[जिसम ें 63.465 दक.मी. की सड़क और 9.179 दक.मी. की सरचनाए ं िाजमल ह ै (जिनकी लम्बाई 60 मीटर स े अजधक ह)ै और जिसकी समकक्ष लम्बाई 91.79 दक.मी. ह]ै (जनमागण अवजध के िौरान) उत्तर प्रििे राज्य म ें एनएच-19 के दकमी 712.900 स े दकमी 785.544 (लंबाई 72.644 दकमी.) तक चार और अजधक लेन खंड के उपयोग हते ु सारणी 1 के स्ट्तम्भ (2) म ें जवजनर्िष्टग िर पर (जिसे इसके पश् चात ् ‘‘आधार िर‘‘ कहा गया ह)ै , नीच े सारणी 1 के स्ट्तम्भ (1) म ें जवजनर्िष्टग प्रकार के वाहनों पर िल्ु क उद्ग्रहीत दकया िाएगा और उतिय ररयायतग्राही को कायागरंभ करन े की तारीख को तथा उस तारीख से अथवा इस अजधसूचना के रािपत्र म ें[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 प्रकािन पर, िो भी बाि म ें हो, करार म ें जवजनर्िष्टग समापन की तारीख तक िल्ु क संग्रहीत तथा प्रजतधाररत करन े हते ु प्राजधक त करती ह।ै यह िल्ु क अजधसूचना टीओटी पररयोिना पर कायागरंभ करने की तारीख से प्रभावी होगी:- सारणी-1 वाहन का प्रकार आधार वषग 2007-08 के जलए प्रजत दक.मी. िल्ु क की आधार िर (रूपए में) (1) (2) कार, िीप, वैन या हल् के मोटर वाहन 0.65 हल् के वाजणजज्यक वाहन, हल् के माल वाहक वाहन अथवा जमनी बस 1.05 बस या रक (िो धुरी वाले) 2.20 तीन धरु ी वाल ेवाजणजज्यक वाहन 2.40 भारी संजनमागण मिीनरी (एच.सी.एम॰) या अथ गमूलवंग उपस्ट् कर (ई.एम.ई) या 3.45 बुधुरीय वाहन (एम.ए.वी.) (चार से छह धरु ी वाल)े बड़े आकार वाल ेवाहन (सात या अजधक धरु ी वाल े ) 4.20 1. नीच े उद्ग्रहीत एव ं संग्रहीत िुल्क, जनम्नजलजखत िुल्क प्लािा पर, ऐसे िल्ु क प्लािा के जवजनर्िष्‍टग ट िरू ी पर िोध्य और संिये होगाः क्रम िुल्क प्लािा का अवस्ट्थान (चैनिे ) िर जिस पर िुल्क संिेय ह ै स.ं लम्बाई (दकलोमीटर म)ें जिसके जलए िुल्क संिेय ह ै 1. उत्तर प्रिेि राज्य के भिोही जिले म ें लालानगर गांव के पास एनएच-19 63.465 दक.मी. ऊपर सारणी-1 में उजल्लजखत (पुराना एनएच-2) के चने ेि दकमी [9.179 दक.मी. लंबाई की सरं चना को आधार िरों का 100% 746.760 (एलएचएस)/ 747.065 छोड़कर] (आरएचएस) दकमी पर 2. उपयुगतिय के अजतररतिय, जनम्नजलजखत संरचनाओं, जिनकी लम्बाई 60 मीटर से अजधक ह,ै के उपयोग के जलए ऐसी संरचनाओं की लम्बाई को समकरण गुणक 10 से गणु ा करके रािमागग की समकक्ष लम्बाई में पररवर्तगत करते ुए, जनम्नजलजखत िुल्क प्लािा (प्लािाओं) पर, जनम्नजलजखत िुल्क भी िोध्य और संिेय होगाः- िुल्क प्लािा का अवस्ट्थान सड़क की समकक्ष लम्बाई सड़क की समकक्ष िर जिस पर िुल् क संिेय ह ै (चैनेि) में पररवर्तगत दकए िान े लम्बाई (दक.मी. म)ें हते ु संरचनाओं की लम्बाई (दक.मी. म)ें उत्तर प्रििे राज्य के भिोही जिले म ें लालानगर गांव के पास 9.179 91.79 ऊपर सारणी-1 में उजल्लजखत एनएच-19 (परु ाना एनएच-2) आधार िरों का 100% के चेनेि दकमी 746.760 (एलएचएस)/ 747.065 (आरएचएस) दकमी पर 60 मी. स ेअजधक लंबाई की सरं चनाओं का ब् यौरा जनम्न जलजखत ह:ै4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] चने िे कुल लबं ाई क्रम स.ं सरं चना का प्रकार (दक.मी. म)ें दक.मी. स े दक.मी. तक 1 दक.मी. 713.396 दक.मी. 715.799 एजलवेटेड वायाडक्ट 2.403 2 दक.मी. 722.089 दक.मी. 723.843 एजलवेटेड वायाडक्ट 1.754 3 दक.मी. 725.648 दक.मी. 727.137 एजलवेटेड वायाडक्ट 1.489 4 दक.मी. 740.291 दक.मी. 742.409 एजलवेटेड वायाडक्ट 2.118 5 दक.मी. 776.084 दक.मी. 777.379 एजलवेटेड वायाडक्ट 1.295 6 दक.मी. 784.235 दक.मी. 784.355 फ्लाईओवर 0.120 कुल लबं ाई 9.179 3. जिस व्यजतिय का अपना यांजत्रक वाहन, गैर-वाजणजज्यक प्रयोिनों के जलए पंिीक त ुआ हो और वह िल्ु क प्लािा स े बीस दकलोमीटर तक की िरू ी में ही रहता/रहती हो, उसके जलए वषग 2022-23 के जलए माजसक पास की िर 315.00/- रूपए (तीन सौ पंरह रूपए मात्र) होगी और राष्ट्रीय रािमागग िल्ु क (िरों का अवधारण एवं संग्रहण) जनयम, 2008 के प्रावधानों के अनुसार उसमें प्रत्येक वषग संिोधन दकया िायेगा । 4. रािमागग खण्ड पर बुयात्राओं हते ु पास जनम्नजलजखत िरों पर िारी दकया िाएगा, अथागतः् संिेय राजि अनुज्ञात एकतरफा यात्राओं की जवजधमान्द्यता की अवजध अजधकतम संख्या एकतरफा यात्रा के जलए िल्ु क का डेढ़ िो भुगतान के समय से चौबीस घंटे गुना पचास एकल यात्राओं के जलए संिेय िुल्क पचास या अजधक भुगतान की दिनांक से एक माह की राजि का िो-जतहाई 5. जिस जिल े में िुल्क प्लािा जस्ट्थत ह,ै उसमें पंिीक त वाजणजज्यक वाहन (राष्ट्रीय परजमट के अधीन चल रह े वाहनों को छोड़कर) के जलए िुल्क उस श्रेणी के जलए वाहन के जलए जनधागररत िुल्क का 50% होगा बिते दक ऐस े वाजणजज्यक वाहनों के उपयोग के जलए कोई सर्वगस सड़क अथवा वैकजल्पक सड़क उपलब्ध न हो। 6. िो यांजत्रक वाहन अपनी श्रेणी के जलए जनधागररत अनुज्ञेय भार की अपेक्षा अजधक भार से लिा ुआ होगा उसके चालक अथवा माजलक अथवा प्रभारी व्यजतिय को ऐसे अजधक भार से लिे ुए वाहन को राष्ट्रीय रािमागग में प्रवेि कराने के जलए िल्ु क सग्रं हण एिेंसी को जनम्न ानुसार बराबर िल्ु क का भगु तान करना । अजधकतम अनुमेय सकल वाहन भार से गुणक को आधार िर स ेगणु ा करना िुल् क अजधक भार का प्रजतित (1) (2) (3) 0% स े 20% िो [(जनयम 4 के उप-जनयम (2) के तहत यांजत्रक वाहन की ऐसी श्रेणी के जलए >20% से 40% चार लाग ूिल्ु क x >40% से 60% छह (गणु क कारक) >60% से 80% आि >80% और अजधक िस[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 7. यांजत्रक वाहनों की श्रणे ी, उनके जलए अनुज्ञेय भार, छूट-प्राप्त वाहनों की श्रणे ी, सर्वगस रोड, वैकजल्पक सड़क आदि सजहत सभी पररभाषाएं उतिय जनयमों में जवजनर्िष्टग पररभाषाओं के अनुसार होंगी। 8. उतिय जनयमों के जनयम 12 के अनुसार,प्रयोगकतागओं की िानकारी के जलए िुल्क की िरों को प्रिर्िगत दकया िाएगा। 9. ऊपर ताजलका-1 में यथा-उजल्लजखत, आधार वष ग 2007-08 के जलए प्रजत दकलोमीटर िुल्क की आधार िर के आधार पर, यांजत्रक वाहनों स े जलए िान े वाल े वास्ट्तजवक िुल्क और कटौजतयों की गणना प्राजधकरण द्वारा खंडों की पूरी कर ली गई लम्बाई के आधार पर की िायेगी और उसे प्राजधकरण द्वारा ररयायतग्राही के माध् यम से अंग्रेिी और स्ट्थानीय भाषा के कम-स-े कम एक समाचार पत्र में प्रकाजित करवाया िाएगा और तत्प श् चात ररयायत करार के प्रावधान एव ं उक्त जनयमों के जनयम 5 के अनुसार उसम ें वार्षगक तौर पर संिोधन दकया िाएगा और प्रकाजित दकया िाएगा, बित े दक िुल्क के पूवगवती संिोधन की तारीख से 6 (छह) महीने की अवजध के भीतर कोई संिोधन प्रभावी नहीं होगा। [फा. स.ं एनएचएआई/13013/टीओटी जडवीिन/2022-23/िुल्क अजधसूचना/टीओटीबंडल9/ई-220741] सुमन प्रसाि लसंह, संयक्ु त सजचव MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi the 28th March, 2023 S.O. 1440(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 78 (E) dated 04.02.1999, issued under Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from Km. 0.000 to Km. 334.00 (Kanpur to Varanasi Section) of Old NH-2 (New NH-19) In the State of Uttar Pradesh to the National Highways Authority of India (hereinafter referred to as the “Authority”); And whereas, in exercise of the powers conferred by Section 7 of the National Highway Act, 1956 (48 of 1956) read with Rule (3) of the National Highway Fee (Determination of Rates and Collection) Rules 2008, the Central Government by notification of the Government of India authorised Authority for levying and collecting fee on mechanical vehicles for the use of stretches as follows: Vide S.O.No. 3815 (E) dated 23rd October, 2020 for the section design Km. 712.900 to Km. 785.544 (existing Km. 713.215 to Km. 785.859) of National Highway number 19 (old NH-2 ) in the State of Uttar Pradesh. And whereas, pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an Agreement (hereinafter referred to as said agreement) with M/s Kashi Tollway Pvt. No. 3815 (E) dated 23rd October, 2020 except as respect things done or omitted to be done before such supersession, the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said Section of said National Highway, interest on the capital invested, reasonable return, the volume of traffic and the period of said agreement entered between the Authority and the Concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles at the rate specified in column (2) of the Table 1 for total equivalent road length of 155.255 km [including 63.465 km road and 9.179 km of structures (having length more than 60m) with equivalent length of 91.79 km] on the Type of Vehicles specified in column (1) of the Table 1 below for use of four and more lane section from Km 712.900 to Km 785.544 (length 72.644 km) of NH-19 in the state of Uttar Pradesh and authorises the said Concessionaire to collect and retain the fee on and from the Appointed Date or publication of this Notification in the Official Gazette, whichever is later, till the date of termination as specified in the agreement. This fee notification shall be effective from the Appointed Date of the ToT project. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs. 315.00 (Rupees Three Hundred Fifteen only) for the year 2022-23 which is subject to revision every year as per the provisions of the said rules. 4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely; Amount Payable Maximum number of one way Period of validity journeys allowed One and half times of the fee for one way Two Twenty four hours from the time of journey payment Two-third of amount of the fee payable for Fifty or more One month from date of payment fifty or more single journeys 5. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 6. The driver or owner or person in charge of a mechanical vehicle shall be liable to pay fee, for entering the overloaded vehicle on the national highway, to the user fee collecting agency, equal to fees as follows: Percentage of excess load over Maximum Permissible Gross Vehicular Multiplying Factor to the base rate Fees Weight (1) (2) (3) 0% to 20% Two >20% to 40% Four [(Fees applicable for such category of mechanical vehicle under sub- >40% to 60% Six rule (2) of rule 4) x (Multiplying >60% to 80% Eight factor)] >80% and Above Ten 7. All definitions, category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the said rules. 8. The Fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules. 9. Based on the Base Rate of Fee per km for the base year 2007-08 as mentioned in Table-1, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of completed length of the Project Highway. The same shall be got published by the Authority through the Concessionaire in at least one newspaper, each in English and vernacular language and thereafter revised annually in accordance with the rule 5 of the said rules and provision of Concession Agreement and got published, provided that no revision shall be effected within a period of 6 (six) months from the date of the preceding revision of Fee.
