L.-33004/99 सी.जी.-डी.एल.-अ.-27112024-258951 CG-DxLx-xEG-I2D7H1x1x2x0 24-258951 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 4683] नई दिल्ली, मगं लवार, नवम् बर 26, 2024/ अग्रहायण 5, 1946 No. 4683] NEW DELHI, TUESDAY, NOVEMBER 26, 2024/ AGRAHAYANA 5, 1946 सड़क परिवहन औि िाजमार् गमत्रं ालय अजधसचू ना नई दिल्ली, 22 नवम् बर, 2024 का.आ. 5073(अ).— यतः, केन्द्रीय सरकार ने, राष्ट्रीय रािमागग अजधजनयम, 1988 (1988 का 68) की धारा 11 के अधीन िारी की गई भारत सरकार के सड़क पररवहन और रािमागग मंत्रालय की अजधसूचना संख्या का.आ. 1726 (अ), दिनांक 06 दिसंबर 2005 द्वारा तजमलनाडु राज्य में राष्ट्रीय रािमागग संख्या 45सी (तंिावुर के जनकट एनएच-67 के साथ अपने िक्ं िन से प्रारंभ होकर कुंभकोणम, सेरियाथोप, नेवेली टाउनजिप, वडालूर, पनरुजत को िोड़ते हुए जवक्रवंडी के जनकट एनएच 45 के साथ अपन े िंक्िन पर समाप्त होन े वाला रािमागग) तक का खंड भारतीय राष्ट्रीय रािमागग प्राजधकरण (जिसे इसके पश्चात् ‘प्राजधकरण’ कहा िाए) को सौंपा है। अतः, अब, राष्ट्रीय रािमागग िुल्क (िर अवधारण एव ं सग्रं हण) जनयम, 2008 (जिसे इसके बाि "जनयम" कहा गया ह)ै के जनयम 3 के साथ परित भारतीय राष्ट्रीय रािमागग अजधजनयम, 1956 (1956 का 48) की धारा 7 द्वारा प्रित्त िजियों का प्रयोग करते हुए, केंर सरकार एतद्द्वारा 38.376 दक.मी. की िुद्ध सड़क खंड लंबाई (सारणी-2) [4 या अजधक लेन वाले खंड के उपयोग के जलए] और 15.640 दक.मी. की समतुल्य संरचना लंबाई (लंबाई 60 मीटर से अजधक) के जलए (लंबाई 1.564 दक.मी., सारणी-4) ताजलका 1 के कॉलम (2) में जवजनर्िगष्ट िर पर और िस करोड़ रुपये या उसस े अजधक लागत वाले 10.54 दक.मी. (सारणी-3) की लंबाई वाले बाईपास के जलए आधार िर का डेढ़ गुना यांजत्रक वाहनों पर िुल्क लगाती ह ै और तजमलनाडु राज्य में एनएच-45सी (नया स.ं 36) पर 7630 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सेरियाथोप-चोलपौरम खंड को जडिाइन दक.मी. 65.960 स े दक.मी. 116.440 (मौिूिा दक.मी. 60.250 स े दक.मी. 111.000) तक चार लेन करने के जलए प्राजधकरण को अपने अजधकाररयों के माध्यम से अथवा संजविाकार के माध्यम से उि िुल्क को संग्रहीत करने के जलए प्राजधकृत करती है, जनम्नानुसार:- सारणी-1 वाहन का प्रकार आधार वर् ग 2007-08 के जलए प्रजत दक.मी. िल्ु क की आधार िर (रुपए म)ें (1) (2) कार, िीप, वैन अथवा हल् के मोटर वाहन 0.65 हल् के वाजणजज्यक वाहन, हल् के मालवाहक वाहन अथवा जमनी 1.05 बस बस अथवा रक (िो धुरी वाल)े 2.20 तीन धरु ा वाल ेवाजणजज्यक वाहन 2.40 भारी जनमागण मिीनरी (एच.सी.एम.) अथवा अथ ग मूववंग उपस्ट्कर (ई.एम.ई) अथवा बहुधुरीय वाहन (एम.ए.वी.) (चार 3.45 से छह धुरी वाले) बड़े आकार वाल ेवाहन (सात अथवा अजधक धुरी वाले) 4.20 1. नीचे उद्ग्रहीत एवं संग्रहीत िल्ु क, जनम्नजलजखत िुल्क प्लािा पर, ऐसे िुल्क प्लािा(ओं) के जलए जवजनर्िगष्ट सड़क की जनवल लंबाई उजल्लजखत आधार िर पर िोध्य और संिेय होगा, अथागत; सारणी -2 लबं ाई (दकमी म)ें जिसके जलए िुल्क िुल्क प्लािा का स्ट्थान (चने िे ) िर जिस पर िल्ु क सिं ये ह ै सिं ये ह ै 38.376 तजमलनाडु राज्य के तंिावुर जिले के (बाईपास की लंबाई (जिनकी लागत चार या अजधक ल ें के जलए ऊपर मनमबाड़ी गांव में एनएच-45सी (नई 10 करोड़ से अजधक) और (>60 सारणी 1-में उजल्लजखत आधार संख्या 36) के जडिाइन दक.मी. मीटर)] संरचनाओं में ही रहता/रहती हो, उसके जलए वर्ग 2024-25 के जलए माजसक पास की िर 340.00/-रूपए (तीन सौ चालीस रूपए मात्र) होगी और उि जनयमों के उपबंधों के अनुसार उसमें प्रत्येक वर्ग संिोधन दकया िायेगा। 5. रािमागग खण्ड पर बहुयात्राओं हते ु पास जनम्नजलजखत िरों पर िारी दकया िाएगा, अथागत्ः4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सारणी-5 अनमु त्य एकतरफा यात्राओं की िये राजि अजधकतम सख्ं या वधै ता अवजध एकतरफा यात्रा के जलए िुल्क का डेढ़ िो भुगतान के समय से चौबीस घंटे गुना पचास एकल यात्राओं के जलए भुगतान की तारीख से एक मास भुगतान िुल्क की राजि का िो-जतहाई पचास 6. जिस जिले में िल्ु क प्लािा पड़ता ह ै उस जिल े में पंिीकृत वाजणजज्यक वाहन (राष्ट्रीय परजमट के अधीन चल रह े वाहनों को छोड़कर) के जलए िुल्क उस श्रेणी के वाहन के जलए जवजनर्िगष्ट िल्ु क का 50% होगा बिते दक ऐस े वाजणजज्यक वाहनों के उपयोग के जलए कोई सर्वगस रोड अथवा वैकजल्पक सड़क उपलब्ध न हो । 7. िो यांजत्रक वाहन अपनी श्रणे ी के जलए जनधागररत अनुज्ञेय भार की अपेक्षा अजधक भार से लिा हुआ होगा उसके चालक अथवा माजलक अथवा प्रभारी व्यजि को ऐसे अजधक भार से लिे हुए वाहन को राष्ट्रीय रािमागग म ें प्रवेि कराने के जलए िल्ु क संग्रहण एिेंसी को जनयम 10 के उप जनयम 1 ए में जवजनर्िगष्ट के अनुसार िुल्क का भुगतान करना होगा और उस े रािमागग खण्ड का उपयोग करने की तब तक अनुमजत नहीं होगी िब तक दक ऐसे यांजत्रक वाहन से अजधक भार को हटा नहीं दिया िाए। 8. यांजत्रक वाहनों की श्रणे ी, उनके जलए अनुज्ञेय भार, छूट-प्राप्त वाहनों की श्रणे ी, सर्वगस रोड, वैकजल्पक सड़क आदि सजहत सभी पररभार्ाएं उि जनयमों में जवजनर्िगष्ट पररभार्ाओं के अनुसार होंगी । 9. उि जनयमों के जनयम 12 के अनुसार, उपयोगकतागओं की िानकारी के जलए िल्ु क की िरों को प्रिर्िगत दकया िाएगा । 10. ऊपर सारणी-1 में यथा-उजल्लजखत, आधार वर्ग 2007-08 के जलए प्रजत दकलोमीटर िल्ु क की आधार िर के आधार पर, यांजत्रक वाहनों से जलए िाने वाले वास्ट्तजवक िल्ु क और कटौजतयों की गणना प्राजधकरण द्वारा खंडों की परू ी कर ली गई पररयोिना रािमागों की लम्बाई के आधार पर की िाएगी तथा उसे ररयायतग्राही के माध्यम से प्राजधकरण द्वारा अंग्रेिी और स्ट्थानीय भार्ा के कम-से-कम एक-एक समाचार पत्र में प्रकाजित दकया िाएगा और तिनुसार उसमें उि जनयमों के जनयम 5 के अनुसार वार्र्गक तौर पर संिोधन दकया िाएगा। 11. पररयोिना की अनुमाजनत पूंिीगत लागत 2904.72 करोड़ रुपए ह।ै पूंिी लागत म ें पररवतगन हो सकता ह ै क्य ोंदक भूजम अिगन, िन-उपयोजगता सेवाओं का स्ट्थ ान बिलने, पेड़ों की कटाई आदि िैसे दक्रयाकलाप अभी परू े दकए िान े हैं। प्राजधकरण द्वारा वसूल दकए गए प्रयोिा िल्ु क के िररए पूंिीगत लागत की वसूली का ररकॉडग रखा िाएगा। ` [फ़ा. सं. notification of the Government of India in the erstwhile Ministry of Shipping, Road Transport and Highways (Department of Road Transport and Highways) number S.0.1726 (E), dated the 06th December, 2005, issued under section 11 of the National Highways Authority of India Act,1988 (68 of 1988), hereinafter referred to as the said Act, the Central Government had entrusted National Highway No.45C (The Highway starting from its junction with NH-67 near Thanjavur connecting Kumbakonam, Sethiyathope, Neyveli Township, Vadalur, Panruti and terminating at its junction with NH45 near Vikravandi) in the State of Tamil Nadu respectively to the National Highways Authority of India (hereinafter referred to as the Authority);[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of rates and Collection) Rules, 2008 and subsequent amendments (hereinafter referred to as the "rules"), the Central Government hereby levies the fee on mechanical vehicles at the rate specified in column(2) of the Table 1 for net road section length of 38.376 Km (Table-2) [for the use of 4 and more laned section] and for equivalent structure length (having length more than 60m) of 15.640 Km (having length of 1.564 Km, Table-4) and at one and one half times the base rate for bypasses having length of 10.54 Km (Table-3) costing rupees ten crore or more on the type of vehicles specified in column (1) Table-1 below of the four laning of Sethiyathope – Cholpauram section from design Km 65.960 to Km 116.440 (existing Km 60.250 to Km 111.000) of NH- 45C (New No.36) in the State of Tamil Nadu and authorize the Authority to collect, The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs.340/- (Rupees Three Hundred and Forty only) for the year 2024-25 and is subject to revision every year as per the provisions of the said rules. 5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely:- Table-5 Maximum number of one- Amount Payable Period of validity way journeys allowed One and one-half times of the fee for one way Twenty-four hours from the Two journey time of payment Two-third of amount of the Fee payable for fifty One month from date of Fifty single journeys payment 6. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 7. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules. 9. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules. 10. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 11. The estimated capital cost of the project is Rupees.2904.72 crore. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed.
