कटनी - िबलपुर खंड (इसके बाि उि खंड के रूप म ें संिर्भगत) के टोललंग, संचालन, रखरखाव और स्ट्थानांतरण (इनजवट) के जलए एनएचआईटी ईस्ट्टन ग प्रोिेक्ट्स प्राइवेट जलजमटेड, जिसका पंिीकृत कायागलय िी-5 और 6, सेक्टटर-10, द्वारका, दिल्ली, िजिण पजश्चम दिल्ली, दिल्ली, भारत, 110075 (इसके बाि "कंसेसनायर" के रूप म ें संिर्भगत) में ह,ै के साथ करार (जिसे इसके पश् चात उि ‘करार’ कहा गया ह)ै दकया ह;ै अतः अब, केन्द्रीय सरकार, राष्ट्रीय रािमाग ग िल्ु क (िरों का अवधारण एव ं संग्रहण) जनयम, 2008 [सा.का.जन. 838 (ई), तारीख 5.12.2008] के जनयम 3 और राष्ट्रीय रािमाग ग िल्ु क (िरों का अवधारण एव ं संग्रहण) संिोधन जनयम, 2010 [सा.का.जन.950(ई), तारीख 03.12.2010], राष्ट्रीय रािमागग िुल्क (िरों का अवधारण एवं संग्रहण) संिोधन जनयम, 2011 [सा.का.जन. 15 ई), तारीख 12.01.2011] राष्ट्रीय रािमागग िुल्क (िरों का अवधारण एव ं संग्रहण) िसू रा संिोधन जनयम, 2011 [सा.का.जन. 756 (ई), तारीख 12.10.2011], राष्ट्रीय रािमागग िुल्क (िरों का अवधारण एव ं संग्रहण) संिोधन जनयम, 2013 [सा.का.जन. 778 (ई), तारीख 16.12.2013], राष्ट्रीय रािमाग ग िल्ु क (िरों का अवधारण एव ं संग्रहण) सिं ोधन जनयम, 2014 [सा.का.जन. 26 (ई), तारीख 16.01.2014], राष्ट्रीय रािमागग िुल्क (िरों का अवधारण एव ं संग्रहण) संिोधन जनयम, 2014 [सा.का.जन. 831 (ई), तारीख 21.11.2014], राष्ट्रीय रािमाग ग िुल्क (िरों का अवधारण एव ं संग्रहण) संिोधन जनयम, 2014 [सा.का.जन. 02(ई), तारीख 29.12.2014], राष्ट्रीय रािमागग िल्ु क (िरों का अवधारण एवं संग्रहण) संिोधन जनयम, 2015 [सा.का.जन. 220 (ई), तारीख 23.03.2015], राष्ट्रीय रािमाग ग िल्ु क (िरों का अवधारण एवं सग्रं हण) संिोधन जनयम, 2016 [सा.का.जन. 585 (ई), तारीख 08.06.2016], राष्ट्रीय रािमागग िल्ु क (िरों का अवधारण एवं संग्रहण) संिोधन जनयम, 2016 [सा.का.जन. 1114(ई), तारीख 02.12.2016] , राष्ट्रीय रािमाग ग िल्ु क (िरों का अवधारण एव ं संग्रहण) संिोधन जनयम, 2017 [सा.का.जन. 248(ई), तारीख 14.03.2017], राष्ट्रीय रािमाग ग िल्ु क (िरों का अवधारण एव ं संग्रहण) संिोधन जनयम, 2018 [सा.का.जन. 427(ई), तारीख 07.05.2018] , राष्ट्रीय रािमागग िल्ु क (िरों का अवधारण एवं सग्रं हण) संिोधन जनयम, 2018 [सा.का.जन. 920(ई), तारीख 25.09.2018] , राष्ट्रीय रािमाग ग िुल्क (िरों का अवधारण एव ं संग्रहण) संिोधन जनयम, 2019 [सा.का.जन. 942(ई), तारीख 20.12.2019] , राष्ट्रीय रािमागग िल्ु क (िरों का अवधारण एव ं संग्रहण) संिोधन जनयम, 2020 [सा.का.जन. 298(ई), तारीख 15.05.2020], राष्ट्रीय रािमाग ग िल्ु क (िरों का अवधारण एव ं संग्रहण) संिोधन जनयम, 2020 [सा.का.जन. 523(ई), तारीख 24.08.2020], राष्ट्रीय रािमागग िुल्क (िरों का अवधारण एवं संग्रहण) सिं ोधन जनयम, 2020 [सा.का.जन. 804(ई), तारीख 30.12.2020], के साथ परठत राष्ट्रीय रािमाग ग अजधजनयम 1956 (1956 का 48) की धारा 8क द्वारा प्रित्त िजियों का प्रयोग करत े हुए और करार की तारीख तक दकसी अन्द् य संिोधनों और अजधसूचना का.आ. 2505(ई) दिनांक 12.07.2019 का अजतक्रमण करत े हुए, जसवाय उन बातों के िो ऐसे अजधक्रमण से पूवग कर ली गईं ह ैं या करने से लोप करा िी गईं हैं, उि राष्ट्रीय रािमागों के उि खण्ड के जनमागण, अनुरिण, प्रबंध और प्रचालन पर हुए व्यय, जनवेजित पूंिी पर ब्याि, युजियुि प्रत्यागम, यातायात के िबाव और प्राजधकरण तथा कंसेसनायर के बीच हुए करार की अवजध को ध्यान म ें रखत े हुए, एतद्द्वारा यह अजधसूजचत करती ह ै दक यांजत्रक वाहनों पर, कुल सड़क खंड लम्बाई 45.278 दक.मी. के जलए नीचे सारणी 1 के स्ट्तम्भ (2) में वर्णगत िल्ु क उद्ग्रग्रहीत दकया िाएगा और कटनी बाईपास के जनमाणग के िौरान बाईपास की 23.797 दकमी लंबाई के जलए सारणी 1 के स्ट्तम्भ (2) में वर्णगत आधार िर का 150% िल्ु क उद्ग्रग्रहीत दकया िाएगा और कुल सड़क खंड लम्बाई 45.278 दक.मी. के जलए तथा[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 1.793 दकमी (लंबाई 0.1793 दकमी) समकि संरचना लम्बाई (जिनकी लम्बाई 60 मीटर से अजधक ह)ै के जलए नीच े सारणी 1 के स्ट्तम्भ (2) में वर्णगत िुल्क उद्ग्रहीत दकया िाएगा और कटनी बाईपास के जनमाणग के बाि 42.165 दकमी लंबाई वाले बाईपास के जलए नीचे सारणी 1 के स्ट्तम्भ (1) में जवजनर्िष्टग प्रकार के वाहनों पर चार या अजधक लने खंडों के इस्ट्तेमाल के जलए सारणी 1 के स्ट्तम्भ (2) में वर्णगत आधार िर का 150% िुल्क उद्ग्रहीत दकया िाएगा और उि ररयायतग्राही को कायागरंभ करन े की तारीख को तथा उस तारीख स े अथवा इस अजधसूचना के रािपत्र म ें प्रकािन पर, िो भी बाि म ें हो, करार म ें जवजनर्िष्टग समापन की तारीख तक िल्ु क सग्रं हीत तथा प्रजतधाररत करन े हते ु प्राजधकृत करती ह।ै यह िल्ु क अजधसूचना टीओटी पररयोिना पर कायागरंभ करने की तारीख से प्रभावी होगी:- सारणी 1 वाहन का प्रकार आधार वर्ग 2007-08 के जलए प्रजत दकमी* चार या अजधक लने के एनएच खंड के जलए िुल्क की आधार िर (रुपये में) (1) (2) कार, िीप, वैन या हल्क े मोटर वाहन 0.65 हल् के वाजणजज्यक वाहन, हल् के माल वाहक वाहन अथवा जमनी बस 1.05 बस या रक (िो धुरी वाले) 2.20 तीन धुरी वाले वाजणजज्यक वाहन 2.40 भारी संजनमागण मिीनरी (एच.सी.एम॰) या अथग मूलवंग उपस्ट्क र 3.45 (ई.एम.ई) या बहुधरु ीय वाहन (एम.ए.वी.) िौरान जनमागण के बाि 1. दकमी 739.000 पर खेरवसानी 45.278 दकमी 45.278 दकमी ऊपर सारणी-1 म ें उजल्लजखत टॉल प्लािा पर (दकमी 725.185 आधार िरों का 100% से दकमी 813.275) 2. उपरोि के अलावा,10 करोड़ रुपये से अजधक की लागत वाले बाईपास के उपयोग हते ु ऐसे िुल्क प्लाजा(ओं) के जलए उजल्लजखत बाईपास की जनवल लबं ाई के जलए जनम्नजलजखत िल्ु क प्लाजा पर जनम्नजलजखत िुल्क िये तथा भगु तान योग्य होगा- सारणी 3.1 कटनी बाईपास के जनमाणग के िौरान टोल प्लािा का बाईपास का नाम से प्रारंभ पर जवलय बाईपास की लम्बाई िर जिस पर िुल्क स्ट् थान (चने िे ) और स्ट्थान (दकलोमीटर म)ें जिसके भुगतान योग् य ह ै जलए िल्ु क भगु तान योग् य ह ै लम्बाई को समकरण गुणक 10 से गणु ा करके रािमागग की समकि लम्बाई में पररवर्तगत करते हुए, जनम्नजलजखत िुल्क प्लािा (प्लािाओं) पर, जनम्नजलजखत िुल्क भी िोध्य और संिेय होगाः क. चार लने संरचनाओं के जलए[भाग लंबाई (दक.मी. म)ें ह ै (दकमी म)ें दकमी 739.000 पर खेरवसानी 0.1793^ 1.793 ऊपर सारणी-1 में उजल्लजखत टॉल प्लािा पर आधार िरों का 100% 4 लने संरचनाओं (60 मीटर से अजधक की लंबाई) का जववरण इस प्रकार ह:ै क्रम गैर-वाजणजज्यक प्रयोिनों के जलए पंिीकृत हुआ हो और वह िल्ु क प्लािा स े बीस दकलोमीटर तक की िरू ी में ही रहता/रहती हो, उसके जलए वर्ग 2023-24 के जलए माजसक पास की िर 330.00/- रूपए (तीन सौ तीस रूपए मात्र) होगी और राष्ट्रीय रािमागग िल्ु क (िरों का अवधारण एवं संग्रहण) जनयम, 2008 के प्रावधानों के अनुसार उसमें प्रत्येक वर्ग संिोधन दकया िायेगा । 5. रािमागग खण्ड पर बहुयात्राओं हते ु पास जनम्नजलजखत िरों पर िारी दकया िाएगा, अथागतः् सारणी 5 सिं ेय राजि अनज्ञु ात एकतरफा यात्राओं की जवजधमान्द्यता की अवजध अजधकतम सख्ं या एकतरफा यात्रा के जलए िल्ु क का डेढ़ गुना िो भुगतान के समय से चौबीस घंटे पचास एकल यात्राओं के जलए संिेय िुल्क पचास भुगतान की दिनांक से एक माह की राजि का िो-जतहाई 6. जिस जिले म ें िल्ु क प्लािा जस्ट्थत ह,ै उसमें पंिीकृत वाजणजज्यक वाहन (राष्ट्रीय परजमट के अधीन चल रह े वाहनों को छोड़कर) के जलए िल्ु क उस श्रेणी के जलए वाहन के जलए जनधागररत िुल्क का 50% होगा बिते दक ऐसे वाजणजज्यक वाहनों के उपयोग के जलए कोई सर्वगस सड़क अथवा वैकजल्पक सड़क उपलब्ध न हो। 7. िो यांजत्रक वाहन अपनी श्रेणी के जलए जनधागररत अनुज्ञेय भार की अपेिा अजधक भार से लिा हुआ होगा उसके चालक अथवा माजलक अथवा प्रभारी व्यजि को ऐस े अजधक भार स े लि े हुए वाहन को राष्ट्रीय रािमाग ग म ें प्रवेि करान े के जलए िल्ु क सग्रं हण एिेंसी को जनम्नानुसार िुल्क का भुगतान करना होगा सारणी 6 अजधकतम अनुमेय सकल वाहन भार से अजधक आधार िर का गुणक कारक िुल्क भार का प्रजतित (1) (2) (3) 0% to 20% िो [(जनयम 4 के उप-जनयम (2) के तहत6 THE की श्रेणी, उनके जलए अनुज्ञेय भार, छूट-प्राप्त वाहनों की श्रेणी, सर्वगस रोड, वैकजल्पक सड़क आदि सजहत सभी पररभार्ाएं उि जनयमों में जवजनर्िष्टग पररभार्ाओं के अनसु ार होंगी। 9. उि जनयमों के जनयम 12 के अनुसार, प्रयोगकतागओं की िानकारी के जलए िल्ु क की िरों को प्रिर्िगत दकया िाएगा। 10. ऊपर ताजलका-1 में यथा-उजल्लजखत, आधार वर्ग 2007-08 के जलए प्रजत दकलोमीटर िुल्क की आधार िर के आधार पर, यांजत्रक वाहनों स े जलए िान े वाल े वास्ट्तजवक िुल्क और कटौजतयों की गणना प्राजधकरण द्वारा की िायेगी। उस े प्राजधकरण द्वारा ररयायतग्राही के माध् यम से अग्रं ेिी और स्ट्थानीय भार्ा के कम-से-कम एक समाचार पत्र में प्रकाजित करवाया िाएगा और तत्प श् चात ररयायत करार के प्रावधान एवं उक्टत जनयमों के जनयम 5 के अनुसार उसम ें वार्र्गक तौर पर संिोधन दकया िाएगा और प्रकाजित दकया िाएगा, बिते दक िुल्क के पूवगवती संिोधन की तारीख से 6 number S.O. No. 910 (E) dated 21.04.2010 & S.O. 2705 (E) dated 02.11.2010, issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from Km 243.600 to Km 377.600 of Rewa – Katni section of National Highway No. 7 and km 377.600 to km 544.000 of Katni -Jabalpur – Lakhnadon section of National Highway No. 7 in the State of Madhya Pradesh to the National Highways Authority of India (hereinafter referred to as the “Authority”); And whereas, in exercise of the powers conferred by Section 7 of the National Highway Act, 1956 (48 of 1956) read with Rule (3) of the National Highway Fee (Determination of Rates and Collection) Rules 2008, the Central Government by notification of the Government of India authorized Authority for levying and collecting fee on mechanical vehicles for the use of stretches as follows: Vide S.O. No. 2505 (E) dated 12.07.2019 for the Rewa – Katni - Jabalpur (excluding Katni Bypass) section from design km 311.585 to km 360.468 and from km 379.465 to km 399.657 (existing chainage km 311.000 to km 359.500 km and Km 378.500 to km 397.000) of National Highway Number -7 in the State of Madhya Pradesh. No. 2505 (E) dated 12.07.2019 except as respect things done or omitted to be done before such supersession, the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said Section of said National Highway, interest on the capital invested, reasonable return, the volume of traffic and the period of said agreement entered between the Authority and the Concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles at the rate specified in column (2) of the Table 1 for net road section length of 45.278 Km and at 150% of the base rate specified in column (2) of the Table 1 for bypasses having length of 23.797 km during construction of Katni Bypass and at the rate specified in column (2) of the Table 1 for net road section length of 45.278 and for equivalent structure length (having length more than 60 m) of 1.793 Km (having length of 0.1793 Km) and at 150% of the base rate specified in column (2) of the Table 1 for bypasses having length of 42.615 km after construction of Katni Bypass for use of four or more lane sections on the type of vehicles specified in column (1) of the Table 1 below and authorizes the said Concessionaire to collect and retain the fee on and from the Appointed Date or publication of this Notification in the Official Gazette, whichever is later, till the date of termination as specified in the agreement. This fee notification shall be effective from the Appointed Date of the ToT project. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs. 330.00 (Rupees Three Hundred Thirty only) for the year 2023-24 which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008. 5. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 7. The driver or owner or person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category under the rules shall be liable to pay fee, for entering the overloaded vehicle on the National Highway to the user fee collecting agency, equal to fee as follows. All definitions, category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the Rules. 9. The Fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules.10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 10. Based on the Base Rate of Fee per km for the base year 2007-08 as mentioned in Table-1, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of completed length of the Project Highway. The same shall be got published by the Authority through the Concessionaire in at least one newspaper, each in English and vernacular language and thereafter revised annually in accordance with the rule 5 of the said rules and provision of Concession Agreement and got published, provided that no revision shall be effected within a period of 6 (six) months from the date of the preceding revision of Fee.
