L.-33004/99 सी.जी.-डी.एल.-अ.-02032023-244030 xxxGIDHxxx CG-DL-E-02032023-244030 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 913] नई दिल्ली, बधु वार, माच ग1, 2023/फाल्ग नु 10, 1944 No. 913] NEW DELHI, WEDNESDAY, MARCH 1, 2023/PHALGUNA 10, 1944 सड़क पररवहन और रािमाग गमत्रं ालय अजधसचू ना नई दिल्ली, 1 माचग, 2023 का.आ. 950(अ).—िबदक, केन्द्र सरकार ने राष्ट्रीय रािमागग अजधजनयम, 1956 (1956 का 48) की धारा 5 के अधीन िारी की गई भारत सरकार के सड़क पररवहन और रािमागग मंत्रालय की अजधसूचना सं. का. आ. 2530(अ), दिनांदकत 17 जसतंबर, 2015 के द्वारा आंध्र प्रिेि राज्य में राष्ट्रीय रािमागग 214ए (नया रारा-216) के दकमी 84.550 से दकमी 124.200 (मछलीपट्टनम से अवनीगड्डा) तक के खंड को आंध्र प्रिेि राज्य सरकार को सुपुि गकर दिया ह;ै अत: अब, राष्ट्रीय रािमागग फीस (िरों का जनधागरण और संग्रहण) जनयम, 2008 (िो इसके आग े ‘जनयम’ के रूप में उजल्लजखत ह)ै के जनयम 3 के साथ परित राष्ट्रीय रािमागग अजधजनयम, 1956 (1956 का 48) की धारा 7 द्वारा प्रित्त िजियों का प्रयोग करते हुए, केन्द्रीय सरकार, एतिद्वारा आंध्र प्रिेि राज्य में जडिाइन दकमी 82.300 से दकमी 117.060 (मौिूिा दकमी 84.550 से दकमी 124.200 तक) राष्ट्रीय रािमागग 214ए (नया रारा– 216) के मछलीपट्टनम से अवनीगड्डा तक के खंड के पेव्ड िोल्डसग सजहत िो लेन के उपयोग के जलए नीचे िी गई ताजलका 1 के कॉलम (1) में जवजनर्िगष्ट वाहनों के प्रकार पर दकमी 20.940 दकमी जनवल सड़क खंड लंबाई के और 2.110 दकमी (0.211 दकमी की कुल लंबाई वाली) की समतुल्य संरचना लंबाई (60 मीटर से अजधक की लंबाई वाले) के जलए ताजलका 1 के कॉलम (2) में जवजनर्िगष्ट िर पर और िस करोड़ रु. या इससे अजधक लागत वाले 13.609 दकमी लंबाई के बाइपास के जलए ताजलका 1 के कॉलम (2) में जवजनर्िगष्ट आधार िर के नब्बे प्रजतित िर पर यांजत्रक वाहनों पर फीस उिगृहीत करती ह ै तथा भारतीय राष्ट्रीय रािमागग प्राजधकरण को उसके अजधकाररयों अथवा दकसी िेकेिार के माध्यम से उि फीस के संग्रहण के जलए प्राजधकृत करती ह,ै अथागत्:- 1359 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ताजलका-1 वाहन का प्रकार आधार वर् ग2007-08 के जलए प्रजत दकमी आधार फीस िर (रु. म)ें (1) (2) कार, िीप, वैन या हल् के मोटर वाहन 0.65 हल्के वाजणजज्यक वाहन, हल्के माल वाहन या जमनी बस 1.05 बस या रक (िो धुरी) 2.20 तीन धुरी वाजणजज्यक वाहन 2.40 भारी जनमागण मिीनरी (एचसीएम) या अथग मूववंग उपस्ट्कर (ईएमई) या बहु धुरीय 3.45 वाहन (एमएवी) (चार से छ: धुरी) जविाल आकार के वाहन (सात या अजधक धुरी) 4.20 1. इसके अंतगगत उिगृहीत और संगृहीत की िाने वाली फीस ऐसे फीस प्लािाओं के जलए जवजनर्िगष्ट जनवल सड़क लंबाई हते ु जनम्नजलजखत पथकर प्लािा में िेय और संिेय होगी:- ताजलका-2 फीस प् लािा की अवजस्ट्थजत (चनै िे ) लंबाई (दकमी म)ें जिसके जलए फीस सिं ेय है िर, जिस पर फीस सिं ये ह ै। आंध्र प्रिेि के कृष्णा जिले में मोजपिेवी गांव 20.940 दकमी ऊपर ताजलका-1 में उजल्लजखत आधार के पास रारा-216 (पुराना रारा-214ए) के िरों का पेव्ड िोल्डसग सजहत िो लेन के [बाइपास की लंबाई (>10 करोड़ रु. लागत दकमी 116+332 पर जलए 60% वाले) और संरचना की लंबाई (>60मी) को छोड़कर] 2. उपयुगि के अजतररि, ऐसे फीस प्लािाओं के जलए जवजनर्िगष्ट बाइपासों की जनवल लंबाई के जलए जनम्नजलजखत िुल्क प्लािा पर 10 करोड़ रु. अथवा अजधक लागत वाले बाइपास के उपयोग हते ु जनम्नजलजखत िुल्क भी िेय और संिेय होगी :- ताजलका-3 फीस प्लािा की बाइपास का िुरू होन ेवाला जमलन ेवाला बाइपास की लबं ाई और लागत, िर, जिस पर अवजस्ट्थजत (चनै िे ) नाम जिसके जलए अजतररि िल्ु क िये फीस सिं ये ह ै है लंबाई (दकमी लागत (करोड़ म)ें रु. म)ें आंध्र प्रिेि के रारा-216 का जडिाइन जडिाइन 7.869 35.35 करोड़ रु. ऊपर ताजलका- कृष् णा जिले में मछलीपट्टनम दकमी 82.300 दकमी90.300 1 में मोजपिेवी गांव के बाइपास (मौिूिा (मौिूिा उजल् लजखत पास रारा-216 आधार िरों का दकमी 84.550) दकमी95.510) (पुराना रारा- पेव् ड िोल् डसग रारा-216 के जडिाइन जडिाइन 5.74 27.42 करोड़ रु. सजहत िो लेन 214ए) के दकमी चल् लापल् ली दकमी 104.700 दकमी110.440 के जलए 90% 116+332 पर बाइपास (मौिूिा (मौिूिा दकमी 110.545) दकमी117.500) बाइपास की कुल 13.609 62.77 करोड़ रु. लंबाई[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 3. उपयुगि के अजतररि, जनम्नजलजखत टोल प्लािा (प्लािाओं) पर 60 मीटर से अजधक लंबाई वाली जनम्नजलजखत अवसंरचनाओं के उपयोग के जलए 10 के समतुल्य गुणक द्वारा ऐसी अवसंरचनाओं की लंबाई को गुणा करके रािमागग की समतुल्य लंबाई में अवसंरचनाओं की लंबाई को पररवर्तगत करके जनम्नजलजखत फीस भी िेय और संिेय होगी:- ताजलका-4 टोल प्ल ािा की अवजस्ट्थजत समतल्ु य सड़क लबं ाई म ें समतल्ु य सड़क लबं ाई (दकमी िर, जिस पर फीस सिं ये ह ै पररवर्ततग दकए िान े के जलए म)ें (चनै िे ) अवसंरचनाओं की लबं ाई. (तीन सौ पंरह रुपए मात्र) ह ै और उि जनयमों के प्रावधानों के अनुसार प्रजतवर्ग संिोधन के अध्यधीन है। 5. रािमागग खंड पर बहुल यात्राओं के जलए जनम्नजलजखत िरों पर पास िारी दकए िाएंग,े अथागत् ताजलका-5 भुगतान-योग्य धनराजि अनमु त एकतरफा यात्राओं की अजधकतम वैधता की अवजध सख्ं य ा एकतरफा यात्रा के जलए फीस का डेढ़ िो भुगतान के समय से चौबीस घंटे गुना पचास एकल यात्राओं के जलए भुगतान- पचास भुगतान की तारीख से एक महीना योग्य फीस की राजि का िो-जतहाई 6. फीस प्लािा जस्ट्थत होने वाले जिले में पंिीकृत वाजणजज्यक वाहनों (राष्ट्रीय परजमट के अधीन प्रचाजलत दकए िा रह े वाहनों को छोड़कर) के जलए फीस उस श्रेणी के वाहन हते ु जनधागररत िर की 50% होगी, बिते दक ऐसे वाजणजज्यक वाहनों के प्रयोग के जलए कोई सर्वगस रोड या वैकजल्पक सड़क उपलब्ध न हों। 7. संबंजधत श्रेणी के वाहनों के जलए जवजनर्िगष्ट अनुज्ञेय भार से अजधक भार लि े यांजत्रक वाहन का चालक या स्ट्वामी या प्रभारी व्यजि, राष्ट्रीय रािमागग पर अजतभार लि े वाहन के प्रवेि के जलए टोल संग्रहण एिेंसी को ऐसी श्रेणी के वाहनों के प्रवेि जलए, कजथत जनयमों के जनयम 10 के उप-जनयम 1ए के अनुसार अनुप्रयोज्य फीस के समतुल्य फीस का भुगतान करने के जलए उत्तरिायी होगा और वह रािमागग खंड का प्रयोग करने के जलए तब तक हकिार नहीं होगा िब तक ऐसे यांजत्रक वाहन से लिा अजतभार हटाया नहीं िाता। 8. सभी पररभार्ाएं, यांजत्रक वाहनों की श्रेणी, इनके अनुज्ञेय भार, छूट प्राप्त वाहनों की श्रेणी, सर्वगस रोड, वैकजल्पक सड़क इत्यादि पूवोि जनयमों में जवजनर्िगष्ट पररभार्ाओं के अनुरूप होंगी। 9. फीस की िरें उि जनयमों के जनयम 12 के अनुसरण में प्रयोिाओं के सूचनाथग प्रिर्िगत करनी होंगी।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 10. यांजत्रक वाहनों से फीस की वास्ट्तजवक राजि उपयुगि ताजलका-1 में यथा-उजल्लजखत आधार वर्ग 2007-08 के जलए प्रजत दकमी फीस की आधार िर के आधार पर प्रभाररत होगी और छूटों की गणना भारतीय राष्ट्रीय रािमागग प्राजधकरण द्वारा खंड की पूरी हो गई लंबाई के आधार पर की िाएगी और उसे उि जनयमों के जनयम 5 के अनुसार प्रजत वर्ग संिोजधत दकया िाएगा तथा तिनुसार उसे अंग्रेिी और क्षेत्रीय भार्ा के कम से कम एक-एक समाचार पत्र में प्रकाजित दकया िाएगा। 11. इस पररयोिना की प्राक्कजलत पूंिीगत लागत 465.71 करोड़ रु. ह।ै भूजम अजधग्रहण, सावगिजनक िन सुजवधाओं के स्ट्थानांतरण, पेड़ों को काटने, आदि कायगकलापों को अभी पूरा दकया िाना ह ै इसजलए, पूंिीगत लागत पररवतगन के अध्यधीन ह ै और अंजतम पूंिीगत लागत को पृथक रूप से अजधसूजचत दकया िाएगा। प्राप्त प्रयोिा फीस के माध्यम से वसूल की गई पूंिीगत लागत का भारतीय राष्ट्रीय रािमागग प्राजधकरण द्वारा ररकाडग रखा िाएगा तथा पूंिीगत लागत की वसूली के पश्चात् उिग्राह्य फीस घटाकर िरों के 40% तक कर िी िाएगी और कजथत जनयमों के अनुसरण में वार्र्गक रूप से संिोजधत की िाएगी। [फा. सं. एमओआरटीएच/पीआईयू/एमपीटी/एनएच-216/16-17/10/टोल नोरटदफकेिन] सुमन प्रसाि वसंह, संयुक् त सजचव MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 1st March, 2023 S.O. 950(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O 2530(E) dated 17th September 2015, issued under section 05 of the National Highways Act, 1956 (48 of 1956), the Central Government has entrusted the stretch from Kilometer 84.550 to Kilometer 124.200 (Machilipatnam to Avanigadda) of National Highway No.214A (New NH-216) in the state of Andhra Pradesh to the State Government of Andhra Pradesh. Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules,2008 (hereinafter referred to as the “said rules”), the Central Government hereby levies the fee on mechanical vehicles at the rate specified in column (2) of the Table 1 for net road section length of 20.940 Km and for equivalent structure length (having length more than 60m) of 2.110Kms(having total length of 0.211 Kms) and at ninety percent of the base rate for bypasses having length of 13.609 Kms costing rupees ten crores or more on the type of vehicles specified in column(1) of Table 1 below for the use of two lane with paved shoulders of the Machilipatnam to Avanigadda section of National Highway number NH-214A [New NH-216)] from design Km82.300to Km.117.060 (Existing km.84.550 to km.124.200) in the state of Andhra Pradesh and authorizes the National Highways Authority of India to collect, either through its officials or through a Contractor, the said fee, namely:- TABLE-1 Base rate of fee per km for the base year Type of vehicle 2007-08 (in Rupees) (1) (2) Car, Jeep, Van or Light Motor Vehicle 0.65 Light Commercial Vehicle, Light Goods Vehicle or Minibus 1.05 Bus or Truck (Two Axles) 2.20 Three-axle Commercial Vehicles 2.40 Heavy Construction Machinery (HCM) or Earth Moving Equipment 3.45 (EME) or Multi Axle Vehicle (MAV) (four to six axles) Oversized Vehicles (seven or more axles) 4.20[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 1. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs.315.00 (Three Hundred and Fifteen rupees only) for the year 2022-23 and is subject to revision every year as per the provisions of the said rules. 5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: - TABLE-5 Maximum number of one-way Amount payable Period of validity journeys allowed One and half times of the fee for one- Twenty-four hours from the time of Two way journey payment Two-third of amount of the fee payable Fifty One month from date of payment. for fifty single journeys 6. Fee for commercial vehicle (excluding vehicle plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 7. The driver or owner a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 8. All definition including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules. 9. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules. 10. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the National Highways Authority of India on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and same shall be published in at least one newspaper in English and vernacular language. 11. The estimated capital cost of the project is Rupees 465.71Crore.[The capital cost is subject to variation as the activities of land acquisition, utility shifting, Tree cutting, etc. are yet to be completed and the final capital cost will be notified separately]. The National Highways Authority of India shall maintain a record of the recovery of capital cost through user fee realized recovery of capital and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
