ान राष्‍टर ीय िोध प्रजतष्‍टठ ान अजधजनयम, 2023 )2023 का 25( की धारा 23 की उप-धारा )1( के अधीन यर्ा अपेजित उपबंधों के अनुसार, जिनसे प्रभाजित होने िाले सभी व्यजियों से आपजियााँ और सुझाि आमंजत्रत करने हते ु भारत के रािपत्र, असाधारण, भाग 2, खंड 3, उप-खंड )i), तारीख 5 अगस्ट् त, 2025 को प्रकाजित दकए गए र्;े और उि प्रारूप जनयमों के संबधं में केन्द्रीय सरकार के जिचारार्ा कोई आपजि या सुझाि प्राप्त नहीं हुआ; अतः अब, केंरीय सरकार अनुसधं ान राष्‍टर ीय िोध प्रजतष्‍टठ ान अजधजनयम, 2023 (2023 का 25) की धारा 23 की उप-धारा )1) और उप-धारा )2( के खडं )घ( द्वारा प्रिि िजियों का प्रयोग करत ेहुए जनम्नजलजखत जनयम बनाती ह,ै अर्ाात:्— 1. संजिप्त नाम और प्रारंभ.- (1) इन जनयमों का संजिप्त नाम अनसु ंधान राष्‍टर ीय िोध प्रजतष्‍टठ ान, समूह ‘क’ और समूह ‘ख’ प्रिासजनक पि भती जनयम, 2026 ह।ै )2( य ेरािपत्र में इनके प्रकािन की तारीख से प्रिृि होंगे। 2. पररभाषाएं.- (1) इन जनयमों म,ें िब तक दक संिभा से अन्द्यर्ा अपेजित न हो,- 2963 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (क) 'अजधजनयम' से अनुसधं ान राष्ट्रीय िोध प्रजतष्ठान अजधजनयम, 2023 )2023 का 25( अजभप्रेत ह;ै (ख) ‘जनयंत्रण प्राजधकारी’ से प्रजतष्‍टठ ान की कायाकारी पररषि अजभप्रेत ह;ै (ग) "प्रजतष्ठान" से अजधजनयम की धारा 3 की उपधारा )1( के अधीन स्ट्र्ाजपत अनुसंधान राष्ट्रीय िोध प्रजतष्ठान अजभप्रेत ह;ै (घ) "अनुसूची" से इन जनयमों से संलग्न अनुसूची अजभप्रेत ह,ै और (ङ) इसमें प्रयुि िब्िों और अजभव्यजियों, िो इन जनयमों में पररभाजषत नहीं ह,ैं दकन्द्तु अजधजनयम में पररभाजषत ह,ैं का िही अर् ाहोगा िो अजधजनयम में क्रमिः ह।ै 3. लाग ूहोना— य ेजनयम, इन जनयमों से उपाबद्ध अनुसूची के स्ट्तम्भ )1) म ेंजिजनर्िाष्ट पिों पर लागू होंगे। 4. पिों की संख्या, िगीकरण और िेतन मैररक्स में स्ट्तर- पिों की संख्या, उनका िगीकरण और िते न मैररक्स में स्ट्तर उि अनुसूची के स्ट्तम्भ )2( से )4( में जिजनर्िाष्ट अनुसार होंगे। 5. भती की पद्धजत, आयु-सीमा, अहता ाय,ें आदि.- उि पिों से संबंजधत भती की पद्धजत, आय-ु सीमा, अहता ायें और अन्द्य मामले पूिोि अनुसूची के स्ट्तम्भ )5( से )13( में जिजनर्िाष्ट अनसु ार होंगी। 6. जनयुजि प्राजधकारी.– प्रजतष्‍टठ ान की कायाकारी पररषि पूिोक्त अनुसूची के स्ट्तम्भ )1( में उजल्लजखत पिों के जलए जनयुजि प्राजधकारी होगा। 7. िार्षाक काय-ा जनष्‍टपािन मूल्यांकन ररपोर्ा— उि अनुसूची के स्ट्तम्भ )1) में जिजनर्िाष्ट पिों को धारण करन े िाले अजधकारी, स्ट्कीम में जिजनर्िाष्ट प्रारूप में, िार्षाक आधार पर, आज्ञापक रूप से अपना िार्षका काया जनष्‍टपािन मूल्यांकन ररपोर्ा भरेंगे। 8. पररिीिा.—(1) सीधी भती द्वारा अनुभाग अजधकारी के ग्रेड में जनयिु अजधकाररयों के जलए पररिीिा अिजध िो िषा की होगी: परंत,ु जनयंत्रण प्राजधकारी, केंरीय सरकार द्वारा समय-समय पर िारी जनिेिों के अनुसार, पररिीिा की अिजध का जिस्ट्तार कर सकेगा: और परंतु यह दक, पररिीिा अिजध के जिस्ट्तार के संबंध म ेंकोई भी जिजनश्चय, साधारणत्या: पूिािती पररिीिा अिजध की समाजप्त के पश्चात् आठ सप्ताह के भीतर जलया िाएगा तर्ा उि अिजध के भीतर ही, ऐसा करन ेके कारणों सजहत, संबंजधत अजधकारी को जलजखत रूप म ेंसूजचत दकया िाएगा। (2) पररिीिा की अिजध अर्िा उसके दकसी जिस्ट्तार की समाजप्त पर, यदि अजधकारी को स्ट्र्ायी जनयुजि के जलए उपयुि समझा िाता ह,ै तो उसे उपलब्ध स्ट्र्ायी ररजि पर स्ट्र् ायीकरण प्रिान दकया िाएगा। (3) यदि पररिीिा की अिजध अर्िा उसके दकसी जिस्ट्तार के िौरान, यर्ाजस्ट्र्जत, प्रजतष्ठान का यह जिचार हो दक अजधकारी स्ट्र्ायी जनयुजि के जलए उपयिु नहीं है, तो यर्ाजस्ट्र्जत प्रजतष्ठान अजधकारी को काया मुि कर सकता ह ै या उस े उसकी प्रजतष्ठान म ेंजनयुजि स ेपिू ा धाररत पि पर पुनः जनयुि कर सकता ह।ै (4) पररिीिा की अिजध, अर्िा उसके दकसी जिस्ट्तार के िौरान, पररिीिा की संतोषिनक पणू ाता की ित ा के रूप म ें अजधकारी को प्रजतष्ठान द्वारा अपेजित समझे िान े पर ऐसे प्रजििण पाठ्यक्रम और जनििे प्राप्त करने, तर्ा परीिाएाँ और परीिण, जिसमें हहिं ी भाषा की परीिा भी िाजमल हो सकती ह,ै िैसा प्रजतष्ठान उजचत समझे, उिीणा करन ेकी आिश्यकता होगी। (5) पररिीिा से संबंजधत अन्द्य मामलों में, अजधकारी को इस संबंध में केंरीय सरकार द्वारा िारी दकए गए जनिेिों का पालन करना होगा। 9. पुष्टीकरण.— सीधी भती के माध्यम स े जनयिु अजधकारी का पुष्टीकरण, अनुसूची म ें जनर्िाष्ट जिभागीय पुष्टीकरण सजमजत की जसफाररिों के आधार पर, जनयंत्रण प्राजधकारी द्वारा दकया िाएगा। 10. अनहता ा.- कोई भी व्यजि,- क). जिसने दकसी ऐसे व्यजि से जििाह दकया ह ैजिसका पजत/पत्नी िीजित ह,ै या[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 ख). जिसने अपन े पजत/पत्नी िीजित रहत े हुए दकसी अन्द्य व्यजि से जििाह दकया है, उि पिों पर जनयुजि के जलए पात्र नहीं होगा: परंत ु यदि केंरीय सरकार संतुष्‍टर् हो िाए दक ऐसा जििाह ऐसे व्यजि और जििाह के िसू रे पिकार पर लागू स्ट्िीय जिजध के अधीन अनुज्ञेय ह ैऔर ऐसा करने के जलए अन्द्य आधार ह ैंतो िह दकसी व्यजि को इस जनयम के प्रितान से पर्ृ क कर सकती ह।ै 11. बाह्य जचदकत्सा उपचार.- )1( अजधकारी स्ट्ियं और कुर्ुंब के घोजषत सिस्ट्यों के जलए जचदकत्सा प्रजतपूर्ता पाने के पात्र होंगे स्ट्पष्टीकरण:- इस जनयम के प्रयोिनों के जलए, "कुर्ुंब" िब्ि का िही अर्ा होगा िो केंरीय सेिा )जचदकत्सा पररचारक( जनयम, 1944 में ह।ै )2( िषा के िौरान बाह्य जचदकत्सा व्यय की प्रजतपूर्ता िास्ट्तजिक व्यय या िषा की पहली िनिरी को एक माह के िेतन मूल िेतन + महगं ाई भिा िो भी कम हो, तक सीजमत होगी: परंतु िषा के िौरान दकसी िेतन िृजद्ध या पिोन्नजत का प्रभाि 1 िनिरी को जनधााररत सीमा पर नहीं पडेगा। )3( जचदकत्सा िािे के समर्ान में जचदकत्सा अजधकारी का पचाा और जचदकत्सा अजधकारी के हस्ट्तािर और मुहर से जिजधित हस्ट्तािररत और प्रमाजणत उपचार और ििाओं की खरीि के मूल कैि मेमो या जबल होने चाजहए। )4( 1 िनिरी के बाि िषा के िौरान कायाभार ग्रहण करन ेिाले अजधकाररयों के जलए, िार्षाक हक़िारी आनुपाजतक आधार पर प्रजतबंजधत होगी। )5( बाह्य उपचार केिल प्रजतष्‍टठ ान द्वारा जिजधित रूप से पैनल में िाजमल अजधकृत जचदकत्सा पररचारकों से ही प्राप्त दकया िा सकेगा। )6( गंभीर बीमाररयों की जस्ट्र्जत में, ििाओं और परीिणों, यदि कोई हो, की लागत की प्रजतपर्ू ता के प्रयोिनार्ा, केंरीय सेिा )जचदकत्सा पररचारक( जनयम, 1944 या केंरीय सरकार स्ट्िास्ट््य योिना के अंतगात मान्द्यता प्राप्त या किर दकए गए अस्ट्पतालों का पचाा स्ट्िीकाया होगा। )7( अत्यजधक लागत िाल ेउपचार के प्रयोिनार्ा, प्रजतपूर्ता, केंरीय सरकार स्ट्िास्ट््य योिना या केंरीय सेिा )जचदकत्सा पररचयाा( जनयम, 1944 के उपबंधों के अनसु ार, अलग-अलग मामल ेके आधार पर प्रजतष्‍टठ ान के अनुमोिन से, जिजनर्िाष्ट िरों पर स्ट्िीकाया होगी। )8( आपातकाल की जस्ट्र्जत म ें कमाचारी जनकर्तम अस्ट्पताल में उपचार करा सकता ह ैऔर व्यय की प्रजतपूर्त ा केंरीय सरकार स्ट्िास्ट््य योिना के लाभार्र्ायों के जलए जिजनर्िाष्ट िरों के अनुसार की िाएगी, यह जचदकत् सा अजधकारी या अस्ट्पताल प्राजधकाररयो के आपातकालीन प्रमाण पत्र प्रस्ट्ततु करने के अध्यधीन ह।ै 12. आंतररक जचदकत्सा उपचार.- )1( आंतररक जचदकत्सा उपचार के प्रयोिनों के जलए, अजधकारी इस संबंध में प्रजतष्‍टठ ान द्वारा अजधकृत अस्ट्पतालों में उपचार प्राप्त करने के जलए पात्र होगा और इस प्रयोिन के जलए अस्ट्पताल आिास, नर्सिंग होम सुजिधा सजहत उपचार की लागत केंरीय सेिा )जचदकत्सा पररचारक( जनयम, 1944 के उपबंधों के अनुसार होगी, िो िेतन मैररक्स में समतुल्य िेतन पाने िाल ेकेंरीय सरकार के अजधकाररयों पर लागू होती ह।ै (2) उप-जनयम )1( में उजल्लजखत प्राजधकृत अस्ट्पतालों में उपचार िही होगा िो केंरीय सेिा )जचदकत्सा पररचारक( जनयम, 1944 के अनुसार उपचार प्राप्त करने िाले केन्द्रीय सरकारी अजधकाररयों के जलए अनमु ेय ह।ै (3) आपातकालीन जस्ट्र्जत को छोडकर, उप-जनयम )1( में उजल्लजखत प्राजधकृत अस्ट्पतालों म ें प्राजधकृत जचदकत्सा पररचारक की सलाह पर ही उपचार जलया िा सकता ह।ै 13. सेिाजनिृजि लाभ.— उि अनुसूची में जिजनर्िाष्ट प्रजतष्ठान के अजधकाररयों पर, केंरीय सरकार के समकि िेतन स्ट्तर िाल े अजधकाररयों पर लाग ूनई पेंिन योिना अर्िा एकीकृत पेंिन योिना के उपबंध, लागू होंगे। 14. जिजर्ल करने की िजि - िहााँ केंरीय सरकार की यह राय हो दक ऐसा करना आिश्यक अर्िा समीचीन ह,ै तो िह उसके जलए िो कारण ह ैं उन्द्ह ें जलजखत में िि ा करके, आिेि द्वारा, दकसी िगा या प्रिगा के व्यजियों के संबंध में इन जनयमों के दकसी उपबंध को जिजर्ल कर सकती ह।ै4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 15. प्रारंजभक गठन.- (1) इन जनयमों के लाग ूहोन े की तारीख पर, इन पिों पर जनयजमत आधार पर जनयुि सभी अजधकारी, इन जनयमों के अधीन उि पि पर जनयिु मान ेिाएंग,े और उि पि पर ऐसे प्रारम् भ से पूिा उनके द्वारा प्रिान की गई जनयजमत सेिा पर िररष्ठता, प्रोन्नजत, पुजष्टकरण आदि के प्रयोिनों के जलए जिचार दकया िाएगा। (2) इन जनयमों के लाग ूहोने स ेतुरंत पूिा सेिारत प्रजतष्ठान के अजधकाररयों की सेिा की जनबंधन एिं ित,ें इन जनयमों के उपबंधों के अनुरूप होंगी। 16. व्यािृजि.-इन जनयमों की कोई बात ऐसे आरिण, आय-ु सीमा में छूर् और अन्द्य ररयायतों पर प्रभाि नहीं डालेगी जिनका केंरीय सरकार द्वारा इस संबंध में िारी दकए गए आििे ों के अनुसार अनुसूजचत िाजतयों, अनुसूजचत िनिाजतयों, भूतपूिा सैजनकों और अन्द्य जििषे प्रिगों के व्यजियों के जलए उपबंध करना अपेजित ह।ै अनुसूची पद का नाम पदों की संख् या वर्गीकरण वेतन मैट्रिक् स स् तर चयन पद है या सीधी भती के र्गैर-चयन पद लिए आय-ु सीमा (1) (2) (3) (4) (5) (6) 1. 2* (2026) समूह ‘क’ प्रशासननक ववलभन्न ववधधयों से भर जाने वाि ररक्क्तयों का प्रनतशत। (7) (8) (9) (10) िार्गू नह ं होता िार्गू नह ं होता िार्गू नह ं होता प्रनतननयुक्क्त (अल् पकाि न संववदा सट्रहत) प्रोन्ननत या प्रनतननयुक्क्त/समायोजन के माध्यम से भती के मामिे में, व े ग्रेड क्जनसे प्रोन्ननत या प्रनतननयुक्क्त/केंद्र समायोजन ककया जाएर्गा। (11) • केंद्र य सरकार, राज्य सरकार, संघ राज्य क्षेत्र प्रशासन, सावजय ननक क्षेत्र उपक्रम, मान्यता प्राप्त अनुसंधान संस्थान, ववश्वववद्यािय, अध-य सरकार या कानूनी ननकाय अथवा स्वायत्त संर्गठन के अधधकार — (क) (i) मूि संवर्ग/यववभार्ग में ननयलमत आधार पर समकक्ष पद पर कायरय त हो; अथवा (ii) वेतन मैट्रिक्स के स्तर-12 (रु. 78800–209200) या समकक्ष स्तर में ननयलमत आधार पर ननयुक्क्त के पश्चात ् उक्त ग्रेड में पाँच वर् य की ननयलमत सेवा पूण य की हो; अथवा (iii) वेतन मैट्रिक्स के स्तर-11 (रु. 67700–208700) या समकक्ष में ननयलमत आधार पर ननयुक्क्त के पश्चात ् उक्त ग्रेड में दस वर् य की ननयलमत सेवा पूण य की हो; तथा (b) ववत्त, िेखा या प्रशासन के क्षेत्र में न्यूनतम दो वर् य का पयायप्त अनुभव रखता हो।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 ट्रिप्पण 1.- प्रनतननयुक्क्त की अवधध, क्जसमें इस ननयुक्क्त से ठीक पूव य केंद्र य सरकार या राज्य सरकार के उसी या ककसी अन्य संर्गठन या ववभार्ग में धाररत ककसी अन्य बाह्य संवर्गय बाह्य पद पर प्रनतननयुक्क्त की अवधध भी सक्ममलित है, साधारणतः तीन वर् य से अधधक नह ं होर्गी। ट्रिप्पण 2.- प्रनतननयुक्क्त के आधार पर ननयुक्क्त के लिए अधधकतम आय-ु सीमा आवेदन प्राप्त होने की अंनतम तार ख को छप्पन वर् य से अधधक नह ं होर्गी। ट्रिप्पण 3.- ववभार्गीय अवर सधचव, क्जन्होंने वेतन मैट्रिक्स के स्तर-11 (रु. 67700–208700) में ननयलमत आधार पर ननयुक्क्त के पश्चात ् संबंधधत ग्रेड में दस वर् य की ननयलमत सेवा पूण य की हो, उन्हें प्रनतननयुक्क्त पर आने वाि े अभ्यधथययों के साथ ववचाराथ य लिया जाएर्गा तथा यट्रद उनका चयन उक्त पद पर ननयुक्क्त के लिए ककया जाता है, तो ऐसी ननयुक्क्त को प्रोन्ननत द्वारा भरा र्गया माना जाएर्गा। यदि प्रोन्द् नजत या स्ट् र्ायीकरण पर जिचार करने हते ु कोई जिभागीय िे पररजस्ट्र्जतयां िब भती करते समय संघ लोक सेिा आयोग प्रोन्द् नजत सजमजत जिद्यमान ह ैतो उसकी संरचना क्या ह ै से परामिा दकया िाना ह।ै (12) (13) जिभागीय प्रोन्नजत सजमजत )पुजष्टकरण हते ु( की संरचना इस प्रकार ह:ै- लागू नहीं होता (1) मुख्य कायाकारी अजधकारी - अध्यि; (2) संयुि सजचि, अजधकारी, जिन्द्होंने िेतन मैररक्स के स्ट्तर-7 (रु. 44900–142400) में जनयजमत आधार पर जनयुजि के पश्चात् संबंजधत ग्रेड में नौ िषा की जनयजमत सेिा पूणा की हो, पर प्रजतजनयुजि पर आने िाले अजधकाररयों के सार्6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] जिचार दकया िाएगा तर्ा यदि उनका चयन उि पि पर जनयुजि हेतु दकया िाता है, तो ऐसी जनयजु ि को प्रोन्नजत द्वारा भरा गया माना िाएगा। रर्प्पण 2.- िहााँ ऐसे कजनष्ठ अजधकाररयों/कमाचाररयों की प्रोन्नजत पर जिचार दकया िा रहा हो, जिन्द्होंने जनधााररत अहका अर्िा पात्रता सेिा पूणा कर ली है, िहााँ उनके िररष्ठ अजधकाररयों/कमाचाररयों पर भी प्रोन्नजत पर जिचार दकया िाएगा, परंतु िे जनधााररत अहका अर्िा पात्रता सेिा से उस सेिा की आधी अिजध अर्िा िो िषा, िो भी कम हो, से अजधक कम न हों, तर्ा उन्द्होंने अपने कजनष्ठ अजधकाररयों/कमाचाररयों के सार्, जिन्द्होंने उि अहाक अर्िा पात्रता सेिा पहले ही पूणा कर ली है, अगले उच्चतर ग्रेड में पिोन्नजत हते ु जिजहत पररिीिा अिजध सफलतापूिाक पूणा कर ली हो। प्रजतजनयजु ि: केंरीय सरकार, राज्य सरकार, सघं राज्य ित्रे प्रिासन, साििा जनक ित्रे के उपक्रम, मान्द्यता प्राप्त अनसु धं ान सस्ट्ं र्ान, जिश्वजिद्यालय, अद्ध-ा सरकारी या काननू ी जनकाय अर्िा स्ट्िायि संगठन के अजधकारी— (क) (i) िो अपने मूल संिगा या जिभाग में समकि पि पर जनयजमत आधार पर कायारत हों; अर्िा (ii) जिन्द्होंने िेतन मैररक्स के स्ट्तर–10 (रु. 56100–177500) या समकि स्ट्तर में जनयजमत आधार पर जनयुजि के पश्चात उस ग्रेड में पााँच िषा की जनयजमत सेिा प्रिान की हो; अर्िा (iii) 311(E).— Whereas certain draft rules, namely, the Anusandhan National Research Foundation Group ‘A’ and Group ‘B’ Administrative Posts Recruitment Rules, 2025, were published, as required under sub-section (1) of section 23 of the Anusandhan National Research Foundation Act, 2023 (25 of 2023), in the Gazette of India, th Extraordinary, Part II, Section 3, Sub-section (i), dated the 5 August, 2025 for inviting objections and suggestions from all persons likely to be affected thereby; And Whereas, no objection or suggestion was received in respect of the said draft rules for the consideration of the Central Government;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 Now, therefore, in exercise of the powers conferred by sub-section (1) and clause (d) of sub-section (2) of section 23 of the Anusandhan National Research Foundation Act, 2023 (25 of 2023), the Central Government hereby makes the following rules, namely: — 1. Short title and commencement. - (1) These rules may be called the Anusandhan National Research Foundation, Group ‘A’ and Group ‘B’ Administrative Posts Recruitment Rules, 2026. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions. – (1) In these rules, unless the context otherwise requires, — (a) “Act” means the Anusandhan National Research Foundation Act, 2023 (25 of 2023); (b) “controlling authority” means the Executive Council of the Foundation; (c) “Foundation” means the Anusandhan National Research Foundation established under sub-section (1) of section 3 of the Act; (d) “Schedule” means the Schedule appended to these rules, and (2) Words and expressions used herein and not defined in these rules but defined in the Act shall have the meaning respectively assigned to them in the Act. 3. Application. - These rules shall apply to posts specified in column (1) of the Schedule annexed to these rules. 4. Number of post, classification and level in pay matrix. - The number of posts, their classification and level in pay matrix shall be as specified in columns (2) to (4) of the said Schedule. 5. Method of recruitment, age-limit, qualifications, etc.- The method of recruitment, age-limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the aforesaid Schedule. 6. Appointing Authority. - The Executive Council of the Foundation shall be the appointing authority in respect of the posts mentioned in column (1) of the Schedule. 7. Annual Performance Appraisal Report. – The Officers holding posts specified in column (1) of the said Schedule shall fill up the Annual Performance Appraisal Report, in the format provided for in the Scheme, mandatorily on an annual basis. 8. Probation. – (1) The period of probation for officers appointed to the grade of Section Officer by direct recruitment shall be two years: Provided that the controlling authority may extend the period of probation in accordance with the instructions issued by the Central Government: Provided further that any decision for extension of a probation period shall be made ordinarily within eight weeks after the expiry of the previous probationary period and communicated in writing to the concerned officer together with the reasons for so doing within the said period. (2) On completion of the period of probation or any extension thereof, the Officer shall, if considered fit for permanent appointment, be confirmed against the available substantive vacancy. (3) If, during the period of probation or any extension thereof, as the case may be, the Foundation is of the opinion that an Officer is not fit for permanent appointment, the Foundation may discharge or revert the Officer to the post held by him prior to his appointment in the Foundation, as the case may be. (4) During the period of probation, or any extension thereof, Officer may be required by Foundation to undergo such courses of training and instructions and to pass examinations and tests, including examination in Hindi language, as Foundation may deem fit, as a condition to satisfactory completion of the probation.10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (5) As regards other matters relating to probation, the Officer shall be governed by the instructions issued by the Central Government in this regard. 9. Confirmation. – Confirmation of officer appointed through direct recruitment shall be done by the controlling authority on the recommendations of the Departmental Confirmation Committee as specified in the Schedule. 10. Disqualification. - No person, - (a) who has entered into, or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person: shall be eligible for appointment to the said posts. Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 11. Outdoor medical treatment. – (1) The Officers shall be eligible to get medical reimbursement for self and declared members of family. Explanation. - For the purposes of this rule, the expression “family” shall have the meaning assigned to it in the Central Services (Medical Attendants) Rules, 1944. (2) The reimbursement of outdoor medical expenses during the year shall be limited to the actual expenses or one month's pay on the 1st day of January of the year, basic pay plus dearness allowance, whichever is less: Provided that release of increment or promotion during the year shall not affect the limit as on the 1st day of January. (3) The medical claim shall be supported by medical officer’s prescription and the original cash memos or bills for treatment and purchase of medicines duly signed and authenticated with the signature and seal of the medical officer. (4) For Officers joining the duty during the year after the 1st day of January, the annual entitlement shall be restricted on pro-rata basis. (5) The outdoor treatment shall be availed only from the Authorised Medical Attendants duly empanelled by the Foundation. (6) In case of chronic ailments, prescription from the hospitals recognised or covered under the Central Service (Medical Attendance) Rules, 1944 or the Central Government Health Scheme shall be admissible for the purposes of reimbursement of the cost of medicines and tests, if any. (7) For the purposes of cost intensive treatment, the reimbursement shall be admissible at the rates specified in accordance with the provisions of the Central Government Health Scheme or the Central Services (Medical Attendants) Rules, 1944 with the approval of the Foundation on a case to case basis. (8) In case of emergency, the Officer may avail treatment at the nearest hospital and expenditure shall be reimbursed as per the rates specified under the Central Government Health Scheme subject to production of emergency certificate from the medical officer or the hospital authorities. 12. Indoor medical treatment. - (1) For the purposes of indoor medical treatment, the Officer shall be eligible to avail treatment in hospitals authorised by the Foundation in this behalf and for this purpose cost of treatment including hospital accommodation, nursing home facility shall be as per the provisions of the Central Services (Medical Attendants) Rules, 1944 as applicable to the Central Government officers drawing equivalent salary in pay matrix. (2) The treatment in authorised hospitals referred to in sub-rule (1) shall be the same as may be admissible to the Central Government officers availing the treatment in accordance with the Central Services (Medical Attendants) Rules, 1944.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 11 (3) The treatment at authorised hospitals referred to in sub-rule (1) shall be availed only on the advice of the Authorised Medical Attendant, except in emergency cases. 13. Retirement Benefits. - The provisions of New Pension Scheme or Unified Pension Scheme, as applicable to the Central Government Officers of corresponding pay levels, shall be applicable to the Officers of the Foundation specified in the said Schedule. 14. Power to relax. - Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons. 15. Initial Constitution. - (1) All officers appointed on a regular basis to these posts on the date of commencement of these rules shall be deemed to have been appointed to the said post under these rules and the regular service rendered by them in the said post before such commencement shall be taken into account for the purposes of seniority, promotion, confirmation etc. (2) The terms and conditions of service of the officers of the Foundation in service immediately before the commencement of these rules shall be in accordance with the provisions of these rules. 16. Saving. - Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government in this regard.
