4. दकसी पदने सदस्ट्य से जभन्न दकसी सदस्ट्य को केन्द्रीय सरकार द्वारा जवजनजश्चत दकए गए सजन्नयमों के अनुसार भत्तों
का संदाय दकया िाएगा।
5. जहत के दकसी टकराव से बिन े के जलए, सदस्ट्य, दकसी ऐसी पररयोिना, जिसके जलए उन्होंने परामि ा काया संबंधी
सेवा दी ह,ै के मूल्यांकन की प्रदक्रया में, प्राजधकरण की बैठक से स्ट्वयं को दरू रखेंगे।
6. प्राजधकरण, तटीय पयाावरण की गुणवत्ता की संरक्षा और उसका सुधार करने के और लक्षद्वीप प्रिासन संघ
राज्यक्षेत्र के तटीय जवजनयमन िोन क्षेत्रों में पयाावरणीय प्रदर्ू ण को रोकने, उसका उपिमन करने तथा जनयंत्रण करने के
प्रयोिनों के जलए जनम् नजलजखत उपाय करेगा, अथाात ् :--
i. प्राजधकरण, पररयोिना प्रस्ट्त ाव के अनुमोदन के जलए आवेदन प्राप्त करने के पश्चात् इसकी िांि करेगा और
यदद वह अनुमोददत तटीय िोन प्रबंध योिना के अनुसार ह ै और संख्य ा का.आ. 19(अ) तारीख 6 िनवरी,
2011 (जिस े इसमें इसके पश् िात् उक् त अजधसूिना कहा गया ह)ै द्वारा भारत सरकार के तत्सकालीन
पयाावरण और वन मंत्रालय द्वारा िारी की गई द्वीप संरक्षा िोन अजधसूिना की अपेक्षा के भीतर ह ैतथा ऐसे
आवेदन की प्राजप्त की तारीख से साठ ददन के भीतर, उक् त अजधसूिना में यथा जवजनर्ददष् ट, संबद्ध
प्राजधकरण को ऐसी पररयोिना के अनुमोदन के जलए जसफाररि करेगा;
ii. प्राजधकरण उक् त अजधसूिना में यथा जवजनर्ददष् ट तटीय जवजनयमन िोन में सभी जवकासात्स मक दक्रयाकलापों
को जवजनयजमत करेगा;
iii. प्राजधकरण उक् त अजधसूिना के उपाबंधों को प्रवृत्सत करने और उनको मानीटर करने के जलए उत्तरदायी
होगा;
iv. प्राजधकरण, तटीय जवजनयमन िोन क्षेत्रों केवगीकरण में और तटीय प्रबंध योिना में पररवतान या उपांतरण
के जलए संघ राज्यक्षेत्र प्रिासन से प्राप्त प्रस्ट् तावों की समीक्षा करेगा और राष्र ीय तटीय िोन प्रबंध
प्राजधकरण को उसके संबंध में जवजनर्ददष् ट जसफाररि करेगा;
v. प्राजधकरण, उक् त अजधजनयम के उपबंधों और उसके अधीन बनाए गए जनयमों के अजभकजथत उल् लघं न के
मामलों की िांि करेगा और उक् त अजधजनयम और उसके अधीन बनाए गए जनयमों के उपबंधों के अजतक्रमण
या उल्लंघन को अंतवर्तलत करने वाल े मामलों का पुनर्तवलोकन करेगा;
vi. प्राजधकरण, स्ट्व प्रेरणा से या दकसी व्य जष्ट या जनकाय या संगठन द्वारा की गई जिकायत के आधार पर, उक्त
अजधसूिना के अजतक्रमण या उल् लघं न के मामलों की िांि या उनका पुनर्तवलोकन करेगा;
vii. प्राजधकरण को उक् त अजधजनयम की धारा 19 के अधीन जिकायत ें फाइल करने के जलए प्राजधकृत दकया िाता

viii. प्राजधकरण, अपने समक्ष मामले के तथ्यों का सत्सयापन करने के जलए उक् त अजधजनयम की धारा 10 के अधीन
ऐसी कारावाई जिसकी अपेक्षा की िाएकरेगा।
7. प्राजधकरण, अपन े कायाकरण में, पारदर्तिता बनाए रखने के प्रयोिन के जलए एक समर्तपत वेबसाइट तैयार करेगा
और अपने कृत्सयों से संबंजधत िानकारी इस पर डालेगा, जिसके अंतगात उसकी बैठक में कायासूिी, बैठक का कायावृत्स त, प्रत्सयेक
बैठक में दकए गए जवजनश् िय, उक्त अजधसूिना के अजतक्रमण और उल् लघं न पर मामलों के जलए जसफ़ाररिें और ऐसे
अजतक्रमण और उल् लघं न पर की गई कारावाई, न्यायालय मामले, जिनम ें न्य ायालयों के आदिे भी ह,ैं और संघ राज्य क्षेत्र
प्रिासनकी अनुमोददत तटीय िोन प्रबंध योिना भी ह ै।
8. प्राजधकरण, राष् रीय तटीय िोन प्रबंध प्राजधकरण को अपन े दक्रयाकलापों की ररपोटा छह मास में कम से कम एक
बार प्रस्ट् तुत करेगा ।

ORDER
New Delhi, the 10th September, 2021
S.O. 3688(E).—In exercise of the powers conferred by sub-sections (1) and (3) of section 3 of the
Environment (Protection) Act, 1986 (29 of 1986) (hereinafter referred to as the said Act), the Central Government
hereby constitutes the Lakshadweep Coastal Zone Management Authority (hereinafter referred to as the Authority)
consisting of the following persons, for a period of three years, from the date of publication of this order in the
Official Gazette, namely:-

2. The Authority shall have its headquarters at Kavaratti, Lakshadweep
3. The quorum for the meeting of the Authority shall be one-third of the total number of its Members.
4. A Member, other than an ex-officio Member, shall be paid allowances as per the norms decided by the Central

5. In order to avoid any conflict of interest, the member(s) shall recuse themselves from the meeting of the
Authority, in the process of appraisal of any project, for which they have rendered consultancy service.
6. The Authority shall, for the purposes of protecting and improving the quality of the costal environment and
preventing, abating and controlling environmental pollution in the Coastal Regulation Zone areas in the Union
territory of Lakshadweep Administration, take the following measures, namely: -
i. the Authority shall, after receiving the application for approval of project proposal, examine the same if it
is in accordance with the approved Coastal Zone Management Plan and within the requirements of the
Island Protection Zone notification issued by the Government of India in the erstwhile Ministry of
Environment and Forests and published vide number S.O.20(E), dated the 6th January, 2011 (hereinafter
referred to as the said notification), and make recommendations for approval of such project to the
concerned authority, as specified in the said notification, within a period of sixty days from the date of
receipt of such application;
ii. the Authority shall regulate all developmental activities in the Coastal Regulation Zone areas as specified
in the said notification;
iii. the Authority shall be responsible for enforcing and monitoring the provisions of the said notification;
iv. the Authority shall examine the proposals received from the Union territory Administration for changes or
modifications in the classification of Coastal Regulation Zone areas and in the Coastal Zone Management
Plan and make specific recommendations thereon, to the National Coastal Zone Management Authority;
v. the Authority shall inquire into cases of alleged violation of the provisions of the said Act or the rules
made thereunder, and review the cases involving violations or contraventions of the provisions of the said
Act and the rules made thereunder;
vi. the Authority shall inquire or review cases of violations or contraventions of the said notification suo-
moto, or on the basis of a complaint made by any individual or body or organisation;
vii. the Authority is authorised to file complaints under section 19 of the said Act;
viii. the Authority shall take such action as may be required under section 10 of the said Act, to verify the facts
of the cases before it.
7. The Authority shall, for the purpose of maintaining transparency in its functioning, create a dedicated website
and post the information relating to its functions, including the agenda in its meetings, minutes of the meetings,
decisions taken in each meeting, recommendations for matters on violations and contravention of the said notification
and actions taken on such violations and contraventions, court matters including the orders of the courts and the
approved Coastal Zone Management Plan of the Union Territory Administration.
8. The Authority shall furnish reports of its activities at least once in six months to the National Coastal Zone
Management Authority.
