L.-33004/99 सी.जी.-डी.एल.-अ.-11032025-261558 CG-DxLx-xEG-I1D1H0x3x2x0 25-261558 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 1119] नई दिल्ली, मगं लवार, माच च11, 2025/फाल्ग नु 20, 1946 No. 1119] NEW DELHI, TUESDAY, MARCH 11, 2025/PHALGUNA 20, 1946 सड़क परिवहन औि िाजमार् गमत्रं ालय अजधसचू ना नई दिल्ली, 11 माच,च 2025 का.आ. 1132(अ).— यतः, केन्द्रीय सरकार न,े राष्ट्रीय रािमागच अजधजनयम, 1988 (1988 का 68) की धारा 11 के अधीन िारी की गई भारत सरकार के सड़क पररवहन और रािमाग च मंत्रालय की अजधसूचना संख्या का.आ. 1192 (अ), दिनांक 03/12/2001 और सख्ं या का.आ. 465 (अ), दिनांक 26 अप्रैल, 2002 द्वारा गिु रात राज्य म ें राष्ट्रीय रािमागच संख्या 8बी के क्रमिः दकमी 143.00 स े दकमी 160.00 (गोंडल-ररबड़ा खंड) तथा दकमी 0.00 स े 143.00 और 160.00 स े दकमी 217.00 (पोरबंिर-रािकोट-बामनबोर खंड) के खंडों को भारतीय राष्ट्रीय रािमागच प्राजधकरण (जिसे इसके पश्चात ् ‘प्राजधकरण’ कहा िाए) को सुपुि च दकया ह;ै और यतः, प्राजधकरण न,े राष्ट्रीय रािमाग च संख्या बबी (एनएच बबी) के दकमी 11..00 से दकमी 13..00 (िेतपुर-गोंडल सेक्िन) और दकमी 1.5.00 से दकमी 1ब5.00 (रािकोट बाईपास) के मौिूिा जहस्ट्से को िो लेन से चार लने तक चौड़ा करने और दकमी 13..00 से दकमी 1.5.00 (गोंडल-रािकोट सेक्िन) के मौिूिा चार लेन के जहस्ट्से में सुधार करने और बीओटी (टोल) आधार पर और उक्त खडं के संचालन और रखरखाव हते ु पजश्चम गुिरात एक्सप्रेसवे जलजमटेड, जिसका पंिीकृत कायाचलय आईएलएंडएफएस फाइनेंजियल सेंटर, प्लॉट सी-22, िी-ब्लॉक, बांरा कुलाच कॉम्पप्लेक्स, बांरा ईस्ट्ट, मुंबई-300051 में ह ै(जिसे इसके पश् चात ‘कंसेसनेयर’ कहा िाए) के साथ करार दकया था। 1665 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और यतः, राष्ट्रीय रािमागच (राष्ट्रीय रािमागों के खडं /राष्ट्रीय रािमागों पर स्ट्थायी पुल/अस्ट्थायी पुल के प्रयोग के जलए दकसी व्यजक्त द्वारा िुल्क का संग्रहण) जनयम 199. के जनयम . और राष्ट्रीय रािमाग च (िुल्क की िर) जनयम 199. के जनयम . के साथ परित राष्ट्रीय रािमागच अजधजनयम, 1956 (1956 का 3ब) की धारा बए द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए और भारत सरकार के पोत पररवहन, सड़क पररवहन और रािमागच मंत्रालय (सड़क पररवहन और रािमाग च जवभाग) की अजधसूचना संख्या का.आ. 1.25 (अ), तारीख 6 अक्तूबर, 2006 का अजधक्रमण करते हुए, ऐसे अजधक्रमण स े पूवच की गई या करन े स े छोड़ी गई बातों के संबंध में, केंर सरकार एतिद्वारा भारत सरकार की अजधसूचना का.आ. संख्या 10ब.(ई) दिनांक 05.05.200ब द्वारा कंसेसनेयर को वाजणजज्यक पररचालन की जतजथ स े या आजधकाररक रािपत्र म ें इस अजधसूचना के प्रकािन की जतजथ से, िो भी बाि में हो, तथा समाजि जतजथ तक िल्ु क एकजत्रत करन े तथा प्रजतधाररत करन े के जलए प्राजधकृत दकया गया था। और यतः, प्राजधकरण द्वारा बीओटी (टोल) ररयायत करार को समाि करन े के कारण बीओटी ररयायत करार को बंि कर दिया गया था और अंततः, माननीय दिल्ली उच्च न्द्यायालय के दिनांक .0.0..2022 के आिेि के बाि, प्राजधकरण द्वारा 01.03.2022 को कंसेसनेयर से उक्त खडं को अपने अधीन ले जलया गया ह,ै उक्त खंड को अपने अधीन लने े के बाि, एनएचएआई का.आ. संख्या 10ब. (ई), दिनाकं 05.05.200ब के तहत िारी ररयायत करार/िुल्क अजधसूचना के प्रावधान के अनुसार प्रयोक्ता िल्ु क संग्रह िारी रख रहा ह।ै हालांदक, इस िुल्क अजधसूचना के प्रकािन की जतजथ से, एनएचएआई इस िुल्क अजधसूचना के तहत प्रावधानों के अनुसार प्रयोक्ता िल्ु क संग्रहीत करेगा, िो अजधसूचना संख्या का. आ. 10ब. (अ) दिनांक 05-05-200ब को रद्द कर िगे ा। अब, उक्त खंड को सावचिजनक जवत्त पोजित मोड पर छह लने तक चौड़ा करन े के जलए पहल े ही जलया िा चुका है, इसजलए, राष्ट्रीय रािमागच िल्ु क (िर अवधारण एवं सग्रं हण) जनयम, 2008 के जनयम 3 के साथ परित राष्ट्रीय रािमाग च अजधजनयम, 1956 (1956 का 48) की धारा 7 द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, केन्द्र सरकार एतद्द्वारा अजधसूजचत करती ह ै दक जनमाचण अवजध के िौरान 66.2ब.15 दकलोमीटर की जनवल सड़क खंड लंबाई (सारणी-2) तथा 11.12ब5 दकलोमीटर (1.112ब5 दकलोमीटर की लंबाई वाली) (सारणी-.) की समतल्ु य संरचना लंबाई (60 मीटर से अजधक लंबाई वाली) के जलए ताजलका 1 के स्ट्तंभ (2) म ें जवजनर्िष्टच िर के .5% पर वार्िचक संिोधन के जबना िुल्क लगाया एवं वसूला िाएगा तथा छह लने का कायच पूरा होने के बाि, चार या अजधक लेन के उपयोग के जलए जलए 65.1ब.15 दकलोमीटर की जनवल सड़क खडं लंबाई (सारणी-2) तथा 22.12ब5 दकलोमीटर (2.212ब5 दकलोमीटर की लंबाई वाली) (सारणी-.) की समतुल्य संरचना लंबाई (60 मीटर से अजधक लंबाई वाली) के जलए नीचे िी गई सारणी (1) में जवजनर्िष्टच प्रकार के वाहनों पर िुल्क उद्ग्रहीत करती ह ै एवं प्राजधकरण को अपन े अजधकाररयों के माध्यम से अथवा संजविाकार के माध्यम से उक्त िुल्क को संग्रहीत करने के जलए प्राजधकृत करती ह,ै अथाचत:- सारणी-1 वाहन का प्रकार आधार वि च200.-0ब के जलए प्रजत दक.मी. आधार िल्ु क िर (रुपए म)ें (1) (2) कार, िीप, वनै अथवा हल् के मोटर वाहन 0.65 हल् के वाजणजज्यक वाहन, हल् के मालवाहक वाहन अथवा जमनी बस 1.05 बस अथवा रक (िो धुरी वाले) 2.20 तीन धुरा वाले वाजणजज्यक वाहन 2.40 भारी जनमाचण मिीनरी (एच.सी.एम.) अथवा अथच मूववंग उपस्ट्कर (ई.एम.ई) 3.45 अथवा बहुधुरीय वाहन (एम.ए.वी.) वास्ट्तजवक समापन की जतजथ के बीच की जवलंजबत अवजध के जलए कोई प्रयोक्ता िुल्क नहीं लगाया िाएगा। इस जनयम के प्रयोिनों के जलए, पररयोिना के दकसी भी अनंजतम समापन को पररयोिना का पणू च होना नहीं माना िाएगा। 4. गैर-वाजणजज्यक प्रयोिनों के जलए पंिीकृत यांजत्रक वाहन के स्ट् वामी और पथकर प् लाज़ा स े बीस दक.मी. की िरू ी के भीतर जनवास करने वाल े व् यजक्त के जलए माजसक पास की िर वि च 2024-25 के जलए 340/-रूपए (तीन सौ चालीस रूपए मात्र) ह ै और उक्त जनयमों के प्रावधानों के अनुसार प्रजतविच संिोधन के अध् यधीन ह।ै 5. रािमागच खण्ड पर बहुयात्रा क हते ु पास जनम्नजलजखत िरों पर िारी दकया िाएगा, अथाचतः् सारणी-3 अनज्ञु ात एकतरफा यात्रा क की अजधकतम संख्या सिं ये धनराजि जवजधमान्द्यत की अवजध एकतरफा यात्रा के जलए िुल्क का डेढ़ गुना िो भुगतान के समय से चौबीस घंटे पचास एकल यात्रा क के जलए भुगतान िुल्क भुगतान की तारीख से एक मास की राजि का िो-जतहाई पचास 6. िुल्क प्लािा जस्ट्थत होन े वाले जिले म ें पंिीकृत वाजणजज्यक वाहनों (राष्ट्रीय परजमट के अधीन प्रचाजलत दकए िा रह े वाहनों को छोड़कर) के जलए िल्ु क उस श्रेणी के वाहन हते ु जनधाचररत िर की 50% होगी, बिते दक ऐस े वाजणजज्यक वाहनों के प्रयोग के जलए कोई सर्वचस रोड या वैकजल्पक सड़क उपलब्ध न हो। 7. संबंजधत श्रेणी के वाहनों के जलए जवजनर्ि‍च ट अनज्ञु ेय भार से अजधक भार लि े यांजत्रक वाहन का चालक या स्ट् वामी या प्रभारी व्यजक्त, राष्ट्रीय रािमाग च पर अजतभार लि े वाहन के प्रवेि के जलए टोल संग्रहण एिसें ी को ऐसी श्रेणी के वाहनों के प्रवेि के जलए, कजथत जनयमों के जनयम 10 के उप जनयम 1ए के अनुसार अनुप्रयोज्य िल्ु क के समतुल् य िुल् क का भुगतान करने के जलए उत् तरिायी होगा और वह रािमाग च खंड का प्रयोग करन े के जलए तब तक हकिार नहीं होगा िब तक ऐस े यांजत्रक वाहन से लिा अजतभार हटाया नहीं िाता। 8. सभी पररभािाएं, यांजत्रक वाहनों की श्रणे ी, इनके अनुज्ञेय भार, छूट-प्राि वाहनों की श्रणे ी, सर्वचस रोड, वैकजल्पक सड़क इत् यादि जनयमों में जवजनर्िष्टच पररभािा क के अनरूु प होंगी। 9. उक्त जनयमों के जनयम 12 के अनुसार, उपयोगकताच क की िानकारी के जलए िल्ु क की िरों को प्रिर्िचत दकया िाएगा। 10. यांजत्रक वाहनों से िुल् क की वास्ट् तजवक राजि उपयुचक् त ताजलका-1 में यथा-उजल्लजखत, आधार वि च 2007-08 के जलए प्रजत दकलोमीटर िल्ु क की आधार िर के आधार पर प्रभाररत होगी और छूटों की गणना प्राजधकरण द्वारा खडं की पूरी हो गई लंबाई के आधार पर की िाएगी और उसे उक्त जनयमों के जनयम 5 के अनुसार प्रजत विच संिोजधत दकया िाएगा तथा तिनुसार उसे अग्रं ेिी और क्षेत्रीय भािा के कम-स-े कम एक-एक समाचार पत्र म ेंप्रकाजित दकया िाएगा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 11. इस पररयोिना की अनुमाजनत पूंिीगत लागत 1815.81 करोड़ रुपए ह।ै चूंदक, भूजम अजधग्रहण, सावचिजनक िन- सुजवधा क के स्ट्थ ानांतरण, पेड़ों को काटने, इत् यादि कायचकलापों को अभी परू ा दकया िाना है, इसजलए, पूंिीगत लागत पररवतचन के अध् in the Ministry of Road Transport and Highways number S.O. 1192(E) dt. 03/12/2001 and number S.O. 465 (E) dated the 26th April, 2002 issued under Section 11 of the National Highway Authority of India Act 1988 (68 of 1988), the Central Government has entrusted the stretches from km 143.00 to km 160.00 (Gondal-Ribda section) and from Km. 0.00 to 143.00 and 160.00 to Km. 217.00 (Porbandar-Rajkot-Bamanbore Section) of National Highway no. 8B respectively in the State of Gujarat to the National Highways Authority of India referred to as the “Authority”); And whereas, the Authority was entered into an agreement with West Gujarat Expressway Limited, having its registered office at The IL&FS Financial Centre, Plot C-22, G-Block, Bandra Kurla Complex, Bandra East, Mumbai-400051 (hereinafter referred to as the “Concessionaire”) for widening of the existing stretch from Km. 117.00 to Km. 143.00 (Jetpur-Gondal Section), and from Km. 175.00 to km. 185.00 (Rajkot bypass) from two lane to four lane and making improvement in the existing four lane stretch from km. 143.00 to km. 175.00 (Gondal-Rajkot Section), of the national highway number 8B (NH 8B) and Operation and Maintenance of the said section on BoT(Toll). And whereas, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways (Collection of Fees by any Person for the user of Section of the National Highways/Permanent Bridge/Temporary Bridge on National Highways), Rules 1997, and rule 3 of the National Highways (Rate of Fee), Rules, 1997, and in supersession of the notification of the Government of India in the Minister of Shipping, Road Transport and Highways (Department of Road Transport and Highways) number S.O. 1725 (E), dated the 6th October, 2006, except as respects things done or omitted to be done such supersession the Central Government, by notification of the Government of India vide S.O. No. 1083(E) , dated 05.05.2008, authorized Concessionaire for collect and retain fees on and from the date of Commercial operation or publication of this notification in the Official Gazette, whichever is later: and till the termination date. And whereas, the BoT (Toll) Concession Agreement was foreclosed on account of termination of BoT Concession Agreement by the Authority and Eventually, the said section has been taken over by Authority on 01.04.2022 from Concessionaire, after order of Hon’ble High Court of Delhi Dt. 30.03.2022, upon taken over the said section, NHAI is continuing the user fee collection as per provision of Concession Agreement/Fee Notification issued vide S.O. No. 1083(E) , dated 05.05.2008. However, w.e.f. date of publication of this fee notification, NHAI shall collect user fee as per provisions under this fee notification, superseding the notification bearing No. S.O. 1083 (E) dated 05.05.2008. Now, the said stretch has already been taken up for widening upto six laning on Public Funded Mode, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008, the Central Government, hereby notifies that there shall be levied and collected fees at 75% of the rate specified in column (2) of the Table 1 for net road section length of 66.28715 Km (Table-2) and for equivalent structure length (having length more than 60m) of 11.1285 km (having length of 1.11285 km (Table-3) during construction period without annual revision and at the rate specified in column (2) of the Table 1 for net road section length of 65.18715 Km (Table-2) and for equivalent structure length (having length more than 60m) of 22.1285 km (having length of 2.21285 km (Table-3) after completion of six laning, for use of four or more lane sections on the type of vehicles specified in Table 1 below, and authorises the Authority to collect, either through its officials or through a contractor, the said fee, as under:- Table 1 Type of vehicle Base rate of fee per km for the base year 2007-08 (in Rupees) (1) (2) Car, Jeep, Van or Light Motor Vehicle 0.656 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Light Commercial Vehicle, Light Goods Vehicle or Mini Bus 1.05 Bus or Truck (Two Axles) 2.20 Three-Axle Commercial Vehicles 2.40 Heavy Construction Machinery (HCM) or Earth Moving Equipment (EME) 3.45 or Multi Axle Vehicle (MAV) (four to six axles) Oversized Vehicles (seven or more axles) 4.20 1. No user fee shall be levied for the delayed period between the Scheduled date of completion (910 days from the Appointed Date) and the date of actual completion of the project, if it is delayed. For the purposes of this rule, any provisional completion of the project shall not be treated as completion of the project. 4. The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometres from the fee plaza is Rs 340.000 (Three Hundred and Forty Only) for the year 2024-25 and is subject to revision every year as per the provisions of the said rules. 5. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 7. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc., shall be as per definitions specified in the said rules. 9. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules. 10. Based on the base rate of fee per kilometre for the base year 2007-2008 as mentioned in Table 1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the Rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 11. The estimated capital cost of the project is Rupees 1815.81 crore. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting etc., are yet to be completed.
