L.-33004/99 सी.जी.-डी.एल.-अ.-24082023-248302 CG-DxLx-xEG-I2D4H0x8x2x0 23-248302 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 3624] नई ददल्ली, बृहस्ट्प जतवार, अगस्ट्त 24, 2023/भार 2, 1945 No. 3624] NEW DELHI, THURSDAY, AUGUST 24, 2023/BHADRA 2, 1945 सड़क पररवहन और राजमाग गमत्रं ालय अजधसचू ना नई ददल्ली, 23 अगस्ट् त, 2023 का.आ. 3784(अ).—जबदक,केन्द्र सरकार ने राष्ट्रीय राजमागग अजधजनयम, 1956 (1956 का 48) की धारा 5 के अधीन जारी की गई भारत सरकार के सड़क पररवहन और राजमागग मंत्रालय की अजधसूचना स.ं का.आ. 4201(अ), ददनांदकत 11 अक्टूबर, 2021 के द्वारा महाराष्ट्र राज्य म ें राष्ट्रीय राजमाग ग स.ं 161ए को महाराष्ट्र राज्य सरकार को सुपुद ग कर ददया ह;ै अत: अब, राष्ट्रीय राजमागग फीस (दरों का जनधागरण और संग्रहण) जनयम, 2008 (जो इसके आग े ‘जनयम’ के रूप म ें उजल्लजखत ह)ै के जनयम 3 के साथ परित राष्ट्रीय राजमाग ग अजधजनयम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त िजियों का प्रयोग करते हुए, केन्द्रीय सरकार, एतदद्वारा महाराष्ट्र राज्य म ें पेव्ड िोल्डर सजहत दो लेन के रारा-161ए के अकोला – देवरी - अकोट खंड के जडजाइन दकमी 8.364 स े दकमी 24.250 और दकमी 27.200 स े दकमी 50.600 (लंबाई = 39.286) तक के 39.142 दकमी की जनवल सड़क लंबाई और 1.44 दकमी [0.144 दकमी की लंबाई वाली) की समतुल्य संरचना लंबाई (60 मीटर स े अजधक की लंबाई वाली) के जलए ताजलका 1 के कॉलम (2) म ें जवजनर्ददष्ट आधार दर के 60% दर पर नीच े दी गई ताजलका 1 के कॉलम (1) म ें जवजनर्ददष्ट वाहनों के प्रकार पर फीस उदगृहीत करती ह ै तथा भारतीय राष्ट्रीय राजमागग प्राजधकरण को उसके अजधकाररयों अथवा दकसी िेकेदार के माध्यम स े उि फीस के संग्रहण के जलए प्राजधकृत करती ह,ै अथागत्:- 5447 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ताजलका-। वाहन का प्रकार आधार वर् ग 2007-08 के जलए प्रजत दकमी आधार फीस दर (रु. म)ें (1) (2) कार, जीप, वैन या हल्के मोटर वाहन 0.65 हल्के वाजणज्जयक वाहन, हल्के माल वाहन या जमनी बस 1.05 बस या रक (दो धुरी) 2.20 तीन धुरी वाजणज्जयक वाहन 2.40 भारी जनमागण मिीनरी (एचसीएम) या अथग मूववग उपस्कर (ईएमई) या बहु धुरीय वाहन 3.45 (एमएवी) (चार से छ: धुरी) जविाल आकार के वाहन (सात या अजधक धुरी) 4.20 1. इसके अंतगगत उदगृहीत और संगृहीत फीस ऐस े पथकर प्लाजाओं के अतं गतग जवजनर्ददष्ट दरू ी हते ु जनम्नजलजखत पथकर प्लाजाओं म ेंदये और संदेय होगी:- ताजलका-2 लंबाई (दकमी म)ें जजसके जलए फीस सदं ेय पथकर पल् ाजा की अवसज् थजत (चैनजे ) दर, जजस पर फीस सदं ये ह ै। है महाराष्ट्र राज्य में उगवा गांव के जनकट, तालुका पेव्ड िोल्डर सजहत दो लेन के जलए 39.142 अकोला, जजला अकोला में रारा-161ए के दकमी ऊपर ताजलका-1 में उजल्लजखत आधार [संरचना की लंबाई (>60मी) को छोड़कर] 19.350 पर दरों का 60% 2. उपयुगि के अजतररि, जनम्नजलजखत टोल प्लाजा (प्लाजाओं) पर 60 मीटर स े अजधक लंबाई वाली जनम्नजलजखत अवसंरचनाओं के उपयोग के जलए 10 के समतुल्य गुणक द्वारा ऐसी अवसंरचनाओं की लंबाई को गणु ा करके राजमाग ग की समतुल्य लंबाई म ेंअवसंरचनाओं की लंबाई को पररवर्ततत करके जनम्नजलजखत फीस भी दये और संदेय होगी:- ताजलका-3 समतल्ु य सड़क लबं ाई म ें पथकर पल् ाजा की अवसज् थजत पररवर्ततत दकए जान ेके जलए समतल्ु य सड़क लबं ाई (दकमी म)ें दर, जजस पर फीस सदं ये है (चनै जे ) अवसंरचनाओं* की लबं ाई (दकमी म)ें महाराष्ट्र राज्य में उगवा गांव के पेव्ड िोल्डर सजहत दो लेन के जनकट, तालुका अकोला, जजला जलए ऊपर ताजलका-1 में 0.144 दकमी^ 1.44 दकमी अकोला में रारा-161ए के दकमी उजल्लजखत आधार दरों का 19.350 पर 60% ^ ब्यौरा जनम्नानुसार ह:ैं - क्र. स.ं चनै ेज सरं चना का प्रकार लंबाई (दकमी म)ें दकमी स े दकमी तक 1 30.450 30.594 बड़ा पुल 0.144 कुल लंबाई 0.144[भाग II—खण् ड 3(ii)] भारत का राजपत्र : असाधारण 3 3. गैर-वाजणजज्यक प्रयोजनों के जलए पंजीकृत यांजत्रक वाहन के स्ट्वामी और पथकर प्लाजा स े बीस दकमी की दरू ी के भीतर जनवास करन े वाल े व्यजि के जलए माजसक पास की दर वर् ग 2023-24 के जलए 330 रु. (तीन सौ तीस रुपए मात्र) ह ै और उि जनयमों के प्रावधानों के अनुसार प्रजतवर्ग संिोधन के अध्यधीन ह।ै 4. राजमागग खंड पर बहुल यात्राओं के जलए जनम्नजलजखत दरों पर पास जारी दकए जाएंग,े अथागत ् ताजलका-4 भुगतान-योगय् धनराजि अनमु त एकतरफा यात्राओं की अजधकतम वैधता की अवजध सखं य् ा एकतरफा यात्रा के जलए फीस का डेढ़ दो भुगतान के समय से चौबीस घंटे गुना पचास एकल यात्राओं के जलए भुगतान- पचास भुगतान की तारीख से एक महीना योग्य फीस की राजि का दो-जतहाई 5. फीस प्लाजा जस्ट्थत होन े वाले जजल े म ें पंजीकृत वाजणजज्यक वाहनों (राष्ट्रीय परजमट के अधीन प्रचाजलत दकए जा रह े वाहनों को छोड़कर) के जलए फीस उस श्रेणी के वाहन हते ु जनधागररत दर की 50% होगी, बिते दक ऐसे वाजणजज्यक वाहनों के प्रयोग के जलए कोई सर्तवस रोड या वैकजल्पक सड़क उपलब्ध न हों। 6. संबंजधत श्रणे ी के वाहनों के जलए जवजनर्ददष्ट अनुज्ञेय भार स े अजधक भार लद े यांजत्रक वाहन का चालक या स्ट्वामी या प्रभारी व्यजि, राष्ट्रीय राजमाग ग पर अजतभार लद े वाहन के प्रवेि के जलए टोल सग्रं हण एजेंसी को ऐसी श्रेणी के वाहनों के प्रवेि जलए, उि जनयमों के जनयम 10 के उप-जनयम 1ए म ें जवजनर्ददष्ट फीस के समतल्ु य फीस का भगु तान करन े के जलए उत्तरदायी होगा और वह राजमागग खंड का प्रयोग करन े के जलए तब तक हकदार नहीं होगा जब तक ऐसे यांजत्रक वाहन स े लदा अजतभार हटाया नहीं जाता। 7. सभी पररभार्ाए,ं यांजत्रक वाहनों की श्रेणी, इनके अनज्ञु ेय भार, छूट प्राप्त वाहनों की श्रेणी, सर्तवस रोड, वैकजल्पक सड़क इत्यादद पूवोि जनयमों म ेंजवजनर्ददष्ट पररभार्ाओं के अनरूु प होंगी। 8. फीस की दरें उि जनयमों के जनयम 12 के अनुसरण म ेंप्रयोिाओं के सूचनाथग प्रदर्तित करनी होंगी। 9. यांजत्रक वाहनों स े फीस की वास्ट्तजवक राजि उपयुगि ताजलका-1 म ें यथा-उजल्लजखत आधार वर् ग 2007-08 के जलए प्रजत दकमी फीस की आधार दर के आधार पर प्रभाररत होगी और छूटों की गणना भारतीय राष्ट्रीय राजमागग प्राजधकरण द्वारा खंड की पूरी हो गई लंबाई के आधार पर की जाएगी और उसे उि जनयमों के जनयम 5 के अनुसार प्रजत वर्ग संिोजधत दकया जाएगा तथा तदनुसार उसे अंग्रेजी और क्षेत्रीय भार्ा के कम स े कम एक-एक समाचार पत्र म ें प्रकाजित दकया जाएगा। 10. इस पररयोजना की प्राक्कजलत पूंजीगत लागत 313.95 करोड़ रु. ह।ै [भूजम अजधग्रहण, सावगजजनक जन सुजवधाओं के स्ट्थानांतरण, पेड़ों को काटन,े आदद कायगकलापों को अभी परू ा दकया जाना ह ै इसजलए, पूंजीगत लागत पररवतगन के अध्यधीन ह ैऔर अंजतम पूंजीगत लागत को पृथक रूप स े अजधसूजचत दकया जाएगा।] प्राप्त प्रयोिा फीस के माध्यम स े वसूल की गई पूंजीगत लागत का भारतीय राष्ट्रीय राजमागग प्राजधकरण द्वारा ररकाडग रखा जाएगा तथा पूंजीगत लागत की वसूली के पश्चात ् उदग्राह्य फीस घटाकर दरों के 40% तक कर दी जाएगी और कजथत जनयमों के अनुसरण म ें वार्तर्क रूप स े संिोजधत की जाएगी। [फा. सं. आरओ/एमयूएम/पी-1084/टोल/2023- 24/ई-223438] सुमन प्रसाद वसह, संयुि सजचव MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 23rd August, 2023 S.O. 3784(E).— Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 4201(E) dated 11th October, 2021 issued under Section 5 of the National Highway Act, 1956 (48 of 1956, the Central Government has entrusted the stretch of National Highway No. 161A situated within the State of Maharashtra to the State Government of Maharashtra;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the ―rules‖), the Central Government hereby levies the fee on mechanical vehicles at 60% of the base rate specified in column (2) of Table 1 for net road section length of 39.142 km and for equivalent structure length (having length more than 60m) of 1.44 km (having length of 0.144 km) on the type of vehicles specified in column (1) of the Table 1 below for use of two lane with paved shoulders of Akola – Deori – Akot section from design kilometer 8.364 to kilometer 24.250 & kilometer 27.200 to kilometer 50.600 (length = 39.286 Km) of National Highway No. 161A and authorises the National Highways Authority of India to collect, either through its officials or through a contractor, the said fee, namely:- Table-1 Type of vehicle Base rate of fee per km for the base year 2007-08 (in Rupees) (1) (2) Car, Jeep, Van or Light Motor Vehicle 0.65 Light Commercial Vehicle, Light Goods Vehicle or Mini Bus 1.05 Bus or Truck (Two Axles) 2.20 Three-axle commercial vehicles 2.40 Heavy Construction Machinery (HCM) or Earth Moving Equipment 3.45 (EME) or Multi Axle Vehicle (MAV) (four to six axles) Oversized Vehicles (seven or more axles) 4.20 1. The fee to be levied and collected hereunder shall be due and payable at the Fee Plaza for net road length specified for such Fee Plaza(s) namely: - Table-2 Location of Fee Plaza Length (in km) for which Fee is Rate at which fee is payable (chainage) payable At design Km. 19.350 of NH- 39.142 60% for two lane with paved shoulders, of 161A near Ugwa village Taluka the base rates mentioned in Table-1 above [Excluding length of structures (>60m)] Akola Dist.- Akola in the State of Maharashtra. 2. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometres from the fee plaza is Rs 330.00 (Three Hundred and Thirty Rupees only) for the year 2023-24 and is subject to revision every year as per the provisions of the said rules. 4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: - Table-4 Amount Payable Maximum number of Period of validity one way journeys allowed One and one-half times of the fee for one Two Twenty four hours from the time of payment way journey Two-third of amount of the fee payable Fifty One month from date of payment for fifty single journeys 5. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 6. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules. 8. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules. 9. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the National Highways Authority of India on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 10. The estimated capital cost of the project is Rupees 313.95 crore. [The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed and the final capital cost will be notified separately]. The National Highways Authority of India shall maintain a record of the recovery of capital cost through user fee realised and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
