This is a *new* policy that establishes the rules for recruitment to the post of Additional Assistant Director Group B in Directorates under the Central Board of Indirect Taxes and Customs (CBIC). The policy outlines the method of recruitment, age limits, qualifications, and other relevant matters. The report identifies the key provisions, target audience, inferred implementation aspects, and expected outcomes based solely on the provided text.
**2. Introduction:**
The purpose of this report is to provide a comprehensive overview of the "Central Excise and Customs Directorates, Additional Assistant Director Group B, Gazetted, Non-Ministerial Posts Recruitment Rules, 2022," based on the official policy text published in the Gazette of India. This analysis will focus on the core objectives, key provisions, affected stakeholders, inferred implementation aspects, and expected outcomes of the policy as evident from the provided document.
**3. Policy Overview:**
* This is a *new* policy.
* **Core Objective(s):** As inferred from the text, the core objective of this policy is to establish a structured and transparent framework for the recruitment of Additional Assistant Directors (Group B, Gazetted, Non-Ministerial) within the CBIC's directorates. This includes defining eligibility criteria, recruitment methods, and hierarchical structure.
**4. Background and Rationale:**
* Since this is a *new* policy, it can be inferred that the likely problem/issue it addresses is the need for a standardized and clearly defined recruitment process for the Additional Assistant Director position within the specified directorates. The policy aims to supersede potentially outdated or inconsistent recruitment rules previously in place (Directorate of Revenue Intelligence Class II, Gazetted posts Recruitment Rules,1975, the Directorate of Inspection and Audit Customs and Central Excise Inspecting Officers Recruitment Rules, 1987 and the Directorate of Statistics and Intelligence Central Excise and Customs Group B posts, Recruitment Rules, 1999). The previous rules, in so far as they relate to the posts of Superintendent of Central Excise Class II Appraiser Inspector of Customs, Inspecting Officer and Additional Assistant Director, except as respect things done or omitted to be done before such supersession, are now addressed under this new policy.
**5. Key Provisions / Changes:**
Since this is a *new* policy, the following are the main components, rules, and actions mandated by the provided text:
* **Title and Commencement:** The policy is named "Central Excise and Customs Directorates, Additional Assistant Director Group B, Gazetted, Non-Ministerial Posts Recruitment Rules, 2022" and came into effect on the date of its publication in the Official Gazette (April 4, 2022).
* **Application:** The rules apply specifically to the post of Additional Assistant Director (Group B, Gazetted, Non-Ministerial) in the Directorates under the control of CBIC.
* **Cadre Controlling Authority:** The Directorate General of Performance Management, CBIC, New Delhi, is designated as the Cadre Controlling Authority for Group B and C posts (Gazetted and Non-Gazetted) for the directorates listed in the policy.
* **Number of Posts, Classification, and Pay Matrix:** The policy specifies that the number of posts, their classification (General Central Service, Group B, Non-Ministerial, Gazetted) and the pay matrix (Level 8, Rs. 47600-151100; Level 9, Rs. 53100-167800 after 4 years of service) are as specified in the Schedule. The number of posts is 390 in 2022.
* **Method of Recruitment, Age Limit, and Qualifications:** These are specified in columns 5 to 13 of the Schedule. Key points:
* **Age Limit:** Not applicable for direct recruits.
* **Educational Qualifications:** Not applicable for direct recruits.
* **Recruitment Methods:**
* 15% by Promotion: Inspector Central Excise in level 7 with two years of regular service and successful completion of 24 weeks of training.
* 85% by Deputation: Officers from Central/State Government/Union Territories holding analogous posts or with two years of service in Level 7, possessing a Bachelor's degree and three years of experience in levy, assessment, and collection of Customs duty, Central Excise duties, Goods and Service Tax and Integrated Goods and Service Tax, Intelligence and Investigation, enforcement of border control on goods and conveyances, dispute resolution including drafting of Show Cause Notices, adjudication and appeals or Audit of assessments for ensuring tax compliance.
* **Disqualification:** Individuals with more than one living spouse are ineligible for appointment, subject to exceptions under personal law and Central Government discretion.
* **Power to Relax:** The Central Government reserves the power to relax any provisions of the rules, in consultation with the Union Public Service Commission, if deemed necessary.
* **Saving Clause:** The rules do not affect existing reservations, age relaxations, and other concessions for Scheduled Castes, Scheduled Tribes, ex-servicemen, and other special categories.
* **Departmental Promotion Committee:** Composition defined.
* **UPSC Consultation:** Consultation with UPSC is not necessary for promotion but is necessary for appointment by deputation.
**6. Target Audience and Stakeholders:**
Based on the provided text, the target audience and stakeholders directly affected by this policy are:
* Individuals seeking appointment to the post of Additional Assistant Director (Group B, Gazetted, Non-Ministerial) in the specified Directorates.
* Current Inspectors of Central Excise who are eligible for promotion.
* Officers of the Central Government, State Governments, or Union Territories eligible for deputation.
* The Directorate General of Performance Management, CBIC (as the Cadre Controlling Authority).
* The Central Board of Indirect Taxes and Customs (CBIC).
* The Directorates under the control of CBIC, specifically those listed in section 3(1) of the notification.
* Union Public Service Commission.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Directorate General of Performance Management, CBIC, is the primary responsible body for implementing these rules, as the Cadre Controlling Authority.
* **Timelines/Procedures:** The policy came into effect on the date of publication (April 4, 2022). Specific procedures for recruitment (promotion/deputation) are outlined in the Schedule.
* The policy also outlines specific compositions for the Departmental Promotion Committee.
**8. Expected Outcomes / Impact of Changes:**
Since this is a *new* policy, the likely intended outcomes based on the policy's stated provisions in the text are:
* A standardized and consistent recruitment process for Additional Assistant Directors across the specified Directorates.
* A clearly defined career path for Inspectors of Central Excise through promotion.
* Attraction of qualified officers from other government departments through deputation.
* Improved efficiency and effectiveness in the functioning of the Directorates due to the recruitment of qualified personnel.
**9. Conclusion:**
The "Central Excise and Customs Directorates, Additional Assistant Director Group B, Gazetted, Non-Ministerial Posts Recruitment Rules, 2022" establishes a new framework for recruitment to a key position within the CBIC's directorates. The policy aims to streamline the recruitment process, ensure qualified candidates are selected, and ultimately contribute to the efficient functioning of the indirect tax administration. The policy's significance lies in its comprehensive coverage of recruitment aspects, from eligibility criteria to promotion pathways, promoting transparency and consistency in personnel management.
