IV).—केंद्रीय सरकार ने अजधसूचना सं. 17/3/2018-ईपी (एग्री-IV) ददनांक 27.02.2019 के तहत ‘जवजिष्ट कृजि उत्पादों के जलए पररवहन एवं जवपणन सहायता (टीएमए) स्ट्कीम िीिषक' से एक स्ट्कीम आरंभ की थी। इस स्ट्कीम में अजधसूचना सं. 17/3/2018-ईपी (एग्री-IV) ददनांक 06.06.2019, अजधसूचना सं. 7/3/2018-ईपी (एग्री-IV) ददनांक 17.03.2020 और अजधसूचना सं.17/3/2018-ईपी (एग्री-IV) ददनांक 27.04.2020 के तहत अन्य सिं ोधन दकए गए थे। अब ‘जवजिष्ट कृजि उत्पादों के जलए सिं ोजधत पररवहन और जवपणन सहायता स्ट्कीम (टीएमए)’ आरंभ करन े का जनणयष जलया गया ह ै िो ददनाकं 01.04.2021 को अथवा उसके बाद दकए गए जनयाषतों पर लाग ूहोगी। पवू वष तती स्ट्कीम ददनाकं 31.03.2021 तक दकए गए जनयातष ों के जलए प्रचालन म ेंरहगे ी। 2. भजू मका एव ंउद्दश्े य जवजिष्ट कृजि उत्प ादों के जलए “पररवहन एवं जवपणन सहायता” (टीएमए) स्ट्क ीम का उद्देश् य कृजि उत् पादों के मालभाे े एवं जवपणन के अंतराषष्र ीय घटक के जलए सहायता उपलब् ध कराना ह ै जिससे रांस-जिपमेंट के कारण जवजिष् ट कृजि उत्प ादों के जनयाषत के पररवहन की उच् च लागत की हाजन में कमी होगी और जवदिे जस्ट्थत जवजन्दष् ट बािारों में भारतीय कृजि उत्प ादों के जलए ब्ांड पहचान संवधषन होगा। 3. कवरेि (क) जवदिे व य् ापार नीजत के अनुसार संगत जनयाषत संवधषन पररिद में जवजधवत पंिीकृत पात्र कृजि उत् पादों के सभी जनयाषतक इस स्ट्कीम के अंतगषत कवर दकए िाएंगे। 5016 GI/2021 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] (ख) यह सहायता अजधसूजचत दरों पर समय-समय पर यथा जवजन्दष् ट अनुमत दिे ों को पात्र कृजि उत्प ादों के जनयाषत के जलए उपलब्ध होंगी। 4. प्रयोिनीयता: यह स्ट्क ीम 1.04.2021 से 31.03.2022 तक दकए गए जनयाषतों पर लागू होगी। 5. उत्प ादों की पात्रता : यह सहायता, अनबु धं -1 में उजल् लजखत उत्प ादों को डोे कर, समुद्री एवं रोपण उत्प ादों सजहत एचएसएन अध् याय 1 से 24 में िाजमल सभी कृजि उत् पादों के जनयाषत पर उपलब्ध कराई िाएगी। 6. सहायता का पटै न ष (क) टीएमए के तहत सहायता अदा दकए गए मालभाडे की क्षजतपूर्तत के भाग के रूप में सीधे बैंक रांसफर के िररए नगद में उपलब्ध कराई िाएगी। एफबबी आपूर्ततयों को िहां भारतीय जनयाषतकों ्ारा कोई मालभाे ा अदा नहीं दकया गया, इस स्ट्क ीम के तहत िाजमल नहीं दकया िाएगा। (ख) जभन् न क्षेत्रों के जलए सहायता का स्ट्त र जभन् न होगा िैसा दक पात्र उत् पादों के जनयाषत के जलए समय–समय पर अजधसूजचत दकया गया ह।ै टीएमए के तहत सहायता के जलए प्रत् येक क्षेत्र में पात्र जनयाषत गंतव् यों/दिे ों की सूची अनबु धं -2 में दी गई ह।ै (ग) यह सहायता जनयाषतकों ्ारा इंडेजिटी क्षजतपूर्तत बांड के साथ जबल ऑफ लौडडग/एयर वे जबल, जनयाषत के फलीभूत नहीं होने की जस्ट्थजत में स्ट्कीम के तहत सहायता के रूप में प्राप्त राजि को वापस करने की अंडरटेककग दने े पर ही स्ट्वीकाय ष होगी। (घ) ईडीआई पत्त नों के माध् यम से दकए गए जनयाषतों के जलए ही इस स्ट् कीम की अनुमजत दी िाएगी। (ड.) इस स्ट्क ीम में हवाई मागष एवं समु्द्री मागष से (सामान् य और रीफर कागगो दोनों) दकए गए जनयाषतों हते ु माल भाडा और जवपणन सहायता िाजमल ह।ै (च) उत्प ादों के समु्द्री मागष से जनयाषत के जलए टीएमए पूरे बीस–फीट इक्व ीवेलेंट यूजनट (टीईयू) कंटेनरों के जलए भुगतान दकए गए माल भाडा पर आधाररत होगा। यह सहायता (i) कंटेनर लोड से कम (एलसीएल) और (ii) कंटेनर में उपयुक् त और गैर उपयुक् त दोनों वगगो के कागह होने पर उपलब्ध नहीं होगी। इसके अजतररक् त, यदद कागह बल् क/ब्ेक बल् क मोड में जि्‍ ड दकया िाता ह ैतो कोई टीएमए उपलब् ध नहीं होगा। चालीस फीट के कंटेनर को दो टीईयू माना िाएगा। (ड) वायुयान ्ारा जनयाषत दकए गए उत्प ादों के जलए सहायता जनयाषत कागगो के जनवल भार पर प्रजत दकलोग्राम माल भाडा िुल् क, जिसकी गणना पूणष दकलोग्राम आधार पर, उसके दकसी भाग को िाजमल न करते हुए की िाएगी। (ि) यह सहायता अनबु धं -3 म ेंदी गई अजधसूजचत दरों पर प्रदान की िाएगी। 7. टीएमए के जलए अपात्र जनयाषत की श्रणे ी इस स क् ीम के तहत जनम्न जलजखत जनयाषत श्रेणी/क्षेत्र अपात्र होगें : (i) एफटीपी के पैरा 2.46 के तहत िाजमल दकए गए आयाजतत माल के जनयाषत। (ii) रांस–जिपमेंट के माध्य म से जनयाषत अथाषत जनयाषत जिनका उ्गमम तीसरे दिे में हुआ ककतु जिनका भारत से होकर रांस–जिप दकया गया। (iii) यदद जवजिष् ट रूप से अजधसूजचत न दकया गया हो तो, आईटीसी (एचएस) में जनयाषत नीजत की अनुसूची–2 के तहत जनयाषत के जलए जनजिद्ध अथवा प्रजतबंजधत मद।ें (iv) यदद जवजिष् ट रूप से अजधसूजचत न दकया गया हो, तो न्य ूनतम जनयाषत कीमत अथवा जनयाषत िुल् क के अध् यधीन जनयाषत उत् पाद। (v) ई–कामसष का उपयोग करते हुए कुररयर अथवा जवदिे ी पोस्ट् ट ऑदफसों के माध्य म से माल का जनयाषत। 8. स्ट्क ीम के तहत सहायता लाभ उनान ेके जलए प्रदाया टीएमए की प्रजतपूर्तत दायाजवजध पुजस्ट् तका अध् याय 7(क) में जनधाषररत प्रदाया के अनुसार डीिीएफटी के क्षेत्रीय प्राजधकाररयों ्ारा की िाएगी।[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 3 9. दावा, लखे ा परीक्षा, वसलू ी एव ंदडं ात्म क कारषवाई की सवं ीक्षा के जलए तत्रं डीिीएफटी दावा, दकए गए भुगतान की लेखा परीक्षा, भुगतान की गई अपात्र/अजधक सहायता की वसूली, इन वसूजलयों पर ब्य ाि की संवीक्षा के जलए कायष पद्धजत जनधाषररत करेगा। चूककताष जवदिे व्य ापार (जवकास एवं जवजनयमन) अजधजनयम,1992, के प्रावधानों एवं इसके अधीन बनाए गए जनयम और आदिे ों के अंतगषत दडं ात्म क कारषवाई के जलए उत्त रदायी होगें। अनबु धं -1 टीएमए स्ट्कीम के तहत सहायता के जलए अपात्र कृजि उत्पादों की सचू ी इस स्ट्कीम के तहत, जनिजलजखत अपवादों के साथ, एचएसएन अध्याय 1 से 24 के तहत आने वाले सभी कृजि उत्पादों के जलए सहायता प्रदान की िाएगी: अध्याय एचएस कोड जववरण अध्याय 1, 2 और सभी एचएस कोड - The Scheme was further amended vide Notification No. 17/3/2018-EP (Agri.IV) dated 06.06.2019, Notification no. 7/3/2018-EP (Agri.IV) dated 17.03.2020 and Notification no. 17/3/2018-EP (Agri.IV) dated 27.04.2020. It has now been decided to introduce the ‘Revised Transport and Marketing Assistance (TMA) for Specified Agriculture Products Scheme’ for the exports effected on or after 01.04.2021. The earlier scheme would remain in operation for the exports effected up to 31.03.2021. 2. Introduction and Objective The “Transport and Marketing Assistance” (TMA) for specified agriculture products scheme aims to provide assistance for the international component of freight and marketing of agricultural produce which is likely to mitigate disadvantage of higher cost of transportation of export of specified agriculture products due to trans-shipment and to promote brand recognition for Indian agricultural products in the specified overseas markets. 3. Coverage (a) All exporters, duly registered with relevant Export Promotion Council as per Foreign Trade Policy, of eligible agriculture products shall be covered under this scheme. (b) The assistance, at notified rates, will be available for export of eligible agriculture products to the permissible countries, as specified from time to time. 4. Applicability: The Scheme would be applicable for the exports effected from 1.4.2021 to 31.03.2022 5. Eligibility of Products: The assistance will be provided on export of all agriculture products covered in HSN chapter 1 to 24 including marine and plantation products, except those mentioned in Annexure-1. 6. Pattern of Assistance (a) Assistance under TMA would be provided in cash through direct bank transfer as part reimbursement of freight paid. FOB supplies, where no freight is paid by Indian exporters, are not covered under this scheme. (b) The level of assistance would be different for different regions as notified from time to time for export of eligible products. List of export destinations/countries in each region eligible for assistance under TMA are mentioned in Annexure-2. (c) The assistance shall be admissible on the production of Bill of Lading/ Airway Bill with an indemnity bond to be submitted by the exporter, undertaking to refund the amount received as assistance under the scheme in case the export does not fructify.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] (d) The scheme shall be admissible for the exports made through EDI ports only. (e) The scheme covers freight and marketing assistance for export by air as well as by sea (both normal and reefer cargo). (f) For export of products by sea, TMA will be based on the freight paid for a full Twenty-feet Equivalent Unit (TEU) containers. The assistance will not be available for (i) Less than Container Load (LCL) and (ii) a container having both eligible and ineligible category of cargo. Further, no TMA is available where the cargo is shipped in bulk/break bulk mode. A forty feet container will be treated as two TEUs. (g) Assistance for products exported by air would be based on per kilogram freight charges on net weight of the export cargo, calculated on full kilogram basis, ignoring any fraction thereof.” (h) The assistance will be provided at the rates as notified in Annexure-3. 7. Categories of export ineligible for TMA The following exports categories / sectors shall be ineligible under this scheme: (i) Export of imported goods covered under paragraph 2.46 of the FTP. (ii) Exports through trans-shipment, i.e. exports that are originating in third country but trans- shipped through India. (iii) Items, which are restricted or prohibited for export under Schedule-2 of Export Policy in ITC (HS), unless specifically notified. (iv) Export products which are subject to Minimum Export Price or export duty, unless specifically notified. (v) Export of goods through courier or foreign post offices using e-Commerce. 8. Procedure for Availing Assistance under the Scheme TMA would be reimbursed through the Regional Authorities of DGFT as per the procedure laid down in Chapter 7(A) of Handbook of Procedures. 9. Mechanism for Scrutiny of the claims, audit, recovery and penal action DGFT will lay down procedure for scrutiny of the claims, audit of the payments made, recovery of the ineligible/excess paid assistance, interest on such recoveries. The defaulters shall be liable for penal action under the provisions of Foreign Trade (Development & Regulation) Act, 1992, Rules and orders made thereunder.
