और (ख) दकसी ऐसी पररर्ोिना के जलए पर्ाावरणीर् समाघात जनधाारण और पर्ाावरण प्रबंधन र्ोिना की तैर्ारी के संबंध में कोई परामि ा र्ा सहर्ोग नहीं िगें े, जिसका उनके कार्ाकाल के िौरान प्राजधकरण द्वारा जवजनश्चर् दकर्ा िाना ह ैर्ा सजमजतर्ों द्वारा अंकन दकर्ा िाना ह;ै (ii) जपछले पांच वषों में र्दि प्राजधकरण और सजमजतर्ों के अध्र्क्ष और दकसी सिस्ट्र् ने दकसी पररर्ोिना प्रस्ट्तावक के जलए परामिा संबंधी सेवाएं प्रिान की ह ैंर्ा पर्ाावरण समाघात जनधारा ण का अध्र्र्न दकर्ा है, तो उस जस्ट्थजत म ें वे ऐस े प्रस्ट् तावकों द्वारा प्रस्ट्ताजवत दकसी पररर्ोिना के अंकन की प्रदक्र्ा म ें प्राजधकरण र्ा सजमजतर्ों की बैठक स े स्ट्वर्ं को अलग रखेंगे। 9. सजमजतर्ां सामूजहक उत्तरिाजर्त्व के जसद्धांत पर कार् ाकरेंगी और अध्र्क्ष प्रत्र्ेक मामल ेमें सवासम् मजत पर पहुचं ने का प्रर्ास करेगा और र्दि सवासम् मजत पर नहीं पहुचं ा िा सकता ह ैतो बहुमत का मत अजभभावी होगा । 10. उत् तर प्रिेि राज्र् सरकार, प्राजधकरण और सजमजतर्ों के जलए सजचवालर् के रूप म ेंकार्ा करने के जलए दकसी अजभकरण को जवजनर्िाष् ट करेगी िो जवत्तीर् तथा संभार तंत्र संबंधी सहार्ता, जिसके अंतगात उि अजधसूचना के अधीन उनके सभी कृत्र्ों की बाबत वास-सुजवधा, पररवहन और अन्‍दर् सुजवधाएं भी ह,ैं उपलब्ध कराएगी । 11. प्राजधकरण और सजमजतर्ों के अध्र्क्ष तथा सिस्ट्र्ों की बैठक की फीस, र्ात्रा भत्ता और महं गाई भत्ता उत् तर प्रििे राज्र् सरकार के सुसंगत जनर्मों के उपबंधों के अनुसार संित्त दकर्ा िाएगा । [फा.सं.-ि-े 11013/43/07-आईए.।।(।) (पीटी.)] रित अग्रवाल , संर्ुि सजचव6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 26th August, 2025 S.O. 3921(E).—In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the erstwhile Ministry of Environment and Forests, number S.O. 1533(E), dated the 14th September, 2006 and in suppression of the notification of the Government of India, in the Ministry of Environment, Forests and Climate Change number vide S.O.2776(E ) dated the 11th June, 2021 except as respects things done or omitted to be done before such suppression, the Central Government hereby constitutes the State Level Environment Impact Assessment Authority, Uttar Pradesh (hereinafter referred to as the Authority) comprising of the following Members, namely: ⸺ (i) Shri. The Chairperson and Members of the Authority and the Committees, shall hold office for a period of three years from the date of publication of this notification in the Official Gazette. 7. The Authority and the Committees shall exercise such powers and follow such procedures as specified in the said notification. 8. In order to avoid any conflict of interest,[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 (i) the Chairperson and Members of the Authority, and the Committees shall, (a) declare to which consulting organisation they have been associated with and also the project proponents; and (b) not undertake any consultation or associate with regard to preparation of Environment Impact Assessment and Environment Management Plan for project, which is to be decided by the Authority or to be appraised by the Committees during their tenure; (ii) in the preceding five years, if the Chairperson or any Member of the Authority, and the Committees have provided consultancy services or conducted Environment Impact Assessment studies for any project proponent, in that event they shall recuse themselves from the meetings of the Authority or the Committees as the case may be, from the process of appraisal of any project proposed by such proponents. 9. The Committees shall function on the principle of collective responsibility and the Chairperson shall endeavour to reach a consensus in each case, and if consensus cannot be reached, the views of the majority shall prevail. 10. The State Government of Uttar Pradesh shall specify an agency to act as Secretariat of the Authority and the Committees which shall provide financial and logistic support, including accommodation, transportation and such other facilities in respect of their functions under the said notification. 11. The sitting fees, travelling allowances and dearness allowances to the Chairperson and Members of the Authority and the Committees shall be paid in accordance with the provisions of relevant rules of the State Government of Uttar Pradesh.
