L.-33004/99 सी.जी.-डी.एल.-अ.-17052022-235795 xxxGIDHxxx CG-DL-E-17052022-235795 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3 Sub- section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 2134] नई दिल्ली, मगं लवार, मई 17, 2022/वि ाख 27, 1944 No. 2134] NEW DELHI, TUESDAY, MAY 17, 2022/VAISAKHA 27, 1944 सड़क पररवहन और रािमाग गमत्रं ालय अजधसचू ना नई दिल्ली, 13 मई, 2022 का.आ. 2249(अ).—िबदक, केन्‍द र सरकार ने रा्ीय रािमागग अजधजनयम, 1956 (1956 का 48) की धारा 5 के अधीन िारी की गई भारत सरकार के सड़क पररवहन और रािमागग मंत्रालय की अजधसूचना सं. का. आ. 1054(अ), दिनांदकत 12 माचग, 2020 के द्वारा रारा-548डी [महारा् राज्य की बीओटी पररयोिना के तहत तलेगांव िाभाडे, चाकन, जिकरापुर, नवरा खंड के दकमी 0/00 से दकमी 83/551 तक को छोडकर] खंड को महाराष्‍ट र राज्य सरकार को सुपुि गकर दिया ह ; अत: अब, राष्‍ट रीय रािमागग ीस (िरों का जनधागरण और संग्रहण) जनयम, 2008 और समय समय पर संिोजधत (िो इसके आग े ‘जनयम’ के रूप में उजल् लजखत ह ) के जनयम 3 के साथ परित राष्‍ट रीय रािमागग अजधजनयम, 1956 (1956 का 48) की धारा 7 द्वारा प्रित् त िजतिययों का प्रयोग करते ुए, केन्‍दर सरकार, एतद्द्वारा महाराष्‍ट र राज्य में राष्‍ट रीय रािमागग 548डी (लंबाई-32.172 दकमी) के मंिरसुंभ से चुम्बली ाटा तक खंड के जडिाइन दकमी 137+300 से दकमी 169+472 (मौिूिा दकमी 45+877 से दकमी 13+689) तक 2.2 दकमी [चार अथवा अजधक लेन के खंड के उपयोग के जलए] के जलए ताजलका 1 के कॉलम (2) में जवजनर्िष्टग िर के 100% पर और 29.972 दकमी जनवल सड़क खंड लंबाई [पेव्ड िोल्डर सजहत िो लेन के खंड के उपयोग के जलए] के जलए ताजलका 1 के कॉलम (2) में जवजनर्िष्टग िर के 60% पर नीचे िी गई ताजलका 1 के कॉलम (1) में जवजनर्िष्‍टग ट वाहनों के प्रकार पर ीस उिगहहीत करती ह तथा भारतीय राष्‍ट रीय रािमागग प्राजधकरण को उसके अजधकाररयों अथवा दकसी िेकेिार के माध्य म से उ्‍ त ीस के संग्रहण के जलए प्राजधकहत करती ह ,अथागत-् : 3280 GI/2022 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ताजलका-1 वाहन का प्रकार आधार वर् ग 2007-08 के जलए प्रजत दकमी आधार ीस िर (रु. म)ें (1) (2) कार, िीप, व न या हल् के मोटर वाहन 0.65 हल्के वाजणजज्य क वाहन, हल्के माल वाहन या जमनी बस 1.05 बस या रक (िो धुरी) 2.20 तीन धुरी वाजणजज्य क वाहन 2.40 भारी जनमागण मिीनरी (एचसीएम) या अथग मूववंग उपस्ट् कर (ईएमई) या बु धुरीय वाहन 3.45 (एमएवी) (चार से छ: धुरी) जविाल आकार के वाहन (सात या अजधक धुरी) 4.20 1. इसके अंतगगत उिगहहीत और संगहहीत ीस ऐस ेपथकर प्ल ािा क के अंतगगत जवजनर्िष्‍टग ट िरू ी हते ु जनम् नजलजखत पथकर प्ल ािा क म ें िये और संिये होगी:- ताजलका-2 पथकर प् लािा की अवजस्ट्थ जत लंबाई (दकमी म)ें , जिसके जलए ीस सिं ेय ह िर, जिस पर ीस सिं ये ह । (चन िे ) महारा् राज्य के बीड जिले में 29.972 दकमी पेव् ड िोल् डर सजहत िो लेन के जलए पपर गांव-व द्यककंही, के पास जडिाइन ताजलका-1 में उजल् लजखत आधार िरों का दकमी 154+400 (मौिूिा दकमी 60% 29+300) पर। 2.200 दकमी चार और उससे अजधक लेन के जलए पपर ताजलका-1 में उजल् लजखत आधार िरों का 100% 2. ग र-वाजणजज्य क प्रयोिनों के जलए पंिीकहत यांजत्रक वाहन के स्ट् वामी और पथकर प्ल ािा से बीस दकमी की िरू ी के भीतर जनवास करने वाले व् यज्‍ त के जलए माजसक पास की िर वर्ग 2021-22 के जलए 285.00 रु. (िो सौ जपचासी रुपए मात्र) ह और राष्‍ट रीय रािमागग िुल् क (िरों का जनधागरण और संग्रहण) जनयमावली, 2008 के जनयमों के प्रावधानों के अनुसार और प्रजतवर्ग संिोधन के अध्य धीन ह। 3. रािमागग खंड पर बुल यात्रा क के जलए जनम् नजलजखत िरों पर पास िारी दकए िाएंगे, अथागत् ताजलका-3 भुगतान-योग्य धनराजि अनमु त एकतर ा यात्रा क की अजधकतम व धता की अवजध सख्ं य ा एकतर ा यात्रा के जलए ीस का डेढ़ गुना िो भुगतान के समय से चौबीस घंटे पचास एकल यात्रा क के जलए भुगतान- पचास भुगतान की तारीख से एक महीना योग्य ीस की राजि का िो-जतहाई[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 4. ीस प्ल ािा जस्ट् थत होने वाले जिले में पंिीकहत वाजणजज्य क वाहनों (राष्‍ट रीय परजमट के अधीन प्रचाजलत दकए िा रह े वाहनों को छोड़कर) के जलए ीस उस श्रेणी के वाहन हते ु जनधागररत िर की 50% होगी, बिते दक ऐसे वाजणजज्य क वाहनों के प्रयोग के जलए कोई सर्वगस रोड या व कजल् पक सड़क उपल‍ ध न हों। 5. संबंजधत श्रेणी के वाहनों के जलए जवजनर्िष्‍टग ट अनु्ेय भार से अजधक भार लि े यांजत्रक वाहन का चालक या स्ट् वामी या प्रभारी व् यज्‍ त, रा्ीय रािमागग पर अजतभार लि े वाहन के प्रवेि के जलए टोल संग्रहण एिेंसी को ऐसी श्रेणी के वाहनों के प्रवेि जलए, उ्‍ त जनयमों के जनयम 10 के उप-जनयम 1ए में जवजनर्िष्‍टग ट ीस के समतुल् य ीस का भुगतान करने के जलए उत् तरिायी होगा और वह रािमागग खंड का प्रयोग करने के जलए तब तक हकिार नहीं होगा िब तक ऐसे यांजत्रक वाहन से लिा अजतभार हटाया नहीं िाता। 6. सभी पररभार्ाएं, यांजत्रक वाहनों की श्रेणी, इनके अनु्ेय भार, छूट प्राप्त वाहनों की श्रेणी, सर्वसग रोड, व कजल् पक सड़क इत् यादि पूवो्‍ त जनयमों में जवजनर्िष्‍टग ट पररभार्ा क के अनुरूप होंगी। 7. ीस की िरें उतिय जनयमों के जनयम 12 के अनुसरण में प्रयो्‍ ता क के सूचनाथग प्रिर्िगत करनी होंगी। 8. यांजत्रक वाहनों से ीस की वास्ट् तजवक राजि उपयुग्‍ त ताजलका-1 में यथा-उजल् लजखत आधार वर्ग 2007-08 के जलए प्रजत दकमी ीस की आधार िर के आधार पर प्रभाररत होगी और छूटों की गणना भारतीय रा्ीय रािमागग प्राजधकरण द्वारा खंड की पूरी हो गई लंबाई के आधार पर की िाएगी और उसे उ्‍ त जनयमों के जनयम 5 के अनुसार प्रजत वर्ग संिोजधत दकया िाएगा तथा तिनुसार उसे अंग्रेिी और क्षेत्रीय भार्ा के कम से कम एक-एक समाचार पत्र में प्रकाजित दकया िाएगा। 9. इस पररयोिना की प्रा्‍ कजलत पूंिीगत लागत 228.54 करोड़ रु. ह। [भूजम अजधग्रहण, सावगिजनक िन सुजवधा क के स्ट् थानांतरण, पेड़ों को काटने, आदि कायगकलापों को अभी पूरा दकया िाना ह इसजलए, पूंिीगत लागत पररवतगन के अध्य धीन ह और अंजतम पूंिीगत लागत को पहथक रूप से अजधसूजचत दकया िाएगा।] प्राप्त प्रयो्‍ ता ीस के माध्य म से वसूल की गई पूंिीगत लागत का भारतीय रा्ीय रािमागग प्राजधकरण द्वारा ररकाडग रखा िाएगा तथा पूंिीगत लागत की वसूली के प‍ चात् उिग्राय फ ीस घटाकर िरों के 40% तक कर िी िाएगी और कजथत जनयमों के अनुसरण में वार्र्गक रूप से संिोजधत की िाएगी। [ ा. सं. आरओ/एमयूएम/पी-1085/2016-17] अजमत वरिान,संयु्‍त सजचव MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 13th May, 2022 S.O. 2249(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 1054(E) dated 12th March 2020, issued under section 5 of the National Highways Act, 1956 (48 of 1956), the Central Government has entrusted the stretch NH- 548D [excluding Talegaon Dabhade, Chakan, Shikrapur, Nhavra section from km 0/00 to km 83/551 under BOT project of State Govt. of Maharashtra] is entrusted to the State Government of Maharashtra; Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended from time to time (hereinafter referred to as the “said Rules”), the Central Government hereby levies the fee at rate specified in column (2) in Table 1 below (hereinafter referred to as “base rate”) at 100% for net road length of 2.2 km [for use of four and more lane section] and at 60% for net road length of 29.972 km [for use of two lane with paved shoulder section] on the type of vehicles specified in column (1) of Table 1 below for the use of Manjarsumbha to Chumbali Phata from design Km. 137+300 to Km. 169+472 (existing km 45+877 to km 13+689) section of NH- 548D (Length – 32.172 Km) developed to two lane with paved shoulder /4 lane standards in the state of Maharashtra and authorizes the National Highways Authority of India to collect, either through its officials or through a contractor, the said fee, namely: - Table 1 Type of vehicle Base rate of fee per km for the base year 2007-08 (in Rupees) (1) (2) Car, Jeep, Van or Light Motor Vehicle 0.65 Light Commercial Vehicle, Light Goods Vehicle or Mini Bus 1.05 Bus or Truck (Two Axles) 2.20 Three-axle commercial vehicles 2.404 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Heavy Construction Machinery (HCM) or Earth Moving Equipment (EME) or Multi 3.45 Axle Vehicle (MAV) (four to six axles) Oversized Vehicles (seven or more axles) 4.20 1. The fee to be levied and collected hereunder shall be due and payable at the following Fee Plaza for net road length specified for such Fee Plaza: Table-2 Location of Fee Plaza (chainage) Length (in km) for which Fee is Rate at which fee is payable payable At design km 154+400 (existing km 29.972 Km. 60% of the base rates for two 29+300) near Village-Vaidyakinhi, District lane with paved shoulder section Beed in the State of Maharashtra. mentioned in Table-1 above 2.200 Km. 100% of the base rates for four and more lane section mentioned in Table-1 above 2. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs. 285 (Rupees Two Hundred Eighty Five only) for the year 2021-22 and is subject to revision every year as per the provisions of the said rules. 3. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: Table-3 Amount Payable Maximum number of one way Period of validity journeys allowed One and half times of the fee for one way Two Twenty four hours from the journey time of payment Two-third of amount of the fee payable for Fifty One month from date of fifty single journeys payment 4. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 5. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, as per Rule 10(1A) of the said rules and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 6. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the rules. 7. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules. 8. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the National Highways Authority of India on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly. 9. The estmated capital cost of the project is Rupees 228.54 Crore. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed. The final capital cost will be notified separately. The National Highways Authority of India shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
