## Report on Amendment to the Central Motor Vehicles Rules, 1989 **1. Executive Summary:** This report analyzes a notification amending the Central Motor Vehicles Rules, 1989, as published in the Gazette of India on April 18, 2022. The core purpose of this amendment, as inferred from the text, is to refine driver training and testing requirements, particularly for two-wheeler driving, and adjust related administrative processes, including accreditation fees. Key changes involve modifications to rules concerning driving techniques, accreditation for driver training centers, and specific details regarding two-wheeler driving course content. These amendments aim to enhance driver competence and potentially improve road safety. **2. Introduction:** This report provides an overview and analysis of the amendments to the Central Motor Vehicles Rules, 1989, based solely on the provided government notification. The analysis focuses on the specific changes introduced, their potential impact, and relevant implementation aspects discernible from the text. **3. Policy Overview:** * This notification pertains to an amendment of the Central Motor Vehicles Rules, 1989. * Core Objective(s): The core objectives, inferred from the text, include: * Enhancing driver competency through standardized training. * Incorporating fuel-efficient driving techniques into training curricula. * Specifying detailed requirements for two-wheeler driving training. * Adjusting the accreditation process for driver training centers. **4. Background and Rationale:** The amendments likely address a perceived need to improve the quality and standardization of driver training, particularly for two-wheeler operators. The inclusion of fuel efficiency training suggests a broader goal of promoting environmentally conscious driving practices. The detailed specification of the two-wheeler driving course indicates a focus on reducing accidents involving this vehicle type. The amendment also appears to streamline administrative processes related to driver training center accreditation. **5. Key Provisions / Changes:** The following specific changes are introduced by the amendment text: * **Rule 11 (Driver Training):** * **Change:** Clause (e) of subrule 1 is omitted (original clause content not provided). * **Change:** After clause (d) of subrule 2, clause (e) is inserted, mandating "knowledge and understanding of fuel-efficient driving technique." * **Effect:** Introduces the importance of fuel-efficient driving techniques as a core element of driver training. * **Rule 14 (Driver Licensing):** * **Change:** Clause "f Certificate from accredited driver training Center in Form 5B as per rule 31E, if any" is omitted. * **Change:** In subrule 1, after clause g, clause h is inserted, reading "Certificate from accredited driver training Center in Form 5B as per rule 31E, if any". * **Effect:** Streamlines the process related to certificates from accredited driver training centers. It appears that there is a move to make the certificate not mandatory, depending on conditions described in rule 31E. * **Rule 31C (Driver Refresher Courses):** * **Change:** After the words "may be renewed," the words ", for a period of five years at a time," are inserted. * **Effect:** Specifies the renewal period for driver refresher courses, adding clarity and standardization. * **Rule 31J (Accredited Driver Training Curriculum):** * **Change:** Under subrule 1, clause D is inserted, detailing a two-wheeler driving course. The course duration is 20 sessions over a maximum of 2 weeks, split into theory (7 sessions) and practical (13 sessions). * **Effect:** Provides a detailed curriculum for two-wheeler driver training, covering topics from driving theory and traffic education to vehicle engineering, first aid, and practical driving skills. It sets a standard for accredited two-wheeler driver training programs. * **Rule 31J (Motor Vehicle Inspector's Test):** * **Change:** In clause 6, "Motor Vehicle Inspector's Test" is replaced with "Test of competence to drive." * **Effect:** Clarifies the nature of the final assessment, focusing on demonstrating driving competence rather than solely relying on an inspector's evaluation. * **Rule 32 (Fees):** * **Change:** The text shows an omission and then a re-insertion of the fees associated with accreditation of driver training centers. * **Effect:** It is not clear what the intention of this change is. **6. Target Audience and Stakeholders:** Based on the provided text, the directly affected audience and stakeholders include: * Individuals seeking driver's licenses, particularly for two-wheelers. * Accredited driver training centers and their instructors. * Motor Vehicle Inspectors or individuals responsible for conducting driving tests. * Ministry of Road Transport and Highways (MoRTH) officials involved in policy implementation. **7. Implementation Aspects (Inferred):** * Responsible Agency: Ministry of Road Transport and Highways (MoRTH). * Timelines: The amendment comes into force on the date of its publication in the Official Gazette (April 18, 2022). * Procedures: Driver training centers will need to adapt their curricula to incorporate the specified two-wheeler driving course content. Motor Vehicle Inspectors or designated testers will need to adjust their assessment methods to focus on "competence to drive." Refresher courses will now be renewed for a 5 year period. **8. Expected Outcomes / Impact of Changes:** The likely intended outcomes of these amendments include: * Improved driver competence, particularly among two-wheeler operators, leading to fewer accidents. * Increased awareness of fuel-efficient driving techniques among all drivers. * Standardized driver training programs across accredited institutions. * Enhanced road safety through better-trained and more responsible drivers. **9. Conclusion:** The amendments to the Central Motor Vehicles Rules, 1989, represent a significant step towards enhancing driver training standards and promoting safer driving practices. The focus on two-wheeler training, fuel efficiency, and competency-based assessments suggests a commitment to improving road safety and environmental consciousness. The implementation of these changes will require collaboration between MoRTH, driver training centers, and testing authorities. Overall, this amendment aims to modernize and improve the efficacy of driver training and licensing processes.
