6. प्राजधकरण, ओजडिा राज्र् में तटीर् जवजनर्मन िोन क्षेत्रों म ेंतटीर् पर्ाावरण की गणु वत्ता की संरक्षा और उसका
सुधार करन ेऔर पर्ाावरणीर् प्रदर्ू ण को रोकने, उसका उपिमन करने तर्ा जनर्ंत्रण करने के जलए जनम् नजलजखत उपार्
करेगा, अर्ाात् :--
(i) पररर्ोिना प्रस्ट् ताव के अनुमोदन के जलए पररर्ोिना प्रस्ट्त ावक स े प्राप् त आवेदन की, भारत सरकार की,
र्र्ाजस्ट्र्जत, अजधसूिना संख् र्ा का. आ. 37(अ) तारीख 18 िनवरी, 2019 (जिसे इसमें इसके पश् िात् उक्त
अजधसूिना कहा गर्ा ह)ै के अधीन तैर्ार अनुमोददत तटीर् िोन प्रबंधन र्ोिना के अनुसार, िांि करेगा और
आवेदन की प्राजि की तारीख से साठ ददन के भीतर, उक्त अजधसूिना में र्र्ाजवजनर्दाष् ट, संबद्ध प्राजधकरण को
पररर्ोिना प्रस्ट्ताव के अनुमोदन के जलए जसफाररि करना;
(ii) उक्त अजधसूिना में र्र्ाजवजनर्दाष् ट तटीर् जवजनर्मन िोन क्षेत्रों म ेंसभी जवकासात्स मक दक्रर्ाकलापों को
जवजनर्जमत करना ;
(iii) उक्त अजधसूिना के उपबंधों का प्रवतान और मानीटरी करना ;
(iv) भारत के रािपत्र, म ेंप्रकाजित भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतना मंत्रालर् की अजधसूिना
स0ं 4650(अ), तारीख 30 जसतंबर, 2022 म ें र्र्ा जवजनर्दाष्ट के अनुसार, उक्त अजधजनर्म की धारा 5 के
अधीन जनदेि िारी करना ;
(v) उक्त अजधजनर्म की धारा 10 के अधीन िजक्तर्ों का प्रर्ोग करना ;
(vi) उक्त अजधजनर्म की धारा 19 के अधीन पररवाद फाइल करना ;
(vii) तटीर् जवजनर्मन िोन क्षेत्रों म ें और तटीर् िोन प्रबंधन र्ोिना में उपांतरण के जलए राज्र् सरकार से प्राि
प्रस्ट्तावों की समीक्षा करना और उक्त अजधसूिना के अधीन राष्ट्रीर् तटीर् िोन प्रबंधन प्राजधकरण को जसफाररिें
करना;
(viii) उक्त अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों र्ा उक्त अजधसूिना के अनुपालन में जवफलता र्ा उल्लंघन
के मामलों की, स्ट् वप्ररे णा स े र्ा दकसी व्यजक्त द्वारा उसके समक्ष की गई जिकार्त के आधार पर, िांि और
पुनरीक्षा करना ।
7. प्राजधकरण, अपन े कार्ाकरण में, पारदर्िता ा बनाए रखन े के प्रर्ोिन के जलए एक समर्पात वेबसाइट तैर्ार करेगा और
अपने कृत्सर्ों से संबंजधत िानकारी इस पर डालगे ा, जिसके अंतगात उसकी बैठक म ेंकार्ासूिी, बैठक का कार्ावृत्स त, बैठक
में दकए गए जवजनश् िर्, उक्त अजधसूिना के अनुपालन म ेंजवफलता र्ा उल् लघं न पर मामलों के जलए जसफ़ाररिें और ऐसी
जवफलता र्ा उल् लघं न पर की गई कारावाई, न्र्ार्ालर् मामल,े जिनमें न् र्ार्ालर्ों के आदेि भी ह,ैं और ओजडिा सरकार
की अनुमोददत तटीर् िोन प्रबंधन र्ोिना भी ह ै।
8. प्राजधकरण, राष्ट्रीर् तटीर् िोन प्रबंधन प्राजधकरण को अपने दक्रर्ाकलापों की ररपोटा छह मास में कम से कम एक बार
प्रस्ट् तुत करेगा ।

S.O. 2001(E).— In exercise of the powers conferred by section 3 of the Environment (Protection)
Act, 1986 (29 of 1986) (hereinafter referred to as the said Act), the Central Government hereby constitutes
the Odisha Coastal Zone Management Authority (hereinafter referred to as the Authority) consisting of the
following persons, for a period of three years, with effect from the date of publication of this Order in the
Official Gazette, namely:-

2. The Headquarter of the Authority shall be at Bhubaneswar, Odisha.
3. The quorum for the meeting of the Authority shall be one- third of the total number of its Members.
4. The member, other than Member ex officio, shall be paid allowances as per the terms and conditions
decided by the Central Government.
5. In order to avoid any conflict of interest, the Members shall recuse themselves from the meeting of the
Authority, in the process of appraisal of any project, for which they have rendered any consultancy service.
6. The Authority shall take following measures for protecting and improving the quality of the coastal
environment and preventing, abating and controlling environmental pollution in the Coastal Regulation
Zone areas in the State of Odisha, namely: -
(i) examine proposals received from the project proponent for approval of project proposal, in accordance
with the approved Coastal Zone Management Plan prepared under the notification of the Government of
India number G.S.R. 37(E), dated the 18th January, 2019 (hereinafter referred to as the said notification), as
the case may be, and make recommendation for approval of project proposal to the authority concerned, as
specified in the said notification, within a period of sixty days from the date of receipt of application;
(ii) regulate all developmental activities in the Coastal Regulation Zone areas as specified in the said
notification;
(iii) enforce and monitor the implementation of provisions of the said notification;
(iv) issue directions under section 5 of the said Act as specified in the notification of the Government of
India, in the Ministry of Environment, Forest and Climate Change, number S.O. 4650(E), dated the 30th
September, 2022;
(v) exercise powers under section 10 of the said Act;
(vi) file complaint under section 19 of the said Act;
(vii) examine proposals received from the State Government for modifications in the classification of
Coastal Regulation Zone areas and in the Coastal Zone Management Plan and making recommendations to
the National Coastal Zone Management Authority under the said notification; and
(viii) inquire and review cases of failure of compliance or contravention of the said Act or rules made
thereunder or the said notification, suo-moto or on the basis of a complaint made by any person before it.
7. The Authority shall, for the purposes of maintaining transparency in its functioning, create a dedicated
website and post the information relating to its functions, including the agenda in its meeting, minutes of
the meeting, decision taken in the meeting, recommendation for matters on failure of compliance or

including the order of the court and the approved Coastal Zone Management Plan of the Government of
Odisha.
8. The Authority shall furnish report of its activity at least once in six months to the National Coastal Zone
Management Authority.
