Notification
In exercise of the powers conferred by rule 3(FF) of the Karnataka Government Employees
(Medical Attendance) Rules, 1963 (subject to the condition that medical facilities at CGHS rates shall
be provided only to Ayurvedic system), the Government of Karnataka has ordered the inclusion of
the following hospital in the list of approved Ayurvedic hospitals under Schedule-1 of the said rules.
“Arujiva Ayurvedic Hospital, Human Welfare Trust, Survey No. 512/1A, Srinivasa
Saradagi, Sedam Road, Kalaburagi District-585102.”

NOTIFICATION
Whereas the draft of the Karnataka Private Medical Establishments (Amendment) Rules, 2026 was
published as required by sub-section (1) of section 26 of the Karnataka Private Medical Establishments Act,
2007 (Karnataka Act 21 of 2007) in Notification No. HFW 287 FPR 2025, dated: 10.03.2026 in Part-IVA of
the Karnataka extra-ordinary Gazette dated: 13.03.2026 inviting objections and suggestions from all the
persons likely to be affected thereby within thirty days from the date of its publication in the Official Gazette.
And whereas, the said Gazette was made available to the public on 13.03.2026.
And whereas, no objections or suggestions have been received in this regard.
Now, therefore, in exercise of the powers by sub-section (1) of section 26 of the
Karnataka Private Medical Establishments Act, 2007 (Karnataka Act 21 of 2007), the Government
of Karnataka hereby makes the following rules, namely: -1946 , , 13 , 2026 ¨sÁUÀ 4J
RULES
1. Title and Commencement. - (1) These rules may be called the Karnataka Private Medical
Establishments (Amendment) Rules, 2026
(2) They shall come into force from the date of theirpublication in the Official Gazette.
2.Amendment of rule 3.-In the Karnataka Private Medical Establishments Rules, 2009 (hereinafter
referred to as the said rules)in rule 3,-
(1) in sub-rule (2), after item (xviii), the following shall be inserted, namely:-
“(xix) Mental Health Establishment from Category ‘A’ to ʼDʼ(under Category Hospital level
2);
(xx) Mental Health Establishment Category ‘E' (under Category Hospital level 1B)”
(2) in sub-rule (5), item (a), (b), (c), (d) and (f) and the entries relating thereto shall be omitted.
3.Amendment of rule 4.-In rule 4 of the said rules,after sub-rule (3), the following sub-rule shall be
inserted, namely:-
“(3-A) The processing fee for provisional registration and renewal application shall be fifty
percent of thefee specified in sub-rule (1) rounded ofto nearest rupees.”
4. Amendment of rule 5.-In rule 5 of the said rules, in sub-rule (1),for clause (v), the following shall
be substituted, namely:-
“(v)Bio Medical Waste Management certificate in compliance with the Bio Medical
Waste Management Rules, 2016 and guidelines issued by the Karnataka State Pollution Control
Board from time to time”.
5. Amendment of rule 7.- In rule 7 of the said rules for sub-rule (2) the following shall
besubstituted, namely: -
“ (2) The Registering Authority in respect of private medical establishments which does not bring
accreditation certificate or the third party inspection certificate from QCI shall refer the matter to the
inspection committee constituted under rule 7D and after receipt of report from the inspection
committee process the application. The Registering Authority shall process the application and grant
or reject the registration based on whether or not the conditions of registration specified in the Act
and these rules are satisfied and where they are not fulfilled, the Registering Authority may reject the
application.”¨sÁUÀ 4J , , 13 , 2026 1947
6. Amendment of rule 7A.-In rule 7A of the said rules, for sub-rule (3), the following shall be
substituted, namely:-
“(3) The Registering Authority in respect of private medical establishments which does not
bring accreditation certificate or the third party inspection certificate from QCI shall refer the
matter to the inspection committee constituted under Rule 7D and after receipt of report from the
inspection committee process the application and grant the registration in case the conditions of
renewal specified in the Act and these rules are satisfied and where they are not fulfilled, the
Registering Authority may reject the application after giving an opportunity of being heard.”
7. Insertion of new rule 7AA.-After rule 7A of the said rules, the following new rule shall be
inserted, namely:-
“ 7AA.Provisional registration.-(1)Every private medical establishments coming into existence on or
after the date of commencement of the Karnataka Private Medical Establishments (Amendment) Rules,
2026 shallbe granted a provisional registration within a period of ten days of applying for permanent
registration or for renewal of existing registration in Form -A and Form-B respectively.
(2) The private medical establishments may apply for provisional registration at the stage of
new registration or renewal of a registration in the concerned Form under sub-rule (1) and in the manner
which is specified for application of new registration or renewal of a registration.
(3) The private medical establishments which have applied for a new registration or for
renewal of a registration need not apply separately for a provisional registration.
(4) The provisional registration shall be issued in the concerned Form as is prescribed for the
permanent registration or for renewal of registration wherein only the caption shall be replaced with prefix
‘Provisional’. ”
8. Amendment of Form-A.- In the said rulesin Form-A,-
(a) in serial number 11, after item (f), the following shall be inserted, namely: -
“(g) Pollution Control Board Certificate for Disposal of Bio medical waste
(h) Registration details on e-DAR portal
In case of private labs, declaration regarding distance from Government hospital (not less than 200
metres)”
(b) after serial number (14), the following shall be inserted, namely: -
“(15) Third party inspection certificate from QCI for having fulfilled the conditions specified in
sections 6,7,8, and 9.
(16) Accreditation Certificate for having fulfilled the conditions specified in section 6,7,8 and 9 from
any of the following three accreditation agencies, namely:-1948 , , 13 , 2026 ¨sÁUÀ 4J
(i) National Quality Assurance Standards (NQAS); or
(ii) National accreditation board for hospitals and healthcare providers (NABH); or
(iii) National accreditation board for Laboratories (NABL); or
(iv) Quality and accreditation institute (QAI)”
10. Amendment of Form-B.- In the said rules, in Form-B,-
(a) in serial number11, after item (h), the following shall be inserted, namely:-
“(i) Pollution Control Board Certificate for Disposal of Bio medical waste
(j) Registration details on e- DAR portal:
Provided that, in case of private labs, here shall be a declaration regarding distance from
Government hospital (not less than 200 metres)”
(b)after serial no. 14, the following shall be inserted, namely: -
“
Particulars
(15) Third party inspection certificate from QCI for having fulfilled the conditions
specified in sections 6,7,8 and 9
(16) Accreditation Certificate for having fulfilled the conditions specified in sections
6,7,8 and 9 from any of the following three accreditation agencies namely:-
(i) National Quality Assurance Standards (NQAS); or
(ii) National accreditation board for hospitals and healthcare providers
(NABH);
(iii) National accreditation board for Laboratories (NABL); or
(iv) Quality and accreditation institute (QAI)
”

In the Government Notification No: HFW 31 FPR 2023, dated: 03.05.2025, a
Hospital-Based Authorization Committee has been constituted to Sparsh Hospital, No-08,
Ideal Homes HBCS Layout, RajarajeshwariNagara, Mysore Road, Bangalore-560098 for
approval of transplantation of human organs at hospital level, as per the powers conferred byR.N.I. No. KARBIL/2001/47147 POSTAL REGN. No. RNP/KA/BGS/2202/2017-19

clause (b) of sub section (4) of the section 9 of the Transplantation of Human Organs and
Tissues Act, 1994 (Central Ad 42 of 1994) read with rule 11 and 12 of the Transplantation of
Human Organs and Tissues Rules, 1994.
Now, that the Committee Chairperson, Dr.AmaneRupaliVijaysinh, has resigned from the
hospital, Commissioner, Health and Family Welfare Services, Bengalooru, in the E-file No.
HFWS/502/2024 (Computer No. 1607700) has submitted a proposal to appoint Major
Dr.MohsinChidgupkar (AGM - Medical Services) as the new Chairperson of the committee in her
place.
Now, therefore, the Government of Karnataka, after due consideration of the above proposal,
hereby orders the appointment of Major Dr.MohsinChidgupkar, AGM – Medical Services, Sparsh
Hospital, as the Chairperson of the Committee, in place of Dr.ArmaneRualiVuaya Sen, Assistant
General Manager, Sparsh Hospital, RajarajeshwariNagara, Mysore Road, Bengaluru–560098, who
was earlier appointed vide Government Notification No. HFW 31 FPR 2023 dated 03.05.2025.
