संख्या का. आ. 461 (अ) दिनांक 30.03.2006 द्वारा हररयाणा तथा उत्तर प्रििे राज्य म ें छह-लने ईस्ट्टन ग पेररफेरल
एक्सप्रेसवे (एनएच नंबर एनई - II) को 1.000 दकमी स े 136.000 दकमी (एनएच -1 पर दकमी 36.083 स े 1.00 दकमी
की िरू ी पर िुरू होत े हुए और एनएच-2 पर 64.330 दकमी स े 1.00 दकमी की िरू ी पर समाप्त होते हुए) के जवकास का
काय ग भारतीय राष्ट्रीय रािमाग गप्राजधकरण (जिसे इसके पश्चात् ‘प्राजधकरण‘ कहा िाए) को सौंपा ह ैं;
और यत:, केन्द्रीय सरकार ने, राष्ट्रीय रािमाग ग िल्ु क (िरों का अवधारण एव ं सग्रं हण) जनयम, 2008 के जनयम
(3) के साथ परित राष्ट्रीय रािमागग अजधजनयम, 1956 (1956 का 48) की धारा 7 द्वारा प्रित्त िजियों का प्रयोग करत े
हुए भारत सरकार की अजधसूचना द्वारा यांजत्रक वाहनों पर खंडों के उपयोग के जलए िल्ु क उिग्रहीत और सग्रं हीत करन े के
जलए प्राजधकरण को जनम्न ानुसार प्राजधकृत दकया :

पर, सड़क की कुल समकक्ष लम्बाई 156.090 दक.मी. [जिसम ें 135.000 दक.मी. की सड़क और 2.343 दकमी की
सरचनाएं िाजमल ह ै(जिनकी लम्बाई 60 मीटर स े अजधक ह)ै और जिसकी समकक्ष लम्बाई 23.433 दक.मी. ह]ै हते ु सारणी

4. िुल्क प्लािा को पार करके खडं के केवल एक जहस्ट्से का उपयोग करन े वाले वाहन को केवल उस प्लािा के जलए
वाहन की उस श्रेणी के जलए जनर्िगष्ट िुल्क का भुगतान करना होगा और पूरे खंड का उपयोग करने वाल ेवाहन के
पास पहल े िुल्क प्लािा पर पूरे िुल्क का भुगतान करके और िल्ु क रसीि दिखाकर िसू रे िल्ु क प्लािा को पार
करने का जवकल्प होगा। ।
5. रािमागग खण्ड पर बहुयात्राओं हते ु पास जनम्नजलजखत िरों पर िारी दकया िाएगा, अथागतः्
सिं ेय राजि अनज्ञु ात एकतरफा यात्राओं जवजधमान्द्यता की अवजध
की अजधकतम सख्ं या
एकतरफा यात्रा के जलए िल्ु क का डेढ़ गुना िो भुगतान के समय से चौबीस घंटे
पचास या अजधक एकल यात्राओं के जलए संिेय पचास अथवा अजधक भुगतान की जतजथ स ेएक माह
िुल्क की राजि का िो-जतहाई *
*बिते दक उपयोगकताग यात्रा करते समय एक ही प्रवेि और जनकास िुल्क प्लािा का उपयोग करता हो।

7. यांजत्रक वाहनों की श्रेणी, उनके जलए अनज्ञु ेय भार, छूट-प्राप्त वाहनों की श्रेणी, सर्वगस सड़क, वैकजल्पक सड़क आदि
सजहत सभी पररभार्ाएं जनयमों में जवजनर्िगष्ट पररभार्ाओं के अनुसार होंगी।
8. उि जनयमों के जनयम 12 के अनुसार उपयोगकताओंग की िानकारी के जलए िल्ु क की िरें प्रिर्िगत की िाएगं ी।
9. ऊपर सारणी-1 म ें यथा-उजल्लजखत, आधार वर् ग 2007-08 के जलए प्रजत दकलोमीटर िल्ु क की आधार िर के
आधार पर, यांजत्रक वाहनों स े जलए िाने वाले वास्ट्तजवक िल्ु क और कटौजतयों की गणना प्राजधकरण द्वारा खंडों की पूरी कर
ली गई लम्बाई के आधार पर की िायेगी और उसम ें उि जनयमों के जनयम 5 के अनुसार वार्र्गक तौर पर संिोधन दकया
िाएगा तथा उसे, तिनुसार, अग्रं ेिी और स्ट्थानीय भार्ा के कम-स-े कम एक-एक समाचार पत्र म ें प्रकाजित दकया िाएगा ।
10. ऊपर सारणी-1 म ें यथा-उजल्लजखत, आधार वर्ग 2007-08 के जलए प्रजत दकलोमीटर िुल्क की आधार िर के आधार
पर, यांजत्रक वाहनों से जलए िानेवाले वास्ट्तजवक िुल्क और कटौजतयों की गणना प्राजधकरण द्वारा खंडों की पूरी कर ली गई
लम्बाई के आधार पर की िायगे ी। उसे, तिनुसार, ररयायतग्रही के माध्यम से अंग्रेिी और स्ट्थानीय भार्ा के कम-स-े कम
एक-एक समाचार पत्र म ें प्रकाजित दकया िाएगा और इसके बाि उि जनयमों के जनयम 5 और ररयायत समझौत े के
प्रावधानों के अनुसार वार्र्गक संिोजधत दकया िाएगा और प्रकाजित दकया िाएगा, बिते, हालांदक, ऐसा संिोधन पूवगवती

S.O. 4153(E).—Whereas, by the notification of the Government of India in the Ministry of Road
Transport and Highways, number S.O. 461(E) dated the 30.03.2006, issued under section 11 of the
National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted
Development of Six-Lane Eastern Peripheral Expressway (NH No. NE – II) from km 1.000 to km 136.000
(starting at 1.00 km distance from Km 36.083 on NH – 1 and ending at 1.00 km distance from Km 64.330
on NH – 2) in the states of Haryana and Uttar Pradesh to the National Highways Authority of India
(hereinafter referred to as the “Authority”);
And whereas, in exercise of the powers conferred by Section 7 of the National Highway Act, 1956
(48 of 1956) read with Rule (3) of the National Highway Fee (Determination of Rates and Collection)
Rules 2008, the Central Government by notification of the Government of India authorized Authority for
levying and collecting fee on mechanical vehicles for the use of stretches as follows:
Vide S.O.No. 2299 (E) dated 06th June, 2018 for the section from Km 1.000 to km 136.000
(starting at 1.00 km distance from Km 36.083 on NH – 1 and ending at 1.00 km distance from Km 64.330
on NH – 2) (approximately 135 km) on National Highway No.NE-II (hereinafter called the “NHNE-II”) in
the States of Haryana and Uttar Pradesh.
And whereas, pursuant to the provision of Section 14 of the National Highways Authority of India
Act, 1988 (68 of 1988), the Authority has entered into an Agreement (hereinafter referred to as said
agreement) with M/s NCR Eastern Peripheral Expressway Pvt. Ltd. C-2/39, BLK-C-2, Safdarjung Dev
Area, New Delhi- 110016,, (hereinafter referred to as the “Concessionaire”), on 06.05.2022 for the bid
submitted on 27.01.2022 for the Tolling, Operation, Maintenance and Transfer (ToT mode) of km 1.000 to
km 136.000 [starting at 1.00 km distance from km 36.083 on NH-44(old NH-1) and ending at 1.00 km
distance from km 64.330 on NH-19(old NH-2) (approximately 135.000 km) ] on National Highway
No.NE-2 in the States of Haryana and Uttar Pradesh;
Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act,

the Notification Number S.O. No. 2299 (E) dated 06th June, 2018 except as respect things done or omitted
to be done before such supersession, the Central Government, having regard to the expenditure involved in
building, maintenance, management and operation of the said Section of said National Highway, interest on
the capital invested, reasonable return, the volume of traffic and the period of said agreement entered
between the Authority and the Concessionaire, hereby notifies that there shall be levied and collected fees
on mechanical vehicles at the rate specified in column (2) of the Table 1 for total equivalent road length of
156.090 km [ including 135.000 km road and 2.343km of structures (having length more than 60 m) with8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
equivalent length of 23.433 km ] for the use of 6 lane sections on the Type of Vehicles specified in Column
(1) of the Table 1 below for the use of section from km 1.000 to km 136.000 [starting at 1.00 km distance
from km 36.083 on NH-44(old NH-1) and ending at 1.00 km distance from km 64.330 on NH-19(old NH-
2) (approximately 135.000 km) ] on National Highway No.NE2 in the States of Haryana and Uttar Pradesh
and authorizes the said Concessionaire to collect and retain the fee on and from the Appointed Date or
publication of this Notification in the Official Gazette, whichever is later, till the date of termination as
specified in the agreement. This fee notification shall be effective from the Appointed Date of the ToT
project.

4. The vehicle using only a part of the section by crossing a fee plaza shall pay the specified fee for that
category of the vehicle for that plaza only and the vehicle using the whole section shall have an option to pay the whole
fee at the first fee plaza and cross another fee plaza by showing the fee receipt.
5. For multiple journey on the highway section, passes shall be issued at the following rates, namely:

6. The driver or owner or person in charge of a mechanical vehicle shall be liable to pay fee, for entering the
overloaded vehicle on the national highway, to the user fee collecting agency, equal to fees as follows

7. All definitions including category of mechanical vehicles, its permissible load, category of exempted
vehicles, service road, alternative road etc. shall be as per definitions specified in the rules.
8. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules.
9. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual
amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the
Authority on the basis of the completed length of the section and revised annually in accordance with the rule
5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular
language accordingly.
10. The Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the
actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the
Authority. The same shall be got published by the Authority in at least one newspaper in English and
vernacular language through the Concessionaire and thereafter revised annually in accordance with the rule 5
of the said rules and provisions of the Concession Agreement and will be published, provided, however, that
such revision shall not be affected until a period of 6 (six) months from the date of the preceding revision of
fee.
