(1) इन जनयमों का संजष प्त नाम रेलव े को चाल ू करन े संबंधी (याजत्रयों के सावडिजनक वहन के जलए) िसू रा संिोधन जनयम, 2023 ह। (2) ये जनयम रािपत्र म ेंइनके प्रकािन की तारीख को प्रवृत् त होंगे। 2. उि जनयमों के अध् याय - II म,ें - (i) जनयम 3 के उप-जनयम (3) के पश्चात,् - (क) परंतुक में, (i) “फॉमड XVI क” िब्ि और अषरों के पश्चात ्“या फॉमड XVI ख” िब्ि और अषर रखे िाएगं ;े (ii) मि (च) म,ें संिोधन आवश्यक नहीं ह; (झ) याडड का पुन: जनमाडण दकए जबना पार्श्डस्ट्र् स्ट्टेिनों पर तत्स्ट्र्ानी पररवतडनों के सार्, जस्ट्लप साइडडंग और क च साइडडंग वाले खण्डों के जसवाय, नए मध्यवती खंड संकेतक प्रणाली का पुर:स्ट्र्ापना करना; और (ञ) याडड का पनु : जनमाडण दकए जबना पार्श्डस्ट्र् स्ट्टेिनों पर तत्स्ट्र्ानी पररवतडनों के सार्, जस्ट्लप साइडडंग और क च साइडडंग वाले खण्डों के जसवाय, नए स्ट्वचाजलत खडं संकेतक प्रणाली का पुर:स्ट्र्ापना करना’’। (ii) जनयम 4क म,ें “जनयम 3 के परंतुक म ें जवजनर्िष्टड मामलों के जलए”, िब् िों और अंक के स्ट्र्ान पर "जनयम 3 के उप-जनयम (3) के परंतुक म ें जवजनर्िष्टड मि (क) स े (छ) स े संबंजधत मामलों के जलए" िब्ि , कोष्ठक, अषर और अंक रख े िाएगं ;े (iii) जनयम 4क. के पश्चात,् जनम्न जलजखत जनयम अतं :स्ट्र्ाजपत दकया िाएगा, अर्ाडत्:- “4ख. महाप्रबधं क को प्रस्ट्त तु दकए िान े वाल े िस्ट्त ाव े - जनयम 3 के उप-जनयम (3) के परंतकु में जवजनर्िष्टड मि (ि) से (ञ) से संबंजधत मामलों के जलए और जवजिष्ट मामले स े यर्ा संबंजधत जनयम 4 म ें उजल्लजखत िस्ट्तावे संबंजधत उच्च प्रिासजनक ग्रेड अजधकारी द्वारा षेत्रीय रेलवे के महाप्रबंधक को प्रस्ट्तुत दकए िाएंगे, िो महाप्रबंधक को फॉमड XVI ख में यर्ा जनर्िष्टड प्रमाण पत्र प्रिान करेगा”; (iv) जनयम 5क के िीर्ड म,ें “षत्रे ीय रेलों के” िब् िों के पश्चात ्“महाप्रबंधक या” िब्ि रखे िाएगं ।े 3. उि जनयमों के अध्याय - VII म,ें जनयम 25क. म,ें- (i) उप-जनयम (1) म,ें (क) मि (ङ) में, “ग र-अंतपाडजित” िब् िों का लोप दकया िाएगा। (ख) मि (ङ) के पश्चात ्जनम्नजलजखत रटप्पण अंत:स्ट्र्ाजपत दकया िाएगा, अर्ातड ्:- रटप्पण : उप-जनयम (1) के जलए, यात्री रेलगाजडयों वाली चाजलत लाइनों को प्रभाजवत करन े वाले कायों के जलए स्ट्वीकृजत प्रिान करने हते ु प्रधान मुख्य इंिीजनयर सषम प्राजधकारी होगें। (ii) उप-जनयम (2) म,ें (क) “स्ट् टेिन की सीमा स े बाहर अंतपाडिन के सार् अं तपाडजित समपारों के अपग्रडे ेिन” िब् िों के स्ट्र्ान पर “समपारों के अंतपाडिन” िब् ि रखे िाएगं ;े (ख) “के जनष्प ािन” िब् िों का लोप दकया िाएगा। (iii) उप-जनयम (2) के पश् चात,् जनम्न जलजखत उप-जनयम अंत:स्ट्र्ाजपत दकया िाएगा, अर्ाडत:्- “(3) मिों के जलए: “(क) याडड का पुन: जनमाडण दकए जबना पार्श्डस्ट्र् स्ट्टेिनों पर तत्स्ट्र्ानी पररवतडनों के सार् िोहरी िरू ी संकेतक प्रणाली का पुर:स्ट्र्ापना करना;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (ख) याडड का पुन: जनमाडण दकए जबना पार्श्डस्ट्र् स्ट्टेिनों पर तत्स्ट्र्ानी पररवतडनों के सार्, जस्ट्लप साइडडंग और क च साइडडंग वाले खण्डों के जसवाय, नए मध्यवती खंड संकेतक प्रणाली का पुर:स्ट्र्ापना करना; और (ग) याडड का पुन:जनमाडण दकए जबना पार्श्डस्ट्र् स्ट्टेिनों पर तत्स्ट्र्ानी पररवतडनों के सार्, जस्ट्लप साइडडंग और क च साइडडंग वाले खण्डों के जसवाय, नए स्ट्वचाजलत खडं संकेतक प्रणाली का पुर:स्ट्र्ापना करना। उपरोि कायों की मंिरू ी प्रिान करन े के जलए आग े जबना दकसी और को प्रत् यायोजित दकए सषम प्राजधकारी षेत्रीय रेल के महाप्रबंधक होंगे। रटप्पण : षेत्रीय रेलव े के महाप्रबंधक अर्वा प्रधान मख्ु य जसगनल और िरू संचार इंिीजनयर, ि सा भी मामला हो, जनरीषण करन े के उपरांत या जनरीषण दकए जबना, यदि वह सतं ुष्ट हो तो, जनयम 25क के उप-जनयम (2) और (3) के अधीन, यात्री यातायात के जलए उपरोि कायों को िुरू करने की स्ट्वीकृजत प्रिान कर सकते हैं और जनरीषण दकय े जबना िूरू दकए गए कायों का सामान्यतया यर्ािीघ्र जनरीषण कर लने ा चाजहये परंत ु छोटे दकस्ट्म के कायों के मामल े में षेत्रीय रेलवे के महाप्रबंधक अर्वा प्रधान मुख्य जसगनल और िरू संचार इंिीजनयर, ि सा भी मामला हो, अपन े जववेकानुसार तिनुरूपी जनरीषण करने की आवश्यकता जनधाडररत करेंगे”।; 4. उि जनयमों के अध्याय – VIII म,ें जनयम 31 के उप - जनयम (7) म,ें- (i) “भाग I” िब् ि और अषर का लोप दकया िाएगा; (ii) “अध्याय – VII” िब् ि और अषर के स्ट्र्ान पर “अध्याय – 7” िब् ि और अंक रखा िाएगा; 5. उि जनयमों म,ें फॉमड XVI क और उससे संबंजधत प्रजवजष्टयााँ, के पश्चात,् जनम्नजलजखत “फॉमड XVI ख और प्रजवजष्टयााँ” अंत:स्ट्र्ाजपत दकया िाएगा, अर्ाडत्: - "फॉम ड XVI ख [जनयम 3 के उप-जनयम (3) के परंतुक म ेंजवजनर्िष्टड मि (ि) से (ञ) और जनयम 4 ख िेखें] उच्च प्रिासजनक ग्रडे अजधकारी द्वारा दिया िान ेवाला प्रमाणपत्र मैं प्रमाजणत करता ह:ाँ- (i) दक संलग्न जववरण म ें दिए गए अपवािों सजहत भारत म ें रेलों के जलए प्रत्येक मामले म ें अजधकतम आयामों का पालन दकया गया ह तर्ा भजवष्य म ें मानक आयामों का पालन दकया िाएगा, तर्ा मानक आयामों का उल्लंघन करन े वाली संरचनाओं की केंद्रीय सरकार की स्ट्वीकृजत के जबना इसके पश्चात ् अनुमजत नहीं िी िाएगी। (ii) दक रेलवे म ें डाक तर्ा सवारी गाज़ियों म ें प्रयोग के जलए प्राप्त या जनर्मडत प्रत्येक कोडचंग वाहन म ें व क्यूम या वाय ु ब्रेक ह तर्ा याजत्रयों, गाडड तर्ा चालक के मध्य प्रभाविाली संचार साधन उपलब्ध कराया िाएगा। रटप्पण:- यह प्रमाण-पत्र उन हल्की लाइनों के जलए आवश्यक नहीं ह जिन पर व क्यूम या वायु ब्रेक के प्रयोग पर िोर नहीं दिया गया ह। (iii) दक रेलव े भारतीय रेल के साधारण जनयम के खंड अध्याय-VIII या अध्याय-IX में जवजहत जवजनयमों के अनुसार एब्सोल्यूट ब्लॉक प्रणाली या ओटोमेरटक ब्लॉक प्रणाली के रूप में प्रचजलत प्रणाली को संचाजलत करेगी। रटप्पण - ऐस े मामलों का ब्यौरा जिसमें न्यनू तम तर्ा अजधकतम आयाम का उल्लंघन हुआ ह, प्रत्येक मामल े का पूण ड जववरण संलग्न फॉम ड (फॉम ड XVII) में ििाडया िाएगा और ऐसे उल्लधं न की आवश्यकता का स्ट्पष्टीकरण तर्ा दकस प्राजधकार स े दकया गया ह, उसका संिभड दिया िाएगा। यदि न्यूनतम और अजधकतम आयामों का उल्लघं न नहीं हुआ ह तो “संलग्न जववरण म ें उजल्लजखत अपवािों सजहत” िब्िों का लोप कर िेना या काट िने ा चाजहए।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (iv) दक जसगनल तर्ा िरू संचार उपकरणों को अनुमोदित अनुिेिों के अनुसार स्ट्र्ाजपत दकया गया ह और यातायात के संचालन हते ु सुरजषत ह। (v) दक महाप्रबंधक द्वारा जनरीषण दकए िात े समय श्री ............... को उनके सार् िान े के जलए प्राजधकृत दकया गया ह तर्ा उसके द्वारा िी गई सभी सूचनाएं या उसके द्वारा दकए गए सभी कायड मरे े प्राजधकार के अतं गतड दकए गए मान े िाएंगे। उच्च प्रिासजनक ग्रडे अजधकारी” [सं. 70/डब्ल्यू डी ओ/ओ आर आई/आर ओ/1/वॉल्यूम.IX] रूप नारायण सनु कर, सिस्ट्य अवसंरचना और पिने सजचव रटप्पण : मलू जनयम भारत के रािपत्र, असाधारण, भाग II, खंड 3, उप-खंड (i), में सा.का.जन. संख्या 625(अ), तारीख 21 िुलाई, 2000 द्वारा प्रकाजित दकए गये र्े और उसमें सा.का.जन. संख्या 321(अ), 28 अप्र ल, 2023 के द्वारा अंजतम संिोधन दकए गय ेर्े। MINISTRY OF RAILWAYS (Railway Board) NOTIFICATION New Delhi, the 28th August, 2023 G.S.R. 633(E).—In exercise of the powers conferred by section 198 of the Railways Act, 1989 (24 of 1989), the Central Government hereby makes the following rules further to amend the Railways (Opening for Public Carriage of Passengers) Rules, 2000 (hereinafter referred to as the said rules), namely:- 1. (1) These rules may be called the Railways (Opening for Public Carriage of Passengers) Second Amendment Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In Chapter II of the said rules,- (i) after sub- rule (3) of rule 3,- (a) in the proviso,- (i) after the word and letters “Form XVI A”, the word and letters “or Form XVI B” shall be inserted; (ii)) in item (f), the word ‘and’ occurring at the end, shall be omitted; (b) after item (g), the following items shall be inserted, namely:- “(h) introduction of Double Distant Signalling alongwith corresponding changes at adjacent stations without yard remodelling; (i) introduction of new Intermediate Block Signaling, except in section with Slip Siding and Catch Siding, alongwith corresponding changes at adjacent stations without yard remodelling; and (j) introduction of new Automatic Block Signaling, except in section with Slip Siding and Catch Siding, alongwith corresponding changes at adjacent stations without yard remodeling”. (ii) In rule 4A, for the words and figure “For matters specified in proviso to rule 3”, the words, brackets, letters and figures “For matters relating to items (a) to (g) specified in proviso to sub-rule (3) of rule 3” shall be substituted; (iii) after rule 4A, the following rule shall be inserted, namely:- “4B. Supply of documents to General Manager. - For matters relating to items (h) to (j) specified in proviso to sub-rule (3) of rule 3 and documents mentioned in rule 4, as relevant to specific matter, shall[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 be submitted to the General Manager by concerned Higher Administrative Grade Officer of Zonal Railway, who shall provide the certificate as specified in Form XVI B to the General Manager”; (iv) in rule 5A, in the heading, after the words “supplied to the”, the words “General Manager or” shall be inserted. 3. In Chapter VII of the said rules,in rule 25A,- (i) in sub-rule (1),- (a) in item (e), the words “non-interlocked” shall be omitted; (b) after item (e), the following Note shall be inserted, namely:- Note: For sub-rule (1), the Principal Chief Engineer shall be the Competent Authority to grant sanction for works affecting running lines carrying passenger’s trains.; (ii) in sub-rule (2),- (a) for the words “For upgradation of interlocked level crossing, including interlocking outside station limits,” ,the words “interlocking of level crossing” shall be substituted; (b) the words “execute and” shall be omitted; (iii) after sub-rule (2), the following sub-rules shall be inserted, namely:- “(3). For items,- (a) introduction of Double Distant Signalling alongwith corresponding changes at adjacent stations without yard remodelling; (b) introduction of new Intermediate Block Signaling, except in section with Slip Siding and Catch Siding, alongwith corresponding changes at adjacent stations without yard remodelling; and (c) introduction of new Automatic Block Signaling, except in section with Slip Siding and Catch Siding, alongwith corresponding changes at adjacent stations without yard remodeling, the Competent Authority to grant sanction to open works, shall bethe General Manager of Zonal Railway, with no further delegation. Note-The General Manager or Principal Chief Signal and Telecommunication Engineer of the Zonal Railway, as the case may be, may sanction the opening of works for passenger traffic under sub-rules (2) and (3) of rule 25A, if he is satisfied, either with or without inspection and works so opened without inspection, should ordinarily be inspected at the earliest possible date, but in case of works of a minor types, the General Manager or Principal Chief Signal and Telecommunication Engineer of Zonal Railway, as the case may be, shall exercise his discretion as to the necessity of carrying out a subsequent inspection.” 4. In Chapter VIII of the said rules, in sub-rule (7) of rule 31,- (i) the word and letter ‘Part I’ shall be omitted; (ii) for the word and letters “Chapter VII”, the word and figure “Chapter 7” shall be substituted; 5. In the said rules, after Form XVI A and the entries relating thereto, the following “Form XVI B and entries”, shall be inserted, namely:- “FORM XVI B [See items (h) to (j) specified in proviso to sub-rule (3) of rule 3 and rule 4B] CERTIFICATE TO BE GIVEN BY HIGHER ADMINISTRATIVE GRADE OFFICER I do hereby certify:- (i) that the Maximum Dimensions for railway in India have in every case been worked to, with the exceptions detailed in the statement herewith annexed and also, that the Standard Dimensions will be observed in future, and that no work or structure infringing the Standard Dimensions will hereafter be permitted without the sanction of the Central Government. (ii) that every coaching vehicle constructed or procured for the use of the railway in mail and passenger trains is, and shall be provided with vacuum or air brake and effective means of communication between passengers, guard and driver. Note: This item of certificate is not necessary for those light lines on which the use of vacuum or air brake has not been insisted upon.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (iii) that the railway shall be worked on the system known as Absolute Block System or Automatic Block System in accordance with the regulations prescribed in section Chapter VIII or Chapter IX of the General Rules for Railways in India. Note: In the statement showing the cases in which the Maximum and Minimum dimensions have been infringed full details for each case must be given, in the form attached (Form XVII) with explanation of the necessity for such infringements and a reference to the Authority under which it was permitted. If there have been no infringements of the Maximum and Minimum Dimensions the words, “with the exception detailed in the statement herewith annexed”, should be omitted or stuck out. (iv) that the signaling and telecommunication equipment have been installed in accordance with the approved instructions and they are safe for passing traffic. (v) that ………….. has been delegated to accompany the General Manager on his inspection and all information supplied or engagements entered into by him shall bear my authority.
