## Policy Analysis Report: Extension of 'Free' Import Policy for Moong Beans **1. Executive Summary:** This report analyzes a notification issued by the Ministry of Commerce and Industry, Department of Commerce, regarding the import policy for Moong Beans (SPP Vigna Radiata L. Wilczek) under ITC HS Code 0713 31 90. This notification amends a previous notification (S.O. 1858 E dated 15.05.2021) by extending the 'Free' import policy for Moong Beans. The key finding is that the amendment provides an extended timeframe for importers to ship and clear Moong Bean consignments, specifically setting new deadlines for the Bill of Lading/Lorry Receipt issuance and customs clearance. **2. Introduction:** The purpose of this report is to provide a clear and concise analysis of the notification regarding the import policy for Moong Beans, based solely on the information provided in the official gazette notification. This analysis will focus on the changes introduced by the amendment, their implications, and the affected parties. **3. Policy Overview:** * This notification is an *amendment* to Department of Commerce Notification S.O. 1858 E dated 15.05.2021. * The core objective of the amendment, as inferred from the text, is to extend the period during which the 'Free' import policy for Moong Beans is applicable. **4. Background and Rationale:** The original policy allowed 'Free' import of Moong Beans. This amendment likely addresses a need to provide importers with additional time to complete their import processes, possibly due to disruptions or delays that prevented them from meeting the original deadlines. The text explicitly mentions extending the validity of the "Free" import policy indicating that the reasons are probably related to logistical concerns or unforeseen circumstances hindering the import process within the originally stipulated timeframe. **5. Key Provisions / Changes:** This notification focuses specifically on extending the deadlines associated with the 'Free' import policy. * **Specific Part Changed:** The amendment modifies the effective dates of the original 'Free' import policy for Moong Beans, as established in Notification S.O. 1858 E dated 15.05.2021. * **New Rule/Provision:** The 'Free' import policy for Moong Beans is extended with the following conditions: * The Bill of Lading/Lorry Receipt must be issued on or before *31.03.2022*. * Customs authorities must authorize the Out of Charge on or before *30.06.2022*. * **Effect of Change:** The amendment provides importers with approximately a ten-month extension for Bill of Lading/Lorry Receipt (from May 15, 2021 to March 31, 2022), and a corresponding extension for customs clearance. This allows shipments initiated before 31.03.2022 to be cleared by 30.06.2022, while still benefiting from the 'Free' import policy. **6. Target Audience and Stakeholders:** The target audience and primary stakeholders affected by this amendment are: * Importers of Moong Beans (SPP Vigna Radiata L. Wilczek) under ITC HS Code 0713 31 90. * Customs authorities responsible for clearing Moong Bean consignments. * Logistics and shipping companies involved in the transportation of Moong Beans. **7. Implementation Aspects (Inferred):** * **Responsible agency:** The Ministry of Commerce and Industry, specifically the Department of Commerce, is responsible for implementing this notification. The Customs Authorities are responsible for enforcing the dates specified in the notification. * **Timelines:** * Bill of Lading/Lorry Receipt must be issued on or before 31.03.2022. * Out of Charge authorization by Customs Authorities must occur on or before 30.06.2022. **8. Expected Outcomes / Impact of Changes:** The intended outcome of this amendment is likely to: * Facilitate smoother import operations for Moong Beans by providing a longer timeframe for shipment and clearance. * Prevent disruption to the supply chain by allowing consignments delayed beyond the original policy's deadline to still qualify for the 'Free' import policy. * Reduce potential losses for importers who may have faced difficulties in meeting the original deadlines. **9. Conclusion:** The notification extends the 'Free' import policy for Moong Beans by adjusting the deadlines for Bill of Lading/Lorry Receipt issuance and customs clearance. This change is significant for importers of Moong Beans, providing them with extended flexibility and potentially mitigating disruptions in the supply chain. The amendment demonstrates the government's responsiveness to practical challenges faced by importers and its commitment to facilitating trade.
