7. जातक के टकराव से बचने के जलए-
(i) प्राजधकरण और सजमजत के अध्र्क्ष और सिस्ट्र्-
(क) र्ा घ जर्त करेंगे दक व ेदकस परामिा सगं ठन और पररर् िना के प्रस्ट्तावक से िु़े े ा ;
(ख) दकसी पररर् िना के जलए पर्ाावरणीर् समाघात जनधाारण और पर्ाावरण प्रबंधन र् िना की त)र्ारी
के जलए क ई परामि ा नाीं िगे ें र्ा सार् ग नाीं करेंग,े ि उनके कार्ाकाल के िौरान प्राजधकरण द्वारा
जवजनजश् चत और सजमजत द्वारा मूल्र्ांदकत की िानी ा ); तर्ा
(ii) र्दि जपछले पांच वर्ों में, अध्र्क्ष र्ा प्राजधकरण और सजमजत के दकसी भी सिस्ट्र् ने दकसी पररर् िना
प्रस्ट्तावक के जलए परामिा सेवाएं प्रिान की ा र्ा पर्ाावरणीर् समाघात जनधाारण अध्र्र्न आर् जित दकर्ा ा,) त
उस जस्ट्र्जत में वे स्ट्वर्ं क ऐसे समर्ाकक द्वारा प्रस्ट्ताजवत दकसी भी पररर् िना के मूल्र्ांकन की प्रदिर्ा में
प्राजधकरण और सजमजत की ब)ठक बचाव करेंगे ।
8. सजमजत ऐसी िजक्तर्क का प्रर् ग करेगी और ऐसी प्रदिर्ाओं का पालन करेगी, ि उक्त अजधसूचना में जवजनर्िष्ा ट
ा ।
9. सजमजत सामूजाक उत्तरिाजर्त्व के जसद्ांत पर काम करेगी और अध्र्क्ष प्रत्र्ेक मामल े में सवासम् मजत पर पएचं न े का
प्रर्ास करेगा और र्दि सवासम् मजत पर नाीं पएचं ा िा सकता ा )त बएमत का मत अजभभावी ा गा ।
10. िम्म-ू कश्मीर संघ राज्र्क्षेत्र सरकार, प्राजधकरण और सजमजत के जलए सजचवालर् के रूप में कार्ा करन े के जलए दकसी
अजभकरण क अजधसूजचत करेंगी और सभी जवत्तीर् और संभार तंत्र संबंधी साार्ता, जिसके अंतगात वास-सुजवधा, पररवान
और उनके सभी कानूनी कृत्र्क की बाबत अन्दर् सुजवधाएं भी ा, उपलब्ध कराएगी ।
11. प्राजधकरण के अध्र्क्ष और सिस्ट्र्क तर्ा सजमजत के अध्र्क्ष और सिस्ट्र्क की ब)ठक की फीस, र्ात्रा भत्ता और मंागाई
भत्ता िम्म-ू कश्मीर संघ राज्र्क्षत्रे सरकार के जनर्मक के अनुसार संित्त दकर्ा िाएगा ।

NOTIFICATION
New Delhi, the 12th February, 2024
S.O. 637(E).—In exercise of the powers conferred by sub-section (3) of section 3 of the Environment
(Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India, in the erstwhile
Ministry of Environment and Forests, number S.O. 1533(E), dated the 14th September, 2006 (hereinafter referred to as
the said notification), the Central Government hereby constitutes the Union territory of Jammu and Kashmir
Environment Impact Assessment Authority (hereinafter referred to as the Authority) comprising of the following
persons, namely: -
(a) Shri Lal Chand, former Member Jammu and Kashmir Public Service -Chairman;

2. The Chairman and Members of the Authority shall hold office for a period of three years from the date of
publication of this notification in the Official Gazette.
3. The Authority shall exercise the powers and follow the procedures specified in the said notification.
4. The Authority shall take its decision on the recommendations of the Union territory Expert Appraisal Committee
constituted under paragraph 5 for the Union territory of Jammu and Kashmir.
5. The Central Government, in consultation with the Government of Jammu and Kashmir, for the purpose of assisting
the Authority, hereby constitutes the Union territory of Jammu and Kashmir Expert Appraisal Committee (hereinafter
referred to as the Committee), comprising of the following persons, namely:-

6. The Chairman and Members of the Committee, shall hold office for a period of three years from the date of
publication of this notification in the Official Gazette.
7. In order to avoid any conflict of interest, -
(i) the Chairman and Members of the Authority, and the Committee shall, -
(a) declare to which consulting organisation they have been associated with and also the project proponents;
(b) not undertake any consultation or associate with regard to preparation of Environment Impact Assessment
and Environment Management Plan for project, which is to be decided by the Authority or to be appraised by
the Committee during their tenure; and
(ii) in the preceding five years, if the Chairman or any Member of the Committee has provided consultancy services or
conducted Environment Impact Assessment studies for any project proponent, they shall recuse themselves from the
meetings of the Committee from the process of appraisal of any project proposed by such proponents.
8. The Committee shall exercise the powers and follow the procedures specified in the said notification.
9. The Committee shall function on the principle of collective responsibility and the Chairman shall endeavour to
reach consensus in each case, and if they fail to reach consensus, the view of the majority shall prevail.
10. The Government of Jammu and Kashmir shall specify an agency to act as secretariat of the Authority and the
Committee and the secretariat shall provide financial and logistic support including accommodation, transportation
and such other facilities in respect of their functions under the said notification.
11. The sitting fee, travelling allowance and dearness allowance to the Chairman and Members of the Authority and
the Committee, shall be paid in accordance with the provisions of relevant rules of the Union territory of Jammu and
Kashmir.
