7. जहतों के दकसी टकराव से बचने के जलए,--
(i) प्राजधकरण, ओजडिा और सजमजत, ओजडिा के अध्र्क्ष और सिस्ट्र्,--
(क) र्ह घोजषत करेंग ेदक वे दकस परामिा संगठन स ेऔर पररर्ोिना के प्रस्ट्तावक से भी िड़ु े हैं; और
(ख) दकसी ऐसी पररर्ोिना, जिसका उनके कार्ाकाल के िौरान प्राजधकरण, ओजडिा द्वारा जवजनश्चर्
दकर्ा िाना ह ै र्ा सजमजत द्वारा मूल्र्ांकन दकर्ा िाना ह,ै के जलए पर्ाावरण समाघात जनधाारण
और पर्ाावरण प्रबंध र्ोिना तैर्ार करने के संबंध में कोई परामिा नहीं करेंगे र्ा न ही उसके सार्
सहर्ुि होंग े ; और
(ii) र्दि पूवावती पांच वषों में प्राजधकरण, ओजडिा और सजमजत के अध्र्क्ष र्ा सिस्ट्र्ों में स े दकसी सिस्ट्र् न े
दकसी पररर्ोिना प्रस्ट्तावक के जलए परामिा सेवाएं उपलब्ध कराई ह ैं र्ा पर्ाावरण समाघात जनधाारण
अध्र्र्न संचाजलत दकर्ा है, तो उस ििा म ें ऐस े प्रस्ट्तावकों द्वारा प्रस्ट्ताजवत की िा रही दकसी पररर्ोिना
के मूल्र्ांकन की प्रदक्रर्ा में, र्र्ाजस्ट्र्जत, प्राजधकरण, ओजडिा और सजमजत की बैठकों में स्ट्वर्ं उपजस्ट्र्त
नहीं होंगे ।
8. सजमजत, सामूजहक उत् तरिाजर्त् व के जसद्ांत पर कार्ा करेगी और अध् र्क्ष, प्रत् र्ेक मामल े म ें सवासम्मजत पर पहुचं न े
का प्रर्ास करेगा और र्दि सवासम्मजत पर पहुचं ा नहीं िा सकता हो तो बहुमत का मत अजभभावी होगा ।
9. ओजडिा राज्र् सरकार, प्राजधकरण, ओजडिा और सजमजत के जलए सजचवालर् के रूप म ें कार्ा करन े के जलए दकसी
अजभकरण को अजधसूजचत करेगी, िो सभी जवत् तीर् और संभार तंत्र संबंधी सहार्ता, जिसके अतं गात वास-सुजवधा, पररवहन
और उनके सभी कानूनी कृत् र्ों के संबंध में अन् र् सुजवधाएं भी ह,ैं उपलब्ध कराएगा ।
10. प्राजधकरण, ओजडिा और सजमजत के अध् र्क्ष और सिस्ट् र्ों को बैठक की फीस, र्ात्रा भत् ता और महं गाई भत् ता, ओजडिा
राज्र् सरकार के लागू जनर्मों के अनुसार संित्त दकर्ा िाएगा ।

NOTIFICATION
New Delhi, the 16th December, 2025
S.O. 5802(E).—In exercise of the powers conferred by sub-section (3) of section 3 of the Environment
(Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the erstwhile
Ministry of Environment and Forests, published in the Gazette of India, Extraordinary, Part II, Section 3,
Sub –section(ii), vide number S.O. 1533(E), dated the 14th September, 2006 (hereinafter referred to as the said
notification), the Central Government hereby constitutes the State Level Environment Impact Assessment Authority,
Odisha (hereinafter referred to as the Authority Odisha) comprising of the following persons, namely:⸺

2. The Authority, Odisha shall take its decision on the recommendations of the State Level Expert Appraisal Committee
constituted under paragraph 4 of this notification.
3. All decisions of the Authority, Odisha shall be taken in a meeting and shall ordinarily be unanimous:
Provided that, in case a decision is taken by majority, the details of views, for and against it, shall be clearly
recorded in the minutes and a copy thereof sent to the Central Government.
4. The Central Government, in consultation with the State Government of Odisha, for the purpose of assisting the
Authority, Odisha, hereby constitutes the State Level Expert Appraisal Committee for the State of Odisha, (hereinafter
referred to as the Committee) comprising of the following persons, namely: ⸺

5. The Chairman and Members of the Authority, Odisha and the Committee shall hold office for a period of three years
from the date of publication of this notification in the Official Gazette.
6. The Authority, Odisha and the Committee shall exercise such powers and follows such procedures as specified in the
said notification.
7. In order to avoid any conflict of interest,⸺
(i.) the Chairman and Members of the Authority, Odisha and the Committee shall,⸺
(a) declare to which consulting organisation they have been associated with and also the project proponents;
and
(b) not undertake any consultation or associate with regard to preparation of Environment Impact Assessment
and Environment Management Plan for a project, which is to be decided by the Authority, Odisha or to
be appraised by the Committee during their tenure; and
ii. in the preceding five years, if the Chairman or any Member of the Authority, Odisha and the Committee have
provided consultancy services or conducted Environment Impact Assessment studies for any project proponent,
in that event they shall recuse themselves from the meetings of the Authority, Odisha or the Committee, as the
case may be, from the process of appraisal of any project proposed by such proponents.
8. The Committee shall function on the principle of collective responsibility and the Chairman shall endeavour to reach
a consensus in each case, and if a consensus cannot be reached, the views of the majority shall prevail.
9. The State Government of Odisha shall notify an agency to act as Secretariat of the Authority, Odisha and the
Committee which shall provide financial and logistic support, including accommodation, transportation and such other
facilities in respect of all their statutory functions.
10. The sitting fees, travelling allowances and dearness allowances to the Chairman and Members of the Authority,
Odisha and the Committee shall be paid in accordance with the provisions of relevant rules of the State
Government of Odisha.
