L.-33004/99 सी.जी.-डी.एल.-अ.-25102024-258227 CG-DxLx-xEG-I2D5H1x0x2x0 24-258227 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 4281] नई दिल्ली, बृहस्ट्प जतवार, अक्त बू र 24, 2024/कार्तकग 2, 1946 No. 4281] NEW DELHI, THURSDAY, OCTOBER 24, 2024/KARTIKA 2, 1946 सड़क पररवहन और रािमाग गमत्रं ालय अजधसचू ना नई दिल्ली, 22 अक् तूबर, 2024 का.आ. 4657(अ).—िबदक, केन्द्र सरकार ने राष्ट्रीय रािमागग अजधजनयम, 1956 (1956 का 48) की धारा 5 के अधीन िारी की गई भारत सरकार के सड़क पररवहन और रािमागग मंत्रालय की अजधसूचना सं. का. आ. 5567(अ), दिनांदकत 29 अक्टूबर, 2018 के द्वारा कनागटक राज्य में नई राष्ट्रीय रािमागग सं. 50 (महाराष्ट्र/कनागटक सीमा – बीिर – हुमनाबाि खंड) को कनागटक राज्य सरकार को सुपुि गकर दिया ह;ै अत: अब, राष्ट्रीय रािमागग फीस (िरों का जनधागरण और संग्रहण) जनयम, 2008 (िो इसके आग े‘जनयम’ के रूप में उजल्लजखत ह)ै के जनयम 3 के साथ परित राष्ट्रीय रािमागग अजधजनयम, 1956 (1956 का 48) की धारा 7 द्वारा प्रित्त िजियों का प्रयोग करते हुए, केन्द्रीय सरकार, एतिद्वारा कनागटक राज्य में राष्ट्रीय रािमागग सं. 50 बीिर – हुमनाबाि खंड के दकमी 54+370 से दकमी 101+400 तक 35.70 दकमी जनवल सड़क खंड लंबाई [पेव्ड िोल्डर सजहत िो लेन खंड के उपयोग के जलए आधार िर के साि प्रजतित पर: ताजलका-2], 6.173 दकमी लंबाई [चार लेन खंड के उपयोग के जलए आधार िर के सौ प्रजतित पर: ताजलका-2], 4.69 दकमी (0.469 दकमी की लंबाई वाली) की समतुल्य संरचना लंबाई (60 मीटर से अजधक की लंबाई वाले) के जलए [चार लेन खंड के उपयोग के जलए आधार िर के सौ प्रजतित पर: ताजलका-4] और 4.688 दकमी जनवल लंबाई के बाइपास के जलए [चार लेन खंड के उपयोग के जलए आधार िर के 150% पर: ताजलका-3] ताजलका 1 के कॉलम (2) में जवजनर्िगष्ट िर पर नीचे िी गई ताजलका 1 के कॉलम (1) में जवजनर्िगष्ट वाहनों के प्रकार पर फीस उिगृहीत करती ह ैतथा भारतीय राष्ट्रीय रािमागग प्राजधकरण को उसके अजधकाररयों अथवा दकसी िेकेिार के माध्यम से उि फीस के संग्रहण के जलए प्राजधकृत करती ह,ै जनम्नानुसार:- 6935 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ताजलका-1 वाहन का प्रकार आधार वर् ग 2007-08 के जलए प्रजत दकमी आधार फीस िर (रु. म)ें (1) (2) कार, िीप, वैन या हल्के मोटर वाहन 0.65 हल्के वाजणजज्यक वाहन, हल्के माल वाहन या जमनी बस 1.05 बस या रक (िो धुरी) 2.20 तीन धुरी वाजणजज्यक वाहन 2.40 भारी जनमागण मिीनरी (एचसीएम) या अथग मूववंग उपस्ट्कर (ईएमई) या बहु धुरीय वाहन 3.45 (एमएवी) (चार से छ: धुरी) जविाल आकार के वाहन (सात या अजधक धुरी) 4.20 1. इसके अंतगगत उिगृहीत और संगृहीत फीस ऐसे पथकर प्लािाओं के अंतगगत जवजनर्िगष्ट िरू ी हते ु जनम् नजलजखत पथकर प्लािाओं में िेय और संिेय होगी:- ताजलका-2 पथकर प् लािा की अवजस्ट्थ जत (चनै िे ) लंबाई (दकमी म)ें जिसके जलए फीस सिं ये ह ै िर, जिस पर फीस संिये है । दकमी 67+400 से दकमी 67+800 तक पेव्ड िोल् डर सजहत िो लेन खंड के के जलए (जडिाइन चैनेि) – जनकट खािेरनगर गांव, 35.70 ऊपर ताजलका-1 में उजल् लजखत आधार िरों का 60% जिला बीिर, कनागटक राज्य चार अथवा अजधक लेन के जलए ऊपर 6.173 ताजलका-1 में उजल् लजखत आधार िरों का 100% 2. उपयुगक् त के अजतररक् त, ऐसे िुल्क प् लािा के जलए जवजनर्िगष् ट बाइपास की जनवल लंबाई के जलए जनम् नजलजखत िुल्क प्ल ािा पर 10 करोड़ रु. अथवा अजधक लागत वाले बाइपास के उपयोग हते ु जनम् नजलजखत िुल्क भी िेय और संिेय होगी:- ताजलका-3 पथकर प् लािा का अवस्ट्थ ान (चनै िे ) बाइपास िुरू होन ेपर जमलन ेबाइपास की लबं ाई और िर, जिस पर फीस का नाम वाला वाला लागत जिसके जलए अजतररक्त सिं ये ह ै फीस सिं ये ह ै लंबाई (दकमी) लागत (करोड़ रु.) दकमी 67+400 से दकमी 67+800 तक चार लेन के जलए (जडिाइन चैनेि) – जनकट खािेरनगर गांव, हुमनाबाि ऊपर ताजलका-1 में 96+640 101+400 4.688 34.03 बाइपास उजल् लजखत आधार जिला बीिर, कनागटक राज्य िरों का 150% 3. उपयुगक् त के अजतररक् त, जनम् नजलजखत टोल प् लािा (प् लािाओं) पर 60 मीटर से अजधक लंबाई वाली जनम् नजलजखत अवसंरचनाओं के उपयोग के जलए 10 के समतुल् य गुणक द्वारा ऐसी अवसंरचनाओं की लंबाई को गुणा करके रािमागग की समतुल् य लंबाई में[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 अवसंरचनाओं की लंबाई को पररवर्तगत करके जनम् नजलजखत फीस भी िेय और संिेय होगी:- ताजलका-4 पथकर प् लािा का अवस्ट्थ ान (चनै िे ) समतल्ु य सड़क लबं ाई म ें पररवर्ततग दकए समतल्ु य सड़क लबं ाई िर, जिस पर फीस िाने के जलए अवसंरचनाओं की लंबाई (दकमी म)ें सिं ये ह ै (दकमी म)ें दकमी 67+400 से दकमी 67+800 तक चार अथवा अजधक लेन के जलए ऊपर ताजलका- (जडिाइन चैनेि) – जनकट खािेरनगर गांव, 0.469^ 4.69 1 में उजल् लजखत आधार जिला बीिर, कनागटक राज्य िरों का 100% ^60 मीटर से अजधक की लंबाई वाले संरचनाओं के ब् यौरे जनम् नानुसार ह:ैं- क्र. स.ं सरं चना जडिाइन चनै िे (दकमी) लंबाई दकमी म ें 1. बड़ा पुल 73.686 0.317 2. बड़ा पुल 81.655 0.080 3. बड़ा पुल 100.418 0.072 कुल लंबाई 0.469 4. गैर-वाजणजज्य क प्रयोिनों के जलए पंिीकृत यांजत्रक वाहन के स्ट् वामी और पथकर प्ल ािा से बीस दकमी की िरू ी के भीतर जनवास करने वाले व् यजक् त के जलए माजसक पास की िर वर् ग 2024-25 के जलए 340.00 रु. (तीन सौ चालीस रुपए मात्र) ह ै और उक् त जनयमों के प्रावधानों के अनुसार प्रजतवर्ग संिोधन के अध्य धीन है। 5. रािमागग खंड पर बहुल यात्राओं के जलए जनम् नजलजखत िरों पर पास िारी दकए िाएंग,े अथागत् ताजलका-5 भुगतान-योग्य धनराजि अनमु त एकतरफा यात्राओं की अजधकतम वैधता की अवजध सख्ं य ा एकतरफा यात्रा के जलए फीस का डेढ़ गुना िो भुगतान के समय से चौबीस घंटे पचास एकल यात्राओं के जलए भुगतान- पचास भुगतान की तारीख से एक माह योग्य फीस की राजि का िो-जतहाई 6. फीस प् लािा जस्ट् थत होने वाले जिले म ें पंिीकृत वाजणजज्य क वाहनों (राष्र ीय परजमट के अधीन प्रचाजलत दकए िा रह े वाहनों को छोड़कर) के जलए फीस उस श्रेणी के वाहन हते ु जनधागररत िर का 50% होगा, बिते दक ऐसे वाजणजज्य क वाहनों के प्रयोग के जलए कोई सर्वगस रोड या वैकजल् पक सड़क उपलब्ध न हों। 7. संबंजधत श्रणे ी के वाहनों के जलए जवजनर्िगष् ट अनुज्ञेय भार स े अजधक भार लि े यांजत्रक वाहन का चालक या स्ट् वामी या प्रभारी व् यजक्त , राष्ट्रीय रािमागग पर अजतभार लि े वाहन के प्रवेि के जलए टोल संग्रहण एिेंसी को ऐसी श्रेणी के वाहनों के प्रवेि जलए, कजथत जनयमों के जनयम 10 के उप-जनयम 1ए के अनुसार अनप्रु योज्य फीस के समतुल् य फीस का भुगतान करन े के जलए उत् तरिायी होगा और वह रािमाग ग खंड का प्रयोग करन े के जलए तब तक हकिार नहीं होगा िब तक ऐसे यांजत्रक वाहन स े लिा अजतभार हटाया नहीं िाता।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 8. सभी पररभार्ाए,ं यांजत्रक वाहनों की श्रेणी, इनके अनुज्ञये भार, छूट प्राप् त वाहनों की श्रेणी, सर्वगस रोड, वैकजल् पक सड़क इत् यादि पूवोक्त जनयमों म ें जवजनर्िगष् ट पररभार्ाओं के अनुरूप होंगी। 9. फीस की िरें उि जनयमों के जनयम 12 के अनुसरण में प्रयोक्त ाओं के सूचनाथग प्रिर्िगत करनी होंगी। 10. यांजत्रक वाहनों स े फीस की वास्ट् तजवक राजि उपयुगक्त ताजलका-1 म ें यथा-उजल् लजखत आधार वर् ग 2007-08 के जलए प्रजत दकमी फीस की आधार िर के आधार पर प्रभाररत होगी और छूटों की गणना भारतीय राष्ट्रीय रािमागग प्राजधकरण द्वारा खंड की पूरी हो गई लंबाई के आधार पर की िाएगी और उसे उक्त जनयमों के जनयम 5 के अनुसार प्रजत वर्ग संिोजधत दकया िाएगा तथा तिनुसार उसे अंग्रेिी और क्षेत्रीय भार्ा के कम स े कम एक-एक समाचार पत्र म ें प्रकाजित दकया िाएगा। 11. इस पररयोिना की प्राक्कजलत पूंिीगत लागत 304.23 करोड़ रु. ह ै और भूजम अजधग्रहण, सावगिजनक िन सुजवधाओं के स्ट्थानातं रण, पेड़ों को काटने, आदि कायगकलापों को अभी पूरा दकया िाना ह ै इसजलए, पूंिीगत लागत पररवतनग के अध्यधीन ह।ै प्राप् त प्रयोक्त ा फीस के माध् यम स े वसूल की गई पिूं ीगत लागत का भारतीय राष्ट्रीय रािमाग ग प्राजधकरण द्वारा ररकाडग रखा िाएगा। [फा. स.ं आरडब्ल् य/ू बीएनिी/एनएच-50/दकमी 54-101/96/2019(पाटग)/ई-237097] कमलेि चतुवेिी, संयुक् त सजचव MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 22nd October, 2024 S.O. 4657(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 5567 (E) dated the 29th October 2018 issued under Section 5 of the National Highway Act, 1956 (48 of 1956), the Central Government has entrusted the stretch of new National Highway No.50 (Maharashtra/Karnataka border-Bidar-Humnabad section) in the State of Karnataka to the State Government of Karnataka. Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "rules"), the Central Government hereby levies the fee at the rate specified in column (2) of the Table 1 for net road section length 35.70 Km [at sixty percent of the base rate for use of two lane with paved shoulder section: Table-2], 6.173 Km [at hundred percent of the base rate for use of four lane section: Table-2], for equivalent structure length (having length more than 60m) of 4.69Km (having length of 0.469Km) [at hundred percent of the base rate for use of four lane section: Table-4] and net bypass length 4.688Km [at 150% of the base rate for use of four lane section: Table-3] on the type of vehicles specified in column (1) of Table 1 below Bidar-Humnabad section from kilometer 54.370 to kilometer 101.400 of National Highway number 50 in the State of Karnataka and authorises the National Highway Authority of India to collect, either through its officials or through a contractor, the said fee, as under:- TABLE-1 Type of vehicle Base rate of fee per km for the base year 2007-08 (in Rupees) (1 ) (2) Car, Jeep: Van or Light Motor Vehicle 0.65 Light Commercial Vehicle Light Goods Vehicle or 1.05 Mini Bus Bus or Truck (Two Axles) 2.20 Three-axle commercial vehicles 2.40[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 Heavy Construction Machinery (HCM) or Earth Moving Equipment (EME) or Multi Axle Vehicle 3.45 (MAV) (four to six axles) Oversized Vehicles (seven or more axles) 4.20 1. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-Commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs. 340.00* (Rupees Three Hundred and Forty rupees only) for the year 2024-25 and is subject to revision every year as per the provisions of the said rules. 5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: - TABLE-5 Amount Payable Maximum number of one-way Period of validity journeys allowed One and one-half times of the fee for one Two Twenty-four hours from the time of way journey payment Two-third of amount of the fee payable Fifty One month from date of payment for fifty Single journeys 6. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such. 7. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules. 9. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules. 10. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned inTable-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the National Highway Authority of India on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 11. The estimated capital cost of the project is Rupees 304.23 Crore and the capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed. The National Highways Authority of India shall maintain a record of the recovery of capital cost through user fee realised. [F.
