सा.का.जन. 360(अ).— राष्ट्रपजत, संजवधान के अनुच्छेि 309 के परंतुक द्वारा प्रित्त िजियों का प्रयोग करते हुए जनम्नजलजखत जनयम बनाती ह,ैं अर्ाडत:् - 1. सजं िप्त नाम और प्रारंभ.- (1) इन जनयमों का संजिप्त नाम रेलव ेबोडड सजचवालय सेवा जनयम, 2026 ह।ै (2) ये रािपत्र म ेंप्रकािन की तारीख को प्रवृत्त होंगे। 2. पररभाषाएं .– इन जनयमों म,ें िब तक दक संिभड स ेअन्यर्ा अपेजित न हो,- (क) दकसी ग्रेड के संबंध म ें “जनयिु प्राजधकारी” से वह प्राजधकारी अजभप्रेत ह ैिो भारतीय रेल स्ट्र्ापना संजहता, जिल्ि-I, के उपबंधों के अधीन उस ग्रेड म ेंजनयुजि करने के जलए सिि ह;ै (ख) “जनयत दिन” से वह तारीख अजभप्रेत ह ैिब य ेजनयम प्रवृत्त हों; (ग) दकसी ग्रडे के संबंध म ें “अनुमोदित सेवा” स ेअजभप्रेत ह ै- 3440 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (i) उस ग्रडे म ें सीध े भती दकए गए दकसी अजधकारी के संबंध में, उस वषड से, िब सीधी भती के जलए परीिा आयोजित की गई र्ी, अगले वषड के िलु ाई मास की पहली तारीख से उस ग्रेड में की गई जनयजमत सेवा की अवजध या अवजधयां, जिसमें अनुपजस्ट्र्जत की वह अवजध या अवजधयां सजममजलत ह ैं जिसके िौरान उसन े ग्रेड में जनयजमत आधार पर तब पिधाररत दकया रहता, यदि वह छुट्टी पर नहीं होता या उस पि को धाररत करन े के जलए अन्यर्ा उपलब्ध नहीं होता; (ii) उस ग्रेड म ेंजवभागीय परीिा के माध्यम से भती दकए गए दकसी अजधकारी के संबंध में उस वष डके िुलाई मास की पहली तारीख से, जिसकी ररजियों के जलए ऐसी परीिा आयोजित की गई र्ी, ग्रडे में की गई जनयजमत सेवा की अवजध या अवजधयां, जिसमें अनुपजस्ट्र्जत की वह अवजध या अवजधया ं सजममजलत ह ै जिसके िौरान उसने ग्रेड में जनयजमत आधार पर उस ििा में ऐसा पि धाररत दकया रहता, यदि वह छुट्टी पर नहीं होता या उि पि पर धाररत करने के जलए अन्यर्ा उपलब्ध नहीं होता; (iii) जनम्नतर ग्रडे में सेवाकाल के आधार पर ग्रडे में भती दकए गए दकसी अजधकारी के संबंध में उस वषड के िुलाई मास की पहली तारीख से, जिसके जलए भती की गई र्ी, ग्रडे में की गई जनयजमत सेवा की अवजध या अवजधयां जिसमें अनुपजस्ट्र्जत की वह अवजध या अवजधयां सजममजलत ह ैंजिसके िौरान उसने ग्रडे म ेंजनयजमत आधार पर उस ििा में पिधाररत दकया रहता ह ैजिसके िौरान यदि वह छुट्टी पर नहीं होता या उि पि धाररत करन ेके जलए अन्यर्ा उपलब्ध नहीं होता: परंत ु उपखंड (i), (ii) और (iii) में उजल्लजखत मामलों में से दकसी में भी जनयुजि ग्रहण करने म ेंनब्बे दिन से अजधक का जवलंब हो तो वह जवलंब उस अजधकारी की दकसी त्रुरि से नहीं होना चाजहए; (घ) सेवा की दकसी ग्रेड के संबंध में "प्राजधकृत संख्या" स ेउस ग्रेड में ड्यूिी पिों की वह संख्या, िो जनयम 5 म ें यर्ाजवजनर्िडष्ट ह,ै अजभप्रेत ह ैजिसके प्रजत जनयजमत जनयुजियां की िा सकेंगी; (ङ) "संवगड" से रेल मंत्रालय (रेलवे बोडड) म ेंउच्च प्रिासजनक ग्रडे (सलाहकार), वररष्ठ प्रिासजनक ग्रडे (संयुि सजचव या कायडकारी जनिेिक), वररष्ठ चयन ग्रेड (जनििे क), चयन ग्रडे (उप सजचव या संयुि जनिेिक), ग्रेड-I (अवर सजचव या उप जनिेिक), अनुभाग अजधकारी और सहायक अनुभाग अजधकारी के पिों का समूह अजभप्रते ह;ै (च) रेलवे बोड डसजचवालय सेवा के दकसी भी ग्रेड में जनयिु अजधकाररयों के संबंध में "संवगड जनयंत्रण प्राजधकारी" से रेल मंत्रालय (रेलवे बोड)ड अजभप्रेत ह;ै (छ) दकसी भी ग्रेड के संबंध म ें "संवगड अजधकारी" स ेरेलवे बोड डसजचवालय सेवा के सिस्ट्य अजभप्रते हैं; (ि) “आयोग” स ेसंघ लोक सेवा आयोग अजभप्रेत ह;ै (झ) सीजमत जवभागीय प्रजतयोजगता परीिा के संबंध में "जनणाडयक जतजर्" से उस वषड की िुलाई की पहली तारीख अजभप्रेत ह,ै जिसमें परीिा आयोजित की िाती ह;ै (ञ) “सीधी भती” स ेवह व्यजि अजभप्रेत ह ैजिसकी भती कमडचारी चयन आयोग के माध्यम स ेभती की गई जवभागीय प्रजतयोगी परीिा से जभन्न, दकसी प्रजतयोगी परीिा के आधार पर भती की गई है; (ि) सेवा की दकसी ग्रेड के संबंध में “ड्यूिी पि” से वह संवगड पि अजभप्रेत ह ैिो सेवा के अजधकाररयों ने उस ग्रेड के दकसी पि में मलू आधार पर धाररत दकया हुआ है; (ठ) “पात्र अजधकारी” से ऐसा अजधकारी अजभप्रेत ह ैजिसने रेल मत्रं ालय द्वारा जवजहत संवग डप्रजििण योिना, यदि कोई हो, के अंतगडत अजनवायड प्रजििण कायडक्रम को सफलतापवू डक पूरा कर जलया हो और िो जनयम 8, 9 और 10[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 के अधीन रेलवे बोड डसजचवालय सेवा की, यर्ाजस्ट्र्जत, उच्चतर प्रिासजनक ग्रडे , वररष्ठ प्रिासजनक ग्रडे , वररष्ठ चयन ग्रेड, चयन ग्रेड, ग्रडे -I, अनुभाग अजधकारी और सहायक अनुभाग अजधकारी ग्रेड में जनयुजि के जलए जवचार दकए िाने का पात्र हो, उस कैलडें र वषड की 1 िलु ाई को जिसके जलए चयन सूची तैयार की िाती है; (ड) "चयन िेत्र" स ेपात्र अजधकाररयों की वह सूची अजभप्रेत है, जिसमें से चयन सूची म ेंिाजमल करने के जलए चयन दकया िाएगा; (ढ) “ग्रडे ” से जनयम 3 म ें जवजनर्िडष्ट कोई ग्रेड अजभप्रते ह;ै (ण) “सरकार” से रेल मंत्रालय, भारत सरकार अजभप्रेत ह;ै (त) सेवा की दकसी ग्रेड के संबंध में “सीजमत जवभागीय प्रजतयोगी परीिा” स,े यर्ाजस्ट्र्जत, सघं लोक सेवा आयोग या कमडचारी चयन आयोग द्वारा उस ग्रेड के जलए अभ्यर्र्डयों के चयन के जलए आयोजित प्रजतयोगी परीिा अजभप्रेत है; (र्) “मंत्रालय” से भारत सरकार का रेल मंत्रालय (रेलवे बोडड) अजभप्रेत ह;ै (ि) “अन्य जपछडा वगड” से भारत सरकार द्वारा समय-समय पर अन्य जपछडा वग डके रूप म ेंअजधसूजचत िाजतयां और समुिाय अजभप्रेत ह;ैं (ध) “स्ट्र्ायी अजधकारी” से वह व्यजि अजभप्रेत ह ैजिसे सेवा में पुजष्टकरण दकया गया है; (न) “दिव्यांग व्यजि" से दिव्यांगिन अजधकार अजधजनयम 2016 (2016 का 49) की धारा 2 के खंड (ध) में पररभाजषत दिव्यांग व्यजि अजभप्रेत ह;ै (प) “पररवीिाधीन” से वह अजधकारी अजभप्रेत ह ैजिसे सहायक अनुभाग अजधकारी की ग्रेड में सीधे भती दकया गया ह ै या प्रोन्नत दकया गया ह ैया जनयजमत ररजि के जलए पररवीिा पर ग्रेड-I में जनयिु दकया गया ह;ै (फ) दकसी ग्रेड के संबंध म ें "वररष्ठता की सीमा" से उस ग्रेड को चयन सूची में िोडने के जलए वररष्ठता सूची में केन्रीय सरकार के रेल मंत्रालय द्वारा जवजनर्िडष्ट सीमा अजभप्रेत है; (ब) दकसी ग्रेड के संबंध म ें “जनयजमत अजधकारी” से वह व्यजि अजभप्रेत ह ैजिसे सीधी भती के माध्यम से या सीजमत जवभागीय प्रजतयोगी परीिा के माध्यम से या चयन सूची से प्रोन्नजत के माध्यम से जनयजमत ररजि के जलए जनयिु दकया गया ह ैऔर जिसने जनयुजि प्राजधकारी की संतुजष्ट के अनसु ार जनयम 12 के अधीन पररवीिा अवजध परू ी कर ली ह;ै (भ) दकसी ग्रेड के संबंध म ें “जनयजमत ररजियााँ” में पिधाररयों की मृत्यु, सेवाजनवृजत्त, प्रोन्नजत, त्यागपत्र, प्रजतजनयुजि या स्ट्र्ानांतरण या एक वष ड से अजधक लंबी छुट्टी से उत्पन्न ररजिया ंसजममजलत हैं; (म) “अनुसूची” से इन जनयमों की अनुसूची अजभप्रेत ह;ै (य) "अनुसूजचत िाजत" तर्ा "अनुसूजचत िनिाजत" के वही अर् डहोंग,े िो संजवधान के अनुच्छेि 366 के क्रमि: खडं (24) तर्ा (25) द्वारा उनके जलए जनर्िडष्ट ह;ैं (य क) "चयन सूची" से वररष्ठ प्रिासजनक ग्रडे , वररष्ठ चयन ग्रडे , चयन ग्रेड, ग्रेड -I, अनुभाग अजधकारी ग्रडे तर्ा सहायक अनुभाग अजधकारी ग्रडे के संबंध में, यर्ाजस्ट्र्जत, जनयम 8 के उपजनयम (6), जनयम 9 के उपजनयम (3) या जनयम 10 के उपजनयम (5) के अधीन बनाए गए जवजनयमों के अनुसार तैयार की गई चयन सूची अजभप्रेत है; (य ख) "चयन" से रेलवे बोड डसजचवालय सेवा की दकसी भी ग्रेड के जलए चयन सूची म ेंिाजमल होना अजभप्रेत ह;ै4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (य ग) “सेवा” से रेलवे बोडड सजचवालय सेवा अजभप्रेत ह;ै (य घ) दकसी भी ग्रेड के संबंध म ें "वररष्ठता सूची" से उस ग्रेड के अजधकाररयों की जनयत जतजर् को वररष्ठता सूची अजभप्रेत ह,ै जिसे संबंजधत जवजनयमों के अनुसार वार्षडक रूप स ेपुनरीजित दकया िाता है; (य ङ) "जवचाराधीन िेत्र" से पात्र अजधकाररयों की सूची अजभप्रेत ह ैजिसमें से चयन सूची म ेंनाम िाजमल दकये िायेंगे; 3. सवे ा की सरं चना.- (1) सेवा म ेंसात ग्रडे होंग,े जिन्ह ेंनीचे िी गई सारणी म ेंिो समूहों म ेंवगीकृत दकया गया है:- सारणी क्र.सं. पि समूह ग्रेड वगीकरण (1) (2) (3) (4) 1. ‘क’ उच्चतर प्रिासजनक ग्रडे (सलाहकार) रेलवे बोड डसजचवालय सेवा समहू ‘क’ अनुसजचवीय वररष्ठ प्रिासजनक ग्रडे रेलवे बोड डसजचवालय सेवा समहू ‘क’ अनुसजचवीय 2. ‘क’ (संयुि सजचव या कायडकारी जनिेिक) 3. ‘क’ वररष्ठ चयन ग्रडे रेलवे बोड डसजचवालय सेवा समहू ‘क’ अनुसजचवीय (जनिेिक) चयन ग्रडे रेलवे बोड डसजचवालय सेवा समहू ‘क’ अनुसजचवीय 4. ‘क’ (उप सजचव या संयुि जनिेिक) 5. ‘क’ ग्रेड-I रेलवे बोड डसजचवालय सेवा समहू ‘क’ अनुसजचवीय (अवर सजचव या उप जनििे क) 6. ‘ख’ अनुभाग अजधकारी रेलवे बोड डसजचवालय सेवा समहू ‘ख’ (रािपजत्रत) अनुसजचवीय 7. ‘ख’ सहायक अनुभाग अजधकारी रेलवे बोड डसजचवालय सेवा समहू ‘ख’ (अरािपजत्रत) अनुसजचवीय (2) उच् चतर प्रिासजनक ग्रेड, वररष्ठ प्रिासजनक ग्रडे , वररष्ठ चयन ग्रडे , चयन ग्रडे , ग्रडे -I तर्ा अनुभाग अजधकारी ग्रडे के पि रािपजत्रत पि होंगे तर्ा सहायक अनुभाग अजधकारी ग्रडे के पि अरािपजत्रत पि होंगे 4. रेलव ेबोड डसजचवालय सवे ा के अजधकाररयों की सयं िु पिक्रम सचू ी.– जनयम 3 में जवजनर्िडष्ट सेवा के प्रत्येक ग्रडे के जलए एक संयिु पिक्रम सूची होगी जिसे वररष्ठता सूची कहा िाएगा। 5. सवे ा की प्राजधकृत सवं ग डसख्ं या.- सेवा की जवजभन्न ग्रडे ों की प्राजधकृत संख्या और वेतन मैररक्स में स्ट्तर अनुसूची में जवजनर्िडष्ट अनुसार होंग े 6. सवं ग डअजधकररयों द्वारा धाररत दकए िान ेवाल ेड्यिू ी पि.- सेवा में प्रत्येक ड्यूिी पि, समुजचत ग्रेड के संवग ड अजधकारी द्वारा धाररत दकया िाएगा। 7. पजु ष्टकरण.- रेलवे बोडड सजचवालय सेवा के सभी अजधकररयों की पुजष्ट सेवा में प्रवेि स्ट्तर पर केवल एक बार की िाएगी।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 8. उच्च तर प्रिासजनक ग्रडे , वररष्ठ प्रिासजनक ग्रडे , वररष्ठ चयन ग्रडे , चयन ग्रडे और ग्रडे -I म ेंभती. - (1) रेलवे बोड डसजचवालय सेवा के उच्चतर प्रिासजनक ग्रेड में जनयजमत ररजि को, समय-समय पर कार्मडक और प्रजििण जवभाग के परामि डस ेकेन्रीय सरकार के रेल मंत्रालय द्वारा तय दकए गए मानिडं ों के अनुसार वररष्ठ प्रिासजनक ग्रडे के जनयजमत अजधकारी की पिोन्नजत द्वारा भरी िाएगी। (2) वररष्ठ प्रिासजनक ग्रडे में जनयजमत ररजिया ं उन जनयजमत अजधकाररयों की प्रोन्नजत से भरी िाएंगी, जिन्होंन े रेलवे बोडड सजचवालय सेवा के चयन ग्रेड म ें आठ वष ड की अनुमोदित सेवा की हो और जिन्ह ें न्यूनतम तीन वष ड की अवजध के जलए वररष्ठ चयन ग्रेड के पि के जलए उपयुि माना गया हो और िो उप-जनयम (6) के अधीन तैयार की गई वररष्ठ प्रिासजनक ग्रडे की चयन सूची में सजममजलत हों। (3) वररष्ठ चयन ग्रेड में जनयजमत ररजियां चयन ग्रडे के उन जनयजमत अजधकाररयों की प्रोन्नजत से भरी िाएंगी, जिन्होंन े उस ग्रडे में कम स े कम पांच वष ड की अनुमोदित सेवा की हो और िो उप-जनयम (6) के अधीन तैयार की गई वररष्ठ चयन ग्रडे के जलए चयन सूची म ेंसजममजलत हों: परंत ु िहां पांच वष ड की अनुमोदित सेवा वाले पात्र अजधकाररयों की पयाडप्त संख्या उपलब्ध न हो, वहां चयन ग्रडे के जनयजमत अजधकारी, जिन्होंने उस ग्रेड म ेंकम से कम तीन वष डकी जनयजमत सेवा की हो और ग्रडे -I म ेंउनकी जनयुजि से कम स ेकम िस वष डकी अनुमोदित सेवा की हो, वे भी प्रोन्नजत के जलए पात्र होंगे। (4) चयन ग्रेड में जनयजमत ररजिया ंग्रेड-I के ऐस ेजनयजमत अजधकाररयों की प्रोन्नजत से भरी िाएंगी, जिन्होंन े उस ग्रेड म ें कम से कम पांच वषड की अनुमोदित सेवा की हो और उप-जनयम (6) के अधीन चयन ग्रडे के जलए तैयार की गई चयन सूची में सजममजलत हों। (5) ग्रेड-I म ेंजनयजमत ररजियां अनभु ाग अजधकारी ग्रेड के उन जनयजमत अजधकाररयों की प्रोन्नजत स ेभरी िाएंगी, जिन्होंन े उस ग्रेड म ें कम स े कम आठ वषड की अनुमोदित सेवा की हो और उप-जनयम (6) के अधीन तैयार की गई सेवा के ग्रेड-I के जलए चयन सूची में सजममजलत हों। (6) उप-जनयम (2), (3), (4) और (5) के प्रयोिनों के जलए, वररष्ठ प्रिासजनक ग्रेड, वररष्ठ चयन ग्रडे , चयन ग्रेड और ग्रेड-I के जलए चयन सूची वार्षकड रूप स े तैयार और प्रकाजित की िाएगी और चयन सूजचयों को तैयार करने और पुनरीजित करन े की प्रदक्रया जवजनयमों में यर्ा उपबंजधत होगी: परंत ु ग्रडे -I के जलए चयन सूची आयोग के परामिड से तैयार की िाएगी। 9. अनभु ाग अजधकारी ग्रडे म ेंभती.- (1) अनुभाग अजधकारी ग्रडे म ेंजनयजमत ररजियों को अनुभाग अजधकारी ग्रडे के जलए चयन सूची में सजममजलत व्यजियों की जनयुजि स ेभरा िाएगा, जिसमें पचास प्रजतित सहायक अनुभाग अजधकारी ग्रडे के जनयजमत अजधकाररयों में से होंगे, जिन्होंन े उस ग्रेड में कम से कम आठ वषड की अनुमोदित सेवा प्रिान की हो और पचास प्रजतित सीजमत जवभागीय प्रजतयोगी परीिा के माध्यम से चयजनत व्यजियों में से होंगे। (2) उपजनयम (1) म ेंजनर्िडष्ट सीजमत जवभागीय प्रजतयोगी परीिा के जनयम जवजनयमों में यर्ा जवजनर्िडष्ट होंगे: परंत ु यदि दकसी भती वषड म ेंसवं गड इकाई म ेंररजिया ंभरन े के जलए अभ्यर्र्डयों की पयाडप्त संख्या उपलब्ध न हो तो सीजमत जवभागीय प्रजतयोगी परीिा द्वारा या ज्यष्ठे ता के आधार पर प्रोन्नजत द्वारा, अपूररत ररजियों को अग्रेनीत की िाएंगी और उन्ह ेंअगल ेवषड म ेंभरी िाने वाली भती के उसी तरीके की ररजियों की संख्या में िोडा िाएगा: परंत ु यह और दक उि अपूररत ररजियों को उस वषड के पश्चात ्जिससे दक भती संबंजधत है, िो भती वषों से अजधक के जलए अग्रेजषत नहीं दकया िाएगा और इसके पश्चात ्यदि भती की एक रीजत से संबंजधत ररजियां, अपूररत रह िाएं तो उन्ह ेंभती की अन्य रीजत के जलए अजतररि ररजियों के तौर पर अतं ररत दकया िाएगा।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (3) अनुभाग अजधकारी ग्रडे के जलए चयन सूची तैयार करन े और पनु रीजित करन े की प्रदक्रया जवजनयमों में जवजनर्िडष्ट की िाएगी। 10. सहायक अनभु ाग अजधकारी ग्रडे म ेंभती.- (1) सहायक अनुभाग अजधकारी ग्रडे म ेंजनयजमत ररजियों का पचहत्तर प्रजतित, कंप्यूिर म ेंििता प्राप्त स्नातकों की सीधी भती से भरा िाएगा, िैसा दक रेल मंत्रालय से कमडचारी चयन आयोग द्वारा इस प्रयोिन के जलए वष डमें एक बार आयोजित प्रजतयोगी परीिा के पररणामों के आधार पर अजधसूजचत दकया िाएगा और िेष पच्चीस प्रजतित ररजियां सहायक अनुभाग अजधकारी ग्रेड के जलए चयन सूची में सजममजलत व्यजियों की जनयुजि से भरी िाएंगी, जिसमें रेलवे बोड डसजचवालय जलजपक सेवा के वररष्ठ सजचवालय सहायक ग्रडे के जनयजमत अजधकाररयों म ेंसे कुल पंरह प्रजतित िाजमल होंग,े जिन्होंन े उस ग्रडे म ेंकम स ेकम िस वषड की अनुमोदित सेवा प्रिान की हो और िस प्रजतित, रेलवे बोड डसजचवालय जलजपक सेवा के वररष्ठ सजचवालय सहायकों के जलए सीजमत जवभागीय प्रजतयोगी परीिा के माध्यम से चयजनत व्यजियों म ेंसे होंगे, जिसका आयोिन कमचड ारी चयन आयोग द्वारा इस प्रयोिन के जलए वषड म ेंएक बार दकया िाएगा। परंत ु दक पुनरीजित जनयमों की अजधसूजचत जतजर् को जनयजमत आधार पर वररष्ठ सजचवालय सहायक का पि धारण करन े वाले अजधकाररयों के जलए पात्रता सेवा पांच वषड की अनुमोदित सेवा िारी रहगे ी। परंत ु यह और दक िहां िस वष डकी अनुमोदित सेवा वाल ेपात्र वररष्ठ सजचवालय सहायकों की पयाडप्त संख्या उपलब्ध नहीं ह,ै वहां मल्िी-िासस्ट्कंग स्ट्िाफ ग्रडे से वररष्ठ सजचवालय सहायक ग्रडे तक इक्कीस वषड की अनुमोदित सेवा (वररष्ठ सजचवालय सहायक के रूप म ेंन्यूनतम पांच वषड की अनुमोदित सेवा सजहत) प्रिान करने वाल ेअजधकारी भी सहायक अनुभाग अजधकारी ग्रेड की चयन सूची म ेंसममजलत होने के जलए पात्र होंगे।: परंत ु यह भी दक भती वषड 2004 और भती वषड 2011 के जलए रेलवे बोड डसजचवालय सेवा के संवगड पुनसंरचना से उत्पन्न सहायक अनुभाग अजधकारी की पररणामी ररजियों को वररष्ठता के माध्यम से वररष्ठ सजचवालय सहायक से भरा गया समझा िाएगा। (2) जिन व्यजियों का नाम चयन सूची में सजममजलत दकया गया ह ैउनकी जनयुजि, उस चयन सूची में वररष्ठता के क्रम में की िाएगी। (3) इस जनयम के प्रयोिन के जलए सहायक अनुभाग अजधकारी ग्रेड की चयन सूची वार्षडक रूप स ेतैयार की िाएगी और प्रकाजित की िाएगी। (4) उप-जनयम (1) में यर्ाजनर्िडष्ट प्रजतयोगी परीिाओं और सीजमत जवभागीय प्रजतयोगी परीिा के जनयम, जवजनयमों में यर्ा जवजनर्िडष्ट होंगे। (5) सहायक अनुभाग अजधकारी ग्रेड के जलए चयन सूची तैयार और पुनरीजित करन े की प्रदक्रया जवजनयमों में यर्ा जवजनर्िडष्ट होगी। 11. जवभागीय प्रोन्नजत सजमजत की सरं चना.- सेवा के जवजभन्न ग्रडे ों के जलए जवभागीय प्रोन्नजत सजमजत की संरचना जवजनयमों में यर्ा जवजनर्िडष्ट होगी । 12. पररवीिा.- (1) प्रत्येक अजधकारी, चाह ेवह सहायक अनुभाग अजधकारी ग्रडे में सीधे भती दकया गया हो या प्रोन्नत दकया गया हो या ग्रेड-I में जनयिु दकया गया हो, प्रारंभ म ेंपररवीिा पर जनयिु दकया िाएगा और पररवीिा की अवजध, जनयुजि की तारीख से िो वष ड की होगी। (2) उप-जनयम (1) में जवजनर्िडष्ट पररवीिा की अवजध, यदि जनयुजि प्राजधकारी उपयुि समझे, दकसी भी मामले म ें बढाई िा सकेगी, परंत ु पररवीिा बढाए िाने की कुल अवजध, उस जस्ट्र्जत को छोडकर िहां अजधकारी के जवरूद्ध लंजबत दकसी जवभागीय या जवजधक कायडवाजहयों के कारण आवश्यक हो, एक वष ड से अजधक नहीं होगी।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 (3) पररवीिा के िौरान, सेवा के सिस्ट्य से केंरीय सरकार के रेल मत्रं ालय द्वारा समय-समय पर जवजहत प्रजििण प्राप्त करना और परीिा उत्तीण ड करना अपेजित होगी। 13. पररवीिा का समापन.- (1) पररवीिा अवजध या जवस्ट्ताररत पररवीिा अवजध, यदि कोई हो, पूरा होने पर, जनयिु प्राजधकारी द्वारा जवजहत प्रदक्रया के अनुसार अजधकारी के कायों का मूल्यांकन करेगा, और या तो घोजषत करेगा:- (क) दक पररवीिा सफलतापूवडक परू ी हो गई ह;ै (ख) दक पररवीिा सफलतापवू डक पूरा नहीं हुआ ह;ै या (ग) जनयम 12 के उप-जनयम (2) के अधीन पररवीिा अवजध बढाई िानी ह।ै (2) िब पररवीिा पर चल रह ेसीध े भती दकया गया अजधकारी, जनयुजि प्राजधकारी के समाधान के जलए पररवीिा सफलतापूवडक पूरा कर लते ा ह,ै तो वह सेवा में पुजष्ट के जलए पात्र होगा और िब ऐसा अजधकारी अपनी पररवीिा सफलतापूवडक पूरा नहीं करता ह,ै तो उसे जनयम 14 के अनुसार सेवामुि या प्रत्यावर्तडत कर दिया िाएगा। (3) एक अजधकारी तब तक पररवीिा पर रहगे ा, िब तक दक उसे इस जनयम के अधीन पुजष्ट नहीं कर दिया िाता ह ैया जनयम 14 के अधीन सेवा मुि या प्रत्यावर्तडत नहीं कर दिया िाता ह।ै 14. पररवीिाधीन व्यजि की सवे ामजु ि या प्रत्यावतनड .- (1) एक पररवीिाधीन व्यजि जिस पर केन्रीय सरकार या राज्य सरकार के अधीन दकसी पि पर धारणाजधकार नहीं है, वह जबना दकसी सूचना के दकसी भी समय सेवा से उन्मोजचत दकए िाने का िायी होगा, यदि - (i) पररवीिा के िौरान उसके कायड जनष्पािन या आचरण के आधार पर उसे सेवा में आग ेबनाए रखने के जलए अयोग्य माना िाता ह;ै या (ii) उसकी राष्ट्रीयता, आय,ु स्ट्वास्ट््य या पूवडवृत्त से संबंजधत कोई भी िानकारी प्राप्त होन े पर, जनयुजि प्राजधकारी का समाधान हो िाता ह ैदक वह सेवा का सिस्ट्य होने के जलए अपात्र या अन्यर्ा अयोग्य ह।ै (2) जिस पररवीिाधीन व्यजि का केन्रीय सरकार या दकसी राज्य सरकार के अधीन दकसी पि पर धारणाजधकार हो उसे उप-जनयम (1) में जवजनर्िडष्ट दकसी भी समय दकसी भी पररजस्ट्र्जत म ेंउि पि पर प्रत्यावर्तडत दकया िा सकेगा। (3) जिस पररवीिाधीन व्यजि को जनयम 12 के उप-जनयम (1) म ेंजवजहत पररवीिा अवजध की समाजप्त पर या उस जनयम के उप-जनयम (2) के अधीन पररवीिा की बढाई गई अवजध के अतं में, यदि कोई हो, की पुजष्ट के जलए उपयिु न समझा गया हो उसे, यर्ाजस्ट्र्जत, उप-जनयम (1) या उप-जनयम (2) के अनुसार सेवामुि या प्रत्यावर्तडत कर दिया िाएगा। (4) सहायक अनुभाग अजधकारी ग्रेड या ग्रडे -I में सीधी भती स ेजभन्न सेवा के ऐसे पररवीिाधीन सिस्ट्य को जनयम 12 के उप-जनयम (1) म ेंजवजनर्िडष्ट पररवीिा अवजध या उस जनयम के उप-जनयम (2) के अधीन पररवीिा की बढाई गई अवजध, यदि कोई हो, के िौरान या समाजप्त पर उस ग्रडे म ेंबने रहन ेके जलए उपयिु न समझा गया हो उस,े यर्ाजस्ट्र्जत, सेवा की ठीक नीचे की ग्रेड में या रेलवे बोडड सजचवालय जलजपकीय सेवा की उस संबंजधत ग्रडे म ेंप्रत्यावर्तडत कर दिया िाएगा जिससे वह सेवा के ग्रडे म ेंपररवीिा पर जनयिु दकया गया र्ा : परंत ु इस प्रकार नीचे की ग्रडे म ेंप्रत्यावर्तडत अजधकारी की पररवीिा पर उच्चतर ग्रडे म ेंजनयुजि के जलए, ऐसे प्रत्यावतडन की तारीख स ेएक वषड पूरा होने के बाि ही पनु र्वडचार दकया िाएगा। 15. वररष्ठता.- (1) जनयत दिवस से पहले दकसी ग्रेड में जनयिु सेवा के सिस्ट्यों की सापेजिक वररष्ठता, उि तारीख स े पहले यर्ा अवधाररत उनकी सापेजिक वररष्ठता द्वारा जवजनयजमत की िाएगी:8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] परंत ु यदि ऐसे दकसी अजधकारी की वररष्ठता उस तारीख से पहले जवजनर्िडष्ट रूप से जनधाडररत न की गई हो, तो वह रेल मंत्रालय, केन्रीय सरकार द्वारा यर्ा जनधाडररत होगी। (2) जनयत दिवस के बाि दकसी ग्रेड में जनयुि व्यजियों की ज्यष्ठे ता जनम्नजलजखत अनुसार जनधाडररत की िाएगी, अर्ाडत:् - I. उच्च तर प्रिासजनक ग्रडे , वररष्ठ प्रिासजनक ग्रडे , वररष्ठ चयन ग्रडे , चयन ग्रडे , ग्रडे -I और अनभु ाग अजधकारी :- जनयुजि के दिन के पश्चात् उस ग्रेड में जनयिु अजधकाररयों की परस्ट्पर वररष्ठता उन आिेिों स ेजवजनयजमत की िाएगी जिन आिेिों म ेंउनके नाम ग्रेड के जलए चयन सूची म ेंसजममजलत दकए गए हों। II. सहायक अनभु ाग अजधकारी ग्रडे :- (क) सीधी भती वाले अभ्यर्र्डयों को कमडचारी चयन आयोग द्वारा आयोजित परीिा में अभ्यर्ी द्वारा प्राप्त अंकों के आधार पर प्राप्त अंजतम रैंककंग के आधार पर मेररि के क्रम म ें परस्ट्पर रैंक दकया िाएगा, पूवड परीिा द्वारा भती हुए अभ्यर्र्डयों की वररष्ठता रैंक पश्चात् की परीिा में चयजनत अभ्यर्र्डयों के रैंक स ेपहल े जनधाडररत की िाएगी : परंत ु आयोग द्वारा आयोजित प्रजतयोगी परीिा के माध्यम से भती दकए गए व्यजियों की वररष्ठता समूह ‘ख’ केन्रीय जसजवल सेवा पर लागू ऐसी होगी िो केन्रीय सरकार द्वारा जवजहत की िाएगी। (ख) ग्रेड के जलए चयन सूची से ग्रडे में जनयजमत आधार पर जनयुि व्यजियों का परस्ट्पर पिक्रम इस प्रकार रैंक दकया िाएगा जिसमें वे जनयुि दकए िाते ह।ैं (ग) ग्रेड में सीधी भती द्वारा भती दकए गए व्यजियों और ग्रेड के जलए चयन सूची से ग्रडे में जनयजमत आधार पर जनयिु दकए गए व्यजियों की सापेि वररष्ठता जवजनयमों के उपबंधों के अनुसार जनयजमत की िाएगी। 16. वते न का जवजनयमन.- (1) जवजभन्न ग्रडे ों के अजधकाररयों का वते न एवं वते नवृजद्ध भारतीय रेल स्ट्र्ापना संजहता और समय-समय पर सरकार द्वारा िारी दकए गए वते न स ेसंबंजधत अन्य ऐस ेही रेल जनयमों और आििे ों के अनुसार जवजनयजमत की िाएंगी। (2) दकसी ग्रेड म ें पररवीिाधीन का वेतन, जनयोिा प्राजधकारी की संतुजष्ट के अनरूु प पररवीिा का प्रत्येक वषड पूरा करने और जवजहत की गई आवजधक परीिाए ंउत्तीणड करने पर, समय-वेतनमान म ेंएक प्रक्रम बढाया िाएगा। 17. जवजनयमन.- केन्रीय सरकार का रेल मंत्रालय (रेलवे बोडड) इन जनयमों को प्रभावी करन े के प्रयोिन से प्रावधान करने के जलए उन सभी मामलों के जलए इन जनयमों से सुसंगत जवजनयम बना सकेगा, जिनके जलए उपबंध करना आवश्यक या समीचीन ह।ै 18. अवजिष्ट मामल.े- ऐसे मामलों के संबंध में िो इन जनयमों या जवजनयमों या उसके अंतगडत दकए गए या िारी आिेिों या जविेष आिेिों म ेंजवजनर्िडष्ट रूप स ेिाजमल नहीं हैं, सेवा के सिस्ट्य सामान्यतः रेलव ेबोडड सजचवालय सेवा और केन्रीय जसजवल सेवा के जलए लागू जनयमों, जवजनयमों और आििे ों द्वारा िाजसत होंगे। 19. जिजर्ल करन ेकी िजि.- (1) केंरीय सरकार का रेल मंत्रालय (रेलवे बोड)ड यदि इस बात से सतं ुष्ट ह ैदक इनमें से दकसी जनयम के लागू होन े से व्यजियों या पिों के दकसी वगड या प्रवगड के जलए अनुजचत करठनाई पैिा हो रही हैं, तो वह आयोग के परामिड से, जनयमों की अपेिाओं की ऐसी सीमा तक और ऐसी ितों के अध्यधीन िो वह आवश्यक समझे, समाप्त कर सकेगी या जिजर्ल कर सकेगी। (2) केंरीय सरकार का रेल मंत्रालय (रेलवे बोडड) यदि इस बात से सतं ुष्ट ह ैदक इन जनयमों के अधीन बनाए गए दकसी जवजनयम के लाग ूहोन े से व्यजियों या पिों के दकसी वग डया प्रवगड के जलए अनुजचत करठनाई पिै ा हो रही ह,ैं तो वह इन[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 जनयमों के अधीन बनाए गए जवजनयमों की अपेिाओं को ऐसी सीमा तक और ितों के अध्यधीन, िो वह आवश्यक समझे, समाप्त या जिजर्ल कर सकेगी। 20. आरिण.- इन जनयमों की कोई भी बात अनुसूजचत िाजतयों, अनुसूजचत िनिाजतयों और अन्य जपछडा वगों और आर्र्डक रूप स ेकमिोर वगों और अन्य जविेष प्रवगों के व्यजियों के जलए, केंरीय सरकार द्वारा समय-समय पर इस संबंध म ें िारी आिेिों के अनुसार दिए िाने वाले अपेजित आरिण, छूि और अन्य ररयायतों को प्रभाजवत नहीं करेगी। 21. जनवचड न.- यदि इन जनयमों या इसके अंतगडत बनाए गए जवजनयमों के जनवडचन के संबंध में कोई प्रश्न उठता ह ैतो, जनणडय केन्रीय सरकार के रेल मत्रं ालय द्वारा जनजश्चत दकया िाएगा, जिसका जनणडय अंजतम होगा। 22. जनरसन और व्यावजृ त्त.- समय-समय पर यर्ासंिोजधत रेलवे बोडड सजचवालय सेवा जनयम, 1969 और उसके अधीन बनाए गए जवजनयम इसके द्वारा पूवडवती जनयमों या जवजनयमों और ऐसे प्रारंभ से तत्काल पहले प्रवृत्त, के अतं गतड दकसी अजधसूचना, जनयम, जवनयम, िारी आििे या नोरिस या की गई जनयुजि या घोषणा, या िी गई छूि या अजधरोजपत िाजस्ट्त या िुमाडना या की गई कोई चीि या की गई कोई कारडवाई, िहां तक यह इन जनयमों के उपबंधों के असगं त नहीं ह,ैं इन जनयमों के सििृ उपबधं ों के अधीन िारी दकया गया, प्रित्त दकया, बताया गया या जलया गया समझा िाएगा। अनसु चू ी (जनयम 5 िेख)ें President hereby makes the following rules, namely:- 1. Short title and commencement.- (1) These rules may be called the Railway Board Secretariat Service Rules, 2026. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions.- In these rules, unless the context otherwise requires,- (a) “appointing authority” in relation to any Grade means the authority empowered under the provisions of Indian Railway Establishment Code, Volume-I, to make appointments to that Grade; (b) “appointed day” means the date on which these rules come into force; (c) “approved service” in relation to any Grade means - (i) in respect of an officer recruited directly to that Grade, the period or periods of regular service rendered in that Grade, including the period or periods of absence during which he would have held a post on regular basis in that Grade but for his being on leave or otherwise not being available to hold such post, from the first day of July of the year, following the year in which the examination for direct recruitment was held; (ii) in respect of an officer recruited to that Grade through departmental examination, the period or periods of regular service rendered in that grade, including the period or periods of absence during which he would have held a post on regular basis in that grade, but for his being on leave or otherwise not being available to hold such post, from the first day of July of the year for vacancies of which such examination was held;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 11 (iii) in respect of an officer recruited to that Grade on the basis of length of service in the lower Grade, the period or periods of regular service rendered in that Grade, including the period or periods of absence during which he would have held a post on regular basis in that Grade, but for his being on leave or otherwise not being available to hold such post, from the first day of July of the year for which the recruitment was made: Provided that where there is a delay of more than ninety days in joining on appointment, in any of the cases mentioned in the sub-clauses (i), (ii) and (iii), such delay should not be due to any fault on the part of the officer; (d) "authorised strength" in relation to any Grade of the Service means the strength of duty posts in that Grade, as specified in rule 5, against which regular appointments may be made; (e) "cadre" means the group of posts in the Grades of Higher Administrative Grade (Adviser), Senior Administrative Grade (Joint Secretary or Executive Director), Senior Selection Grade (Director), Selection Grade (Deputy Secretary or Joint Director), Grade-I (Under Secretary or Deputy Director), Section Officer and Assistant Section Officer in the Ministry of Railways (Railway Board); (f) “cadre controlling authority” in relation to officers appointed to any Grade of Railway Board Secretariat Service means the Ministry of Railways (Railway Board); (g) “cadre officer” in relation to any Grade means a member of the Railway Board Secretariat Service; (h) “Commission” means the Union Public Service commission; (i) “crucial date” in relation to Limited Departmental Competitive Examination means the 1st day of July of the year in which the examination is held; (j) “direct recruit” means a person recruited on the basis of a competitive examination, other than a departmental competitive examination recruited through the Staff Selection Commission; (k) “duty post” in relation to any Grade of the Service means a Cadre post held by officers of the Service on substantive basis in any post of that Grade; (l) “eligible officer” means any officer who has undergone and successfully completed such mandatory training programme as may be prescribed under cadre training plan, if any, by the Ministry of Railways and is eligible to be considered for appointment to Higher Administrative Grade, Senior Administrative Grade, Senior Selection Grade, Selection Grade, Grade – I, Section Officer and Assistant Section Officers’ Grade, as the case may be, of the Railway Board Secretariat Service, under rules 8, 9 and 10 as on the 1st July of the calendar year for which the Select List is prepared; (m) "Field of Selection" means the list of eligible officers from which a selection shall be made for inclusion in the Select List; (n) “Grade” means any of the Grade specified in rule 3; (o) “Government” means the Government of India in the Ministry of Railways; (p) “Limited Departmental Competitive Examination” in respect of any Grade of the Service means a competitive examination held by the Union Public Service Commission or the Staff Selection Commission, as the case may be, to select candidates for that grade; (q) “Ministry” means Ministry of Railways (Railway Board) in the Government of India; (r) “Other Backward Classes” means the castes and communities notified as Other Backward Classes by the Government of India from time to time; (s) “permanent officer” means a person who has been confirmed in the Service; (t) “person with disability” means the person with disability as defined in clause(s) of section 2 of the Rights of Persons with Disabilities Act 2016 (49 of 2016); (u) “probationer” means an officer either directly recruited or promoted to the Assistant Section Officers’ Grade or appointed to Grade-I on probation against a regular vacancy;12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (v) "range of seniority" in relation to any grade means the range specified by the Central Government in the Ministry of Railways in the seniority list for that Grade for additions to Select List; (w) “regular officer” in relation to any grade, means a person who has been appointed against a regular vacancy either through direct recruitment or through a Limited Departmental Competitive Examination or through promotion from Select List and who has completed the period of probation under rule 12 to the satisfaction of the appointing authority; (x) “regular vacancies” in relation to a grade, includes vacancies arising out of death, retirement, promotion, resignation, deputation or transfer or long leave of incumbents exceeding one year; (y) “Schedule” means the Schedule appended to these rules; (z) “Scheduled Castes” and “Scheduled Tribes” shall have the same meanings as are assigned to them by clauses (24) and (25), respectively of article 366 of the Constitution; (za) "Select List" in relation to the Senior Administrative Grade, Senior Selection Grade, Selection Grade, Grade-I, Section Officers' Grade and the Assistant Section Officers’ Grade means the Select List prepared in accordance with the regulations made under sub-rule (6) of rule 8, sub-rule (3) of rule 9 or sub-rule (5) of rule 10, as the case may be; (zb) “Selection” means inclusion in the Select List for any Grade of Railway Board Secretariat Service; (zc) “Service” means the Railway Board Secretariat Service; (zd) “seniority list” in relation to any Grade means the seniority list of officers of that Grade as on the appointed day and revised annually in accordance with the respective Regulations; (ze) “zone of consideration” means the list of eligible officers from which inclusions shall be made in the Select List; 3. Composition of Service.- (1) There shall be seven grades in the Service, which are classified into two groups as given in Table below:- TABLE Sl. Combined Gradation List of Officers of Railway Board Secretariat Service.- There shall be a single combined gradation list called seniority list for each grade of the Service as specified in rule 3. 5. Authorised cadre strength of Service.- The authorised strength of various grades of the Service and the level in pay matrix shall be as specified in the Schedule. 6. Duty posts to be held by cadre officers.- Every duty post in the Service shall be held by a cadre officer of appropriate Grade. 7. Confirmation.- Confirmation of all Railway Board Secretariat Service officers shall be made only once at the entry level into the Service. 8. Recruitment to Higher Administrative Grade, Senior Administrative Grade, Senior Selection Grade, Selection Grade and Grade –I.- (1) The regular vacancy in Higher Administrative Grade of Railway Board Secretariat Service shall be filled up by promotion of regular officer of Senior Administrative Grade in accordance with the norms decided by Central Government in the Ministry of Railways in consultation with Department of Personnel and Training, from time to time. (2) The regular vacancies in the Senior Administrative Grade shall be filled by promotion of regular officers who have rendered eight years’ approved service in the Selection Grade of Railway Board Secretariat Service and have been assessed suitable for the post of Senior Selection Grade for a minimum period of three years and are included in the Select List for the Senior Administrative Grade prepared under sub-rule (6). (3) The regular vacancies in the Senior Selection Grade shall be filled by promotion of regular officers of Selection Grade who have rendered not less than five years' approved service in that Grade and are included in the Select List for the Senior Selection Grade prepared under sub-rule (6): Provided that where sufficient number of eligible officers with five years’ approved service are not available, regular officers of Selection Grade with not less than three years’ of regular service in that Grade and not less than ten years’ of approved service from their appointment to the Grade-I shall also be eligible for promotion. (4) Regular vacancies in the Selection Grade shall be filled by promotion of regular officers of Grade-I who have rendered not less than five years' approved service in that Grade and are included in the Select List for the Selection Grade prepared under sub-rule (6). (5) Regular vacancies in Grade-I shall be filled by promotion of regular officers of the Section Officers' Grade who have rendered not less than eight years' approved service in that Grade and are included in the Select List for Grade- I of the Service prepared under sub-rule (6). (6) For the purposes of sub-rules (2), (3), (4) and (5), a Select List for the Senior Administrative Grade, Senior Selection Grade, Selection Grade and Grade-I shall be prepared and published annually and the procedure for preparing and revising the Select Lists shall be as provided in the Regulations: Provided that the Select List for Grade-I shall be prepared in consultation with the Commission. 9. Recruitment to Section Officers’ Grade.- (1) The regular vacancies in the Section Officers' Grade shall be filled by appointment of persons included in the Select List for Section Officers’ Grade comprising fifty per cent. from regular officers of Assistant Section Officers’ Grade who have rendered not less than eight years’ approved service in that Grade and fifty percent. from persons selected through Limited Departmental Competitive Examination. (2) The rules for the Limited Departmental Competitive Examination referred to in sub-rule (1) shall be as specified in Regulations: Provided that if sufficient number of candidates are not available for filling up the vacancies in any recruitment year, either by Limited Departmental Competitive Examination or by promotion on the basis of seniority, the unfilled vacancies shall be carried forward and added to the number of vacancies of the same mode of recruitment to be filled in the next recruitment year: Provided further that no such unfilled vacancies shall be carried forward for more than two recruitment years, beyond the year to which the recruitment relates, where after the vacancies, if any, still remaining unfilled14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] belonging to one mode of recruitment shall be transferred as additional vacancies for the other mode of recruitment. (3) The procedure for preparing and revising Select List for Section Officers’ Grade shall be as specified in Regulations. 10. Recruitment to Assistant Section Officers’ Grade.- (1) Seventy-five per cent. of the regular vacancies in the Assistant Section Officers’ Grade shall be filled by direct recruitment of graduates possessing computer proficiency as may be notified by the Ministry of Railways on the basis of results of a competitive examination held by the Staff Selection Commission once a year, for this purpose and the remaining twenty-five per cent. vacancies shall be filled by appointment of persons included in the Select List for Assistant Section Officers’ Grade comprising fifteen per cent. of the total from the regular officers of Senior Secretariat Assistants’ Grade of the Railway Board Secretariat Clerical Service who have rendered not less than ten years’ approved service in that Grade and ten per cent. from persons selected through Limited Departmental Competitive Examination for Senior Secretariat Assistants’ of Railway Board Secretariat Clerical Service to be conducted by Staff Selection Commission, once in a year for this purpose: Provided that eligibility service shall continue to be five years’ of approved service for officials holding the post of Senior Secretariat Assistant on regular basis as on the date of notification of the revised rules: Provided further that where sufficient number of eligible Senior Secretariat Assistants with ten years’ approved service are not available, officials having rendered twenty-one years’ approved service from Multi-Tasking Staff Grade till Senior Secretariat Assistants’ Grade (including a minimum of five years’ approved service as Senior Secretariat Assistant) shall also be eligible for inclusion in the Select List for Assistant Section Officers’ Grade: Provided also that the resultant vacancies of Assistant Section officer arisen from the cadre restructuring of Railway Board Secretariat Service for the recruitment year 2004 and recruitment year 2011 shall be deemed to have been filled up from Senior Secretariat Assistant through seniority. (2) The appointments of the persons whose names have been included in the Select List shall be made in the order of seniority in that Select List. (3) For the purpose of this rule, a Select List for the Assistant Section Officers’ Grade shall be prepared and published annually. (4) The rules for the Competitive Examinations and Limited Departmental Competitive Examination as referred to in sub- rule (1) shall be as specified in Regulations. (5) The procedure for preparing and revising the Select List for Assistant Section Officers’ Grade shall be as specified in Regulations. 11. Composition of Departmental Promotion Committee.- The composition of Departmental Promotion Committee for various Grades of the Service shall be as specified in Regulations. 12. Probation.- (1) Every officer, either directly recruited or promoted to the Assistant Section Officers’ Grade or appointed to Grade-I shall initially be appointed on probation, the period of probation being two years from the date of appointment. (2) The period of probation specified in sub-rule (1) may, if the appointing authority deems fit, be extended in any case, but the total period of extension of probation shall not, save where it is necessary by reason of any departmental or legal proceedings pending against the officer, exceed one year. (3) During probation, a member of the Service may be required to undergo such training and to pass such tests as the Central Government in the Ministry of Railways may, from time to time, prescribe. 13. Completion of Probation.- (1) Upon completion of the probation period or the extended probation period, if any, the appointing authority shall assess the performance of the officer, as per prescribed procedure, and shall declare either:- (a) that the probation has been successfully completed; (b) that the probation has not been successfully completed; or (c) that the probation period is to be extended under sub-rule (2) of rule 12.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 15 (2) When a directly recruited officer undergoing probation has successfully completed the probation to the satisfaction of the appointing authority, he shall be eligible for confirmation in the Service and when such officer has not successfully completed his probation, he shall be discharged or reverted in accordance with rule 14. (3) An officer shall continue to be on probation till he is confirmed under this rule or is discharged or reverted under rule 14. 14. Discharge or reversion of probationers.- (1) A probationer who has no lien on any post under the Central Government or any State Government shall be liable to be discharged from the Service at any time without notice if, - (i) on the basis of his performance or conduct during probation, he is considered unfit for further retention in the Service; or (ii) on the receipt of any information relating to his nationality, age, health or antecedents, the appointing authority is satisfied that he is ineligible or otherwise unfit for being a member of the Service. (2) A probationer who holds a lien on a post under the Central Government or any State Government may be reverted to such post at any time in any of the circumstances specified in sub-rule (1). (3) A probationer who is not considered suitable for confirmation at the end of the period of probation prescribed in sub-rule (1) of rule 12 or at the end of the extended period of probation, if any, under sub-rule (2) of that rule, shall be discharged or reverted in accordance with sub-rule (1) or sub-rule (2), as the case may be. (4) A member of the Service other than a direct recruit on probation in Assistant Section Officers’ Grade or Grade-I who is not considered suitable for continuance in that Grade during or at the end of the period of probation specified in sub-rule (1) of rule 12 or the extended period, if any, under sub-rule (2) of that rule, shall be reverted to the next lower Grade of the Service or to the concerned Grade of the Railway Board Secretariat Clerical Service, as the case may be, from which he was appointed on probation to the Grade of the Service: Provided that an officer so reverted to the lower Grade shall be reconsidered for appointment to the higher Grade on probation, only after completion of one year from the date of such reversion. 15. Seniority.- (1) The relative seniority of members of the Service appointed to any Grade before the appointed day shall be regulated by their relative seniority as determined before the said date: Provided that, if the seniority of any such officer had not been specifically determined before the said date, it shall be as determined by the Central Government in the Ministry of Railways. (2) The seniority of persons appointed to any Grade after the appointed day shall be determined as follows, namely:- I. Higher Administrative Grade, Senior Administrative Grade, Senior Selection Grade, Selection Grade, Grade-I and Section Officer:- The inter-se seniority of officers appointed to the Grade after the appointed day shall be regulated by the order in which their names are included in the Select List for the Grade. II.Assistant Section Officers’ Grade:- (a) Direct recruits shall be ranked inter-se in the order of merit reckoned on the basis of final ranking obtained on the basis of marks obtained by the candidate in the examination conducted by the Staff Selection Commission, the recruits of an earlier examination being ranked senior to those of a later examination: Provided that the seniority of persons recruited through the Competitive Examination held by the Commission shall be such as may be prescribed by the Central Government applicable to Group ‘B’ Central Civil Services. (b) Persons appointed regularly to a Grade from the Select List for the Grade shall be ranked inter-se according to the order in which they are so appointed. (c) The relative seniority of direct recruits to a Grade and persons regularly appointed to the Grade from the Select List for the Grade shall be regulated in accordance with the provisions of Regulations.16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 16. Regulation of Pay.- (1) The pay and increments of officers of the various Grades shall be regulated in accordance with the Indian Railways Establishment Code and other similar Railway Rules and Orders relating to pay issued by Government from time to time. (2) The pay of a probationer in a Grade may, on his completing each year of probation to the satisfaction of the appointing authority and qualifying the prescribed periodic tests, be raised by one stage in the time scale. 17. Regulations.- The Central Government in the Ministry of Railways (Railway Board) may make regulations, not inconsistent with these rules, to provide for all matters for which provision is necessary or expedient for the purpose of giving effects to these rules. 18. Residuary matters.- In regard to matters not specifically covered by these rules or by Regulations or orders made or issued there under, or by special orders, the members of the Service shall be governed by the rules and orders applicable to the Railway Board Secretariat Service and Central Civil Services in general. 19. Power to relax.- (1) Where the Central Government in the Ministry of Railways (Railway Board) is satisfied that the operation of any of these rules causes undue hardship in any class or category of persons or posts, it may dispense with or relax, in consultation with the Commission, the requirements of the rules to such extent and subject to such conditions, as it may consider necessary. (2) Where the Central Government in the Ministry of Railways (Railway Board) is satisfied that the operation of any of the regulations made under these rules causes undue hardship in any class or category of persons or posts, it may dispense with or relax the requirements of the regulations made under these rules to such extent and subject to such conditions, as it may consider necessary. 20. Reservations.- Nothing in these rules shall affect reservations, relaxation and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes and Economically Weaker Section and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard. 21. Interpretation.- If any question arises as to the interpretation of these rules, or the Regulations made there under, the same shall be decided by the Central Government in the Ministry of Railways, whose decision thereon shall be final. 22. Repeal and savings.- The Railway Board Secretariat Service Rules, 1969 and regulations framed there under, as amended from time to time, in force before the commencement of these rules are hereby repealed subject to any notification, rule, regulation, order or notice issued, or any appointment or declaration made, or exemption granted or any penalty or fine imposed or any other thing done or any other action taken under the previous rules or regulations and in force immediately before such commencement shall so far as it is not inconsistent with the provisions of these rules, be deemed to have been issued, made, granted, done or taken under the corresponding provisions of these rules.
