प्रावधान के अनुसरण म,ें प्राजधकरण ने मेसस गआईआरबी हररहर कॉररडोर प्राइवेट जलजमटेड, जिसका पंिीकृत कायागलय 11वां तल, 1101 हीरानंिनी नॉलेि पाकग, पवई, मुंबई-400076 में ह ै(जिसे इसके पश्चात "कंसेसनेयर" कहा िाए) के साथ 27.02.2025 को उत्तर प्रिेि राज्य म ें एनएच-28 (नया एनएच-27) के चार लने लखनऊ–अयोध्या खडं (मौििू ा दकमी 15+400 से मौिूिा दकमी 137+970 तक) पर टोल लगान,े संचालन, अनुरक्षण और हस्ट्तांतरण के जलए संिोधन के अध् यधीन ह।ै 5. रािमागग खण्ड पर बहुयात्राओं हते ु पास जनम्नजलजखत िरों पर िारी दकया िाएगा, अथागतः् सिं ये धनराजि अनज्ञु ात एकतरफा यात्राओं की अजधकतम सख्ं या जवजधमान्द्यता की अवजध एकतरफा यात्रा के जलए िल्ु क का िो भुगतान के समय से चौबीस घंटे डेढ़ गुना पचास एकल यात्राओं के जलए भुगतान भुगतान की तारीख से एक मास िुल्क की राजि का िो-जतहाई पचास 6. िुल्क प्लािा जस्ट्थत होन ेवाल ेजिले म ेंपंिीकृत वाजणजज्यक वाहनों (राष्ट्रीय परजमट के अधीन प्रचाजलत दकए िा रह े वाहनों को छोड़कर) के जलए िल्ु क उस श्रणे ी के वाहन हते ुजनधागररत िर की 50% होगी, बित ेदक ऐस ेवाजणजज्यक वाहनों के प्रयोग के जलए कोई सर्वगस रोड या वैकजल्पक सड़क उपलब्ध न हो। 7. दकसी यांजत्रक वाहन पर जनयमों के अंतगतग उसकी श्रेणी के जलए जनर्िगष्ट अनुज्ञेय भार से अजधक भार लिा हुआ है, तो उसे प्लािा पार करन े के जलए राष्ट्रीय रािमागग का उपयोग करने की अनुमजत तब तक नहीं िी िाएगी िब तक दक ऐस े यांजत्रक वाहन से लिा अजतभार हटाया नहीं िाता। संबंजधत श्रेणी के वाहनों के जलए जवजनर्िगष् ट अनुज्ञेय भार से अजधक भार लिे यांजत्रक वाहन का चालक या स्ट् वामी या प्रभारी व्यजक्त, उक्त जनयमों में लागू प्रावधान के अनुसार िुल्क सग्रं हण एिेंसी को राष्ट्रीय रािमागग पर अजतभाररत वाहन के प्रवेि के जलए िल्ु क का भुगतान करन े के जलए उत्तरिायी होगा, अथागत:् -[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 अजधकतम अनज्ञु ये सकल वाहन भार स े आधार िर म ेंगणु न कारक िल्ु क अजधक भार का प्रजतित (1) (2) (3) 0% स े 20% िो >20% स े 40% चार [(जनयम 4 के उप-जनयम (2) के अंतगतग >40% स े 60% छह यांजत्रक वाहन की ऐसी श्रेणी के जलए लाग ू >60% स े 80% आि िुल्क) x (गुणन कारक)] >80% और उससे अजधक िस 8. उक्त जनयमों के जनयम 12 के अनुसार, उपयोगकताओंग की िानकारी के जलए िल्ु क की िरों को प्रिर्िगत दकया िाएगा। 9. यांजत्रक वाहनों स े िल्ु क की वास्ट् तजवक राजि उपयुगक् त ताजलका-1 म ें यथा-उजल्लजखत, आधार वर् ग 2007-08 के जलए प्रजत दकलोमीटर िल्ु क की आधार िर के आधार पर प्रभाररत होगी और छूटों की गणना प्राजधकरण द्वारा की िाएगी। प्राजधकरण द्वारा इसे कंसेसनेयर के माध्यम से अग्रं ेिी और स्ट्थानीय भार्ा म ेंकम से कम एक समाचार पत्र म ेंप्रकाजित कराया िाएगा और उसके बाि उक्त जनयम के जनयम 5 और ररयायत करार के उपबंधों के अनुसार इसे प्रजतवर् ग संिोजधत दकया िाएगा और प्रकाजित दकया िाएगा; तथाजप, बित ेदक ऐसा सिं ोधन िुल्क के पूवगवती संिोधन की तारीख स े6 (छह) महीन े की 22nd January, 2026 S.O. 358(E).— Whereas, by the notification of the Government of India in the Ministry of Road Transport and Highways and S.O. 465 (E) dated 26th April 2002 issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from km 0.000 to km 365.570 (Lucknow to Faizabad to Gorakhpur to Uttar Pradesh/ Bihar Border section) on National Highway No. 28 in the State of Uttar Pradesh to the National Highways Authority of India (hereinafter referred to as the “Authority”). And whereas pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an agreement (hereinafter referred to as said Agreement) with M/s th IRB Harihara Corridors Pvt Ltd, having its Registered Office at 11 Floor, 1101 Hiranandani Knowledge Park, Powai, Mumbai- 400076 (Hereinafter referred to as “Concessionaire”) the successful bidder forthe bid submitted on 27.02.2025 for the Tolling, Operation, maintenance, and Transfer of four lane Lucknow - Ayodhya (from Existing Km 15+400 to Existing Km 137+970) section of NH-28 (New NH 27) in the State of Uttar Pradesh (hereinafter referred to as the said section). Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and in supersession of the Notification Number S.O. No. 5948(E) dated 19.12.2022, only insofar as it relates to NH-28 from Km 15.400 to Km 137.970 except as respect things done or omitted to be done before such supersession, the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said section, interest on the capital invested, reasonable return, the volume of traffic and the period of the agreement entered into the Authority and the Concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said section at the rates specified in column (2) of Table -1 below for8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Before Completion of construction of VUP at Km 137+100 from Existing Km 15+400 to Existing Km 137+970) Lucknow – Ayodhya Section Net Road Section Length of 102.105 km [Table-2.1] and for equivalent structure length (having length more than 60m) of 17.049 Km (having length 1.7049 Km[Table-4.1]) and at one and a half times of the base rate for use of bypasses, costing rupees ten crore or more, having length of 18.760 Km [Table-3.1] for four or more lane section on the type of vehicles specified in Column (1) of Table 1 and authorizes the said Concessionaire to collect and retain the fee on and from the Appointed Date or publication of this Notification in the Official Gazette, whichever is later, till the termination date as specified in the agreement. The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs. 340.00 (Rupees Three Hundred Forty only) for the year 2025-26 and is subject to revision every year as per the provisions of said Rules. 5. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 7. A mechanical vehicle which is loaded in excess of permissible load specified for its category under the rules, shall not be permitted to use the National Highway for crossing the plaza until the excess load has been removed from such mechanical vehicle. The driver or owner or a person in-charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency as per the applicable provision in the said rules, namely: - Percentage of excess load over Multiplying Maximum Permissible Gross Fees Factor to the Vehicular Weight base rate (1) (2) (3) 0% to 20% Two >20% to 40% Four [(Fees applicable for such category of mechanical vehicle under sub- rule (2) of rule 4) x (Multiplying factor)] >40% to 60% Six >60% to 80% Eight >80% and above Ten 8. The Fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules. 9. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority. The same shall be got published by the authority in at least one newspaper in English and vernacular language through the concessionaire and thereafter revised annually in accordance with the rule 5 of the said rule and provisions of the concession agreement and will be published; provided, however, that such revision shall not be effected until a period of 6 (six) months from the date of preceding revision of fee.
