और, केंद्रीय सरकार द्वारा ईक्त प्रारूप प जनयमं के सम् बन्ध म ें िनता स े प्राप् त अपजियं और सुझावं पर जवचार कर जलया गया ह;ै ऄत:, ऄब केन् द्रीय सरकार, मोटर यान ऄजधजनयम, 1988 (1988 का 59) की धारा 59 की ईप-धारा (4) और धारा 64 के खंड (त) द्वारा प्रदत् त िजययं का प्रयोग करत े हुए जनम्न जलजखत जनयम बनाती ह,ै ऄथागत्:- 1. संजिि नाम और प्रारंभ - (1) आन जनयमं का संजिप् त नाम मोटर यान (यान स्ट्रैपपग सुजवधा का रजिस्ट् रीकरण और काय)ग 2024 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] संिोधन जनयम, 2024 कहा िाएगा। (2) यह रािपत्र म ें ईनके प्रकािन की तारीख स ेलागू हंगे। 2. मोटर यान (यान स्ट्रैपपग सुजवधा का रजिस्ट् रीकरण और काय)ग जनयम, 2021 (जिसे आसमें आसके बाद ईय जनयम कहा िाएगा) म,ें जनयम 5 म ें- (क) ईप-जनयम (ख) के स्ट्थ ान पर जनम्नजलजखत खंड को रखा िाएगा, ऄथागत:् - '' (ख) आकाइ को ईस राज्य या संघ राज्य ित्रे के प्रदषू ण जनयंत्रण बोड ग स े स्ट्थाजपत करन े की सहमजत के जलए ऄनुमोदन प्राि करना होगा जिसम ें रजिस्ट् रीकृत वाहन स्ट्रैपपग सुजवधा को स्ट्थाजपत करन े का अिय ह।ै '' (ख) ईप-जनयम (च) के स्ट्थान पर जनम्नजलजखत खडं रखा िाएगा, ऄथागत्:- ''आकाइ को प्रदषू ण जनयंत्रण बोडग स े संचालन की सहमजत प्राि करनी होगी या संचालन िुरूप होने की तारीख स े कम स े कम 60 ददन पहल े आसके जलए अवेदन करना होगा।'' (ग) ईप-जनयम (ि) म,ें " ओरेंि श्रेणी" िब्द का जवलोप दकया िाएगा। 3. ईय जनयमं के जनयम 7 के ईप-जनयम (5) का जवलोप दकया िाएगा। 4. ईय जनयमं के जनयम (10) में (क) ईप-जनयम (1) के खंड (viii) में, "रसीद प्राि करें" िब्दं के पश् चात,् "(वास्ट्तजवक / जडजिटल)" िब्द ऄंतःस्ट्थाजपत दकया िाएगा। (ख) ईप-जनयम (1) के खंड (xii) म,ें "दो वषग" िब्दं के स्ट्थान पर "तीन वषग" िब्द रख ेिाएंगे। (ग) ईप-जनयम (1) के खंड (xiii) म,ें जनम्नजलजखत परंतुक रखा िाएगा: "सरकारी स्ट्वाजमत्व वाले वाहनं या दकसी प्रवतगन ऄजभकरण द्वारा सौंपे गए िब्त वाहनं के जवरूप द्ध िारी िमा प्रमाण पत्र पर कोइ प्रोत्साहन ईपलब्ध नहीं होगा और ऐसा िमा सीडी आलेक्रॉजनक रूप प स ेव्यापार योग्य नहीं होगा। 5. ईय जनयमं के जनयम (14) म ें (क) ईप-जनयम (1) के स्ट्थान पर जनम्नजलजखत रखा िाएगा, ऄथागत ् :- "रजिस्ट् रीकृत स्ट्रैपर केंद्रीय मोटर यान जनयम, 1989 के जनयम 126 के ऄधीन जनर्ददष्ट दकसी भी ऄजभकरण द्वारा रजिस्ट् रीकृत वाहन स्ट्रैपपग सुजवधा के ऑजडट का समय पर करवाना सुजनजित करेगा। (क) जनयामक और ऄनुपालन लखे ा परीिा; और (ख) रजिस्ट् रीकृत वाहन स्ट्रैपपग सुजवधा द्वारा प्ररूप प-3 म ें रख े गए मास फ्लो स्ट्टेटमेंट की लेखा परीिा। (ख) ईप-जनयम (2) का लोप दकया िाएगा और आस प्रकार जवलांप दकए गए ईप-जनयम (2) के पश् चात,् ईसके ईप- जनयम (3), (4), (5) और (6) को ईप-जनयम (2), (3), (4) और (5) के रूप प म ेंपुन: संख् यांदकत दकया िाएगा। 6. ईय जनयमं के प्ररूप प 2 म ें मद संख्या (1) म ें (क) ईप-मद (ड.) म,ें "पैन" िब्द के पश् चात,् जनम्नजलजखत िब्द ऄतं :स्ट्थ ाजपत दकए िाएंगे: - "या टैन (केवल सरकारी वाहनं के जलए)"।[भाग II—खण् ड 3(i)] भारत का रािपत्र : ऄसाधारण 3 (ख) ईप-मद (च) म,ें "बैंक खाता" िब्दं के पश् चात,् जनम्नजलजखत िब्द ऄंत:स्ट् थाजपत दकए िाएगं े: - "(सरकारी स्ट्वाजमत्व वाल े वाहनं के जलए, बैंक खाता भारत कोि या संबंजधत सरकारी जवभाग या जनकाय द्वारा जनर्ददष्ट कोइ ऄन्य खाता हो सकता ह।ै )" [फा. स.ं अरटी-23013/01/2018-टी] महमूद ऄहमद, ऄपर सजचव रटप्प ण : मलू जनयम भारत के रािपत्र, ऄसाधारण, भाग-II, खंड 3, ईप धारा (i) म ें ऄजधसचू ना संख्या सा.का.जन. 653(ऄ), तारीख 23 जसतंबर, 2021 द्वारा प्रकाजित दकए गए थ े और ऄजधसूचना संख् या सा.का.जन 695 (ऄ), तारीख 13 जसतंबर 2022 द्वारा ऄंजतम बार संिोजधत दकया गया। MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 15th March, 2024 G.S.R. 212(E).—WHEREAS, draft of the Motor Vehicles (Registration and Functions of Vehicle Scrapping Facility) Amendment Rules, 2024 was published, as required under sub-section ( of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification in G.S.R. 57(E), dated 194h January, 2024 of the Ministry of Road Transport and Highways in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i) inviting objections and suggestions from all persons thereby before the expiry of the period of thirty days from the date on which copies of the Official Gazette containing the draft rules were made available to the public; AND WHEREAS copies of the said notification were made available to the public on the 23rd January, 2024; AND WHEREAS the objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government; NOW, THEREFORE, in exercise of the powers conferred sub- section (4) of section 59 and clause (p) of section 64 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Motor Vehicles (Registration and Functions of Vehicle Scrapping Facility) Rules, 2021, namely: 1. Short title and commencement. - (1) These rules may be called the Central Motor Vehicles (Registration and Function s of Vehicle Scrapping Facility) Amendment Rules, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Motor Vehicles (Registration and Functions of Vehicle Scrapping Facility) Rules, 2021, (hereinafter referred as the said rules), in rule 5,- (a) for clause (b), the following clause shall be substituted, namely: "b) The entity shall have an approval for consent to establish from the Pollution Control Board of the State or Union territory in which the Registered Vehicle Scrapping Facility is intended to be located."; (b) for clause (f), the following clause shall be substituted, namely: "The entity shall have obtained Consent to Operate from Pollution Control Board, or shall have applied for the same, at least 60 days prior to the date of commencement of operations.”; (c) in clause (h), the words "the orange category of" shall be omitted. 3. The sub rule (5) of rule 7 of the said rules, shall be omitted. 4. In rule 10 of the said rules,- (a) in clause (vii) of sub-rule (1), after the words "obtain a receipt", the words "(physical/ digital)" shall be inserted; (b) in clause (xii) of sub rule (1), for the words "two years" the words "three years" shall be substituted; (c) for clause (xiii) of sub rule (1), the following proviso shall be substituted, namely:-4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] "The Certificate of Deposit shall be electronically tradeable and there shall be no incentives on Certificate of Deposit issued against the Government-owned vehicle or impounded vehicle handed over by an Enforcement agency and such Certificate of Deposit shall not be electronically tradeable.". 5. In rule 14 of the said rules,- (a) for sub rule (1), the following shall be substituted, namely: "The Registered Scrapper shall ensure timely conduct of audit of the Registered Vehicle Scrapping Facility by any of the agencies specified under rule 126 of the Central Motor Vehicles Rules, 1989 to undertake, (a) regulatory and compliance audit and (b) audit of the mass flow statement as maintained in Form- by the Registered Vehicle Scrapping Facility."; (b) sub rule (2) shall be omitted and after sub rule (2) as so omitted, sub-rules (3), (4), (5) and (6) thereof shall be renumbered as sub-rules (2), (3), (4) and (5). 6. In FORM 2, item no 1 of the said rules, (a) in sub-item (E), after the word PAN", the following shall be inserted, namely:- "or TAN (for Government Vehicles onty)"; (b) in sub-item (F), after the words "Bank Account", the following shall be inserted, namely:- "(for Government owned vehicles, the bank account may be Bharat Kosh or any other account specified by the concerned Government Department)" [F.
