वाहनों के ईपयोग के जलए कोइ सर्तवस रोड ऄथवा वैकजल्पक सड़क ईपलब्ध न हो।
6. जो यांजत्रक वाहन ऄपनी श्रणे ी के जलए जनधागररत ऄनुज्ञेय भार की ऄपेक्षा ऄजधक भार से लदा हुअ होगा ईसके चालक
ऄथवा माजलक ऄथवा प्रभारी व्यजि को ऐसे ऄजधक भार से लदे हुए वाहन को राष्ट्रीय राजमागग में प्रवेि कराने के जलए
िुल्क सग्रं हण एजेंसी को ईि जनयमों के जनयम 10 के ईप-जनयम 1ए के ऄनुसार जवर्तनददष्ट िुल्क के बराबर का भगु तान
करना होगा और ईसे राजमाग ग खण्ड का ईपयोग करन े की तब तक ऄनुमजत नहीं होगी जब तक दक ऐस े यांजत्रक वाहन स े
ऄजधक भार को हटा न ददया जाए।
7. यांजत्रक वाहनों की श्रणे ी, ईनके जलए ऄनुज्ञेय भार, छूट-प्राप्त वाहनों की श्रणे ी, सर्तवस रोड, वैकजल्पक सड़क अदद
सजहत सभी पररभार्ाएं ईि जनयमों में जवजनर्ददष्ट पररभार्ां के ऄनुसार होंगी।
8. ईि जनयमों के जनयम 12 के ऄनुसार, ईपयोगकतागं की जानकारी के जलए िल्ु क की दरों को प्रदर्तित दकया जाएगा।
9. उपर सारणी-1 में यथा-ईजल्लजखत, अधार वर्ग 2007-08 के जलए प्रजत दकलोमीटर िुल्क की अधार दर के अधार
पर, यांजत्रक वाहनों से जलए जाने वाल े वास्ट्तजवक िल्ु क और कटौजतयों की गणना प्राजधकरण द्वारा खंडों की पूरी कर ली गइ
लम्बाइ के अधार पर की जायेगी और ईसमें ईि जनयमों के जनयम 5 के ऄनुसार वार्तर्क तौर पर संिोधन दकया जाएगा
तथा ईस,े तदनुसार, ऄंग्रेजी और स्ट्थानीय भार्ा के कम-स-े कम एक-एक समाचार पत्र में प्रकाजित दकया जाएगा।
10. आस पररयोजना के पूंजीगत लागत का ऄनुमाजनत मल्ू य 1885.79 करोड़ रुपए ह।ै [पूंजी लागत म ें पररवतगन हो
सकता ह ै क्य ोंदक भूजम ऄजगन, जन-ईपयोजगता सेवां का स्ट् थान बदलन,े पेड़ों की कटाइ अदद जैसे दक्रयाकलाप ऄभी पूरे
दकए जाने िेर् ह।ैं ऄंजतम पूंजीगत लागत को ऄलग से ऄजधसजू चत दकया जाएगा।] प्राजधकरण द्वारा प्रयोगकतागं से वसूल
दकए गए िल्ु क के जररए पूंजीगत लागत की वसूली का ररकाडग रखा जाएगा और पूंजीगत लागत की वसूली हो जान े के
पश् चात, लगाए जान े वाल े िल्ु क की दरों को घटाकर 40% कर ददया जाएगा और ईि जनयमों के ऄनुसार आस में वार्तर्क
तौर पर संिोधन दकया जाएगा।

New Delhi, the 14th November, 2022
S.O. 5311(E).—Whereas by notification of the Government of India in the erstwhile Ministry of
Road Transport and Highways number S.O.78(E) dated the 04th February 1999, issued under section 11 of
the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted
the stretch from Km. 0.000 to Km. 233.000 (Vishakhapatanam –Orisha/Andhra Pradesh Border Section) of
National Highway number 5, in the State of Andhra Pradesh to the National Highways Authority of India
(hereinafter referred to as the ―Authority‖);
And whereas, in exercise of the powers conferred by Section 7 of the National Highway Act, 1956
(48 of 1956) read with Rule (3) of the National Highway Fee (Determination of Rates and Collection)
Rules 2008, the Central Government by notification of the Government of India authorized Authority for
levying and collecting fee on mechanical vehicles for the use of stretches as follows:
Vide S.O. No. 1124 (E) dated 16th May, 2012 for the section Champavati/Kopperla-
Visakhapatnam from km. 49.000 to km. 2.837 (new chainage km. 654.204 to km. 700.544) on NH-5 and
S.O. No. 2169 (E) dated 12th September, 2012 for the section Srikakulam Champavati section from
Km. 97.000 to Km. 49.000 (Km. 606.204 to Km. 654.204) of NH-5 in the State of Andhra Pradesh.
Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act,
1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection)
Rules, 2008 (hereinafter referred to as the ―rules‖) and supersession of the notification S.O. No. 1124 (E)
dated 16th May, 2012 & S.O. No. 2169 (E) dated 12th September, 2012 except as respect things done or
omitted to be done before such supersession, the Central Government hereby levies the fee on the
mechanical vehicles at 100% for the rate specified in column (2) of the Table 1 for net road section length
of 65.707 Km. for the use of four and more alone section and for equivalent structure length (having length
more than 60m) of 8.37 Km. (having length of 0.837 km) on the type of vehicles specified in column (1) of
the Table 1 below of Ranastalam to Hanumanthvaka Junction section from design kilometer 634.000 to
kilometer 700.544 (existing Km. 634.000 to Km. 700.544) of National Highway number 16 (Old NH-5) in
the State of Andhra Pradesh and authorizes the Authority to collect, either through its officials or through a
contractor, the said fee, namely:—

1. The fee to be levied and collected hereunder shall be due and payable at the Fee Plaza for net road length specified
for such Fee Plaza(s) namely:—

3. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and
resides within a distance of twenty kilometres from the fee plaza is 315.00 (Rupees Three Hundred and Fifteen
Only) for the year 2022-23 and is subject to revision every year as per the provisions of the said rules.
4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely:—

5. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district
where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service
road or alternative road is available for use of such commercial vehicles.
6. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of
permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on
the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of
the said rules, and shall not be entitled to make use of the highway section unless the excess load has been
removed from such mechanical vehicle.
7. All definitions including category of mechanical vehicles, its permissible load, category of exempted
vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules.
8. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules.
9. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the
actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the
Authority on the basis of the completed length of the section and revised annually in accordance with the
rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular
language.
10. The estimated capital cost of the project is Rupees 1885.79 crore. [The capital cost is subject to
variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed and
the final capital cost will be notified separately]. The Authority shall maintain a record of the recovery of
capital cost through user fee realised and after recovery of the capital cost, the fee leviable shall be reduced
to 40% of the rates and shall be revised annually in accordance with the said rules.
