के संबंध में कोई परामि ार्ा सहर्ोग नहीं िेंग,े जिसका उनके कार्ाकाल के िौरान प्राजधकरण द्वारा जवजनश्चर्
दकर्ा िाना ह ैर्ा सजमजतर्ों द्वारा अंकन दकर्ा िाना ह;ै
(ii) जपछल े पांच वषों में र्दि प्राजधकरण, केरल और सजमजतर्ों के अध्र्क्ष और दकसी सिस्ट्र् ने दकसी पररर्ोिना
प्रस्ट्तावक के जलए परामिा संबधं ी सेवाएं प्रिान की ह ैं र्ा पर्ावा रण समाघात जनधाारण का अध्र्र्न दकर्ा है,
तो उस जस्ट्र्जत म ें व े ऐसे प्रस्ट् तावकों द्वारा प्रस्ट्ताजवत दकसी पररर्ोिना के अंकन की प्रदक्रर्ा में प्राजधकरण,
केरल र्ा सजमजतर्ों की बैठक स ेस्ट्वर्ं को अलग रखगें े।
9. सजमजतर्ां सामूजहक उत्तरिाजर्त्व के जसद्धांत पर कार्ा करेंगी और अध्र्क्ष प्रत्र्ेक मामल ेमें सवासम् मजत पर पहुचं ने का प्रर्ास
करेगा और र्दि सवासम् मजत पर नहीं पहुचं ा िा सकता ह ैतो बहुमत का मत अजभभावी होगा ।
10. केरल राज्र् सरकार, प्राजधकरण, केरल और सजमजतर्ों के जलए सजचवालर् के रूप में कार्ा करने के जलए दकसी अजभकरण
को जवजनर्िाष् ट करेगी और जवत्तीर् तर्ा संभार तंत्र संबंधी सहार्ता, जिसके अंतगता उनके सभी कानूनी कृत्र्ों की बाबत वास-
सुजवधा, पररवहन और अन्दर् सुजवधाएं भी ह,ैं उपलब्ध कराएगी।
11. प्राजधकरण और सजमजतर्ों के अध्र्क्ष तर्ा सिस्ट्र्ों की बैठक की िीस, र्ात्रा भत्ता और मंहगाई भत्ता केरल राज्र् सरकार
के जनर्मों के अनुसार संित्त दकर्ा िाएगा ।

(Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the erstwhile
Ministry of Environment and Forests, published in the Gazette of India, Extraordinary, Part II, Section 3, sub section
(ii), vide number S.O. 1533(E), dated the 14th September, 2006 (hereinafter referred to as the said notification), the
Central Government hereby constitutes the State Level Environment Impact Assessment Authority, Kerala (hereinafter
referred to as the Authority, Kerala) comprising of the following Members, namely:—

8. In order to avoid any conflict of interest,⸺
(i) the Chairman and Members of the Authority, Kerala and the Committees shall,⸺
(a) declare to which consulting organisation they have been associated with and also the project
proponents; and
(b) not undertake any consultation or associate with regard to preparation of Environment Impact
Assessment and Environment Management Plan for a project, which is to be decided by the Authority
or to be appraised by the Committees during their tenure; and
(ii) in the preceding five years, if the Chairman or any Member of the Authority, Kerala and the Committees have
provided consultancy services or conducted Environment Impact Assessment studies for any project proponent,
in that event they shall recuse themselves from the meetings of the Authority, Kerala or the Committees as the
case may be, from the process of appraisal of any project proposed by such proponents.
9. The Committees shall function on the principle of collective responsibility and the Chairman shall endeavour to
reach a consensus in each case, and if cannot be reached consensus, the views of the majority shall prevail.
10. The State Government of Kerala shall notify an agency to act as Secretariat of the Authority, Kerala and the
Committees which shall provide financial and logistic support, including accommodation, transportation and such other
facilities in respect of all their statutory functions.
11. The sitting fees, travelling allowances and dearness allowances to the Chairman and Members of the Authority and
the Committees shall be paid as per the rules of the State Government of Kerala.
