बेंगरे, मगैं लोर-575013, कनाटा क । 16. जनदेिक, (तकनीकी प्रकोष्ठ) वन, पाररजस्ट्र्जतकी और पर्ाावरण जवभाग, 7वां तल, सदस्ट्र्-सजिव । एम.एस. भवन बेंगलुरु, कनााटक । 2. प्राजधकरण का मख्ु र्ालर् बेंगलरु, कनााटक म ेंहोगा । 3. प्राजधकरण की बैठकों के जलए गणपूर्ता इसके सदस्ट्र्ों की कुल संख्र्ा के एक जतहाई होगी । 4. पदने सदस्ट्र् से जभन्न सदस्ट्र् को केंद्रीर् सरकार द्वारा जवजनजश्चत जनबंधनों और ितों के अनसु ार भत्ते संदत्त दकए िाएंग े । 5. जहतों में दकसी टकराव से बिने के जलए, सदस्ट्र् दकसी पररर्ोिना के मूल्र्ांकन की प्रदिर्ा में, जिसके जलए उन्ह ें कोई परामिी सेवा प्रदान की हो, प्राजधकरण की बैठक से स्ट्वर् ंको अलग कर लगें े । 6. प्राजधकरण कनााटक राज्र् के तटीर् जवजनर्मन िोन क्षेत्रों में तटीर् पर्ाावरण की क्वाजलटी का संरक्षण और सुधार करन े तर्ा पर्ाावरण प्रदर्ू ण का जनवारण करने, कम करन े और जनर्ंजत्रत करन े के जलए जनम्नजलजखत उपार् करेगा, अर्ाात ् :- (i) पररर्ोिना प्रस्ट्तावक से पररर्ोिना प्रस्ट्ताव के अनुमोदन के जलए प्राप्त आवेदन की परीक्षा, अनुमोददत तटीर् िोन प्रबंधन र्ोिना के अनुसार और संख्र्ांक सा.का.जन. 37 (अ), तारीख 18 िनवरी, 2019 में प्रकाजित भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूिना(जिसे इसमें इसके पश्चात् उक्त अजधसूिना कहा गर्ा ह)ै की अपेक्षाओं के भीतर और उक्त अजधसूिना म ें र्र्ाजवजनर्दाष्ट संबंद्ध प्राजधकारी को आवेदन प्राजप्त की तारीख स े साठ ददन की अवजध के भीतर ऐसी पररर्ोिना के अनुमोदन के जलए जसफाररि करना; (ii) उक्त अजधसूिना म ेंर्र्ाजवजनर्दाष्ट तटीर् जवजनर्मन िोन क्षत्रे ों में सभी जवकासात्समक कार्ाकलापों को जवजनर्जमत करना; (iii) उक्त अजधसूिना के उपबंधों के कार्ाान्वर्न का प्रवतना करना और उसकी मॉनीटरी करना; (iv) भारत सरकार के पर्ाावरण, वन और िलवार्ु मंत्रालर् की संख्र्ांक का.आ. 4650 (अ) तारीख 30 जसतंबर, 2022 की अजधसूिना म ेंर्र्ाजवजनर्दाष्ट अजधजनर्म की धारा 5 के अधीन जनदेि िारी करना; (v) अजधजनर्म की धारा 10 के अधीन िजक्तर्ों का प्रर्ोग करना; (vi) अजधजनर्म की धारा 19 के अधीन पररवाद करना; (vii) तटीर् जवजनर्मन िोन क्षत्रे ों के वगीकरण म ें पररवतना ों र्ा उपांतरणों के जलए राज्र् सरकार स े प्राप्त प्रस्ट्तावों की परीक्षा करना और उक्त अजधसूिना के अधीन राष्ट्रीर् तटीर् िोन प्रबंधन प्राजधकरण को इस संबंध में जवजिष्ट जसफाररिें करना; और (viii) उक्त अजधजनर्म र्ा तद्धीन बनाए गए जनर्मों र्ा उक्त अजधसूिना के अनपु ालन म ें असफलता र्ा उल्लंघन के मामलों की स्ट्वप्रेरणा से र्ा दकसी व्यजक्त द्वारा उसके समक्ष दकए गए पररवाद के आधार पर िांि र्ा पुनरीक्षण करना। 7. प्राजधकरण, अपन े कार्ाकरण म ें पारदर्िाता बनाए रखन े के प्रर्ोिन से, एक समर्पात वेबसाइट तैर्ार करेगा और उस पर अपन े कार्ों स े संबंजधत सूिना, जिसके अंतगात इसकी बैठकों की कार्ासूिी, बैठकों का कार्ावृत्त, बैठकों म ें दकए गए जवजनश्चर्, उक्त अजधसूिना के अनुपालन की असफलता र्ा उल्लंघन पर मामलों के जलए जसफाररि और ऐसी असफलता र्ा उल्लघं न पर की गई कारावाई और न्र्ार्ालर्ी मामल े जिसके अंतगता न्र्ार्ालर् का आदेि भी ह ै और कनााटक सरकार की अनुमोददत तटीर् िोन प्रबंधन र्ोिना पोस्ट्ट करेगा । 8. प्राजधकरण राष्ट्रीर् तटीर् िोन प्रबंधन प्राजधकरण को छह मास में कम से कम एक बार अपने कार्ाकलापों की ररपोटा प्रस्ट्तुत करेगा । [फा.सं. 12-4/2005-आईए III (भाग-3)] रित अग्रवाल, संर्ुक्त सजिव4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE ORDER New Delhi, the 31st December, 2025 G.S.R. 942(E).––In exercise of the powers conferred by sub section (1) and (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereinafter referred to as the Act), the Central Government hereby constitutes the Karnataka Coastal Zone Management Authority (hereinafter referred to as the Authority) consisting of the following persons, for a period of three years, with effect from the date of publication of this Order in the Official Gazette, namely:⸻ 1. The quorum for the meeting of the Authority shall be one-third of the total number of its Members. 4. The member, other than Member ex officio, shall be paid allowances as per the terms and conditions decided by the Central Government. 5. In order to avoid any conflict of interest, the Members shall recuse themselves from the meeting of the Authority, in the process of appraisal of any project, for which they have rendered any consultancy service. 6. The Authority shall take the following measures for protecting and improving the quality of the coastal environment and preventing, abating and controlling environmental pollution in the Coastal Regulation Zone areas in the State of Karnataka, namely:⸺ (i) examine the application received from the project proponent for approval of project proposal, in accordance with the approved Coastal Zone Management Plan and within the requirements of the notification of the Government of India in the Ministry of Environment, Forest and Climate Change, Published vide number G.S.R. 37(E), dated the 18th January, 2019 (hereinafter referred to as the said notification) and make recommendation for approval of such project to the concerned authority, as specified in the said notification, within a period of sixty days from the date of receipt of application;6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ii) regulate all developmental activities in the Coastal Regulation Zone areas as specified in the said notification; (iii) enforce and monitor the implementation of provisions of the said notification; (iv) issue directions under section 5 of the Act as specified in the notification of the Government of India, in the Ministry of Environment, Forest and Climate Change, vide number S.O. 4650(E), dated the 30th September, 2022; (v) exercise powers under section 10 of the Act; (vi) make a complaint under section 19 of the Act; (vii) examine the proposals received from the State Government for changes or modifications in the classification of Coastal Regulation Zone areas and in the Coastal Zone Management Plan and make specific recommendations thereon, to the National Coastal Zone Management Authority under the said notification; and (viii) inquire or review cases of failure of compliance or contravention of the said Act or rules made thereunder or the said notification, suo-moto or on the basis of a complaint made by any person before it. 7. The Authority shall, for the purpose of maintaining transparency in its functioning, create a dedicated website and post the information relating to its functions, including the agenda in its meeting, minutes of the meeting, decision taken in the meeting, recommendation for matters on failure of compliance or contravention of the said notification and action taken on such failure or contravention and court matters including the orders of the court and the approved Coastal Zone Management Plan of the Government of Karnataka. 8.
