प्रारूप जनयम 1. संजिि िीर्गक एवं प्रारंभ – (1) इन जनयमों को मोटर यान (........संिोधन) जनयमावली, 2025 कहा िाएगा। (2) य ेजनयम आजधकाररक रािपत्र में अपन ेप्रकािन की तारीख से प्रवृत् त होंगे। 8645 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. केंद्रीय मोटर य़ान जनयमावली (सीएमवीआर), 1989 (इसके बाि उि जनयमावली के रूप में उजल्लजखत) में, जनयम 52 में, उप जनयम (2) में, (क) "वाहन प्राजधकरण को भेिगे ा" िब्ि के पश्चात्, "या अजधकृत परीिण स्ट्टेिन" िब्ि अंतःस्ट्थाजपत दकए िाएगं े; (ख) ''दिटनेस प्रमाणपत्र'' िब्िों के पश्चात् ''िामग 38 म'ें' िब्ि अंतःस्ट्थाजपत दकए िाएगं े; (ग) "उस प्राजधकरण" िब्िों के पश्चात्, "या अजधकृत परीिण स्ट्टेिन" िब्ि अतं ःस्ट्थाजपत दकए िाएंगे; 3. जनयम 62 के, उपजनयम (1) में,- (क) ''पररवहन यान के संबंध में'' िब्िों के स्ट्थान पर ''मोटर यान के संबंध में'' िब्ि प्रजतस्ट्थाजपत दकए िाएंग;े (ख) खडं (घ) के पश्चात ्जनम्नजलजखत प्रजवजष्टयां अंतःस्ट्थाजपत की िाएंगी, अथागतः् - (ड़) नया गरै -पररवहन पंद्रह वर् ग वाहन (च) गरै -पररवहन वाहनों के पांच वर्ग: संबंध में दिटनेस प्रमाण पत्र का नवीनीकरण बिते दक केंद्रीय मोटर यान (…… संिोधन) जनयमावली, 2025 के प्रारंभ से हल्के मोटर वाहन की श्रेणी म ें आन े वाल े वाहन की दिटनेस केवल ऐस े स्ट्वचाजलत परीिण स्ट्टेिन के माध्यम से की िाएगी, िो जनयम 175 के तहत पंिीकृत, स्ट्वचाजलत परीिण स्ट्टेिन, पंिीकरण प्राजधकारी के अजधकार िेत्र म ेंसंचाजलत ह।ै "(ग) प्रथम परंतुक म,ें " दिटनसे प्रमाण पत्र का नवीनीकरण केवल एक जनरीिण अजधकारी या अजधकृत परीिण स्ट्टेिनों के पश्चात ् िैसा दक अजधजनयम की धारा 56 की उप-धारा (1) म ें जवजनर्िगष्ट दकए गए परीिण िोदक नीच े िी गई ताजलका म ें जनर्िष्टग ह ैं द्वारा दकया िाएगा ", िब्िों के स्ट्थान पर ""दिटनेस के प्रमाण पत्र का नवीनीकरण दिटनेस परीिण के समय वाहन का कम से कम िस सेकंड का जियो-टैग वीजडयो अपलोड करने के बाि ही दकया िाएगा, जिसमें पंिीकरण संख्या प्लेट, चेजसस नंबर, इंिन नंबर और वाहन की जविेर्ताओं की स्ट्पष्ट िश्ृ यता सुजनजश्चत करत े हुए सामन,े पीछे, िाईं ओर और बाईं ओर स ेवाहन की िश्ृ यता को ििागता हो " जिसमेः (i) जनयम 189 के उप-जनयम (1) में ताजलका-घ में जनर्िष्टग परीिणों को करन े के पश्चात ् धारा 56 की उप-धारा (1) में जनर्िष्टग अजधकृत परीिण स्ट्टेिन; या (ii) नीचे िी गई ताजलका में जनर्िगष्ट परीिणों को करन े के बाि जनरीिण अजधकारी" िब्ि प्रजतस्ट्थाजपत दकए िाएंगे। (घ) पहल े परंतुक में, ताजलका में, क्रम संख्या 20 और उससे संबंजधत प्रजवजष्टयों के पश्चात्, जनम्नजलजखत अंतःस्ट्थाजपत दकया िाएगा, अथागत्, - क्र.सं. िर दिटमेंट ओईएम की ितों की कायगकरण परीिण रटप्पजणयां िांच जसिाररिों के ि ााँच की िााँच अनुसार जनमाणग / प्रकार/ रेटटंग आदि की िांच (1) (2) (3) (4) (5) (6) (7) (8)[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 “(21) स्ट्पीड गवनरग हां हा ं हां हा ं नहीं जनयम 118 का अनुपालन (िश्ृ य) सुजनजश्चत करना। (1) िश्ृ य जनरीिण मानिडं : (i) सुरजित रूप स ेसुसजित; (ii) स्ट्पीड गवनगर को सील कर दिया िाएगा; (iii) स्ट्पीड गवनरग के जवद्युत तारों को अलग नहीं दकया िाएगा; (22) व्हीकल लोकेिन हां हा ं (िश्ृ य) हां (िश्ृ य) हा ं हा ं जनयम 90/जनयम रैककंग 125एच/जनयम 129 का (वीएलटी) अनुपालन सुजनजश्चत करना जडवाइस िश्ृ य जनरीिण मानिंड: (i) वाहन स्ट्थान रैककंग संस्ट्थाजपत की िाएगी; (ii) आपातकालीन अलामग बटन कायग करेगा। कायागत्मक जनरीिण मानिडं : (i) एआईएस 140 के अनुसार वाहन डेटाबेस में व्हीकल लोकेिन रैककंग जडवाइस सदक्रय होगा; (ii) ई-जसम की वधै ता अवजध उस जतजथ तक होगी जिस दिन वाहन के बाि का दिटनसे परीिण िेय होता ह।ै (23) उच्च सुरिा वाल े हां हा ं (िश्ृ य) हां (िश्ृ य) नहीं नहीं जनयम 50 का अनुपालन पंिीकरण प्लेट सुजनजश्चत करना। (एचएसआरपी) िश्ृ य जनरीिण मानिंड: (i) उच्च सरु िा ववंडिील्ड पर ततृ ीय पंिीकरण जचह्न सजहत वाहन के सामन े और पीछे संस्ट्थाजपत पंिीकरण प्लेट; (ii) सुरजित रूप से लगाया गया।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (24) रेरो-ररफ्लेक्टर हां हा ं हां (िश्ृ य) नहीं नहीं िश्ृ य जनरीिण और ररफ्लेजक्टव मानिंड: टेप (क) परावतगक (i) स्ट्वच्छ परावतगक की मौिूिगी सुजनजश्चत करना; (ii) ररफ्लेक्टरों का सुरजित दिटमेंट; (iii) परावतगक िजतग्रस्ट्त नहीं होंगे ितग; (iv) सुजनजश्चत करना दक परावतगक का रंग जनयम 104 के अनुसार होगा, अथागत, पीछे की ओर लाल रंग या सामने की ओर सिेि। (ख) ररफ्लेजक्टव टेप (i) स्ट्वच्छ परावतगक टेपों की मौिूिगी सुजनजश्चत करना; (ii) वाहन पर सुरजित रूप स े जचपकाया गया हो; (iii) सुजनजश्चत करना दक ररफ्लेजक्टव टेप का आकार, रंग और स्ट्थान जनयम 104 के अनुसार होगा; (iv) ररफ्लेजक्टव टेप िजतग्रस्ट्त नहीं हों; (v) जचन्ह अंदकत सामग्री के बाहर स्ट्पष्ट रूप स ेसुपाठ्य दिखाई िेंग ेऔर अजमट होंगे। (25) सुरिा बेल्ट हां नहीं हां नहीं नहीं जनयम 125 या 125क का (सीट बेल्ट) (िश्ृ य) अनुपालन सुजनजश्चत करना। िश्ृ य जनरीिण मानिंड: (i) अजनवायग सुरिा बल्े ट उपलब्ध और सरु जित रूप से दिट दकए िाएंगे; (ii) सुरिा बल्े ट िजतग्रस्ट्त नहीं हों; (iii) सुरिा बेल्ट एंकरेि ढीला नहीं हो;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (iv) सीटबेल्ट ररमाइंडर प्रणाली, यदि उपलब्ध हो, सुचारू जस्ट्थजत में होनी चाजहए; (v) सीटबेल्ट का िी-लॉक सुचारू जस्ट्थजत में होना चाजहए। (ङ) जद्वतीय परंतुक म,ें “दिटनसे प्रमाणपत्र का नवीनीकरण नीचे िी गई ताजलका में जनर्िष्टग परीिणों को संपन्न करने के बाि ही दकया िाएगा” िब्िों के स्ट्थान पर, “दिटनेस प्रमाणपत्र का नवीनीकरण नीचे िी गई ताजलका म ें जनर्िगष्ट परीिणों को संपन्न करने के बाि, वाहन के आग,े पीछे, िाजहनी ओर और बाईं ओर से पंिीकरण संख्या प्लेट, चेजसस संख्या और वाहन की जविेर्ताओं की सुस्ट्पष्ट िश्ृ यता सुजनजश्चत करत े हुए, दिटनेस परीिण के समय वाहन का कम से कम िस सेकंड का जियो-टैग दकया हुआ वीजडयो अपलोड करन े के बाि ही दकया िाएगा” िब्ि प्रजतस्ट्थाजपत दकए िाएंगे। (च) तृतीय परंतुक और चतुथ गपरंतुक का जवलोपन कर दिया िाएगा; (छ) पााँचवें परंतुक के स्ट्थान पर जनम्नजलजखत प्रावधान अतः स्ट्थाजपत दकए िाएंगे, अथागत:् - “इसके अलावा, पूण ग रूप स े जनर्मगत वाहन के रूप म ें जबक्री दकए िाने वाले नए गरै -पररवहन वाहन के पंिीकरण के समय दकसी दिटनेस प्रमाण पत्र की आवश्यकता नहीं होगी और ऐस े वाहन को पंिीकरण की जतजथ स े पंद्रह वर्ों की अवजध के जलए दिटनेस प्रमाण पत्र प्राि माना िाएगा। 4. उि जनयमावली के जनयम 174 म,ें उप-जनयम (1) के खंड (iii) म,ें "िॉमग 25 के जलए" िब्ि जवलोजपत दकए िाएंगे। 5. उि जनयमावली के जनयम 176 म,ें उप-जनयम (1) म,ें (क) प्रथम परंतुक में, “वाहन जनमागता या” और “ऑटोमोबाइल डीलर या” िब्ि का जवलोपन दकया िाएगा; (ख) प्रथम परंतुक में, “के जनमाणग या जबक्री” िब्िों के बाि, “वाहन या” िब्ि का जवलोपन दकया िाएगा; (ग) जद्वतीय परंतुक में, “वाहन जनमागता या” और “ऑटोमोबाइल डीलर या” िब्ि का जवलोपन दकया िाएगा (घ) जद्वतीय परंतुक में, “के जनमागण या जबक्री” िब्िों के बाि, “वाहन या” िब्ि का जवलोपन दकया िाएगा। 6. उि जनयमावली के जनयम 177 म,ें उप-जनयम (2) में, "जवजनमागण या जबक्री" िब्िों के बाि, "वाहन या" िब्ि जवलोजपत दकए िाएंगे। 7. उि जनयमावली के जनयम 181 म,ें (क) उप-जनयम (2) को जवलोजपत दकया िाएगा (ख) उप-जनयम (3) के स्ट्थान पर जनम्नजलजखत उप-जनयम प्रजतस्ट्थाजपत दकया िाएगा, अथागत:् - “(3) स्ट्वचाजलत परीिण केंद्र पर दिटनेस परीिण के जलए स्ट्लॉट बुक करते समय वाहन पहचान और वाहन के स्ट्वामी की पहचान के जलए जनम्नजलजखत िानकारी ििग की िाएगी, अथातग ्: - (i) वाहन की पंिीकरण संख्या (ii) पंिीकृत स्ट्वामी या अजधकृत हस्ट्तािरकताग का मोबाइल नंबर (ग) उप-जनयम (4) म,ें (i) खडं (viii) म,ें "जनमागण का माह और वर्ग;" िब्िों के बाि, "और" िब्ि जवलोजपत दकया िाएगा। (ii) खंड (ix) के स्ट्थान पर जनम्नजलजखत खडं अतः स्ट्थाजपत दकए िाएंगे, अथागत:् - “(x) बीमा वैधता;6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (xi) परजमट वैधता, िहााँ भी लागू हो; (xii) पीयूसीसी वैधता। (घ) उप-जनयम (5) म,ें “दकए िाने वाले परीिणों की सूची” िब्िों स े पहल,े “स्ट्वचाजलत परीिण स्ट्टेिन पर वाहन दिटनेस परीिण तभी प्रारंभ दकया िाएगा िब स्ट्वचाजलत नंबर प्लेट पहचान कैमरे के माध्यम से वाहन पंिीकरण संख्या को पढ़कर स्ट्वचाजलत परीिण स्ट्टेिन पर वाहन की उपजस्ट्थजत को सत्याजपत दकया िाएगा।” िब्ि अतः स्ट्थाजपत दकए िाएंग।े (ङ) उप-जनयम (6) म,ें (i) खडं (ii) के स्ट्थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकया िाएगा, अथातग ्: - “सभी स्ट्वचाजलत परीिण डेटा परीिण उपकरण स े स्ट्वचाजलत परीिण स्ट्टेिन म ें स्ट्थाजपत सवगर पर वास्ट्तजवक समय के आधार पर एजन्क्रप्टेड प्रारूप म ें स्ट्वचाजलत रूप से प्रेजर्त दकया िाएगा और आगे इस सवगर से केंद्रीय सवगर पर एजन्क्रप्टेड प्रारूप म ेंस्ट्वचाजलत रूप से प्रेजर्त दकया िाएगा।” (ii) खंड (v) को जवलोजपत दकया िाएगा (iii) खंड (vi) के स्ट्थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकया िाएगा, अथातग ्: - “वाहन के आग,े पीछे, िाएं और बाएं ओर से ली गई तस्ट्वीरों और कम से कम िस सेकंड के वीजडयो सजहत िश्ृ यता िांच डेटा, जिसमें वाहन की पंिीकरण सख्ं या प्लेट, चेजसस संख्या और इंिन नबं र, वाहन की जविेर्ताएं और स्ट्वचाजलत परीिण स्ट्टेिन म ें परीिण उपकरण कंसोल के साथ वाहन की उपजस्ट्थजत सुस्ट्पष्ट रूप स े दिखाई िे, को ग्लोबल पोजििवनंग जसस्ट्टम (िीपीएसी) से लैस कैमरे द्वारा कैप्चर दकया िाएगा और स्ट्वचाजलत परीिण स्ट्टेिन म ें संस्ट्थाजपत सवगर पर स्ट्थानांतररत दकया िाएगा और दिर इस सवगर से स्ट्वचाजलत रूप से एक केंद्रीय सवगर पर प्रेजर्त दकया िाएगा।” (च) उप-जनयम (7) म,ें (i) “िॉमग 25 या” और “िैसा भी मामला हो” िब्िों का जवलोपन दकया िाएगा। (ii) खंड (iv) म,ें “जववरण” िब्ि के बाि “और िोटोग्राि” िब्ि अतः स्ट्थाजपत दकए िाएंगे। 8. उि जनयमावली के जनयम 182 में, (क) उप-जनयम (1) म,ें “िोर्ों को ठीक करवाने के बाि” िब्िों के स्ट्थान पर, “जनयम 81 में जनर्िष्टग िल्ु क का भुगतान करन े के बाि” िब्ि प्रजतस्ट्थाजपत दकए िाएंग;े (ख) उप-जनयम (1क) को जवलोजपत दकया िाएगा; (ग) उप-जनयम (2) म,ें “एकाजधक पुनः परीिण” िब्िों के बाि, “जनयम 81 म ें जनर्िगष्ट िुल्क का भुगतान करने के बाि” िब्ि अतः स्ट्थाजपत दकए िाएंगे। 9. उि जनयमावली के जनयम 189 में, (क) ताजलका-घ में, क्रमांक 23 पर, (i) कॉलम 5 म,ें "िश्ृ य" िब्ि के स्ट्थान पर "िश्ृ य और कायागत्मक" िब्ि प्रजतस्ट्थाजपत दकए िाएगं े; (ii) कॉलम 7 म ें क्रमांक (ii) के बाि जनम्नजलजखत को अतः स्ट्थाजपत दकया िाएगा, अथागत:् - "कायागत्मक जनरीिण पैरामीटर: (i) वाहन स्ट्थान रैककंग जडवाइस एआईएस 140 के अनुसार वाहन डेटाबेस म ेंसदक्रय होना चाजहए; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty days from the date on which the copies of this notification, as published in the Official Gazette, are made available to the public; Objections and suggestions to these draft rules, if any, may be sent to the Additional Secretary (Transport), email: comments-morth@gov.in, Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110 001. The objections or suggestions which may be received from any person in respect of the said draft rules before the expiry of the aforesaid period will be considered by the Central Government. DRAFT RULES 1. Short title and commencement. – (1) These rules may be called the Central Motor Vehicles (….. Amendment) Rules, 2025 (2) They shall come into force from the date of publication of the notification. 2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the said rules), in rule 52, in sub-rule (2), (a) after the words "shall refer the vehicle to the authority", the words "or authorised testing station" shall be inserted; (b) after the words "certificate of fitness", the words ", in Form 38" shall be inserted; (c) after the words "from that authority", the words "or authorised testing station" shall be inserted. 3. In rule 62, in sub-rule (1), (a) for the words “in respect of a transport vehicle”, the words “in respect of a motor vehicle” shall be substituted; (b) After clause (d), the following entries shall be inserted, namely: - (e) new non-transport fifteen years vehicle (f) renewal of five years: certificate of fitness[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 in respect of non- Provided that where the automated testing station registered under rule 175 is transport vehicles operational in the jurisdiction of a registering authority, the fitness of the vehicle of the category light motor vehicle shall be done only through such automated testing station with effect from the commencement of the Central Motor Vehicles (…… Amendment) Rules, 2025. (c) in the first proviso, for the words “the renewal of a fitness certificate shall be made only after an Inspecting Officer or authorised testing stations as referred to in sub-section (1) of section 56 of the Act has carried the tests specified in the Table given below”, the words “the renewal of a certificate of fitness shall be made only after uploading at least a ten seconds geo- tagged video of the vehicle at the time of fitness test, capturing the vehicle from front, rear, right side and left side ensuring clear visibility of the registration number plate, chassis number, engine number and features of the vehicle by an: (i) authorised testing station as referred to in sub-section (1) of section 56 after carrying out the tests specified in the Table-D in sub-rule (1) of rule 189; or (ii) Inspecting Officer after carrying out the tests specified in the Table given below” shall be substituted. In rule 174 of the said rules, in sub-rule (1), clause (iii), the words “in Form 25 for” shall be omitted. 5. In rule 176 of the said rules, in sub-rule (1), (a) in the first proviso, the words “vehicle manufacturer or” and the words “automobile dealer or” shall be omitted; (b) in the first proviso, after the words “manufacturing or sale of”, the words “vehicle or” shall be omitted; (c) in the second proviso, the words “vehicle manufacturer or” and the words “automobile dealer or” shall be omitted; (d) in the second proviso, after the words “manufacturing or sale of”, the words “vehicle or” shall be omitted. 6. In rule 177 of the said rules, in sub-rule (2), after the words “manufacturing or sale of”, the words “vehicles or” shall be omitted. 7. In rule 181 of the said rules, (a) sub-rule (2) shall be omitted (b) for sub-rule (3), the following sub-rule shall be substituted, namely: - “(3) The following information for vehicle identification and vehicle owner identification shall be entered at the time of booking a slot for fitness test at an automated testing station, namely: - (i) Registration number of a vehicle (ii) Mobile number of the registered owner or authorised signatory” (c) in sub-rule (4), (i) in clause (viii), after the words "Month and Year of Manufacture; ", the word “and” shall be omitted (ii) after clause (ix), the following clauses shall be inserted, namely: - “(x) insurance validity;14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (xi) permit validity, wherever applicable; (xii) PUCC validity.” (d) In sub-rule (5), before the words “The list of tests to be conducted”, the words “The vehicle fitness testing at an automated testing station shall be triggered only after reading the vehicle registration number through Automatic Number Plate Recognition camera to validate the presence of the vehicle at an automated testing station.” shall be inserted. (e) in sub-rule (6), (i) for clause (ii), the following shall be substituted, namely: - “all automated test data shall be automatically transmitted from testing equipment to a server installed in the automated testing station on real-time basis in an encrypted format and further shall be automatically transmitted from this server to a central server in an encrypted format” (ii) clause (v) shall be omitted (iii) for clause (vi), the following shall be substituted, namely: - “The visual checks data, including photographs and at least a ten seconds video of the vehicle from front, rear, right side and left side ensuring clear visibility of the registration number plate, chassis number and engine number of the vehicle, features of the vehicle and presence of the vehicle in the automated testing station along with testing equipment console shall be captured by Global Positioning System enabled camera and shall be transferred to the server installed in the automated testing station and further automatically transmitted from this server to a central server” (f) in sub-rule (7), (i) the words “Form 25 or” and the words “,as the case may be,” shall be omitted. (ii) in clause (iv), after the word “details”, the words “and photographs” shall be inserted. 8. In rule 182 of the said rules, (a) in sub-rule (1), for the words “after getting the defects rectified”, the words “after paying fees as specified in rule 81” shall be substituted; (b) sub-rule (1A) shall be omitted; (c) in sub-rule (2), after the words “multiple re-tests”, the words “after paying fees as specified in rule 81” shall be inserted. 9. In rule 189 of the said rules, (a) In Table-D, at serial number 23,[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 15 (i) In column 5, for the word “Visual” the words “Visual and Functional” shall be substituted; (ii) In column 7, after serial no. (ii), the following shall be inserted, namely:- "Functional inspection parameters: (i) Vehicle Location Tracking Device shall be active in VAHAN database as per AIS 140; (ii) e-SIM shall have a validity period up to the date on which the subsequent fitness test of the vehicle falls due; (iii) Location of the vehicle during the fitness test shall be validated through Vehicle Location Tracking Device." (b) in sub-rule (1), (i) in Note (a), the words “and shall be allowed to apply for multiple re-tests after paying prescribed fitness testing fee” shall be omitted; (ii) for Note (b), the following shall be substituted, namely: - “(b) if a vehicle is not declared as ‘fit’ within 180 days from the first date of vehicle declared as ‘unfit’ (excluding the day of test) after failing any of the tests listed in (a) above or from the date of expiry of fitness certificate, whichever is later, the vehicle shall be categorized as ‘End of Life Vehicle (ELV) and flagged in the VAHAN as ‘ELV’. The registering authority of the State / Union Territory to their satisfaction, may allow extension beyond 180 days, under exceptional circumstances”; (iii) in Note (c), the words “Such vehicle may undergo multiple re-tests, after paying the prescribed fitness testing fee” shall be omitted. (c) in sub-rule (5), for the words “All visual checks conducted on a vehicle in an Automated Testing Station shall be photographed using a mobile device and the record of the same”, the words “All test data and visual checks data, including photographs and videos, captured as per sub-rule (6) of rule 181,” shall be substituted 10.
