L.-33004/99 सी.जी.-डी.एल.-अ.-28032025-262041 CG-DxLx-xEG-I2D8H0x3x2x0 25-262041 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 1475] नई दिल्ली, बृहस्ट्प जतवार, माच ग27, 2025/चत्रै 6, 1947 No. 1475] NEW DELHI, THURSDAY, MARCH 27, 2025/CHAITRA 6, 1947 सड़क पररवहन और रािमाग गमत्रं ालय अजधसचू ना नई दिल्ली, 27 माच,ग 2025 का. आ. 1493(अ).— यतः, केन्द्रीय सरकार न,े भारतीय राष्ट्रीय रािमाग ग प्राजधकरण अजधजनयम, 1988 (1988 का 68) की धारा 11 के अधीन िारी की गई भारत सरकार के सड़क पररवहन और रािमागग मंत्रालय की अजधसूचना संख्या का.आ. 386 (अ), दिनाकं 16 फरवरी 2010 द्वारा उत्तर प्रिेि राज्य में राष्ट्रीय रािमागग-58 के दकमी 131.000 से दकमी 218.200 तक का खंड भारतीय राष्ट्रीय रािमागग प्राजधकरण (जिस े इसके पश्चात ् ‘प्राजधकरण’ कहा िाए) को सुपुि ग दकया ह;ै और यतः, भारतीय राष्ट्रीय रािमागग प्राजधकरण अजधजनयम, 1988 (1988 का 68) की धारा 14 के प्रावधान के अनुसरण में, प्राजधकरण ने एनएचआईटी साउिनग प्रोिेक्ट्स प्राइवेट जलजमटेड ("एनएसपीपीएल"), और जिसका पंिीकृत कायागलय 325, तीसरा तल, डी21 कॉपोरेट पाकग, सेक्टटर 21, द्वारका, धलू जसरस, नई दिल्ली, िजिण पजश्चम दिल्ली- 110077 में ह ै (जिसे इसके पश्चात "कंसेसनेयर" कहा िाए) के साथ 12.03.2025 को उत्तर प्रिेि और उत्तराखंड राज्य म ें राष्ट्रीय रािमागग-58 (पुराना) (नया राष्ट्रीय रािमागग 334 और 34) के दकमी 130.560 स ेदकमी 209.120 तक (जवद्यमान दकमी 131.000 स े दकमी 211.000 तक) मिु फ्फरनगर-हररद्वार खंड (जिसे इसके पश्चात उक्त खंड कहा िाए) पर टोल लगान,े संचालन, अनुरिण और हस्ट्तांतरण के जलए एक करार (जिसे इसके पश्चात उक्त करार कहा िाए) दकया ह।ै 2197 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अब, इसजलए, राष्ट्रीय रािमाग ग िुल्क (िर अवधारण एवं संग्रहण) जनयम, 2008 के जनयम 3 (जिसे इसके पश्चात “जनयम’’ कहा िाए) के साथ परित राष्ट्रीय रािमागग अजधजनयम, 1956 (1956 का 48) की धारा 8ए द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए और करार पर हस्ट्तािर होने तक इसके अजधसूजचत दकसी भी अन्द्य संिोधन और ऐसे अजधक्रमण स े पहले की गई या करन े से छूटी हुई बातों को छोड़कर अजधसूचना संख्या का.आ. संख्या 1168 (अ) दिनांक 05 माचग 2024 और का.आ. संख्या 280 (अ) दिनांक 20 िनवरी 2021 का अजधक्रमण करत े हुए केंर सरकार, उक्त खंड के जनमाणग , अनुरिण, प्रबंधन और संचालन म ें िाजमल व्यय, जनवेि की गई पूंिी पर ब्याि, उजचत ररटनग, यातायात की मात्रा और प्राजधकरण और कंसेसनेयर के साथ दकए गए करार की अवजध को ध्यान म ें रखते हुए, एतिद्वारा अजधसूजचत करती ह ै दक उत्तराखडं राज्य म ें परु ाना राष्ट्रीय रािमागग-58 (नया राष्ट्रीय रािमाग ग 334 और 34) के खडं पर दकमी 166.000 स े दकमी 209.120 तक चार लने रािमाग ग मिु फ्फरनगर – हररद्वार खडं (जिसे इसके पश्चात “उक्त खडं ” कहा िाए), के उपयोग के जलए दकमी 195.400 पर ग्रडे सपे रेटर का जनमाणग पणू गहोन ेस ेपहल:े - नीचे िी गई ताजलका 1 के कॉलम (1) म ें जवजनर्िगष्ट वाहनों के प्रकार पर जनवल सड़क खडं लबं ाई 22.621 दकमी (सारणी- 2.1) और िो लेन/पेव्ड िोल्डस ग सजहत िो लने जनवल सड़क खडं लंबाई 0.397 दकमी (सारणी-2.1) 37.50 दकमी (3.750 दकमी की लंबाई वाली, सारणी 4.1) समतल्ु य सरं चना लंबाई (60 मीटर से अजधक लंबाई वाली) और 6.530 दकमी (0.653 दकमी िो लने सरं चना की लंबाई वाली, सारणी 4.1) िो लने समतुल्य संरचना लंबाई (60 मीटर स े अजधक लंबाई वाली) के जलए यांजत्रक वाहनों पर नीचे ताजलका -1 के कॉलम (2) में जवजनर्िगष्ट िरों के 60% पर और 10 करोड़ रू. या उससे अजधक की लागत वाल े 16.224 दक.मी. कुल जनवल लंबाई (सारणी 3) वाल े बाईपास के जलए आधार िर के डढ़े गुना िर पर िल्ु क उद्ग्रहीत और संग्रहीत दकया िाएगा, तथा उक्त कंसेसनेयर को वाजणजज्यक संचालन की जतजथ या प्रकािन या आजधकाररक रािपत्र में इस अजधसूचना के प्रकािन की जतजथ, िो भी बाि में हो, से लेकर करार में जवजनर्िगष्ट समाजि की जतजथ तक िुल्क संग्रहीत और प्रजतधाररत करने के जलए प्राजधकृत करती ह।ै दकमी 195.400 पर ग्रडे सपे रेटर का जनमाणग पणू गहोन ेके पश्चात : - नीचे िी गई ताजलका 1 के कॉलम (1) म ें जवजनर्िगष्ट वाहनों के प्रकार पर जनवल सड़क खडं लबं ाई 22.531 दकमी (सारणी- 2.2) और िो लेन/पेव्ड िोल्डस ग सजहत िो लने जनवल सड़क खडं लंबाई 0.397 दकमी (सारणी-2.2) 38.40 दकमी (3.840 दकमी की लंबाई वाली, सारणी 4.2) समतल्ु य सरं चना लंबाई (60 मीटर से अजधक लंबाई वाली) और 6.530 दकमी (0.653 दकमी िो लने सरं चना की लंबाई वाली, सारणी 4.2) िो लने समतुल्य संरचना लंबाई (60 मीटर स े अजधक लंबाई वाली) के जलए यांजत्रक वाहनों पर नीचे ताजलका -1 के कॉलम (2) में जवजनर्िगष्ट िरों के 60% पर और 10 करोड़ रू. या उससे अजधक की लागत वाल े 16.224 दक.मी. कुल जनवल लंबाई (सारणी 3) वाल े बाईपास के जलए आधार िर के डढ़े गुना िर पर िल्ु क उद्ग्रहीत और संग्रहीत दकया िाएगा, तथा उक्त कंसेसनेयर को वाजणजज्यक संचालन की जतजथ या प्रकािन या आजधकाररक रािपत्र में इस अजधसूचना के प्रकािन की जतजथ, िो भी बाि में हो, से लेकर करार में जवजनर्िगष्ट समाजि की जतजथ तक िुल्क संग्रहीत और प्रजतधाररत करने के जलए प्राजधकृत करती ह।ै सारणी-1 वाहन का प्रकार आधार वर् ग2007-08 के जलए प्रजत दक.मी. आधार िल्ु क िर (रुपए म)ें (1) (2) कार, िीप, वैन अथवा हल् के मोटर वाहन 0.65 हल् के वाजणजज्यक वाहन, हल् के मालवाहक वाहन अथवा जमनी बस 1.05 बस अथवा रक (िो धुरी वाल)े 2.20[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 तीन धरु ी वाल ेवाजणजज्यक वाहन 2.40 भारी जनमागण मिीनरी (एच.सी.एम.) अथवा अथ गमूववंग उपस्ट्कर 3.45 (ई.एम.ई) अथवा बहुधुरीय वाहन (एम.ए.वी.) And whereas pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an Agreement (hereinafter referred to as said agreement) with NHIT Southern Projects Private Limited ("NSPPL"), and having its registered office at 325, 3rd Floor, D21 Corporate Park, Sector 21. Dwarka, Dhulsiras, New Delhi, South West Delhi-110077. (hereinafter referred to as “Concessionaire”) on 12.03.2025for the Tolling, Operation, Maintenance and Transfer of Muzzafarnagar - Haridwar Section from Km 130.560 to Km 209.120 (Existing Km 131.000 to Km. 211.000) of National Highway No. 58 (Old) (New NH 334 and NH 34), in the State of Uttar Pradesh and Uttarakhand of the National Highway. Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and any other its amendments notified thereof till signing of the Agreement and in supersession of the Notification Number S.O. No. 1168(E) dated 5th Mar, 2024, and S.O. The Authority shall ensure compliance with Rule 4(5) and Rule 4(6) and Rule 4(11) of the NH Fee Rules while determining the user fee rate to be levied on mechanical vehicles, as specified in Table-1.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 13 4. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs. 340.00 (Rupees Three Hundred Forty only) for the year 2024-25 which is subject to revision every year as per the provisions of the said rules. 5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: Maximum number of one- Amount Payable Period of validity way journeys allowed One and half times of the fee for one- Twenty-four hours from the time of Two way journey payment Two-third of amount of the One month from date of Fifty fee payable for fifty single journeys payment 6. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 7. A mechanical vehicle which is loaded in excess of permissible load specified for its category under the rules, shall not be permitted to use the National Highway for crossing the plaza until the excess load has been removed from such mechanical vehicle. The driver or owner or a person in-charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency as per the applicable provision in the said rules, namely: Percentage of excess load over Multiplying Factor to Maximum Permissible Gross Fees Vehicular Weight the base rate (1) (2) (3) 0% to 20% Two >20% to 40% Four [(Fees applicable for such category of mechanical vehicle under sub-rule >40% to 60% Six (2) of rule 4) x >60% to 80% Eight (Multiplying factor)] >80% and above Ten 8. The Fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules. 9. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority. The same shall be got published by the Authority in at least in at least one newspaper in English and vernacular language through the Concissionaire and thereafter revised annually in accordance with the rule 5 of the said rules and provisions of the Concession Agreement and will be published; provided, however, that such revision shall not be effected until a period of 6 (six) months from the date of the preceding revision of fee.
