L.-33004/99 सी.जी.-डी.एल.-अ.-14032024-252994 CG-DxLx-xEG-I1D4H0x3x2x0 24-252994 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 178] नई दिल्ली, बृहस्ट्प जतवार, माचा 14, 2024/फाल्ग नु 24, 1945 No. 178] NEW DELHI, THURSDAY, MARCH 14, 2024/PHALGUNA 24, 1945 पर्ाावरण, वन और िलवार् ु पररवतना मत्रं ालर् अजधसचू ना नई दिल्ली, 14 माच,ा 2024 सा.का.जन. 191(अ).— केंद्रीर् सरकार, वन् र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53) की धारा 63 की उपधारा (1) के खंड (छ viii) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, जनम्नजलजखत जनर्म बनाती ह,ै अर्ाात:् - 1. संजक्षप्त नाम और प्रारंभ . - (1) इन जनर्मों का सजन्क्षप्त नाम बन्िी हार्ी (स्ट्र्ानांतरण र्ा पररवहन) जनर्म, 2024 ह।ै (2) वे रािपत्र म ेंउनके प्रकािन की तारीख से प्रवृत् त होंगे। 2. पररभाषा.- (1) इन जनर्मों म,ें िब तक संिभा से अन्र्र्ा अपेजक्षत न हो,- (क) "अजधजनर्म" से वन्र् िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53) अजभप्रेत ह;ै (ख) "िाता राज्र्" से वह राज्र्, जिसके अजधकार क्षेत्र से हार्ी को स्ट्र्ानांतररत दकर्ा िा रहा ह ैअजभप्रते ह;ै (ग) "हार्ी" से एक बन्िी हार्ी अजभप्रते ह,ै जिसके संबंध म ें अजधजनर्म की धारा 42 के अधीन स्ट्वाजमत्व प्रमाण पत्र िारी दकर्ा गर्ा ह;ै (घ) "हार्ी सहार्क" से महावत की सहार्ता के जलए जनर्िु व्यजि अजभप्रेत ह;ै (ड.) "प्ररूप" से इन जनर्मों के पररजिष्ट म ेंदिर्ा गर्ा प्ररूप अजभप्रेत ह;ै (च) "महावत" से वह व्यजि िो हार्ी का प्रबंधन करता ह,ै अजभप्रेत ह;ै 1911 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (छ) "माजलक" से वह व्यजि, जिसके पास अजधजनर्म की धारा 42 के अधीन हार्ी के स्ट्वाजमत्व के जलए िारी वैध प्रमाण पत्र ह,ै अजभप्रेत ह ै; (ि) "प्राप्तकताा राज्र्" से वह राज्र्, जिसके अजधकार क्षेत्र में हार्ी का स्ट्र्ानांतरण दकर्ा िाना ह,ै अजभप्रेत ह;ै (झ) "पिु जचदकत्सा व्य्वसार्ी" से भारतीर् पि ु जचदकत्सा पररषि अजधजनर्म, 1984 (1984 का 52) के अधीन स्ट्र्ाजपत भारतीर् पिु जचदकत्सा पररषि के सार् पंिीकृत व्यजि अजभप्रेत ह;ै (2) इन जनर्मों म ें प्रर्ुि और पररभाजषत नहीं दकए गए ककंतु अजधजनर्म म ें पररभाजषत िब्िों और अजभव्यजिर्ों का वही अर् ाहोगा िो उन्ह ेंक्रमिः अजधजनर्म म ेंदिर्ा गर्ा ह।ै 3. हार्ी के स्ट्र्ानातं रण के जलए आविे न.- हार्ी के स्ट्र्ानांतरण के जलए आवेिन प्ररूप 1 म,ें जिस क्षेत्र में वह हार्ी पंिीकृत ह,ै उस क्षेत्र पर अजधकाररता रखन े वाले उप वन संरक्षक की श्रेणी से अन्र्ून अजधकारी को प्रस्ट्त ुत दकर्ा िाएगा। 4. उप वन सरं क्षक द्वारा िाचं .- (1) जनर्म 3 के अधीन आवेिन प्राप्त होने पर, उप वन संरक्षक :- (क) प्ररूप 2 में पि ुजचदकत्सा व्य्वसार्ी का प्रमाण पत्र प्राप्त करेगा; (ख) उस स्ट् र्ान की जवस्ट्ततृ िाचं और भिजतक सत्र्ापन करेगा िहां वतामान में हार्ी को रखा गर्ा ह ै और उस स्ट् र्ान की भी िहां हार्ी को रखे िाने का प्रस्ट्ताव ह,ै र्दि प्रस्ट्त ाजवत स्ट् र्ान उसके अजधकार क्षेत्र में जस्ट्र्त ह;ै और (ग) प्ररूप 3 में आवेिन और ररपोटा को पि ु जचदकत्सा व्य्वसार्ी की ररपोट ा के सार् पंद्रह दिनों की अवजध के भीतर मुख्र् वन्र् िीव प्रजतपालक को अग्रेजषत करेगा। 5. राज्र् के भीतर स्ट्र्ानातं रण.- (1) मुख्र् वन्र् िीव प्रजतपालक, ररपोट ा की िांच के पश्चात सात दिनों की अवजध के भीतर एक जलजखत आििे द्वारा उस हार्ी के स्ट्र्ानातं रण को अस्ट्वीकार कर सकता ह ै र्ा उसकी अनुमजत ि े सकता ह,ै र्दि ऐसे हार्ी को जनर्म 3 के अधीन आवेिन प्राप्त करन े वाल े अजधकारी की अजधकाररता के भीतर रखे िाने का प्रस्ट्ताव ह ै। (2) मुख्र् वन्र् िीव प्रजतपालक, जनर्म 4 के उप-जनर्म (1)(ग) के अनुसार प्राप्त आवेिन और ररपोट ा को उस क्षत्रे , िहां हार्ी को रखा िाना प्रस्ट्ताजवत ह ै और िो जनर्म 3 के अधीन सात दिनों की अवजध के भीतर आवेिन प्राप्त करन े वाल े अजधकारी की अजधकाररता स े बाहर ह,ै पर अजधकाररता रखने वाल े उप वन संरक्षक की श्रेणी स े अन्र्नू अजधकारी को अग्रेजषत करेगा । (3) संबंजधत उप वन संरक्षक उप-जनर्म (2) के अनुसार आवेिन और ररपोट ा प्राप्त होने पर, सुजवधा की जवस्ट्तृत िांच और भिजतक सत्र्ापन करेगा और पंद्रह दिनों की अवजध के भीतर प्ररूप 3 में मुख्र् वन्र् िीव प्रजतपालक को ररपोटा प्रस्ट्तुत करेगा। (4) मुख्र् वन्र् िीव प्रजतपालक आवेिन और ररपोटा के परीक्षण के पश्चात, सात दिनों की अवजध के भीतर जलजखत आिेि द्वारा स्ट्र्ानांतरण को अस्ट्वीकार कर सकता ह ैर्ा उसकी अनुमजत िे सकता ह।ै 6. राज्र् के बाहर स्ट्र्ानातं रण.- (1) िाता राज्र् का मुख्र् वन्र् िीव प्रजतपालक, जनर्म 4 के उपजनर्म (1) के खंड (ग) के अनुसार प्राप्त ररपोट ा के सार् आवेिन को पंद्रह दिनों की अवजध के भीतर प्राप्तकताा राज्र् के मख्ु र् वन्र् िीवन प्रजतपालक को अग्रेजषत करेगा। (2) प्राप्तकताा राज्र् का मुख्र् वन्र् िीव प्रजतपालक, सात दिनों की अवजध के भीतर आवेिन और ररपोटा को उस क्षत्रे , िहां हार्ी को रखा िाएगा, पर अजधकाररता रखने वाले उप वन संरक्षक की श्रेणी स े अन्र्ून अजधकारी को अग्रेजषत करेगा। (3) संबंजधत उप वन संरक्षक, उप-जनर्म (2) के अनुसार आविे न और ररपोट ा प्राप्त होन े पर सुजवधा की जवस्ट्तृत िांच और भिजतक सत्र्ापन करेगा और प्ररूप 3 में पंद्रह दिनों की अवजध के भीतर मुख्र् वन्र् िीव प्रजतपालक को ररपोटा प्रस्ट्तुत करेगा। (4) प्राप्तकताा राज्र् का मुख्र् वन्र् िीव प्रजतपालक, उप-जनर्म (3) के अनुसार ररपोटें प्राप्त होने के पश्चात, पंद्रह दिनों की अवजध के भीतर प्ररूप 4 में िाता राज्र् के मुख्र् वन्र् िीव प्रजतपालक को अपनी[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 जसफाररिें अग्रेजषत करेगा। (5) िाता राज्र् का मख्ु र् वन्र् िीव प्रजतपालक, ररपोटों की िांच के पश्चात सात दिनों की अवजध के भीतर, जलजखत आिेि द्वारा स्ट्र्ानांतरण को अस्ट्वीकार करेगा र्ा उसकी अनुमजत िेगा। (6) िाता राज्र् का मुख्र् वन्र् िीव प्रजतपालक, प्राप्तकताा राज्र् के मुख्र् वन्र् िीव प्रजतपालक को स्ट्र्ानांतरण की अस्ट्वीकृजत र्ा अनुमजत के आिेि की सूचना िगे ा। 7. स्ट्र् ानातं रण के जलए जनबधं न और ित.ें- (1) मुख्र् वन्र् िीव प्रजतपालक, ऐसे स्ट्र्ानांतरण की अनुमजत िगे ा, िहां स्ट्र्ानांतरण के जलए प्रस्ट्ताजवत हार्ी के संबंध में, ऐसे हाजर्र्ों से पिै ा हुए हार्ी की ििा के जसवार्, स्ट्वाजमत्व प्रमाण पत्र इन जनर्मों के प्रवृत होने से पूव ाजवद्यमान र्ा। (2) हार्ी के स्ट्र्ानांतरण की अनुमजत मुख्र् वन्र् िीव प्रजतपालक द्वारा िी िा सकती ह,ै र्दि:- (क) माजलक अब हार्ी का भरण-पोषण करने की जस्ट्र्जत में नहीं ह;ै र्ा (ख) हार्ी की िेखभाल वतामान पररजस्ट्र्जतर्ों से बेहतर होगी; र्ा (ग) मामले की पररजस्ट्र्जतर्ों म ेंवह हार्ी की ब हे तर िेखभाल के जलए उपर्ुक् त और उजचत समझता हो। (3) दकसी हार्ी के स्ट्र्ानांतरण की अनुमजत तब तक नहीं िी िाएगी िब तक दक पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् के इलेक्रॉजनक मॉजनटररन्ग एजललकेिन म ें हार्ी की आनुवंजिक प्रोफाइल ििा नहीं की गई हो। 8. हार्ी के पररवहन के जलए आविे न.- (1) हार्ी के पररवहन के जलए आवेिन प्ररूप 5 में उप वन सरं क्षक की श्रेणी स े अन्र्नू अजधकारी को दकर्ा िाएगा, जिसकी उस क्षेत्र पर अजधकाररता ह ैिहां हार्ी रजिस्ट्रीकृत ह।ै (2) संबंजधत उप वन सरं क्षक, आवेिन प्राप्त होन े पर प्ररूप 2 में पिु जचदकत्सा व्यवसार्ी की ररपोटा अजभप्राप्त करेगा और पंद्रह दिनों की अवजध के भीतर पिु जचदकत्सा व्यवसार्ी की ररपोटा के सार् प्ररूप 3 में अपनी जसफाररिें मुख्र् वन्र् िीव प्रजतपालक को प्रस्ट्तुत करेगा। (3) मुख्र् वन्र् िीव प्रजतपालक, उप-जनर्म (2) के अनुसार आवेिन और ररपोटा प्राप्त होने पर, प्ररूप 6 में पररवहन परजमट िारी कर सकता ह ैर्ा जलजखत आिेि द्वारा आवेिन को अस्ट्वीकार कर सकता ह।ै (4) मुख्र् वन्र् िीव प्रजतपालक, पररवहन परजमट की एक प्रजत जनम्नजलजखत को अग्रेजषत करेगा:- (क) राज्र् के भीतर संबंजधत उप वन सरं क्षक जिसके अजधकाररता से हार्ी का पररवहन दकर्ा िाना ह;ै और (ख) संबंजधत मुख्र् वन्र् िीव प्रजतपालक जिसके अजधकार क्षेत्र से हार्ी का पररवहन दकर्ा िाना ह।ै 9. पररवहन के जलए ित.ें- (1) हार्ी का पररवहन, जिसके संबंध म ें पररवहन परजमट िारी दकर्ा गर्ा ह,ै जनम्नजलजखत ितों के सार् होगा दक:- (क) हार्ी के सार् एक महावत और एक हार्ी सहार्क होगा; (ख) दकसी पिु जचदकत्सा व्यवसार्ी से इस आिर् का स्ट्वास्ट््र् प्रमाण पत्र प्राप्त दकर्ा िाता ह ै दक हार्ी पररवहन के जलए र्ोग् र् ह ै और उसमें आक्रमक जस्ट्र्जत के लक्षण र्ा संक्रामक र्ा सांस्गाक रोग का कोई लक्षण नहीं पार्ा गर्ा ह;ै (ग) सांस्गाक रोग की ििा में पिु जचदकत्सा व्यवसार्ी द्वारा सलाह के अनुसार अजनवार् ा संगरोध अवजध समाल त होने के पश्चात पररवहन दकर्ा िाएगा; (घ) हार्ी को वाहन पर चढाने से पहल ेठीक से खाना जखलार्ा िाएगा और पानी जपलार्ा िाएगा; (ड.) रास्ट्ते म ेंहार्ी को भोिन और पानी उपलब्ध कराने के जलए आवश्र्क व्यवस्ट्र्ा की िाएगी; (च) हाजर्र्ों की घबराहट र्ा जचड़जचड़ेपन को जनर्ंजत्रत करन े के जलए पि ु जचदकत्सा व्यवसार्ी द्वारा परामि ा पर प्रिांतक/िामक िवाओं का उपर्ोग दकर्ा िाएगा । 10. जवजधमान्र्ता - (1) हार्ी का स्ट्र्ानांतरण, अनुमजत दिए िाने की तारीख से तीन मास से अनजधक अवजध के भीतर दकर्ा िाएगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) पररवहन परजमट की जवजधमान्र्ता एक मास से अजधक नहीं होगी। (3) स्ट्र्ानांतरण र्ा पररवहन परजमट के जलए अनुमजत की जवजधमान्र्ता की अवजध को बढाने की अनुज्ञा नहीं िी िाएगी। 11. अपील.- (1) मुख्र् वन्र् िीव प्रजतपालक की अस्ट् वीकृजत से व्यजर्त आवेिक, मुख्र् वन्र् िीव प्रजतपालक के आिेि के प्राप्त होने की तारीख से साठ दिनों की अवजध के भीतर, रजिस्ट्रीकृत डाक के माध्र्म से एक जलजखत कर्न भेिकर अपील करन े के कारणों को उजचत ठहराते हुए, संबंजधत राज्र् सरकार के राज्र् वन जवभाग के प्रिासजनक प्रमुख के समक्ष अपील कर सकता ह।ै (2) राज्र् सरकार अपील प्राप्त होने के तीस दिन की अवजध के NOTIFICATION New Delhi, the 14th March, 2024 G.S.R. 191(E).— In exercise of the powers conferred by clause (gviii) of sub- section (1) of Section 63 of the Wild Life (Protection) Act, 1972 (53 of 1972), the Central Government hereby makes the following rules, namely:- 1. Short title and commencement. – (1) These rules may be called the Captive Elephant (Transfer or Transport) Rules, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definition .- (1) In these rules, unless the context otherwise requires,- (a) "Act" means the Wild Life (Protection) Act, 1972 (53 of 1972); (b) “donor State” means a State from whose jurisdiction the elephant is going to be transferred; (c) “elephant” means a captive elephant in respect of which an ownership certificate has been issued under Section 42 of the Act; (d) "elephant assistant" means a person engaged to assist the Mahout; (e) “Form” means form appended to these rules; (f) "mahout" means the person who manages the elephant; (g) "owner" means a person having a valid certificate of ownership for the elephant issued under section 42 of the Act; (h) “recipient State” means a State in whose jurisdiction the transfer of elephant is going to be transferred; (i) “veterinary practitioner” means a person registered with the Veterinary Council of India established under the Indian Veterinary Council Act, 1984 (52 of 1984); (2) The words and expressions used and not defined in these rules but defined in the Act shall have the meaning respectively assigned to them in the Act. 3. Application for Transfer of Elephant .– An application for transfer of elephant shall be made in Form I to the officer not below the rank of Deputy Conservator of Forests having jurisdiction over the area where the elephant is registered. 4. Inquiry by the Deputy Conservator of Forests.-(1) On receipt of the application under rule 3, the Deputy Conservator of Forests shall:- (a) obtain a certificate of a veterinary practitioner in Form II; (b) conduct a detailed inquiry and physical verification of the facility where the elephant is presently housed and also the facility where the elephant is proposed to be housed in case the facility is located within his jurisdiction; and (c) forward the application and report in Form III along with the report of veterinary practitioner within a period of fifteen days to the Chief Wild Life Warden. 5. Transfer within the State.-(1)The Chief Wild Life Warden after examination of reports may, within a period of seven days by an order in writing reject or permit the transfer of the elephant, if such elephant is proposed to be housed within the jurisdiction of the officer receiving the application under rule 3. (2) The Chief Wild Life Warden shall forward the application and the reports received as per sub-rule (1)(c) of rule 4 to the officer not below the rank of Deputy Conservator of Forests having jurisdiction over the area where the elephant is proposed to be housed and is outside the jurisdiction of the officer receiving the application under rule 3, within a period of seven days. (3) The concerned Deputy Conservator of Forests shall on receipt of the application and the reports in accordance with sub-rule (2) conduct a detailed inquiry and physical verification of the facility and submit report in Form III within a period of fifteen days to the Chief Wild Life Warden. (4) The Chief Wild Life Warden after examination of the application and the reports may, within a period of seven days by an order in writing reject or permit the transfer. 6. Transfer outside State.- (1) The Chief Wild Life Warden of the donor State shall forward the application along with the reports received as per (c) of sub-rule (1) of rule 4 within a period of fifteen days to the Chief Wild Life Warden of the recipient State. (2) The Chief Wild Life Warden of the recipient State shall within a period of seven days forward the application and the reports to the officer not below the rank of Deputy Conservator of Forests having jurisdiction over the area where the elephant is going to be housed. (3) The concerned Deputy Conservator of Forests shall on receipt of the application and reports in12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] accordance with sub-rule (2) conduct a detailed inquiry and physical verification of the facility and submit report within a period of fifteen days in Form III to the Chief Wild Life Warden. (4) The Chief Wild Life Warden of the recipient State after receipt of the reports as per sub-rule (3) shall forward his recommendations to the Chief Wild Life Warden of the donor State in Form IV within a period of fifteen days. (5) The Chief Wild Life Warden of the donor State after examination of the reports shall, within a period of seven days by an order in writing reject or permit the transfer. (6) The Chief Wild Life Warden of the donor State shall intimate the order of rejection or permission of transfer to the Chief Wild Life Warden of the recipient State. 7. Terms and Conditions for transfer.- (1) The Chief Wild Life Warden shall permit the transfer where the ownership certificate in respect of the elephant proposed for transfer existed prior to coming into force of these rules except in case of elephant borne from such elephants. (2) The transfer of the elephant may be permitted by the Chief Wild Life Warden, in case:- (a) the owner is no longer in a position to maintain the elephant; or (b) the elephant will have a better upkeep than in the present circumstances; or (c) he deems it fit and proper in the circumstances of the case for better upkeep of the elephant. (3) No transfer of an elephant shall be permissible unless genetic profile of the elephant has been entered in the electronic monitoring application of the Ministry of Environment, Forest and Climate Change. 8. Application for Transport of elephant .- (1) An application for transport of an elephant shall be made in Form V to the officer not below the rank of the Deputy Conservator of Forests having jurisdiction over the area where the elephant is registered. (2) The concerned Deputy Conservator of Forests shall, on receipt of the application obtain a report of a veterinary practitioner in Form II and submit his recommendations in Form III along with the report of veterinary practitioner within a period of fifteen days to the Chief Wild Life Warden. (3) The Chief Wild Life Warden may, on receipt of the application and reports in accordance with sub-rule (2), issue a transport permit in Form VI or reject the application by an order in writing. (4) The Chief Wild Life Warden shall forward a copy of the transport permit to:- (a) the concerned Deputy Conservator of Forests within the state through whose jurisdiction the elephant is to be transported; and (b) the concerned Chief Wild Life Warden through whose jurisdiction the elephant is to be transported. 9. Conditions for transport.- (1) The transport of the elephant in respect of which a transport permit has been issued shall be with the following conditions that:- (a) the elephant shall be accompanied by a mahout and an elephant assistant; (b) a health certificate from a veterinary practitioner to the effect that the elephant is fit for transport and is not showing any sign of musth or infectious or contagious disease, is obtained; (c) the transport shall be carried out after the mandatory quarantine period as advised by the veterinary practitioner r is over, in case of contagious disease; (d) the elephant shall be properly fed and given water before loading; (e) necessary arrangements shall be made for providing food and water to the elephant en route; (f) tranquilisers/sedatives shall be used to control nervous or temperamental elephants upon prescription by the veterinary practioner. 10. Validity.- (1) The transfer of the elephant shall be effected within a period not exceeding three months from the date of grant of permission. (2) The validity of the transport permit shall not be more than one month. (3) No extension of validity of permission for transfer or transport permit shall be granted. 11. Appeal .- (1) An applicant aggrieved by the refusal of the Chief Wild Life Warden may prefer an appeal to the administrative Head of the State Forest Department of the concerned State Government within a period of sixty days from the date of receipt of the orders of the Chief Wild Life Warden by a written statement sent through registered post justifying reasons for preferring an appeal.
