[जिसमें 61.812 दकमी 4 लने सड़क, और 8.59 दकमी की समकक्ष लिं ाई सजहत 0.859 दकमी लंिाई की 4 लने संरचनाएँ (जिनकी लम्िाई 60 मीटर स े अजधक ह)ै िाजमल ह]ैं (फ्लाईओवर के जनमागण से पहल)े और सड़क की कुल लम्िाई 62.671 दक.मी. [जिसमें 61.721 दकमी 4 लेन सड़क, और 9.50 दकमी की समकक्ष लंिाई सजहत 0.950 दकमी की 4 लने संरचनाए ँ (जिनकी लम्िाई 60 मीटर स े अजधक ह)ै िाजमल ह]ैं (फ्लाईओवर के जनमागण के िाि) और िहलापारा िल्ु क प्लािा के मामले म,ें सड़क की कुल लंिाई 51.500 दकमी [जिसम ें 50.360 दकमी 4 लेन सड़क और 11.40 दकमी की समकक्ष लंिाई सजहत 1.140 दकमी लंिाई वाली 4 लेन संरचनाएं (60 मीटर से अजधक लंिाई) िाजमल ह]ै (फ्लाईओवर के जनमागण स े पहले) और 51.500 दकमी की कुल सड़क लंिाई के जलए [50.258 दकमी 4 लने सड़क और 12.42 दकमी की समकक्ष लंिाई सजहत 1.242 दकमी लिं ाई वाली 4 लने सरं चनाएं (60 मीटर से अजधक लंिाई वाली) िाजमल ह]ैं (फ्लाईओवर के जनमागण के िाि) हते ु सारणी 1 के स्ट्तम्भ (2) म ें जवजनर्िगष्ट िर पर (जिसे इसके पश् चात् ‘‘आधार िर‘‘ कहा गया ह)ै , नीच े सारणी 1 के स्ट्तम्भ (1) म ें जवजनर्िगष्ट प्रकार के वाहनों पर िल्ु क उद्ग्रहीत दकया िाएगा और उि कंसेसनायर को कायागरंभ करन े की तारीख को तथा उस तारीख स े अथवा इस अजधसूचना के रािपत्र म ें प्रकािन पर, िो भी िाि में हो, करार म ें[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 जवजनर्िगष्ट समापन की तारीख तक िुल्क सग्रं हीत तथा प्रजतधाररत करने हते ु प्राजधकृत करती ह।ै यह िुल् क अजधसूचना टीओटी पररयोिना पर कायागरंभ करन े की तारीख स ेप्रभावी होगी:- सारणी 1 वाहन का प्रकार आधार वर्ग 2007-08 के जलए प्रजत दकमी* चार या अजधक लेन के एनएच खंड के जलए िुल्क की आधार िर (रुपये में) (1) (2) कार, िीप, वैन या हल् के मोटर वाहन 0.65 हल् के वाजणजज्यक वाहन, हल् के माल वाहक वाहन अथवा जमनी िस 1.05 िस या रक (िो धुरी वाले) 2.20 तीन धुरी वाले वाजणजज्यक वाहन 2.40 भारी संजनमागण मिीनरी (एच.सी.एम॰) या अथग मूलवंग उपस्ट् कर (ई.एम.ई) 3.45 या िहुधुरीय वाहन (एम.ए.वी.) हो, उसके जलए वर्ग 2023-24 के जलए माजसक पास की िर 330.00/-रूपए (तीन सौ तीस रूपए मात्र) होगी और राष्ट्रीय रािमाग ग िल्ु क (िरों का अवधारण एवं सग्रं हण) जनयम, 2008 के प्रावधानों के अनुसार उसमें प्रत्येक वर्ग संिोधन दकया िायेगा। 5. रािमागग खण्ड पर िहुयात्राओं हेतु पास जनम्नजलजखत िरों पर िारी दकया िाएगा, अथातग ्ः संिेय राजि अनुज्ञात एकतरफा यात्राओं की जवजधमान्द्यता की अवजध अजधकतम संख्या एकतरफा यात्रा के जलए िल्ु क का डेढ़ िो भुगतान के समय से चौिीस घंटे गुना पचास एकल यात्राओं के जलए संिेय िुल्क पचास भुगतान की दिनांक से एक माह की राजि का िो-जतहाई 6. जिस जिले म ें िल्ु क प्लािा जस्ट्थत है, उसमें पंिीकृत वाजणजज्यक वाहन (राष्ट्रीय परजमट के अधीन चल रह े वाहनों को छोड़कर) के जलए िुल्क उस श्रणे ी के जलए वाहन के जलए जनधागररत िुल्क का 50% होगा िित े दक ऐसे वाजणजज्यक वाहनों के उपयोग के जलए कोई सर्वगस सड़क अथवा वैकजल्पक सड़क उपलब्ध न हो। 7.दकसी यांजत्रक वाहन का चालक अथवा माजलक अथवा प्रभारी व्यजि राष्ट्रीय रािमागग पर ओवरलोडडे वाहन को प्रविे कराने के जलए िुल्क एकत्र करन े वाली एिेंसी को जनम्नवत िुल्क के िरािर का भुगतान करने के जलए उत्तरिायी होगा : अजधकतम अनुमेय सकल वाहन भार से आधार िर का गुणक कारक िुल्क अजधक भार का प्रजतित (1) (2) (3) 0% से 20% िो [(जनयम 4 के उप-जनयम (2) के तहत >20% से 40% चार उनके जलए अनुज्ञेय भार, छूट-प्राप्त वाहनों की श्रेणी, सर्वगस रोड, वैकजल्पक सड़क आदि सजहत सभी पररभार्ाए ं जनयमों म ें जवजनर्िगष्ट पररभार्ाओं के अनुसार होंगी। 9. उि जनयमों के जनयम 12 के अनुसार, प्रयोगकतागओं की िानकारी के जलए िल्ु क की िरों को प्रिर्िगत दकया िाएगा। 10. ऊपर ताजलका-1 म ें यथा-उजल्लजखत, आधार वर् ग 2007-08 के जलए प्रजत दकलोमीटर िल्ु क की आधार िर के आधार पर, यांजत्रक वाहनों से जलए िाने वाले वास्ट्तजवक िल्ु क और कटौजतयों की गणना प्राजधकरण द्वारा पररयोिना रािमागग की पूरी कर ली गई लम्िाई के आधार पर की िायगे ी। उसे प्राजधकरण द्वारा कंसेसनायर के माध् यम से अंग्रेिी और स्ट्थानीय भार्ा के कम-स-े कम एक समाचार पत्र में प्रकाजित करवाया िाएगा और तत्प श् चात ररयायत करार के प्रावधान एवं उक्त जनयमों के जनयम 5 के अनुसार उसम ें वार्र्गक तौर पर संिोधन दकया िाएगा और प्रकाजित दकया िाएगा, No. 465(E) dated 26.04.2002, issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from Km 0.00 to Km 93.00 (Bijni to West Bengal / Assam Border) of National Highway No. 31C and km 961.500 to km 1126.00 (Guwahati – Nalbari Bijni) of National Highway no. 31 in the State of Assam to the National Highways Authority of India (hereinafter referred to as the “Authority”); And whereas, in exercise of the powers conferred by Section 7 of the National Highway Act, 1956 (48 of 1956) read with Rule (3) of the National Highway Fee (Determination of Rates and Collection) Rules 2008, the Central Government by notification of the Government of India authorized Authority for levying and collecting fee on mechanical vehicles for the use of stretches as follows: Vide S.O. No. 109 (E) dated 07.01.2020 for the 4 laning of Bijni to West Bengal / Assam Border section from km 30.00 to km 93.000 of NH- 31C and Guwahati to Nalbari – Bijni section from km 961.500 to km 1013.00 of NH- 31 in the state of Assam. No. 109 (E) dated 07.01.2020 except as respect things done or omitted to be done before such supersession, the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said Section of said National Highway, interest on the capital invested, reasonable return, the volume of traffic and the period of said agreement entered between the Authority and the Concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles at the rate specified in column (2) of the Table 1 in case of Patgaon fee plaza, total road length of 62.671 km [including 61.812 km 4 lane road, and 0.859 km length of 4 lane structures (having length more than 60m) with equivalent length of 8.59 km] (Before construction of Flyover) and for total road length of 62.671 km [including 61.721 km 4 lane road and 0.950 km length of 4 lane structures (having length more than 60m) with equivalent length of 9.50 km] (after construction of Flyover) and In case of Dahalpara Fee Plaza, Total road length of 51.500 km [including 50.360 km 4 lane road, and 1.140 km length of 4 lane structures (having length more than 60m) with equivalent length of 11.40 km] (Before construction of Flyover) and for total road length of 51.500 km [including 50.258 km 4 lane road and 1.242 km length of 4 lane structures (having length more than 60m) with equivalent length of 12.42 km] (after construction of Flyover) for use of four and more lane sections (hereinafter referred to as “base rate”) on the Type of Vehicles specified in column (1) of the Table 1 below and authorizes the said Concessionaire to collect and retain the fee on and from the Appointed Date or publication of this Notification in the Official Gazette, whichever is later, till the date of termination as specified in the agreement. This fee notification shall be effective from the Appointed Date of the ToT project. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs. 330.00 (Rupees Three Hundred Thirty only) for the year 2023-24 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008. 5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely; Amount Payable Maximum number of one way Period of validity journeys allowed One and half times of the fee for one way Two Twenty four hours from the time of journey payment Two-third of amount of the fee payable for Fifty One month from date of payment fifty single journeys 6. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 7. The driver or owner or person in charge of a mechanical vehicle shall be liable to pay fee for entering the overloaded vehicle on the national highway, to the user fee collecting agency, equal to fees as follows: Percentage of excess load over Multiplying Factor to the Fees Maximum Permissible Gross base rate Vehicular Weight (1) (2) (3) 0% to 20% Two >20% to 40% Four [(Fees applicable for such category of >40% to 60% Six mechanical vehicle under sub-rule (2) of >60% to 80% Eight rule 4) x (Multiplying factor)] >80% and Above Ten 8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the Rules. 9. The Fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules. 10. Based on the Base Rate of Fee per km for the base year 2007-08 as mentioned in Table-1, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of completed portion of the length of the Project Highway. The same shall be got published by the Authority through the Concessionaire in at least one newspaper, each in English and vernacular language and thereafter revised annually in accordance with the rule 5 of the said rules provided that no revision shall be affected within a period of 6 (six) months from the date of the preceding revision of fee.
