C.R.I.M.—Regulation 2016. In exercise of the powers conferred by clauses (m), (n) and (o) of section 36 of the Indian Medicine Central Council Act, 1970 (48 of 1970), and in supersession of the Central Council of Indian Medicine (Central Register of Indian Medicine) Regulations, 1979, except as respects things done or omitted to be done before such supersession, the Central Council of Indian Medicine, with the previous sanction of the Central Government, hereby makes the following regulations, namely:- 1. Short title and commencement.- (1) These regulations may be called the Central Council of Indian Medicine (Central Register of Indian Medicine) Regulations, 2016. (2) They shall come into force on the date of their publication in the official Gazette. 2. Definitions.- In these regulations, unless the context otherwise requires,- (a)‘Act’ means the Indian Medicine Central Council Act, 1970 (48 of 1970);¹Hkkx IIIμ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 11 (b) “Form” means form annexed to these regulations; (c) ‘President’ means the President of the Central Council elected under sub-section (2) of section 3;; (d) ‘Registrar’ means the Registrar of the Central Council appointed under clause (a) of section 12, who shall also act as the Secretary of the Central Council; (e) “Section” means section of the Act; (f) ‘Vice-President’ means a Vice-President of the Central Council elected under sub-section (3) of section 3; (g) Words and expressions used in these regulations and not defined but defined in the Act shall have the meanings respectively assigned to them in the Act. 3. Maintenance and publication of Central Register of Indian Medicine.-(1) The Registrar shall maintain Central Register of Indian Medicine arranged in four parts, namely Ayurveda, Siddha, Unani and Sowa Rigpa Systems in an alphabetical order State wise and it shall bear the seal of the Central Council. (2) The Central Register of Indian Medicine shall be revised by updating the details of the practitioners of respective systems of medicine and the same shall be published by June, 2017 and after the publication of the first revised copy of Central Register of Indian Medicine, supplements to the Central Register of Indian Medicine shall be published in the Gazette of India every year and the Central Register of Indian Medicine shall as far as possible be revised and published every five years. (3) The Central Register of Indian Medicine shall also bear a preface which shall contain a covering page with the seal of the Central Council, names of the State Boards with whose registers the Central Register of Indian Medicine has been compiled, abbreviations of qualifications shown in the Register, up-to-date list of recognised qualifications as specified in the Schedules to the Act, important sections pertaining to registration of practitioners of Indian Medicine and also names of the President, the Vice-President and the Members (State wise) and the Registrar of the Central Council. (4) To revise the details of practitioners published in the Central Register of Indian Medicine, every practitioner of Indian Medicine shall register themselves through online registration system available at the website of Central Council of Indian Medicine i.e. www.ccimindia.org by providing their details as required in the Form “B” regardless that their names have already been entered in the Central Register of Indian medicine or not and after completion of verification process, Central Registration Certificate shall be issued to the practitioners applying through online and the new Central Registration Certificate shall bear security features in it to mark its genuineness. (5) Practitioners of Ayurveda, Siddha, Unani and Sowa Rigpa belonging to the States in which the Board or Council do not exists shall register themselves directly with the Central Council to obtain the Central Registration Certificate. (6) Practitioners of Ayurveda, Siddha, Unani and Sowa Rigpa who are foreign nationals and want to pursue Post Graduation or Post Graduate Diploma in India shall register themselves with the Central Council to obtain the (temporary) Central Registration Certificate exclusively for the purpose of study, subject to the provisions of sections 15 and 16. (7) Practitioners of Ayurveda, Siddha, Unani and Sowa Rigpa who are possessing recognised medical qualification from a foreign country and wants to practice in India or to pursue Post Graduation or Post Graduate Diploma in India shall register themselves with the Central Council to obtain the Central Registration Certificate, subject to the provisions of sections 15 and 16. (8) Registration Certificate or Enrolment Certificate which has been already issued by the Central Council earlier, shall be surrendered to obtain the new Central Registration Certificate. 4. Supply of information by State Boards.- (1) All the State Boards shall intimate to the Central Council the lists of registered medical practitioners as entered in their State Registers of Indian Medicine, who possess any of the recognised medical qualifications specified in the Second, Third or fourth Schedules to the Act, in the first instance and thereafter all the new entries made during every financial year and the information shall be provided only through online to the Central Council through the login credentials allotted by Central Council to every State Board in Form “A” and hard copies shall not be accepted. (2) The State Boards shall also intimate to the Central Council immediately any change in name or registration of additional qualifications or change in address or cancellation of registration or removal of any name (as required by sub- section (1) of section 27) of a practitioner of Indian Medicine registered with the respective State Board. 5. Application for obtaining Central Registration Certificate.-(1) Applications shall be made for obtaining Central Registration Certificate through online in Form ‘B’ by all the practitioners of Ayurveda, Siddha, Unani and Sowa Rigpa whose names are entered in Central Register of Indian Medicine. (2) Applications shall also be made by all the practitioners of Ayurveda, Siddha, Unani and Sowa Rigpa possessing valid State registration directly through online in Form ‘B’ for obtaining Central Registration Certificate (under section 25).12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (3) Applications for obtaining Central Registration Certificate through online in Form ‘B’ shall also be made by all the practitioners of Ayurveda, Siddha, Unani and Sowa Rigpa belonging to the States in which the Board or Council do not exist. (4) Applications shall also be made by all the practitioners of Ayurveda, Siddha, Unani and Sowa Rigpa possessing valid State registration, for obtaining registration of additional qualification(s) with the Central Council (under section 30) through online in Form ‘B’. (5) A fee of two thousand rupees shall be paid through online payment or Demand Draft as application fee for every such application as referred to in sub-regulations (1) ,(2), (3) and (4) and a certificate in Form ‘C’ shall be issued by the Registrar under his seal to all persons who have applied under the said sub-regulations. (6) Applications shall be made through online in Form ‘B’ by all the practitioners of Ayurveda, Siddha, Unani and Sowa Rigpa for obtaining registration of foreign qualification(s) (under section 16) which have been recognised under the Schedules to the Act, for which ten thousand rupees shall be paid through online payment or Demand Draft as application fee and a certificate in Form ‘D’ shall be issued by the registrar under his seal to all persons who have applied under this sub-regulation. (7) Applications shall be made through online in Form ‘B’ by all the foreign practitioners of Ayurveda, Siddha, Unani and Sowa Rigpa for obtaining temporary registration for the purpose of studying Post Graduate Course in India, for which five thousand rupees shall be paid through online payment or Demand Draft as application fee and a certificate in Form ‘E’ shall be issued by the registrar under his seal to all persons who have applied under this sub- regulation. (8) Applications shall be made by all the practitioners of Ayurveda, Siddha, Unani and Sowa Rigpa with the Central Council through online in Form ‘B’ for change of address of residence or practice (under section 31), for which five hundred rupees shall be paid through online payment or Demand Draft as application fee and a certificate in Form ‘C’ shall be issued by the registrar under his seal to all persons who have applied under this sub-regulation. (9) State Boards or Councils and applicants for registration shall follow the guidelines issued by the Central Council in its website from time to time for the purpose of furnishing information and for applying for registration respectively. 6. Appeal for restoration of name in State Register. - Any person whose name has been removed from a State Register of Indian Medicine on any ground other than that he is not possessed of the requisite medical qualification or where any application by the said persons for restoration of his name to the State Register of Indian Medicine has been rejected, may file an appeal to the Central Government under sub-section (2) of section 27 in Form ‘F’ and every such appeal so filed shall be accompanied by a fee of five thousand rupees in favour of Secretary, Central Council of Indian Medicine, payable at New Delhi.
