## Report on Railway Land Acquisition Notification: Rajnandgaon-Nagpur 3rd Line Project
**1. Executive Summary:**
This report analyzes a notification (S.O. 5227E) issued by the Ministry of Railways, South East Central Railway, regarding the acquisition of land for the Rajnandgaon-Nagpur 3rd Line 228 KM Project in Gondia District, Maharashtra. Based solely on the provided text, this notification initiates the land acquisition process under Section 20A of the Railway Act, 1989. Key findings include the declaration of intent to acquire specified land for a public purpose, the provision for affected individuals to raise objections, and the identification of a Competent Authority to address these objections. The schedule provides a detailed description of the land parcels to be acquired.
**2. Introduction:**
This report aims to provide a detailed overview and analysis of the railway land acquisition notification issued by the Ministry of Railways, focusing on its objectives, provisions, and potential impact on affected parties. The analysis is strictly based on the information contained within the provided notification text.
**3. Policy Overview:**
This is a new policy action initiated under the framework of the existing Railway Act, 1989.
* **Core Objective(s):** The core objective, as stated in the text, is to acquire land for the "public purpose" of executing the Special Railway Project, namely the Rajnandgaon-Nagpur 3rd Line 228 KM Project in Gondia District in the State of Maharashtra.
**4. Background and Rationale:**
This is a new policy initiative, not an amendment. The notification suggests that the current railway infrastructure is insufficient to meet the needs of the region. The Rajnandgaon-Nagpur 3rd Line project implies the need to increase railway capacity, potentially due to growing passenger or freight traffic, or both. The notification explicitly states that the land acquisition is deemed necessary for a "public purpose," suggesting broader economic and social benefits derived from improved rail connectivity.
**5. Key Provisions / Changes:**
This is a new policy action, so the following are the provisions:
* **Declaration of Intent:** The notification declares the Central Government's intention to acquire land for the stated railway project.
* **Objection Process:** It establishes a process for individuals interested in the land to raise objections to the acquisition within 30 days of the notification's publication in the Official Gazette.
* **Competent Authority:** It designates the Sub Divisional Officer, Gondia, District Gondia, Maharashtra, as the "Competent Authority" responsible for receiving and addressing objections.
* **Hearing of Objections:** The Competent Authority is mandated to provide objectors with an opportunity to be heard, either in person or through a legal practitioner.
* **Decision-Making Power:** The Competent Authority has the power to either allow or disallow objections after conducting necessary inquiries.
* **Finality of Order:** The order made by the Competent Authority under subsection 2 of section 20D of the said Act shall be final.
* **Land Details:** The notification includes a schedule providing a brief description of the land to be acquired, including survey numbers, area, and the names of the landholders.
* **Inspection of Plans:** It provides for access to land plans and other details at the office of the Competent Authority.
**6. Target Audience and Stakeholders:**
The primary target audience and stakeholders are:
* Landowners in Gondia District, Maharashtra, whose land is listed in the schedule. Specifically those in the villages of Kudwa, Rahangdale, Tubkar, Dhakni, Sharnagat, Fekanlal Dulichand Gautam, Lanjewar, Pindkepar and Karanja.
* Residents of Gondia District potentially affected by the project.
* The Competent Authority (Sub Divisional Officer, Gondia).
* The Ministry of Railways, South East Central Railway.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency:** The Ministry of Railways, South East Central Railway, is the primary responsible agency. The Sub Divisional Officer, Gondia, acts as the Competent Authority for land acquisition and objection resolution.
* **Timeline:** A 30-day timeline is specified for submitting objections from the date of publication of the notification in the Official Gazette.
* **Procedure:** The procedure involves: (1) Publication of the notification, (2) Submission of objections by interested parties, (3) Hearing of objections by the Competent Authority, (4) Enquiry by the Competent Authority, (5) Decision by the Competent Authority to allow or disallow objections.
* The finalization of the acquisition is contingent upon the objection resolution process and subsequent orders from the Competent Authority.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcomes of this notification are:
* Acquisition of the necessary land for the Rajnandgaon-Nagpur 3rd Line project.
* Facilitation of the railway project's construction and completion.
* Increased railway capacity and improved connectivity in the region.
* Potential economic benefits due to enhanced transportation infrastructure.
* Potential displacement and livelihood disruption for affected landowners, mitigated through compensation and potentially rehabilitation measures (although these are not mentioned in the text).
**9. Conclusion:**
The Ministry of Railways' notification (S.O. 5227E) initiates the land acquisition process for the Rajnandgaon-Nagpur 3rd Line project in Gondia District. The notification outlines the procedures for objection and the role of the Competent Authority. While the text focuses on the initial steps of land acquisition, its successful implementation is crucial for the timely completion of the railway project and the realization of its intended benefits.
