Executive Summary & Key Takeaways

**Executive Summary** The Ministry of Housing and Urban Affairs has announced the regularisation of 1,511 unauthorised colonies in Delhi on an "as-is where-is" basis to grant legal ownership and redevelopment rights to approximately 45 lakh residents. This decision removes the previous requirement for approved layout plans, which had hindered the progress of the PM-UDAY scheme. Applications for residents with existing Conveyance Deeds or Authorisation Slips will be accepted on the SWAGAM portal starting April 24, 2026. **Key Points / Main Content** **Regularisation Provisions** * 1,511 out of 1,731 unauthorised colonies (UCs) qualify for regularisation, excluding those on prohibited land or designated as affluent colonies. * The absence of approved layout plans will no longer act as a barrier to the regularisation of existing built-up structures. * Land use for all plots and buildings within these eligible colonies will be officially treated as residential. * Convenience shops up to 20 sq. metres will be regularised if they have access to a 6-metre right of way; shops up to 10 sq. metres may have a smaller right of way. **Reconstruction and Redevelopment Rules** * For new construction or redevelopment, owners must surrender land equivalent to 50% of the deficiency in the right of way to ensure minimum road widths (6m for internal roads, 9m for approach roads). * Floor Area Ratio (FAR) will be calculated based on the original plot area but must be utilised within the reduced plot area after land surrender. * Existing structures exceeding permissible FAR limits will be subject to penal charges amounting to three times the additional FAR charges. **Administrative and Procedural Framework** * The MCD/local bodies are mandated to issue Certificates of Regularisation, conduct surveys of vacant plots, and develop civic infrastructure. * The Revenue Department (GNCTD) is responsible for issuing Conveyance Deeds (CD) for government land and Authorisation Slips (AS) for private land. * A structured timeline is established for applications: GIS surveys within 7 days, deficiency rectification within 15 days, and issuance of deeds within 45 days. * An inter-agency cell comprising the DDA, MCD, and GNCTD will prepare layout plans using satellite imagery for future planning. **Impact Analysis** **Residents of Unauthorised Colonies** **Impact** Approximately 45 lakh people gain legal ownership, dignity, and the right to transfer or mortgage properties. Residents can now obtain building plan approvals for legal construction and redevelopment under MCD norms. **Action Required** Eligible residents must log into the MCD SWAGAM portal starting April 24, 2026, to apply for regularisation or the issuance of Conveyance Deeds/Authorisation Slips using their PM-UDAY Case IDs. **MCD and Local Bodies** **Impact** Local bodies shift from a restrictive framework to an active role in urbanising these colonies. They are now empowered to approve building plans and develop infrastructure without waiting for RWA-prepared layout plans. **Action Required** MCD must issue Certificates of Regularisation, conduct vacant plot surveys, and facilitate the immediate development of civic infrastructure. **Revenue Department, GNCTD** **Impact** The department is tasked with the critical role of processing legal title documents and coordinating with the DDA for verification. **Action Required** The department must process applications and issue Conveyance Deeds or Authorisation Slips to eligible residents within the mandated 45-day timeline.

Rekha Gupta Applications on SWAGAM portal will be accepted from 24.04.2026 for cases where Conveyance Deeds / Authorisation Slips have been issued Posted On: 07 APR 2026 3:48PM by PIB Delhi Union Minister for Housing and Urban Affairs Shri Manohar Lal during a press conference in New Delhi said that today marks a historic moment in the lives of residents of Delhi. He added that Government of India had enacted the PM-UDAY scheme in 2019 to confer ownership rights to Delhi residents and stated that with the current decision to regularise colonies on an “as is where is” basis, residents will be encouraged to come forward for registration of their properties. This, he added, will not only provide legal ownership but also enable citizens to undertake construction or redevelopment of their homes in accordance with MCD norms. Union Minister Shri Manohar Lal also said that these transformative steps have been undertaken under the guidance and inspiration of Prime Minister Narendra Modi. He stated that under the leadership of the Prime Minister, Delhi is witnessing a new phase of planned and inclusive urban development, aimed at addressing legacy issues while building a future-ready city.Delhi Chief Minister, Smt Rekha Gupta in her address said that the Hon’ble Prime Minister understood the long-standing concerns of families who, despite living in their own homes, were deprived of legal rights. It was this sensitive and visionary approach that paved the way for the PM-UDAY scheme, and today, the regularisation of 1511 out of 1731 unauthorised colonies has been enabled. She added that Regularisation of Unauthorised Colonies in Delhi today marks a new chapter of relief, dignity, and rights in the lives of 45 lakh people of Delhi. The Chief Minister informed that the application process will commence from 24th April. A structured timeline has been put in place—GIS survey within 7 days, rectification of application deficiencies within 15 days, and issuance of conveyance deeds within 45 days. UNAUTHORISED COLONIES – PM-UDAY In October 2019, the Central Government notified the “National Capital Territory of Delhi (Recognition of Property Rights of Residents in Unauthorised Colonies) Regulations, 2019”. Pursuant thereto, the Pradhan Mantri – Unauthorised Colonies in Delhi Awas Adhikar Yojana (PM-UDAY) was launched on 29.10.2019. Under these Regulations, ownership/transfer/mortgage rights are being conferred on the residents of unauthorised colonies (which are not excluded under the Regulations of 2019) out of 1,731 UCs, based on General Power of Attorney (GPA), Agreement to Sell, Payment and Possession documents. Colonies falling under exclusions—where no rights are to be conferred—include those located on prohibited land such as reserved/notified forests, areas protected under the Ancient Monuments and Archaeological Sites and Remains Act, 1958, Zone-O (Yamuna Flood Plain), right of way of roads, high tension lines, ridge areas of Delhi, or land protected under any law. Additionally, 69 affluent unauthorised colonies also fall under the exclusions. Conveyance Deeds (CD) are issued for built-up properties on Government land, and Authorisation Slips (AS) are issued for properties on private land.PM-UDAY is currently implemented through an online portal managed by DDA for submission and processing of applications. As of 31.03.2026, approximately 40,000 Conveyance Deeds / Authorisation Slips have been issued under PM-UDAY. The relatively low response to the scheme has been examined. It has been observed that even after issuance of Conveyance Deeds / Authorisation Slips, residents are unable to get building plans approved or regularise existing structures due to the absence of approved layout plans. These layout plans were to be prepared by RWAs and approved by MCD. REGULARISATION OF THESE UNAUTHORISED COLONIES The 2019 Regulations also envisage regularisation of these colonies on an “as is where is” basis after approval of layout plans. However, the absence of approved layout plans has been a major impediment. Without approval of layout plans and building plans, the objective of bringing residents of unauthorised colonies into the mainstream of urbanisation cannot be fully achieved. While PM-UDAY confers ownership rights, it does not automatically make residents eligible for building plan approvals. Decisions Taken by Ministry of Housing and Urban Affairs To address these issues, the following decisions have been taken: • 1511 unauthorised colonies (out of 1731 UCs), which do not fall under exclusion criteria, will be regularised on an “as-is, where-is” basis without requiring approved layout plans. • Land use of all plots and buildings in these colonies will be treated as residential. • Convenience shops up to 20 sq. metres will be regularised if they have access to a right of way of 6 metres. For shops up to 10 sq. metres, the required right of way may be less than 6 metres. • Regularisation will apply to existing built-up structures on an “as-is where-is” basis. • Absence of approved layout plans will not be a barrier to regularisation. • MCD/local bodies will issue Certificates of Regularisation, conduct surveys of vacant plots, and facilitate development of civic infrastructure. • The Revenue Department, GNCTD, will issue Conveyance Deeds / Authorisation Slips to eligible residents. Process Flow for Online Application 1. Applicant logs into MCD SWAGAM portal (https://mcdonline.nic.in/swagam). 2. Select unauthorised colony name (from eligible 1511 colonies); ward and zone auto- populated. 3. Choose whether a PM-UDAY Case ID exists (Yes/No). 4. If No → redirected to PM-UDAY portal. 5. If Yes → enter Case ID: If CD/AS issued → application form opens. If not issued → redirected to PM-UDAY portal for status. 6. Processing of applications and issuance of CD/AS by Revenue Deptt./GNCTD with DDA support. 7. Issued CD/AS is sent to MCD via SWAGAM portal. Application TimelineApplications on SWAGAM portal will be accepted from 24.04.2026 for cases where Conveyance Deeds / Authorisation Slips have been issued. Provisions for Reconstruction / Redevelopment / Fresh Development In cases of reconstruction or redevelopment, land equivalent to 50% of deficiency in right of way must be surrendered to achieve minimum access width (6m internal roads, 9m approach roads). FAR will be calculated on original plot area but utilised within reduced plot after surrender. If existing FAR exceeds permissible limits, penal charges (3 times additional FAR charges) will apply. Layout plans will be prepared by an inter-agency cell (DDA, MCD, GNCTD) using satellite imagery; however, absence of layout plans will not hinder regularisation. This amendment marks a shift from ownership-only framework to a comprehensive framework enabling both ownership and regularisation of unauthorised colonies, through a simplified, integrated approach from MCD, DDA and GNCTD **** SK (Release ID: 2249686) Visitor Counter : 2877 Read this release in: Urdu , ही
