Govindarajulu, Ex-Asst.Inspector Sericulture, High Capacity Grainage, Madanapalli, Chittoor District, Representation, dt.01-02-2012. --oOo-- ORDER: In a disciplinary case, in the reference 1st read above, the Commissioner of Sericulture, Hyderabad had awarded a penalty of “Reduction to a lower time scale of pay of Farm Foreman besides recovery of Rs.85,649/-” against Sri D. Govindarajulu, Ex-Asst.Inspector Sericulture for allegations of irregularities for non-clearance of due to seed area while working at High Capacity Grainage, Madanapalli, Chittoor District . 2. The A.P.Administrative Tribunal in its order dt.31-03-2003 in O.A.No. 10182/2002 filed by Sri S. Venkataramana, Inspector of Sericulture(Dismissed) directed, inter alia, to pass orders which shall be in uniformity with the orders passed in respect of similarly situated persons. 3. In the light of above A.P.Administrative Tribunal orders, in exercise of powers conferred under Rule 43 of A.P.Civil Services(CCA)Rules, 1991, Government took up revision of the penalty orders issued by the Commissioner of Sericulture, Hyderabad against (24) individuals, whose cases are similarly situated and issued necessary orders accordingly. Sri D. Govindarajulu, Ex-Asst. Inspector Sericulture, High Capacity Grainage, Madanapalli, Chittoor District & Presently Asst. Sericulture Officer(Retired) is one among the above (24) individuals. 4. On the above, in the reference 5th read above, Government had modified the penalty of “Reduction to a lower time scale of pay of Farm Foreman” to that of “Stoppage of one annual grade increment with cumulative effect besides recovery of the amount limited to the share of the charged officer i.e. Rs.85,649/-“ against Sri D. Govindarajulu, Ex-Asst.Inspector Sericulture. 5. In the above case, among the above (24) persons, (7) persons have approached the A.P.Administrative Tribunal and filed O.A.Nos. 8078/2007, 7582/2007, 8021/2007, 8038/2007, 7578/2007, 8083/2007 & 1453/2008 against the penalties awarded against them by the Commissioner of Sericulture, Hyderabad and confirmed by the Government by under revision. 6. The A.P. Administrative Tribunal in its common order dt.29-10-2009, in O.A.Nos.8078/2007, 7582/2007, 8021/2007, 8038/2007, 7578/2007, 8083/2007 & 1453/2008 have ordered as follows:- (PTO)--:2:-- “….It is a fact that the Applicants were entrusted with the stocks of eggs for marketing purpose. They sold the eggs to various customers on credit basis, without the permission of the higher authorities. The Applicants could recover some of the amounts and there was also late remittance and some more amounts could not be realized from the alleged customers. Therefore, from the record, it is made out that there was dereliction of duty on the part of the Applicants, but subsequently, they remitted the amounts due to the Government. Therefore, I am of the view that a lenient view can be taken regarding the imposition of punishment. In the light of the above circumstances, the O.As are disposed of. The order of recovery stands confirmed in view of the remittance said to be made by the Applicants. If any amount remained due, the Respondents are at liberty to recover the amount from the respective Applicants. The punishment of stoppage of three annual grade increments with cumulative effect is modified by reducing the same into stoppage of one increment with cumulative effect. No costs”. 7. Government, after careful examination of the entire matter with reference to the common orders dt.29-10-2009 of A.P. Administrative Tribunal in O.A.Nos.8078/2007, 7582/2007, 8021/2007, 8038/2007, 7578/2007, 8083/2007 & 1453/2008, have reduced the penalty of ‘Stoppage of three annual grade increments with cumulative effect” to that of “Stoppage of one annual grade increment without – repeat without cumulative effect besides recovery against seven individuals vide reference 7th read above. 8. Sri D. Govindarajulu, Ex-Asst. Inspector Sericulture, High Capacity Grainage, Madanapalli, Chittoor District & Presently Asst. Sericulture Officer(Retired) has submitted a representation dt.01-02-2012 before Government requesting to issue similar orders as was done in the case of individuals, whose cases were considered vide reference 7th read above. 9. Government have examined the entire matter yet again carefully and decided to consider the request of Sri D. Govindarajulu, Ex-Asst. Inspector Sericulture to reduce the penalty of “Stoppage of one annual grade increment with cumulative effect” to that of “Stoppage of one annual grade increment without – repeat without cumulative effect besides recovery” against him, in the above disciplinary case. 10. Accordingly, Government hereby reduce the penalty of “Stoppage of one annual grade increment with cumulative effect” to that of “Stoppage of one annual grade increment without – repeat without cumulative effect besides recovery” against Sri D. Govindarajulu, Ex-Asst. Inspector Sericulture, High Capacity Grainage, Madanapalli, Chittoor District & Presently Asst. Sericulture Officer(Retired), in the above disciplinary case. 11. The Commissioner of Sericulture, A.P., Hyderabad shall take necessary action in the matter, accordingly.
