5. रािमागग खण्ड पर बहुयात्राओं हते ु पास जनम्नजलजखत िरों पर िारी दकया िाएगा, अथागतः्
संिेय राजि अनुज्ञात एकतरफा यात्राओं जवजधमान्द्यता की अवजध
की अजधकतम संख्या
एकतरफा यात्रा के जलए िल्ु क का डेढ़ गुना िो भुगतान के समय स े चौबीस घंटे
पचास एकल यात्राओं के जलए संिेय िुल्क की पचास या अजधक भुगतान के दिनांक स े एक माह
राजि का िो-जतहाई
6. जिस जिले म ें िुल्क प्लािा जस्ट्थत ह,ै उसम ें पंिीकृत वाजणजज्यक वाहन (राष्ट्रीय परजमट के अधीन चल रह े वाहनों
को छोड़कर) के जलए िल्ु क उस श्रेणी के जलए वाहन के जलए जनधागररत िुल्क का 50% होगा बित े दक ऐस े वाजणजज्यक
वाहनों के उपयोग के जलए कोई सर्वगस सड़क अथवा वैकजल्पक सड़क उपलब्ध न हो।
7. िो यांजत्रक वाहन अपनी श्रेणी के जलए जनधागररत अनुज्ञेय भार की अपेिा अजधक भार स े लिा हुआ होगा उसके

10. ऊपर ताजलका-1 म ें यथा-उजल्लजखत, आधार वर् ग 2007-08 के जलए प्रजत दकलोमीटर िुल्क की आधार िर के
आधार पर, यांजत्रक वाहनों स े जलए िाने वाले वास्ट्तजवक िल्ु क और कटौजतयों की गणना प्राजधकरण द्वारा खंडों की पूरी कर
ली गई लम्बाई के आधार पर की िायेगी और उस े प्राजधकरण द्वारा ररयायतग्राही के माध् यम स े अग्रं ेिी और स्ट्थानीय भार्ा
के कम-स-े कम एक समाचार पत्र म ें प्रकाजित करवाया िाएगा और तत्प चात ररयायत करार के प्रावधान एव ं उक्त जनयमों
के जनयम 5 के अनुसार उसमें वार्र्गक तौर पर संिोधन दकया िाएगा और प्रकाजित दकया िाएगा, बिते दक िुल्क के
पूवगवती संिोधन की तारीख से 6 (छह) महीने की अवजध के भीतर कोई संिोधन प्रभावी नहीं होगा।

NOTIFICATION
New Delhi, the 19th October, 2022
S.O. 4939(E).—Whereas by notification of the Government of India in the Ministry of Road
Transport and Highways number S.O 78 (E) dated 4th February, 1999 & S.O. 196(E) dated 6th March,
2000 issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the
Central Government has entrusted the stretch from km 93.000 to 479.000 of National Highway number 2
(Haryana/Uttar Pradesh border to Kanpur section) and km 8.000 to km 24.000 (Agra-Gwalior section) of
National Highway number 3 respectively in the State of Uttar Pradesh to the National Highways Authority
of India (hereinafter referred to as the “Authority”);
And whereas, in exercise of the powers conferred by Section 7 of the National Highway Act, 1956
(48 of 1956) read with Rule (3) of the National Highway Fee (Determination of Rates and Collection)
Rules 2008, the Central Government by notification of the Government of India authorized Authority for
levying and collecting fee on mechanical vehicles for the use of stretches as follows:
Vide S.O.No. 2723(E) dated 17th August, 2016 for the section from km 0+000 to km 32+800 of
Agra Bypass in the State of Uttar Pradesh.
And whereas, pursuant to the provision of Section 14 of the National Highways Authority of India
Act, 1988 (68 of 1988), the Authority has entered into an Agreement (hereinafter referred to as said
agreement) with National Highways Infra Projects Private Limited, having its registered office G-5 & 6,
Sector-10, Dwarka, Delhi, South West Delhi, Delhi, India, 110075 (hereinafter referred to as the
“Concessionaire”), on 26.09.2022 for the Tolling, Operation, Maintenance and Transfer (InvIT mode) of
Agra Bypass Section from Km 0.000 to Km 32.800 (length 32.800 Km) taking off at km 176.800 of NH-2
(Design km 0.000 of bypass ) and merging at km 13.030 ( Design km 32.800 of bypass ) of NH-3 in the
state of Uttar Pradesh (hereinafter referred to as the said section) of the National Highway;
Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act,

supersession of the Notification Number S.O. No. 2723(E) dated 17th August, 2016 except as respect
things done or omitted to be done before such supersession, the Central Government, having regard to the
expenditure involved in building, maintenance, management and operation of the said Section of said
National Highway, interest on the capital invested, reasonable return, the volume of traffic and the period
of said agreement entered between the Authority and the Concessionaire, hereby notifies that there shall be
levied and collected fees on mechanical vehicles at the rate specified in column (2) of the Table 1 for
equivalent structure length (having length more than 60 m ) of 7.055 km (having length of 0.7055 kms) and
one half times the base rates for bypass having net length of 32.0945 km costing rupees ten crore or more
for use of four and more lane sections on the Type of Vehicles specified in column (1) of the Table 1 below
and authorizes the said Concessionaire to collect and retain the fee on and from the Appointed Date or
publication of this Notification in the Official Gazette, whichever is later, till the date of termination as
specified in the agreement. This fee notification shall be effective from the Appointed Date of the ToT
project (In VIT Mode).

4. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial
purposes and resides within a distance of twenty kilometers from the fee plaza is Rs. 315.00 (Rupees Three
Hundred Fifteen only) for the year 2022-23 which is subject to revision every year as per the provisions of
the National Highways Fee (Determination of Rates and Collection) Rules, 2008.
5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely;

6. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the
district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no
service road or alternative road is available for use of such commercial vehicles.
7. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of
permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on
the National Highway to the fee collecting agency, as per Rule 10 (1A) of NH Fee Rule 2008 and shall not
be entitled to make use of the highway section unless the excess load has been removed from such
mechanical vehicle.
8. All definitions, category of mechanical vehicles, its permissible load, category of exempted
vehicles, service road, alternative road etc. shall be as per definitions specified in the Rules.
9. The Fee rates shall be displayed for information of the users in accordance with rules 12 of the
said Rules.
10. Based on the Base Rate of Fee per km for the base year 2007-08 as mentioned in Table-1, the
actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the
Authority on the basis of completed length of the Project Highway. The same shall be got published by the
Authority through the Concessionaire in at least one newspaper, each in English and vernacular language
and thereafter revised annually in accordance with the rule 5 of the said rules and provision of Concession
Agreement and got published, provided that no revision shall be effected within a period of 6 (six) months
from the date of the preceding revision of Fee.
