L.-33004/99 सी.जी.-डी.एल.-अ.-01042023-244844 xxxGIDHxxx CG-DL-E-01042023-244844 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 1463] नई दिल्ली, बुधवार, माच ग29, 2023/चत्रै 8, 1945 No. 1463] NEW DELHI, WEDNESDAY, MARCH 29, 2023/CHAITRA 8, 1945 सड़क पररवहन और रािमाग गमत्रं ालय अजधसचू ना नई दिल्ली, 29 माच,ग 2023 का.आ. 1516(अ).—िबदक, केन्‍द र सरकार ने राष्ट्रीय रािमाग ग अजधजनयम, 1956 (1956 का 48) की धारा 5 के अधीन िारी की गई भारत सरकार के सड़क पररवहन और रािमागग मंत्रालय की अजधसूचना सं. का. आ. 2530(अ), दिनांदकत 17 जसतंबर, 2015 के द्वारा आंध्र प्रििे राज्य में राष्‍टर ीय रािमागग 565 के तेलगं ाना सीमा से येरपेडू तक के खंड को आंध्र प्रिेि राज्य सरकार के सुपुिग कर दिया ह;ै अत: अब, राष्‍टर ीय रािमागग फीस (िरों का जनधागरण और संग्रहण) जनयम, 2008 (िो इसके आगे ‘जनयम’ के रूप म ें उजल् लजखत ह)ै के जनयम 3 के साथ परित राष्‍टर ीय रािमाग ग अजधजनयम, 1956 (1956 का 48) की धारा 7 द्वारा प्रित् त िज‍त यों का प्रयोग करते हुए, केन्‍द रीय सरकार, एतिद्वारा आध्रं प्रिेि राज्य में राष्ट्रीय रािमागग 565 पर जडिाइन दकमी 360+156 से दकमी 485+718 (मौिूिा दकमी 361+330 से दकमी 509+400 तक) के िोरनाला टी िं‍िन- पेंचालाकोना-येरपडे ू तक के खडं के उपयोग के जलए नीचे िी गई ताजलका 1 के कॉलम (1) में जवजनर्िगष्‍ट ट वाहनों के प्रकार पर 118.50 दकमी की (पेव्ड िोल्डर खण्ड के साथ िो लने के उपयोग के जलए आधार िर का 60 प्रजतित) जनवल सड़क खडं लंबाई के और 13.10 दकमी (1.31 दकमी की कुल लंबाई वाली) की समतल्ु य संरचना लंबाई (60 मीटर से अजधक की लंबाई वाले) के जलए ताजलका 1 के कॉलम (2) म ें जवजनर्िगष्‍टट िर पर और िस करोड़ रु. या इससे अजधक लागत वाल े 5.75 दकमी लंबाई के बाइपास के जलए ताजलका 1 के कॉलम (2) म ें जवजनर्िगष्‍ट ट आधार िर के नब् बे प्रजतित िर पर यांजत्रक वाहनों पर फीस उिगृहीत करती ह ैतथा भारतीय राष्‍टर ीय रािमागग प्राजधकरण को उसके अजधकाररयों अथवा दकसी िेकेिार के माध् यम से उ‍त फीस के सग्रं हण के जलए प्राजधकृत करती है, अथागत:् - 2123 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ताजलका-। वाहन का प्रकार आधार वर् ग 2007-08 के जलए प्रजत दकमी आधार फीस िर (रु. म)ें (1) (2) कार, िीप, वैन या हल् के मोटर वाहन 0.65 हल्के वाजणजज्य क वाहन, हल्के माल वाहन या जमनी बस 1.05 बस या रक (िो धुरी) 2.20 तीन धरु ी वाजणजज्य क वाहन 2.40 भारी जनमागण मिीनरी (एचसीएम) या अथग मूववंग उपस्ट् कर (ईएमई) या बहु 3.45 धुरीय वाहन (एमएवी) (चार स ेछ: धुरी) जविाल आकार के वाहन (सात या अजधक धरु ी) 4.20 1. इसके अतं गतग उिगृहीत और संगृहीत की िाने वाली फीस ऐसे फीस प् लािाओं के जलए जवजनर्िगष्‍ट ट जनवल सड़क लंबाई हते ु जनम्न जलजखत पथकर प्ल ािा में िेय और संिेय होगी:- ताजलका-2 फीस प्ल ािा की अवजस्ट्थ जत (चनै िे ) लबं ाई (दकमी म)ें जिसके िर, जिस पर फीस सिं ेय ह ै। जलए फीस सिं ेय ह ै टीपी-I दकमी 443+800(रापरु गांव जतरूपजत जिला) 76.502 दकमी. ऊपर ताजलका-1 में उजल्ल जखत आधार िरों का 60% टीपी-II दकमी 500+150 (वचंतालापलेम गांव 42.000 दकमी. ऊपर ताजलका-1 में उजल्ल जखत जतरूपजत जिला) आधार िरों का 60% 2. उपयुग‍ त के अजतरर‍त , ऐसे फीस प्ल ािाओं के जलए जवजनर्िगष्‍ट ट बाइपासों की जनवल लंबाई के जलए जनम्न जलजखत िल्ु क प् लािा पर 10 करोड़ रु. अथवा अजधक लागत वाले बाइपास के उपयोग हते ु जनम्न जलजखत िुल्क भी िेय और संिेय होगी :- ताजलका-3 फीस प्ल ािा बाइपास िरूु होन े जमलन ेवाला बाइपास की लबं ाई और लागत, जिसके िर, जिस पर फीस की अवजस्ट्थ जत का नाम वाला जलए अजतररक्त िल्ु क िेय ह ै सिं ेय ह ै (चनै िे ) लबं ाई (दकमी म)ें लागत (करोड़ रु. म)ें जतरूपजत रापुर 444.650 450.400 5.750 दकमी. 24.430 करोड़ ऊपर ताजलका-1 में जिला के रापुर उजल् लजखत आधार गांव के समीप िरों का पेव्ड रारा 565 के िोल् डसग सजहत िो दकमी लेन के जलए 90% 443+800 पर 5.75 दकमी.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 3. उपयुग‍ त के अजतरर‍त , जनम्न जलजखत टोल प्ल ािा (प् लािाओं) पर 60 मीटर से अजधक लंबाई वाली जनम्न जलजखत अवसंरचनाओं के उपयोग के जलए 10 के समतल्ु य गणु क द्वारा ऐसी अवसंरचनाओं की लंबाई को गणु ा करके रािमाग ग की समतुल् य लंबाई म ेंअवसंरचनाओं की लंबाई को पररवर्तगत करके जनम्न जलजखत फीस भी िेय और संिेय होगी:- ताजलका-4 टोल प्ल ािा की अवजस्ट्थ जत समतल्ु य सड़क लबं ाई म ेंपररवर्ततग समतल्ु य सड़क िर, जिस पर फीस सिं ेय ह ै (चनै िे ) दकए िान ेके जलए अवसरं चनाओं की लबं ाई (दकमी म)ें लबं ाई. (दकमी म)ें जतरूपजत जिला के रापुर गांव 1.31 दकमी. 13.10 दकमी. ऊपर ताजलका-1 म ेंउजल् लजखत के समीप रारा 565 के दकमी आधार िरों का पेव्ड िोल्ड सग 443+800 पर सजहत िो लने के जलए 60% * ब् यौरा जनम्न ानुसार ह:ै- चनै िे क्र.स.ं सरं चना का प्रकार लबं ाई (दकमी म)ें दकमी स े दकमी तक 1 364.302 364.382 मुख्य पलु (2लने +पव्े ड िोल्डर) 0.080दकमी 1 378.071 379.301 मुख्य पलु (2लने +पव्े ड िोल्डर) 1.230 दकमी कुल 1.310 दकमी 4. गरै -वाजणजज्य क प्रयोिनों के जलए पंिीकृत यांजत्रक वाहन के स्ट् वामी और फीस प् लािा से बीस दकमी की िरू ी के भीतर जनवास करने वाल े व् यज‍त के जलए माजसक पास की िर वर् ग 2022-23 के जलए 315.00 रु. (तीन सौ पंरह रुपए मात्र) ह ै और उ‍त जनयमों के प्रावधानों के अनुसार प्रजतवर्ग संिोधन के अध् यधीन ह।ै 5. रािमाग गखंड पर बहुल यात्राओं के जलए जनम्न जलजखत िरों पर पास िारी दकए िाएगं े, अथागत् ताजलका-5 भगु तान-योग्य धनराजि अनमु त एकतरफा यात्राओं की अजधकतम वधै ता की अवजध सख्ं य ा एकतरफा यात्रा के जलए फीस का डेढ़ िो भुगतान के समय से चौबीस घंटे गुना पचास एकल यात्राओं के जलए पचास भुगतान की तारीख से एक महीना भुगतान-योग् य फीस की राजि का िो- जतहाई 6. फीस प् लािा जस्ट् थत होने वाल े जिले म ें पंिीकृत वाजणजज्य क वाहनों (राष्‍टर ीय परजमट के अधीन प्रचाजलत दकए िा रह े वाहनों को छोड़कर) के जलए फीस उस श्रणे ी के वाहन हते ु जनधागररत िर की 50% होगी, बित े दक ऐस े वाजणजज्य क वाहनों के प्रयोग के जलए कोई सर्वगस रोड या वैकजल् पक सड़क उपलब् ध न हों। 7. संबंजधत श्रेणी के वाहनों के जलए जवजनर्िगष्‍ट ट अनुज्ञेय भार स े अजधक भार लिे यांजत्रक वाहन का चालक या स्ट् वामी या प्रभारी व् यज‍त , राष्ट्रीय रािमागग पर अजतभार लिे वाहन के प्रवेि के जलए टोल संग्रहण एिेंसी को ऐसी श्रणे ी के वाहनों के प्रवेि जलए, कजथत जनयमों के जनयम 10 के उप-जनयम 1ए के अनुसार अनुप्रयोज्य फीस के समतल्ु य फीस का भगु तान करने के जलए उत् तरिायी होगा और वह रािमाग ग खंड का प्रयोग करन े के जलए तब तक हकिार नहीं होगा िब तक ऐस े यांजत्रक वाहन से लिा अजतभार हटाया नहीं िाता।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 8. सभी पररभार्ाए,ं यांजत्रक वाहनों की श्रेणी, इनके अनुज्ञेय भार, छूट प्राप् त वाहनों की श्रेणी, सर्वगस रोड, वैकजल् पक सड़क इत् यादि पूवो‍त जनयमों म ेंजवजनर्िगष्‍ट ट पररभार्ाओं के अनरूु प होंगी। 9. फीस की िरें उक्त जनयमों के जनयम 12 के अनुसरण म ेंप्रयो‍त ाओं के सूचनाथग प्रिर्िगत करनी होंगी। 10. यांजत्रक वाहनों से फीस की वास्ट् तजवक राजि उपयुग‍त ताजलका-1 में यथा-उजल् लजखत आधार वर्ग 2007-08 के जलए प्रजत दकमी फीस की आधार िर के आधार पर प्रभाररत होगी और छूटों की गणना भारतीय राष्ट्रीय रािमाग ग प्राजधकरण द्वारा खंड की परू ी हो गई लंबाई के आधार पर की िाएगी और उस े उ‍त जनयमों के जनयम 5 के अनुसार प्रजत वर्ग संिोजधत दकया िाएगा तथा तिनुसार उसे अग्रं ेिी और क्षेत्रीय भार्ा के कम से कम एक-एक समाचार पत्र में प्रकाजित दकया िाएगा। 11. इस पररयोिना की प्रा‍क जलत पूंिीगत लागत 749.07 करोड़ रु. ह।ै (भूजम अजधग्रहण, सावगिजनक िन सुजवधाओं के स्ट् थानांतरण, पेड़ों को काटन,े आदि कायगकलापों के रूप म,ें पिूं ीगत लागत पररवतगन के अध् यधीन ह)ै प्राप् त प्रयो‍त ा फीस के माध् यम स े वसूल की गई पूंिीगत लागत का भारतीय राष्ट्रीय रािमागग प्राजधकरण द्वारा ररकाड ग रखा िाएगा तथा पूंिीगत लागत की वसलू ी के पश् चात् उिग्राह्य फीस घटाकर िरों के 40% तक कर िी िाएगी और कजथत जनयमों के अनुसरण म ेंवार्र्गक रूप से संिोजधत की िाएगी। [फा. स.ं आरओ/बीिेए/िेबीीःएनएचडीपी/एनएच-565/661/सीओआरआरपी/सीओँएमपी स.ं 204372] सुमन प्रसाि वसंह, संयु‍त सजचव MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 29th March, 2023 S.O. 1516(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 2530 (E) dated 17th September, 2015 issued under section 05 of the National Highway Act, 1956 (48 of 1956), the Central Government has entrusted the stretch from Telangana Border to Yerpedu of National Highway No.565 in the State of Andhra Pradesh to the State Government of Andhra Pradesh, Now, therefore in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and in supersession to Gazette Notification S.O. 2896 (E) dated 8th Sept 2016, the Central Government hereby levies the fee on mechanical vehicles at the rate specified in column (2) of the Table-1 for net road section length of 118.50 Km (at sixty percent of the base rate for use of two lane with paved shoulder section) and for equivalent structure length (having length more than 60m) of 13.10 km (having a length of 1.31 Km) and at 90% of the base rate for bypass having length of 5.75 Kms costing rupees ten crore or more on the type of vehicles specified in column (1) of the Table 1 below for the use of the Dornala T Junction-Penchalakona-Yerpedu section from Design kilometer 360+156 to kilometer 485+718 (existing km 361+330 to km 509+400) on the National Highway No. 565 in the State of Andhra Pradesh and authorises the 'National Highway Authority of India' to collect, either through its officials or through a contractor, the said fee, namely: TABLE 1 Base rate of fee per km for the Type of vehicle base year 2007-08 (in Rupees) (1) (2) Car, Jeep, Van or Light Motor Vehicle 0.65 Light Commercial Vehicle, Light Goods Vehicle or Mini Bus 1.05 Bus or Truck (Two Axles) 2.20 Three-axle commercial vehicles 2.40 Heavy Construction Machinery (HCM) or Earth Moving Equipment (EME) or 3.45 Multi Axle Vehicle (MAV) (four to six axles) Oversized Vehicles (seven or more axles) 4.20[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 1. The fee to be levied and collected hereunder shall be due and payable at the Fee Plaza's for net road length specified for such Fee Plazas, namely: - TABLE 2 Location of Fee Plaza Length (in km) for which Fee is Rate at which fee is payable (Chainage) payable 60% for two lane with paved Km. 443+800 (Rapur Village TP-I 76.502 Km shoulders, of the base rates mentioned Tirupati District) in Table-1 above. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs.315/- (Rupees Three Hundred and Fifteen only) for the year 2022-23 and is subject to revision every year as per the provisions of the said rules.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: TABLE 5 Maximum number of one way Amount Payable Period of validity journeys allowed One and half times the fee for one way Twenty-four hours from the time of Two journey payment Two-third of amount of the fee Fifty One month from the date of payment payable for fifty single journeys 6. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 7. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc., shall be as per definitions specified in the said rules. 9. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules. 10. Based on the Base rate of Fee per km for the base year 2007-2008 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by 'National Highway Authority of India' on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language. 11. The estimated capital cost of the project is Rupees 749.07 Crores. (The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting etc). 'National Highway Authority of India' shall maintain a record of the recovery of capital cost through user fee realised and after recovery of the capital cost; the fee leviable shall be reduced to 40 % of the rates and shall be revised annually in accordance with the said rules.
