सारणी-4.2 टोल प्ल ािा का स्ट्थ ान (जवद्यमान सड़क की लबं ाई के समकि सड़क लबं ाई िर जिस पर िल्ु क भगु तान योग्य ह ै दकलोमीटर[दकमी]) समान पररवर्ततग (दक.मी. म)ें बुजनयािी ढाचं ा की लबं ाई (दक.मी. म)ें उत्तर प्रिेि राज्य के मुिफ्फरनगर चार या अजधक लने के जलए, ऊपर जिले में छपार गांव के पास राष्ट्रीय सारणी-1 में उजल्लजखत आधार िरों का रािमागग-58(पुराना)/ राष्ट्रीय 100% रािमागग-334 (नया) के जडज़ाइन 1.186^ 11.860 दकमी 138.552 पर। ^संरचनाओं (>60 मीटर लंबाई वाली) का ब्योरा इस प्रकार ह: ै चने ज़े आरंभ चने ज़े समाि सरं चना का प्रकार कुल लबं ाई (दकमी) क्रम स.ं (दकमी पर) (दकमी पर) 1 164.332 164.468 बड़ा पुल 0.136 2 162.670 163.330 ग्रेड सेपरेटर 0.660 3 165.105 165.495 ग्रेड सेपरेटर 0.390 कुल लंबाई 1.1866 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 4. प्राजधकरण यांजत्रक वाहनों पर लगाए िाने वाल े प्रयोक्ता िुल्क िर का जनधागरण करते समय राष्ट्रीय रािमागग िल्ु क जनयमों के जनयम 4(5) और जनयम 4(6) का अनुपालन सुजनजश्चत करेगा, िैसा दक ताजलका-1 में जवजनर्िगष्ट ह।ै 5 गैर-वाजणजज्यक प्रयोिनों के जलए पंिीकृत यांजत्रक वाहन के स्ट् वामी और पथकर प्ल ाज़ा से बीस दक.मी. की िरू ी के भीतर जनवास करन े वाल े व् यजक्त के जलए माजसक पास की िर वर् ग 2024-25 के जलए 340.000/-रूपए (तीन सौ चालीस रूपए मात्र) ह ैऔर उक्त जनयमों के प्रावधानों के अनुसार प्रजतवर् ग संिोधन के अध् यधीन ह।ै 6. रािमागग खण्ड पर बहुयात्राओं हते ु पास जनम्नजलजखत िरों पर िारी दकया िाएगा, अथागतः् अनज्ञु ात एकतरफा यात्राओं की अजधकतम सख्ं या सिं ेय धनराजि जवजधमान्द्यता की अवजध एकतरफा यात्रा के जलए िल्ु क का डेढ़ िो भुगतान के समय से चौबीस घंटे गुना पचास एकल यात्राओं के जलए भुगतान भुगतान की तारीख से एक मास िुल्क की राजि का िो-जतहाई पचास 7. िुल्क प्लािा जस्ट्थत होन े वाले जिले म ें पंिीकृत वाजणजज्यक वाहनों (राष्ट्रीय परजमट के अधीन प्रचाजलत दकए िा रह े वाहनों को छोड़कर) के जलए िल्ु क उस श्रेणी के वाहन हते ु जनधागररत िर की 50% होगी, बिते दक ऐस े वाजणजज्यक वाहनों के प्रयोग के जलए कोई सर्वगस रोड या वैकजल्पक सड़क उपलब्ध न हो। 8. दकसी यांजत्रक वाहन पर जनयमों के अंतगगत उसकी श्रणे ी के जलए जनर्िष्टग अनज्ञु ेय भार स ेअजधक भार लिा हुआ है, तो उस े प्लािा पार करने के जलए राष्ट्रीय रािमागग का उपयोग करने की अनुमजत तब तक नहीं िी िाएगी िब तक दक ऐसे यांजत्रक वाहन से लिा अजतभार हटाया नहीं िाता। संबंजधत श्रेणी के वाहनों के जलए जवजनर्िगष् ट अनज्ञु ेय भार से अजधक भार लि े यांजत्रक वाहन का चालक या स्ट् वामी या प्रभारी व्यजक्त, उक्त जनयमों में लागू प्रावधान के अनसु ार िुल्क संग्रहण एिेंसी को राष्ट्रीय रािमागग पर अजतभाररत वाहन के प्रवेि के जलए िल्ु क का भुगतान करन े के जलए उत्तरिायी होगा, अथागत:् - अजधकतम अनज्ञु ये सकल वाहन भार स े आधार िर म ेंगणु न कारक िल्ु क अजधक भार का प्रजतित (1) (2) (3) 0% स े 20% िो >20% स े 40% चार [(जनयम 4 के उपजनयम (2) के अंतगतग यांजत्रक >40% स े 60% छह वाहन की ऐसी श्रेणी के जलए लागू िल्ु क) x (गणु न कारक)] >60% स8े 0% आि >80% और उससे अजधक िस 9. उक्त जनयमों के जनयम 12 के अनुसार, उपयोगकतागओं की िानकारी के जलए िल्ु क की िरों को प्रिर्िगत दकया िाएगा। 10. यांजत्रक वाहनों से िुल् क की वास्ट् तजवक राजि उपयुगक्ट त ताजलका-1 में यथा-उजल्लजखत, आधार वर् ग 2007-08 के जलए प्रजत दकलोमीटर िल्ु क की आधार िर के आधार पर प्रभाररत होगी और छूटों की गणना प्राजधकरण द्वारा की िाएगी। प्राजधकरण द्वारा इसे कंसेसनेयर के माध्यम से अग्रं ेिी और स्ट्थानीय भार्ा में कम से कम एक समाचार पत्र में प्रकाजित कराया िाएगा और उसके बाि उक्त जनयम के जनयम 5 और ररयायत करार के उपबंधों के अनुसार इसे प्रजतवर्ग सिं ोजधत दकया िाएगा और प्रकाजित दकया िाएगा; तथाजप, बित े दक ऐसा संिोधन िल्ु क के पूववग ती संिोधन की तारीख स े 6 (छह) महीन े की अवजध तक प्रभावी नहीं होगा। [फा. सं. जवत्तअनुभाग-16012(12)/1/2024-O/o मप्र.(जवत्त-II)-भाग(3)/ई-249666] कमलिे चतुवेिी, सयक्तु सजचव[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 27th March, 2025 S.O. 1494(E).— Whereas, by the notification of the Government of India in the Ministry of Road Transport and Highways, number S.O. 386 (E) dated 16th February 2010, issued under section 11 of the National Highway Authority of India Act 1988 ( 68 of 1988) , the Central Government has entrusted the Highway from km 131.000 to km 218.200 of NH-58 in the state of Uttar Pradesh and Uttarkhand to the National Highways Authority of India (hereinafter referred to as the “Authority”); And whereas, pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an Agreement (hereinafter referred to as said agreement) with NHIT Southern Projects Private Limited ("NSPPL"), and having its registered office at 325, 3rd Floor, D21 Corporate Park, Sector 21. Dwarka, Dhulsiras, New Delhi, South West Delhi-110077. (hereinafter referred to as “Concessionaire”) on 12.03.2025 for the Tolling, Operation, Maintenance and Transfer of Muzzafarnagar - Haridwar Section from Km 130.560 to Km 209.120 (Existing Km 131.000 to Km. 211.000) of National Highway No. 58 (Old) (New NH 334 and NH 34), in the State of Uttar Pradesh and Uttarakhand of the National Highway. Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008, and any other its amendments till signing of the Agreement and in supersession of the Notification Number S.O. No. 3890(E) dated 29th October, 2020 except as respect things done or omitted to be done before such supersession, the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said section of the said national highway, interest on the capital invested, reasonable return, the volume of traffic and the period of said agreement between the Authority and the Concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the Four lane Muzzafarnagar - Haridwar Section from Km 130.560 to Km 166.000 of Old NH 58 (New NH 334) Section in the State of Uttar Pradesh and Uttarkhand (hereinafter referred to as the “said section’), for Before completion of construction of Grade Separator at Km 163+000, and Km 165+300: - Net road length of 27.595 km (Table 2.1) at the rates specified in Column (2) of Table 1 below, and for equivalent structure length (having more than 60m) of 1.36 km (having length 0.136 km, Table 4.1), and one and half times of the base rate for use of bypasses, costing rupees ten crore or more, having total net length of 7.709 km (Table 3) on the type of vehicles specified in Column (1) of Table 1 below, and authorises the said Concessionaire to collect and retain the fee on and from the date of commercial operation or publication of this Notification in the Official Gazette, whichever is later, till the termination date as specified in the agreement. The Authority shall ensure compliance with Rule 4(5) and Rule 4(6) of the NH Fee Rules while determining the user fee rate to be levied on mechanical vehicles, as specified in Table-1. 5. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometres from the fee plaza is Rs. 340.00 (Rupees Three Hundred Fourty only) for the year 2024-25 which is subject to revision every year as per the provisions of the said rules. 6. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 8. A mechanical vehicle which is loaded in excess of permissible load specified for its category under the rules, shall not be permitted to use the National Highway for crossing the plaza until the excess load has been removed from such mechanical vehicle. The driver or owner or a person in-charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency as per the applicable provision in the said rules, namely: - Percentage of excess load over Multiplying Factor to Maximum Permissible Gross Fees Vehicular Weight the base rate (1) (2) (3) 0% to 20% Two >20% to 40% Four [(Fees applicable for such category of mechanical vehicle under sub-rule >40% to 60% Six (2) of rule 4) x >60% to 80% Eight (Multiplying factor)] >80% and above Ten 9. The Fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules. 10. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority. The same shall be got published by the Authority in at least in at least one newspaper in English and vernacular language through the Concissionaire and thereafter revised annually in accordance with the rule 5 of the said rules and provisions of the Concession Agreement and will be published; provided, however, that such revision shall not be effected until a period of 6 (six) months from the date of the preceding revision of fee.
