## Policy Analysis Report: Toll Fee Notification for Aligarh-Kanpur Section of National Highway 91 **1. Executive Summary:** This report analyzes a notification from the Ministry of Road Transport and Highways, Government of India, published on July 15, 2022, regarding the imposition of toll fees on mechanical vehicles using the four-lane Aligarh-Kanpur section of National Highway (NH) 91 in Uttar Pradesh. The core purpose is to levy and collect fees for the use of this highway section, including specific provisions for bypasses and structures exceeding 60 meters in length. The report details the fee structure, implementation aspects, and likely impact on users of the specified highway section. **2. Introduction:** This report aims to provide a comprehensive overview of a notification issued by the Ministry of Road Transport and Highways concerning the levy of toll fees on the Aligarh-Kanpur section of NH-91. The analysis is based solely on the provided text of the notification. **3. Policy Overview:** This is a *new* policy establishing toll fees for a specific section of National Highway 91. * **Core Objective(s):** * To levy fees on mechanical vehicles for using the Aligarh-Kanpur section of NH-91. * To authorize the National Highways Authority of India (NHAI) to collect these fees, either directly or through a contractor. * To recover the capital cost of the project and subsequently reduce the fee to 40% of the initial rate. **4. Background and Rationale:** As this is a new policy for this specific section of highway, the notification likely addresses the need to recover the investment made in upgrading the Aligarh-Kanpur section of NH-91 to a four-lane highway. Imposing toll fees is a standard practice for recouping infrastructure development costs and ensuring the continued maintenance and improvement of highways. The explicit mention of recovering the capital cost through user fees underscores this rationale. **5. Key Provisions:** The notification establishes the following key provisions: * **Fee Structure:** * Sets base rates per kilometer for different vehicle types (cars, buses, trucks, etc.) for the base year 2007-08 (Table 1). * Specifies a fee of 100% for four and more lane of the base rates mentioned in Table1 above in Aligarh district of Uttar Pradesh for 39.908 km length of the section near Kiratpur village, excluding bypass and structures. * Establishes a fee for bypasses costing ₹10 crore or more, calculated at one and one-half times the base rate (Table 3). Specifically Sikandra Rao Bypass of NH 91 is considered, where the length is 5.590 km and the cost is Rs. 94.92 crore. * Includes fees for structures longer than 60 meters, converting their length into an equivalent road length using an equalisation factor of 10 (Table 4). * **Fee Plaza Location:** Specifies the Design Km 167.328 of NH 91 near Kiratpur village in Aligarh district of Uttar Pradesh. * **Monthly Pass:** Offers a monthly pass for non-commercial vehicles registered to residents within 20 kilometers of the fee plaza at a rate of ₹315.00 for the year 2022-23. * **Multiple Journey Passes:** Offers passes for multiple journeys at discounted rates (Table 5). * **Fee for Commercial Vehicles:** Stipulates that commercial vehicles excluding vehicles plying under National permit registered in the district where the fee plaza falls shall be charged 50% of the specified rate. * **Overloaded Vehicles:** Mandates that overloaded vehicles must pay a fee as specified in subrule 1A of rule 10 of the said rules. * **Annual Revision:** States that the fee will be revised annually based on the completed length of the section and in accordance with the rules. * **Capital Cost Recovery:** Indicates that the fee will be reduced to 40% of the rates after the capital cost of the project has been recovered. * **Display of Fee Rates:** Mandates displaying the fee rates for user information. **6. Target Audience and Stakeholders:** The primary target audience and stakeholders include: * Owners and operators of mechanical vehicles using the Aligarh-Kanpur section of NH-91. * Residents living within 20 kilometers of the Kiratpur toll plaza. * Commercial vehicle operators registered in the district of the toll plaza. * The National Highways Authority of India (NHAI). * Contractors responsible for toll collection. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The NHAI is the primary responsible body for implementing the policy, including collecting the fees and maintaining records of capital cost recovery. * **Timelines/Procedures:** * The notification is effective from July 15, 2022. * Fees are subject to annual revision. * The capital cost is subject to variation and will be notified separately. * **Collection Mechanism:** The NHAI can collect fees directly or through a contractor. **8. Expected Outcomes / Impact of Changes:** The likely intended outcomes of this policy are: * **Revenue Generation:** Generation of revenue to recover the capital cost of upgrading the Aligarh-Kanpur section of NH-91. * **Infrastructure Maintenance:** Funding for the maintenance and improvement of the highway. * **User Fee:** Imposition of a user fee for the use of the improved highway infrastructure. * **Economic Impact:** Potential impact on transportation costs for businesses and individuals using the highway. **9. Conclusion:** The notification outlines the implementation of toll fees on the Aligarh-Kanpur section of NH-91. It specifies the fee structure, responsible parties, and expected outcomes. The policy is significant as it represents a mechanism for funding highway infrastructure development and maintenance through user fees. Understanding the specifics of this notification is crucial for all stakeholders, particularly vehicle owners and operators using this section of the national highway.
