(अ).—िबदक, केन्‍द र सरकार न े राष्ट्रीय रािमाग ग अजधजनयम, 1956 (1956 का 48) की धारा 5 के 2679 अधीन िारी की गई भारत सरकार के सड़क पररवहन और रािमागग मंत्रालय की अजधसूचना स.ं का. आ. 2219 (अ), दिनांक 14 िलु ाई, 2017 के द्वारा आध्रं प्रिेि राज्य म ें राष्‍टर ीय रािमाग ग स.ं रारा- 544डीडी के दकमी 56.000 स े दकमी 102.200 (कल् याणिगु ग– मोलाकलमुरू खंड) तक को आध्रं प्रििे राज्य सरकार को सुपिु ग कर दिया ह।ै अत: अब, राष्‍टर ीय रािमाग ग फीस (िरों का जनधागरण और सग्रं हण) जनयम, 2008 (िो इसके आग े ‘जनयम’ के रूप में उजल् लजखत ह)ै के जनयम 3 के साथ परित राष्‍टर ीय रािमागग अजधजनयम, 1956 (1956 का 48) की धारा 7 द्वारा प्रित् त िज‍त यों का प्रयोग करत े हुए केन्‍द रीय सरकार, एतिद्वारा आध्रं प्रिेि राज्य म ें राष्‍टर ीय रािमागग स.ं रारा- 544डीडी के जडिाइन दकमी 56/000 स े दकमी 102/200 (मौिूिा दकमी 58/344 स े 105/400) तक ‘कल् याणिगु ग – मोलाकलमुरू खंड’ के उपयोग के जलए नीच े िी गई ताजलका 1 के कॉलम (1) म ें जवजनर्िष्‍टग ट वाहनों के प्रकार पर 42.455 दकमी (2 लने + पेव्ड िोल् डर के 42.455 दकमी) खंड के (चार लेन या अजधक लेन वाले खंड अथवा पेव्ड िोल् डर के साथ िो लेन खंड के उपयोग के जलए आधार िर का साि प्रजतित) जनवल सड़क खंड लंबाई के और 3.00 दकमी (0.30 दकमी की कुल लंबाई वाली) की समतुल् य संरचना लंबाई (60 मीटर स े अजधक की लंबाई वाली) के जलए ताजलका 1 के कॉलम (2) म ें जवजनर्िष्‍टग ट िर पर और िस करोड़ रु. या इससे अजधक लागत वाल े 3.465 दकमी लंबाई के बाइपास के जलए ताजलका 1 के कॉलम (2) म ें जवजनर्िष्‍टग ट आधार िर के 1.5 गुना पर यांजत्रक वाहनों पर फीस उिगृहीत करती ह ै तथा भारतीय राष्‍टर ीय रािमागग प्राजधकरण को उसके अजधकाररयों अथवा दकसी िेकेिार के माध् यम स े उ‍त फीस के संग्रहण के जलए प्राजधकृत करती ह,ै अथागत:्- 3868GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ताजलका-। वाहन का प्रकार आधार वर् ग 2007-08 के जलए प्रजत दकमी फीस का आधार िर (रु. म)ें (1) (2) कार, िीप, वैन या हल्के मोटर वाहन 0.65 हल्के वाजणजज्यक वाहन, हल्के माल वाहन या जमनी बस 1.05 बस या रक (िो धुरी) 2.20 तीन धुरी वाजणजज्यक वाहन 2.40 भारी जनमागण मिीनरी (एचसीएम) या अथग मूववंग उपस्ट्कर (ईएमई) या बहु धुरीय वाहन 3.45 (एमएवी) (चार से छ: धुरी) जविाल आकार के वाहन (सात या अजधक धुरी) 4.20 1. इसके अंतगगत उिगृहीत और सगं ृहीत की िान े वाली फीस ऐसे फीस प् लािां के जलए जवजनर्िष्‍टग ट जनवल सड़क लंबाई हते ु जनम्न जलजखत पथकर प् लािा म ेंिये और संिेय होगी:- ताजलका-2 फीस प्लािा की अवजस्ट्थजत (चनै ेि) लंबाई (दकमी म)ें जिसके जलए फीस सिं ेय ह ै िर, जिस पर फीस संिये है आंध्र प्रििे राज्य के अनंतपुरामु जिले में 42.455 दकमी ऊपर ताजलका-1 में उजल्लजखत िो किरामपल्ली गांव के पास रारा- 3.465 दकमी के बाईपास (लागत>10 करोड़) लेन/पेव्ड िोल्डसग के साथ िो लेन के 544डीडी का दकमी 77/987 और संरचनां की लंबाई (>60मी) को छोड़कर जलए आधार िरों का 60% 2. उपयुग‍ त के अजतरर‍त , ऐसे फीस प् लािां के जलए जवजनर्िष्‍टग ट बाइपासों की जनवल लंबाई के जलए जनम्न जलजखत िुल्क प् लािा पर 10 करोड़ रु. अथवा अजधक लागत वाल े बाइपास के उपयोग हते ु जनम्न जलजखत िल्ु क भी िये और संिेय होगी :- ताजलका -3 बाइपास की लंबाई और लागत, िर, जिस पर जिसके जलए अजतररक्त िल्ु क िेय फीस सिं ये ह ै फीस प्लािा की बाइपास का नाम िुरू होन ेवाला जमलन ेवाला है अवजस्ट्थजत (चनै िे ) लंबाई लागत (करोड़ रु. (दकमी म)ें म)ें ऊपर ताजलका-1 आंध्र प्रििे राज्य के में उजल्लजखत जडिाइन दकमी जडिाइन दकमी अनंतपुरामु जिले में िो लेन/पेव्ड 92+660 96+125 किरामपल्ली गांव के रायािगु ग बाइपास 3.465 39.91 िोल्डसग के साथ (मौिूिा दकमी (मौिूिा दकमी पास रारा-544डीडी का िो लेन के जलए 95+240) 99+170) दकमी 77/987 आधार िरों का 90% 3. उपयुग‍ त के अजतरर‍त , जनम्न जलजखत टोल प् लािा (प्ल ािां) पर 60 मीटर स े अजधक लंबाई वाली जनम्न जलजखत अवसंरचनां के उपयोग के जलए 10 के समतल्ु य गणु क द्वारा ऐसी अवसंरचनां की लंबाई को गुणा करके रािमाग ग की समतुल् य लंबाई म ेंअवसंरचनां की लंबाई को पररवर्तगत करके जनम्न जलजखत फीस भी िये और संिेय होगी:-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 ताजलका-4 फीस प्लािा की अवजस्ट्थजत समतल्ु य सड़क लबं ाई म ेंपररवर्ततग दकए समतल्ु य सड़क िर, जिस पर फीस (चनै िे ) िान ेके जलए अवसंरचनां की लबं ाई. लंबाई (दकमी म)ें सिं ये ह ै (दकमी म)ें आंध्र प्रििे राज्य के अनंतपुरामु 0.30 दकमी. 3.00 दकमी. ऊपर ताजलका-1 में जिले में किरामपल्ली गांव के उजल्लजखत िो लेन/पेव्ड पास रारा-544डीडी का दकमी िोल्डसग के साथ िो लेन 77/987 के जलए आधार िरों का 60% ब् यौरा जनम् नानुसार है:- 1 चनै ेि सरं चना का प्रकार लंबाई (दकमी म)ें दकमी स े दकमी तक दकमी 73+360 दकमी 73+660 उच्च स्ट्तरीय पुल 0.30 दकमी 4. गैर-वाजणजज्य क प्रयोिनों के जलए पंिीकृत यांजत्रक वाहन के स्ट् वामी और फीस प्ल ािा स े बीस दकमी की िरू ी के भीतर जनवास करने वाले व् यज‍त के जलए माजसक पास की िर वर्ग 2023-24 के जलए 330.00 रु. (तीन सौ तीस रुपए मात्र) ह ै और उ‍त जनयमों के प्रावधानों के अनुसार प्रजतवर्ग संिोधन के अध् यधीन ह।ै 5. रािमागग खडं पर बहुल यात्रां के जलए जनम्न जलजखत िरों पर पास िारी दकए िाएगं ,े अथागत ् ताजलका-5 भुगतान-योग्य धनराजि अनमु त एकतरफा यात्रां की अजधकतम वैधता की अवजध सख्ं या एकतरफा यात्रा के जलए फीस का डेढ़ िो भुगतान के समय से चौबीस घंटे गुना पचास एकल यात्रां के जलए भुगतान- पचास भुगतान की तारीख से एक महीना योग्य फीस की राजि का िो-जतहाई 6. फीस प्ल ािा की अवजस्ट्थजत होन े वाल े जिल े म ें पंिीकृत वाजणजज्य क वाहनों (राष्‍टर ीय परजमट के अधीन प्रचाजलत दकए िा रह े वाहनों को छोड़कर) के जलए फीस उस श्रेणी के वाहन हते ु जनधागररत िर की 50% होगी, बिते दक ऐस े वाजणजज्य क वाहनों के प्रयोग के जलए कोई सर्वगस रोड या वैकजल् पक सड़क उपलब् ध न हों। 7. संबंजधत श्रेणी के वाहनों के जलए जवजनर्िष्‍टग ट अनज्ञु ेय भार स े अजधक भार लि े यांजत्रक वाहन का चालक या स्ट् वामी या प्रभारी व् यज‍त , राष्ट्रीय रािमागग पर अजतभार लि े वाहन के प्रवेि के जलए टोल संग्रहण एिेंसी को ऐसी श्रेणी के वाहनों के प्रवेि जलए, कजथत जनयमों के जनयम 10 के उप-जनयम 1ए के अनुसार अनप्रु योज्य फीस के समतुल् य फीस का भगु तान करन े के जलए उत् तरिायी होगा और वह रािमाग ग खंड का प्रयोग करन े के जलए तब तक हकिार नहीं होगा िब तक ऐस े यांजत्रक वाहन स े लिा अजतभार हटाया नहीं िाता। 8. सभी पररभार्ाए,ं यांजत्रक वाहनों की श्रेणी, इनके अनज्ञु ेय भार, छूट प्राप् त वाहनों की श्रणे ी, सर्वगस रोड, वैकजल् पक सड़क इत् यादि पूवो‍त जनयमों म ें जवजनर्िष्‍टग ट पररभार्ां के अनुरूप होंगी। 9. फीस की िरें उक्त जनयमों के जनयम 12 के अनुसरण म ेंप्रयो‍त ां के सूचनाथग प्रिर्िगत करनी होंगी।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 10. यांजत्रक वाहनों स े फीस की वास्ट् तजवक राजि उपयुग‍ त ताजलका-1 म ें यथा-उजल् लजखत आधार वर् ग 2007-08 के जलए प्रजत दकमी फीस की आधार िर के आधार पर प्रभाररत होगी और छूटों की गणना भारतीय राष्ट्रीय रािमाग ग प्राजधकरण द्वारा खंड की पूरी हो गई लंबाई के आधार पर की िाएगी और उसे उ‍त जनयमों के जनयम 5 के अनुसार प्रजत वर्ग संिोजधत दकया िाएगा तथा तिनुसार उसे अंग्रेिी और क्षेत्रीय भार्ा के कम स े कम एक-एक समाचार पत्र म ें प्रकाजित दकया िाएगा। 11. इस पररयोिना की प्रा‍क जलत पूंिीगत लागत 291.73 करोड़ रु. ह।ै (भूजम अजधग्रहण, सावगिजनक िन सुजवधां के स्ट् थानांतरण, पेड़ों को काटन,े आदि कायगकलापों के रूप म,ें पिूं ीगत लागत पररवतनग के अध् यधीन ह)ै प्राप् त प्रयो‍त ा फीस के माध् यम स े वसूल की गई पूंिीगत लागत का भारतीय राष्ट्रीय रािमागग प्राजधकरण द्वारा ररकाडग रखा िाएगा तथा पूंिीगत लागत की वसूली के पश् चात् उिग्राह्य फीस घटाकर िरों के 40% तक कर िी िाएगी और कजथत जनयमों के अनुसरण म ें वार्र्गक रूप स े संिोजधत की िाएगी। [फा. स.ं आरओ/वीिेए/िबे ी:एनएच(ओ)/666/टोल/ई-206354] सुमन प्रसाि वसंह, संयु‍त सजचव MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 16th June, 2023 S.O. 2679(E).— Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O.2219 (E) dated 14th July, 2017 issued under section 5 of the National Highway Act, 1956 (48 of 1956), the Central Government has entrusted the road stretch from Km.56.000 to Km.102.200 (Kalyanadurg – Molakalmuru Section) of National Highway No.NH-544DD in the state of Andhra Pradesh to the State Government of Andhra Pradesh. Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the “rules”), the Central Government hereby levies the fee on mechanical vehicles at the rate specified in column (2) of the Table 1 for net road section length of 42.455 Km (42.455 Km of 2L+PS) (for the use of four or more lane section or at Sixty percent of the base rate for use of two lane with paved shoulder section) for equivalent structure length (having length more than 60 mts) of 3.00 kms (having length of 0.30 kms) and at one and one half times the base rate for bypasses having a length of 3.465Km costing rupees ten crore or more on the type of vehicles specified in column (1) of the Table 1 below of “Kalyandurg to Molakalmuru section” from design Km. 56/000 to 102/220 (existing Km. 58/344 to 105/400) of National Highway No. 544DD, in the State of Andhra Pradesh and authorises the National Highway Authority of India to collect, either through its officials or through a contractor, the said fee namely:- Table 1 Base Rates of fee per km for the base year 2007-08 Category of Vehicle (in Rupees) 1 2 Car, Jeep, Van or Light Motor Vehicle 0.65 Light Commercial Vehicle, Light Goods Vehicle or Mini Bus 1.05 Bus or Truck (2 Axles) 2.20 Three Axle Commercial Vehicles 2.40 Heavy Construction Machinery (HCM) or Earth Moving Equipment (EME) or Multi Axle Vehicle (MAV) (Four to Six 3.45 Axles) Oversized Vehicles (7 or More Axles) 4.20 1. The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs.330/- (Rupees Three Hundred and Thirty only) for the year 2023-24 and is subject to revision every year as per the provisions of the said rules. 5. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 7. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc., shall be as per definitions specified in the said rules. 9. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules. 10. Based on the Base rate of Fee per km for the base year 2007-2008 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the National Highway Authority of India on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language. 11. The estimated capital cost of the project is Rs.291.73 Cr. The National Highway Authority of India shall maintain a record of the recovery of capital cost through user fee realised and after recovery of the capital cost; the fee leviable shall be reduced to 40 % of the rates and shall be revised annually in accordance with the said rules.
