L.-33004/99 सी.जी.-डी.एल.-अ.-16062022-236638 xxxGIDHxxx CG-DL-E-16062022-236638 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 2627] नई ददल्ली, बहह स्ट्प जतवार, जनू 16, 2022/ज्य ‍े ि 26, 1944 No. 2627] NEW DELHI, THURSDAY, JUNE 16, 2022/JYAISTHA 26, 1944 सड़क पररवहन और राजमाग गमत्रं ालय अजधसचू ना नई ददल्ली, 15 जून, 2022 का.आ. 2760(अ).—जबदक, केन्‍द र सरकार न े रा्ीय राजमागग अजधजनयम, 1956 (1956 का 48) की धारा 5 के अधीन जारी की गई भारत सरकार के सड़क पररवहन और राजमागग मंत्रालय की अजधसूचना सं. का.आ. 4623(अ), ददनांदकत 09 नवंबर, 2021 के द्वारा राज्य म जस्ट् थत रा‍र ीय राजमागग स.ं 248ए को राजस्ट्थ ान राज्य सरकार को सपपपद गकर ददया ह;ै अत: अब, रा‍र ीय राजमागग फीस (दरों का जनधागरण और संग्रहण) जनयम, 2008 (जो इसके आगे ‘जनयम’ के रूप म उजल् लजखत ह)ै के जनयम 3 के साथ परित रा‍र ीय राजमाग ग अजधजनयम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत् त िज‍त यों का प्रयोग करते एए, केन्‍द रीय सरकार, एतद्द्वारा राजस्ट् थान राज्य म रा‍र ीय राजमागग सं. 248ए के अलवर से नूह खंड के जडजाइन दकमी 92.400 से दकमी 127.350 (मौजूदा दकमी 92.400 से दकमी 127.350) तक 23.354 दकमी जनवल सड़क खंड लंबाई और 0.960 दकमी (0.096 दकमी की लंबाई वाली) की समतपल् य संरचना लंबाई (60 मीटर स े अजधक की लंबाई वाल)े के जलए ताजलका 1 के कॉलम (2) म जवजनर्दद‍ ट दर के साि प्रजतित पर तथा 11.50 दकमी जनवल सड़क खंड लंबाई के जलए ताजलका 1 के कॉलम (2) म जवजनर्दद‍ ट दर पर ताजलका 1 के कॉलम (2) म जवजनर्दद‍ ट आधार दर पर नीचे दी गई ताजलका 1 के कॉलम (1) म जवजनर्दद‍ ट यांजत्रक वाहनों के प्रकार पर फीस उदगहहीत करती ह ै तथा भारतीय रा‍र ीय राजमागग प्राजधकरण को उसके अजधकाररयों अथवा दकसी िेकेदार के मा यम से उ‍त फीस के संग्रहण के जलए प्राजधकहत करती ह,ै अथागत:् - 4072 GI/2022 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ताजलका-1 वाहन का प्रकार आधार वर् ग 2007-08 के जलए प्रजत दकमी आधार फीस दर (रु. म) (1) (2) कार, जीप, वैन या हल् के मोटर वाहन 0.65 हल्के वाजणजज्य क वाहन, हल्के माल वाहन या जमनी बस 1.05 बस या रक (दो धपरी) 2.20 तीन धरप ी वाजणजज्य क वाहन 2.40 भारी जनमागण मिीनरी (एचसीएम) या अथग मूववग उपस्ट् कर (ईएमई) या बए धपरीय 3.45 वाहन (एमएवी) (चार से छ: धरप ी) जविाल आकार के वाहन (सात या अजधक धरप ी) 4.20 1. इसके अंतगतग उदगहहीत और संगहहीत फीस ऐसे पथकर प् लाजा क के अतं गतग जवजनर्दद‍ ट दरू ी हते प जन्‍न जलजखत पथकर प् लाजा क म देय और संदेय होगी:- ताजलका-2 पथकर प्ल ाजा (चनै जे ) की अवजस्ट्थ जत लबं ाई (दकमी म) जजसके जलए फीस सदं ेय ह ै दर, जजस पर फीस सदं ेय ह ै। राजस्ट् थान के अलवर जजल ेम बाहला 23.354 दकमी [बाइपास की लंबाई (>10 पेव् ड िोल्ड र सजहत दो लेन के जलए गांव के जनकट रारा-248ए के जडजाइन करोड़ रु. लागत वाली) और सरं चना की ऊपर ताजलका-1 म उजल् लजखत दकमी 100.500 पर लंबाई (>60 दकमी) को छोड़कर] आधार दरों का 60% 11.50 दकमी [बाइपास की लबं ाई (>10 चार अथवा अजधक लने के जलए ऊपर करोड़ रु. लागत वाली) और सरं चना की ताजलका-1 म उजल्ल जखत आधार दरों लंबाई (>60 दकमी) को छोड़कर] का 100% 2. उपयपग‍ त के अजतरर‍त , जन्‍न जलजखत टोल प् लाजा (प् लाजा क) पर 60 मीटर स े अजधक लंबाई वाली जन्‍न जलजखत अवसंरचना क के उपयोग के जलए 10 के समतल्प य गणप क द्वारा ऐसी अवसंरचना क की लंबाई को गणप ा करके राजमाग ग की समतपल् य लंबाई म अवसंरचना क की लंबाई को पररवर्ततत करके जन्‍न जलजखत फीस भी देय और संदेय होगी:- ताजलका-3 पथकर प्ल ाजा की अवजस्ट्थ जत समतल्प य सड़क लबं ाई म पररवर्ततत दकए समतल्प य दर, जजस पर फीस सदं ेय ह ै (चनै जे ) जान ेके जलए अवसरं चना क* की लबं ाई सड़क लबं ाई (दकमी म) (दकमी म) राजस्ट् थान के अलवर जजल ेम 0.096 0.0960^ पेव् ड िोल्ड र सजहत दो लेन के बाहला गांव के जनकट रारा-248ए जलए ऊपर ताजलका-1 म के जडजाइन दकमी 100.500 पर उजल् लजखत आधार दरों का 60% ^ ब् यौरा जन्‍न ानपसार ह: चनै जे सरं चना का प्रकार लबं ाई (दकमी) दकमी स े दकमी तक 118.612 118.708 बड़ा पपल 0.096 जोड़ 0.096[भाग II—खण् ड 3(ii)] भारत का राजपत्र : असाधारण 3 3. गैर-वाजणजज्य क प्रयोजनों के जलए पंजीकहत यांजत्रक वाहन के स्ट् वामी और पथकर प् लाजा से बीस दकमी की दरू ी के भीतर जनवास करन े वाल े व् यज‍त के जलए माजसक पास की दर वर् ग 2021-22 के जलए 285.00 रु. (दो सौ जपचासी रुपए मात्र) ह ैऔर उ‍त जनयमों के प्रावधानों के अनपसार प्रजतवर् ग संिोधन के अ यधीन ह।ै 4. राजमागग खडं पर बएल यात्रा क के जलए जन्‍न जलजखत दरों पर पास जारी दकए जाएगं ,े अथागत् ताजलका-4 भगप तान-योग्य धनराजि अनमप त एकतरफा यात्रा क की अजधकतम वधै ता की अवजध सख्ं य ा एकतरफा यात्रा के जलए फीस का डेढ़ दो भपगतान के समय से चौबीस घंटे गपना पचास एकल यात्रा क के जलए पचास भपगतान की तारीख से एक महीना भपगतान-योग् य फीस की राजि का दो- जतहाई 5. फीस प् लाजा जस्ट् थत होन े वाले जजल े म पंजीकहत वाजणजज्य क वाहनों (रा‍र ीय परजमट के अधीन प्रचाजलत दकए जा रह े वाहनों को छोड़कर) के जलए फीस उस श्रेणी के वाहन हते प जनधागररत दर की 50% होगी, बिते दक ऐसे वाजणजज्य क वाहनों के प्रयोग के जलए कोई सर्तवस रोड या वैकजल् पक सड़क उपलब्ध न हों। 6. संबंजधत श्रेणी के वाहनों के जलए जवजनर्दद‍ ट अनप्ेय भार से अजधक भार लद े यांजत्रक वाहन का चालक या स्ट् वामी या प्रभारी व् यज‍त , रा्ीय राजमागग पर अजतभार लदे वाहन के प्रवेि के जलए टोल सग्रं हण एज सी को ऐसी श्रेणी के वाहनों के प्रवेि जलए, कजथत जनयमों के जनयम 10 के उप-जनयम 1ए के अनपसार अनप्रप योज्य फीस के समतपल् य फीस का भपगतान करन े के जलए उत् तरदायी होगा और वह राजमाग ग खंड का प्रयोग करन े के जलए तब तक हकदार नह होगा जब तक ऐस े यांजत्रक वाहन से लदा अजतभार हटाया नह जाता। 7. सभी पररभार्ाएं, यांजत्रक वाहनों की श्रेणी, इनके अन्प ेय भार, छूट प्राप् त वाहनों की श्रेणी, सर्तवस रोड, वैकजल् पक सड़क इत् यादद पूव्‍त जनयमों म जवजनर्दद‍ ट पररभार्ा क के अनपरूप होंगी। 8. फीस की दर उक्त जनयमों के जनयम 12 के अनपसरण म प्रयो‍त ा क के सूचनाथग प्रदर्तित करनी होंगी। 9. यांजत्रक वाहनों से फीस की वास्ट् तजवक राजि उपयपग‍ त ताजलका-1 म यथा-उजल् लजखत आधार वर्ग 2007-08 के जलए प्रजत दकमी फीस की आधार दर के आधार पर प्रभाररत होगी और छूटों की गणना भारतीय रा्ीय राजमागग प्राजधकरण द्वारा खंड की पूरी हो गई लंबाई के आधार पर की जाएगी और उसे उ‍त जनयमों के जनयम 5 के अनपसार प्रजत वर्ग संिोजधत दकया जाएगा तथा तदनपसार उसे अंग्रेजी और क्षेत्रीय भार्ा के कम से कम एक-एक समाचार पत्र म प्रकाजित दकया जाएगा। 10. इस पररयोजना की प्रा‍क जलत पूंजीगत लागत 186.56 करोड़ रु. ह।ै [भूजम अजधग्रहण, सावगजजनक जन सपजवधा क के स्ट् थानातं रण, पेड़ों को काटने, आदद कायगकलापों को अभी पूरा दकया जाना ह ै इसजलए, पूंजीगत लागत पररवतगन के अ यधीन ह ै और अंजतम पूंजीगत लागत को पथह क रूप से अजधसूजचत दकया जाएगा।] प्राप् त प्रयो‍त ा फीस के मा यम से वसूल की गई पूंजीगत लागत का भारतीय रा्ीय राजमाग ग प्राजधकरण द्वारा ररकाड ग रखा जाएगा तथा पूंजीगत लागत की वसूली के पश् चात ् उदग्राय फ फीस घटाकर दरों के 40% तक कर दी जाएगी और कजथत जनयमों के अनपसरण म वार्तर्क रूप से संिोजधत की जाएगी। [फा. सं. आरज/े डीपीपी/एपी/2018-19/1143/टोल फीस अजधसूचना] अजमत वरदान, संयप‍ त सजचव4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 15th June, 2022 S.O. 2760(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 4623(E) dated 9th November,2021 issued under Section 5 of the National Highways Act ,1956 (48 of 1956), the Central Government has entrusted the National Highway 248A as situated within the State of Rajasthan to the State Government of Rajasthan; Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "rules"), the Central Government hereby levies the fee on mechanical vehicles at sixty percent of the rate specified in column (2) of the Table 1 for net road section length of 23.354 km and for equivalent structure length (having length more than 60m) of 0.960 km (having length of 0.096 km) and at the rate specified in column (2) of Table 1 for net road section length of 11.50 kms on the type of vehicles specified in column (1) of the Table 1 below of Alwar to Nuh Section from design kilometer 92.400 to kilometer 127.350 (existing km 92.400 to km 127.350) of National Highway 248A in the State of Rajasthan and authorises the National Highways Authority of India to collect, either through its officials or through a contractor, the said fee, namely:- Table 1 Base rate of fee per km for the Type of vehicle base year 2007-08 (in Rupees) (1) (2) Car, Jeep, Van or Light Motor Vehicle 0.65 Light Commercial Vehicle, Light Goods Vehicle or Mini Bus 1.05 Bus or Truck (Two Axles) 2.20 Three-axle commercial vehicles 2.40 Heavy Construction Machinery (HCM) or Earth Moving Equipment 3.45 (EME) or Multi Axle Vehicle (MAV) (four to six axles) Oversized Vehicles (seven or more axles) 4.20 1. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometres from the fee plaza is Rs 285.00 (Two Hundred and Eighty Five) for the year 2021-22 and is subject to revision every year as per the provisions of the said rules. 4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: - Table 4 Maximum number of one way Amount Payable Period of validity journeys allowed One and half times of the fee for one way Twenty four hours from the Two journey time of payment Two-third of amount of the fee payable for One month from date of Fifty fifty single journeys. payment 5. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 6. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules. 8. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules. 9. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the National Highways Authority of India on the basis of the completed length of the section and revised6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 10. The estimated capital cost of the project is Rupees 186.56 crore. [The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed and the final capital cost will be notified separately]. The National Highways Authority of India shall maintain a record of the recovery of capital cost through user fee realised and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
