L.-33004/99 ससीी..जजीी..--डडीी..एएलल..--अअ..--0099002222002244--225511995588 xxxGIDHxxx CCGG--DDLLxx--xEEG--I00D99E00x22x22x00 2244--225511995588 असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 558] नई दिल्ली, िुक्रवार, फरवरी 9, 2024/माघ 20, 1945 No. 558] NEW DELHI, FRIDAY, FEBRUARY 9, 2024/MAGHA 20, 1945 सड़क पररवहन और रािमाग गमत्रं ालय अजधसचू ना नई दिल्ली, 8 फरवरी, 2024 का.आ. 589(अ).—िबदक, केन्द्र सरकार ने राष्ट्रीय रािमागग अजधजनयम, 1956 (1956 का 48) की धारा 5 के अधीन िारी की गई भारत सरकार के सड़क पररवहन और रािमागग मंत्रालय की अजधसूचना सं.का.आ. 4201(अ), दिनांक 11 अक्टूबर, 2021 के द्वारा महाराष्र में राष्रीय रािमागग सं. 548सी [महाराष्र राि्य सरकार की बीओटी पररयोिना के तहत तेंभूरनी-कुरूड़वाडी-बारिी खंड को छोड़कर] को महाराष्र सरकार के सुपुि गकर दिया ह।ै अत: अब, राष्रीय रािमागग फीस (िरों का जनधागरण और संग्रहण) जनयम, 2008 और समय-समय पर संिोधजत (िो इसके आग े ‘जनयम’ के रूप में उल्जलजखत ह)ै के जनयम 3 के साथ परित राष्रीय रािमागग अजधजनयम, 1956 (1956 का 48) की धारा 7 द्वारा प्रित्त िक्जतयों का प्रयोग करते हुए केन्द्र सरकार, एतिद्वारा महाराष्र में राष्रीय रािमागग सं. 548सी के जडिाइन दकमी 0.000 से दकमी 51.364 (मौिूिा चैनेि दकमी 118.100 से दकमी 65.000) तक मंथा तालुका सीमा से पारतुर खंड के उपयोग के जलए नीचे िी गई ताजलका 1 के कॉलम (1) में जवजनर्िषग ्ट वाहनों के प्रकार पर 18.518 दकमी के जनवल सड़क खंड और 1.44 दकमी (कुल 0.144 दकमी की लंबाई वाली) की समतुल्य संरचना लंबाई (60 मीटर से अजधक की लंबाई वाली) के चार या अजधक लेन वाले खंड के उपयोग के जलए तथा 32.504 दकमी के जनवल सड़क खंड और 1.98 दकमी (0.198 दकमी की लंबाई वाली) की समतुल्य संरचना लंबाई (60 मीटर से अजधक की लंबाई वाली) के जलए पेव्ड िोल्डर के साथ िो लेन खंड के उपयोग के जलए आधार िर का साि प्रजतित की िर से ताजलका 1 के कॉलम (2) में जवजनर्िषग ्ट िर पर यांजत्रक वाहनों पर फीस उिगृहीत करती है तथा भारतीय राष्रीय रािमागग प्राजधकरण को उसके अजधकाररयों अथवा दकसी िेकेिार के माध्यम से उक्त फीस के संग्रहण के जलए प्राजधकृत करती है, अथागत्:- 890 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ताजलका-1 वाहन का प्रकार आधार वष ग2007-08 के जलए प्रजत दकमी फीस का आधार िर (रु. म)ें (1) (2) कार, िीप, वैन या हल्के मोटर वाहन 0.65 हल्के वाजणि्जयक वाहन, हल्के माल वाहन या जमनी बस 1.05 बस या रक (िो धुरीय) 2.20 तीन धुरी वाजणि्जयक वाहन 2.40 भारी जनमागण मिीनरी (एचसीएम) या अथग मूववंग उपस्कर (ईएमई) या बहु धुरीय 3.45 वाहन (एमएवी) (चार से छ: धुरीय) जविाल आकार के वाहन (सात या अजधक धुरीय) 4.20 1. इसके अंतगगत उिगृहीत और संगृहीत की िाने वाली फीस ऐसे फीस प्लािाओं के जलए जवजनर्िषग ्ट जनवल सड़क लंबाई हते ु जनमन् जलजखत पथकर प्लािा में िेय और संिये होगी:- ताजलका-2 लंबाई (दकमी म)ें जिसके जलए फीस पल् ािा की अवसज् थजत (चनै िे ) िर, जिस पर फीस सिं ये ह ै फीस सिं ये ह ै ऊपर ताजलका-1 में उल्जलजखत पेव्ड िोल्डसग के साथ िो लेन महाराष्ट्र में िालना जिला के ग्राम 32.504 के जलए आधार िरों का 60% नयागांव के जनकट जडिाइन चैनेि ऊपर ताजलका-1 में उल्जलजखत चार या अजधक लेन के जलए दकमी 17.800 पर 18.518 आधार िरों का 100% 2. उपयुगक्त के अजतररक्त, जनमन् जलजखत टोल प्लािा (प्लािाओं) पर 60 मीटर से अजधक लंबाई वाली जनम्नजलजखत अवसंरचनाओं के उपयोग के जलए 10 के समतुल्य गुणक द्वारा ऐसी अवसंरचनाओं की लंबाई को गुणा करके रािमागग की समतुल्य लंबाई में अवसंरचनाओं की लंबाई को पररवर्तगत करके जनम्नजलजखत फीस भी िये और संिये होगी:- ताजलका-3 फीस पल् ािा की अवसज् थजत समतलु य् सड़क लबं ाई म ेंपररवर्ततग समतलु य् सड़क िर, जिस पर फीस सिं ये है दकए िान े के जलए अवसरं चनाओं लंबाई (दकमी म)ें (चनै िे ) की लंबाई* (दकमी म)ें महाराष्ट्र में िालना जिला के ऊपर ताजलका-1 में उल्जलजखत पेव्ड िोल्डसग ग्राम नयागांव के जनकट 0.198 1.98 के साथ िो लेन के जलए आधार िरों का 60% जडिाइन चैनेि दकमी 17.800 पर ऊपर ताजलका-1 में उल्जलजखत चार या अजधक 0.144 1.44 लेन के जलए आधार िरों का 100% *>60 मी. संरचना का ब्यौरा जनमन् ानुसार ह:ै चनै ेि सरं चना का प्रकार क्र.स.ं सरं चना की लबं ाई (दकमी म)ें दकमी स े दकमी तक 1 43.290 43.434 बड़ा पुल 0.144 2 08.466 8.664 बड़ा पुल 0.198[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 3. गैर-वाजणि्जयक प्रयोिनों के जलए पंिीकृत यांजत्रक वाहन के स्वामी और फीस प्लािा से बीस दकमी की िरू ी के भीतर जनवास करने वाले व्यक्जत के जलए माजसक पास की िर वषग 2023-24 के जलए 330.00 रु. (तीन सौ तीस रुपए मात्र) ह ै और राष्रीय रािमागग फीस (िरों का जनधागरण और संग्रहण) जनयम, 2008 के प्रावधानों के अनुसार प्रजतवषग संिोधन के अध्यधीन ह।ै 4. रािमागग खंड पर बहुल यात्राओं के जलए जनमन् जलजखत िरों पर पास िारी दकए िाएंगे, अथागत:् ताजलका-4 भुगतान-योगय् धनराजि अनमु त एकतरफा यात्राओं की वैधता की अवजध अजधकतम सखं य् ा एकतरफा यात्रा के जलए फीस का डेढ़ गुना िो भुगतान के समय से चौबीस घंटे पचास एकल यात्राओं के जलए भुगतान-योगय् पचास भुगतान की तारीख से एक महीना फीस की राजि का िो-जतहाई 5. फीस प्लािा जस्ट्थत होने वाले जिले में पंिीकृत वाजणि्जयक वाहनों (राष्रीय परजमट के अधीन चलाए िा रह े वाहनों को छोड़कर) के जलए फीस उस श्रेणी के वाहन हते ु जनधागररत िर की 50% होगी, बिते दक ऐसे वाजणि्जयक वाहनों के प्रयोग के जलए कोई सर्वगस रोड या वैकल्जपक सड़क उपलब्ध न हों। 6. संबंजधत श्रेणी के वाहनों के जलए जवजनर्िषग ्ट अनुज्ञेय भार से अजधक भार लि े यांजत्रक वाहन का चालक या स्वामी या प्रभारी वय् क्जत, राष्ट्रीय रािमागग पर अजतभार लि े वाहन के प्रवेि के जलए टोल संग्रहण एिेंसी को ऐसी श्रेणी के वाहनों के प्रवेि जलए, कजथत जनयमों के जनयम 10 के उप-जनयम 1ए के अनुसार अनुप्रयोि्य फीस के समतुल्य फीस का भुगतान करने के जलए उत्तरिायी होगा और वह रािमागग खंड का प्रयोग करने के जलए तब तक हकिार नहीं होगा िब तक ऐसे यांजत्रक वाहन से लिा अजतभार हटाया नहीं िाता। 7. सभी पररभाषाएं, यांजत्रक वाहनों की श्रेणी, इनके अनुज्ञेय भार, छूट प्राप्त वाहनों की श्रेणी, सर्वगस रोड, वैकल्जपक सड़क इत्यादि पूवोक्त जनयमों में जवजनर्िषग ्ट पररभाषाओं के अनुरूप होंगी। 8. फीस की िरें उक्त जनयमों के जनयम 12 के अनुसरण में प्रयोक्ताओं के सूचनाथग प्रिर्िगत करनी होंगी। 9. यांजत्रक वाहनों से फीस की वास्तजवक राजि उपयुगक्त ताजलका-1 में यथा-उल्जलजखत आधार वषग 2007-08 के जलए प्रजत दकमी फीस की आधार िर के आधार पर प्रभाररत होगी और छूटों की गणना भारतीय राष्ट्रीय रािमागग प्राजधकरण द्वारा खंड की पूरी हो गई लंबाई के आधार पर की िाएगी और उसे उक्त जनयमों के जनयम 5 के अनुसार प्रजत वषग संिोजधत दकया िाएगा तथा तिनुसार उस े अंग्रेिी और क्षेत्रीय भाषा के कम से कम एक-एक समाचार पत्र में प्रकाजित दकया िाएगा। 10. इस पररयोिना की प्राक्कजलत पूंिीगत लागत 486.19 करोड़ रु. ह।ै पूंिीगत लागत में पररवतगन हो सकता है, क्योंदक भूजम अजधग्रहण, सावगिजनक िन सुजवधाओं के स्थानांतरण, पेड़ों को काटने, मूल्य समायोिन, िीएसटी आदि कायगकलापों को अभी पूरा दकया िाना ह।ै भारतीय राष्ट्रीय रािमागग प्राजधकरण द्वारा प्राप्त प्रयोक्ता फीस के माध्यम से वसूल की गई पूंिीगत लागत का ररकाडग रखा िाएगा। [फा. सं. आरओ/एमयूएम/पी-1129/2016-17/टोल/ई-226685] सुमन प्रसाि वसंह, संयुक् त सजचव MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 8th February, 2024 S.O. 589(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 4201 (E) dated 11th October 2021 issued under section 5 of the National Highways Act, 1956 (48 of 1956), the Central Government has entrusted National Highway No. 548C [excluding Tembhurni -Kurudwadi – Barshi section under BOT project of State Govt. of Maharashtra] in the State of Maharashtra to the State Government of Maharashtra.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended from time to time (hereinafter referred to as the “said Rules”), the Central Government hereby levies the fee at the rate specified in column (2) of the Table 1 for net road section length of 18.518 km & equivalent structure length (having length more than 60m) of 1.44 km (having total length of 0.144 Km) for use of four or more lane section and at sixty per cent of the base rate for net road section length of 32.504 km & equivalent structure length (having length more than 60m) of 1.98 km (having total length of 0.198 Km) for use of two lane with paved shoulder section on the type of Vehicles specified in column (1) of Table 1 below of Mantha Taluka Border to Partur Section from design km. 0.000 to km. 51.364 (existing chainages from km. 118.100 to km. 65.000) of National Highway No. 548C in the State of Maharashtra and authorises the National Highways Authority of India to collect, either through its officials or through a contractor, the said fee, namely:- TABLE 1 Base rate of fee per km for the base Type of vehicle year 2007-08 (in Rupees) (1) (2) Car, Jeep, Van or Light Motor Vehicle 0.65 Light Commercial Vehicle, Light Goods Vehicle or Mini Bus 1.05 Bus or Truck (Two Axles) 2.20 Three-axle commercial vehicles 2.40 Heavy Construction Machinery (HCM) or Earth Moving Equipment (EME) 3.45 or Multi Axle Vehicle (MAV) (four to six axles) Oversized Vehicles (seven or more axles) 4.20 1. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs. 330.00 (Rupees Three Hundred Thirty only) for the year 2023-24 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008. 4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely:- TABLE-4 Amount Payable Maximum number of one-way Period of validity journeys allowed One and half times of the fee for one way journey Two Twenty-four hours from the time of payment Two-third of amount of the fee payable for fifty Fifty One month from date of payment single journeys 5. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 6. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency equal to the fee specified in sub-rule 1A of rule 10 of the said rules and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the rules. 8. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules. 9. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the National Highways Authority of India on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly. 10. The estimated capital cost of the project is Rupees 486.19 Crore. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, price adjustments, GST etc. are yet to be completed.
