencies in this behalf in respect of any measures considered necessary by them to prevent the spread of epidemic/pandemic/ infectious disease/unforeseen situation. (16) There shall be First aid facility readily available at every temporary /permanent place of Public Amusements. (17) Every licensee shall take sufficient steps to prevent overcrowding in or around such place and in the event of any disturbance or incident involving injury to human life or limb, illegal activity therein or threat, shall give immediate information of the same to the police. (18) If any licensee knowingly permits, persons of notoriously bad character to meet or remain in such place or indulges or permits any illegal activity, the Commissioner of Police or any other officer authorized by him in this behalf shall have the power in his discretion at any time to cancel a license granted under these Regulation or to suspend it for such period as he may specify. The person to whom such direction is issued by the Commissioner of Police or any other officer authorized by him in this behalf shall forthwith comply with such direction. (19) Every licensee shall, as soon as he closes or ceases to operate a licensed place of Public Amusements in respect of which a license has been granted under these Regulations and give intimation thereof to the Commissioner of Police or any other officer authorized by him in this behalf for further necessary action by the Licensing Authority. (20) Regulation of sound levels and performance hours which are as follows: (a) Timings of Public Amusement Performance :- (i) The timing for Public Performance at Permanent Places of Public Amusement shall be up to 12.30 AM. (ii) The timing for Public Performance at temporary/open Places of Public Amusement shall be up to 10.00 PM as per the Provisions of Noise Pollution (Regulation & Control) Rules, 2000. (iii) The timings for Public Amusement Performance and playing of music and other amplifying instruments during such public performance on special religious/festive/cultural occasions of a limited duration not exceeding 15 days in all during a calendar year can be increased beyond the normal timings by a special order passed in this regard on each occasion by the Hon‘ble LG, Delhi. (iv) The timing for performances in all the Eating houses and Places of public entertainment which have license for permanent place of amusement will be as per the operational timings prescribed in the respective Registration Certificate/License for such Eating house or places for public entertainment in the respective regulations. (b) Sound levels: For all Public Amusement Performances being held, the level of sound to be played will be as per the Provisions of ‗The Noise Pollution (Regulation & Control) Rules, 2000‘ and/or guidelines issued by any lawful competent authority from time to time. (21) The Police Clearance Certificate (PCC) which has been issued within oneyearprior to date of application shall be considered valid. CHAPTER-V 6. Refusal/Rejection/Suspension/Cancellation/Revocation, Appeal. (1) Refusal, Cancellation and Suspension (a) Refusal for Grant: -The Commissioner of Police or any other officer who has been delegated/authorized by him in this behalf shall have discretion to refuse license for Place of Public Amusement if such place does not fulfill the requirements as mentioned in Regulations. (b) Refusal for Renewal: -The Commissioner of Police or any other officer who has been delegated/authorized by him in this behalf may refuse to renew the License, if the Licensee has submitted a false undertaking or the licensed premises has violated the terms and conditions of the22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] License duly communicated to the Licensing Authority in writing by the area Local Police, making him unsuitable to hold the License. (c) Cancellation and Suspension: - (i) In case of regulating traffic and for presentation of order in public places etc, the Commissioner of Police or any other officer authorized by him in this behalf shall have the power in his discretion at any time to cancel a License granted under these Regulations or to suspend for such period as he may specify and to direct the Licensee of any Place of Public Amusement to close place either permanently or temporarily. (ii) The Licensing Authority may cancel or suspend the license and its operation either permanently or temporarily by giving such order in writing after offering him an opportunity of being heard. (iii) If the Commissioner of Police or any other officer authorized by him in this behalf is satisfied after such enquiry as it deems fit that Licensee is not a suitable person for continuing to hold the license or in order to prevent any obstructions, inconvenience in the vicinity or to prevent disturbance in such place shall have the power at any time to cancel a license granted under these Regulations or to suspend for such period as he may specify and to direct the Licensee to close the place either permanently or temporarily. (iv) If the Commissioner of police or other officer authorized by him in this behalf is satisfied that licensee has violated any term/condition of the license, shall have the power at any time to cancel his license granted under these Regulations or to suspend for such period as he may specify and to direct the Licensee to close the place either permanently or temporarily. (2) No License granted under these Regulations shall be cancelled until the holder of a License has been given a reasonable opportunity of showing cause why this license should not be cancelled. Provided that no such opportunity for showing cause shall be necessary when the license is suspended temporarily pending an enquiry against the holder of the license for contravention of any of these Regulations or any order made there under or of any of the conditions of the License granted to him. (3) Suspension/Cancellation/Revocation/Cessation of operations/Prosecutionby other agencies: Actions like Suspension/Cancellation/Revocation/Cessation of Operations/Prosecution on any violation of license/NOC granted under relevant statutes by other agencies shall be taken by them as per their respective Acts/Rules/Regulations applicable to them. The concerned agencies shall be solely responsible for execution of such Suspension/ Cancellation/ Revocation/Cessation of Operations/ Prosecution orders as per their respective Acts/Rules/Regulations. (4) Power to issue directions : The Commissioner of Police/Licensing Authority shall issue directions/conditions from time to time for operational reasons to be complied with by the Licensee. (5) Responsibilities of the applicant: It shall be the sole responsibility of the applicant to obtain necessary NOCs/permissions/compliances etc. from the concerned authorities and statutory bodies. (6) Responsibilities of other agencies: The Certificates/NOCs/Compliances (wherever applicable) with respect to Health, Fire Safety, Environmental norms, structural and Electrical safety and other safety aspects shall be issued by the respective government agencies as per their acts/rules/byes -laws. (7) The Licensee of a Place of Public Amusement shall ensure that no public amusement performance is held unless necessary public performance license has been obtained from the competent authority. It shall be collective responsibility of the licensee, organiser or authorised nominees to ensure that all the terms and conditions of the license are complied within letter and spirit during the performance. In case of violation of these provisions, the place of public amusement licensee and the organizer shall be jointly held responsible and prosecuted as per law. (8) Appeal- (a) Any person, aggrieved by an order of the officer authorized by Commissioner of Police refusing to grant or renew license or cancelling a license under the provisions of these Regulations may within 30 days from the date of communication to him of such order, appeal to the Commissioner of Police, Delhi. (b) Any person, aggrieved by an order of Commissioner of Police refusing to grant or renew license or cancelling a license under the provisions of these Regulations may within 30[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 23 days from the date of communication to him of such order, appeal to the Administrator, Delhi. (9) Review of Regulations:- In order to bring them in conformity with the changed circumstances, these Regulations shall be reviewed from time to time and at-least once in two years. (10) Repeal and Savings:-(1) Immediately with effect from the date on which these Regulations come into force, the Notification issued on 29th December, 1980 shall stand repealed. (2) Notwithstanding any such repeal, anything done or any action taken or purported to have been taken or any license granted, under the notification repealed by sub-regulation (1), shall, in so far as these are not inconsistent with these Regulations or the Delhi Police Act, 1978, be deemed to have been done, taken or granted under the corresponding provisions of these Regulations Supersession Clause: -This Notification supersedes the previous Notification N.4935 Special Cell issued on 29th December, 1980.
