प्रारूप, मोटर यान ऄजधजनयम, 1988 (1988 का 59) की धारा 212 की ईपधारा (1) के ऄधीन यथाऄपेजित, भारत के
राजपत्र, ऄसाधारण, भाग 2, खंड 3, ईपखंड (i) म ें भारत सरकार के सड़क पररवहन और राजमागग मंत्रालय की ऄजधसूचना
सं. सा.का.जन. 192(ऄ), तारीख 10 माच,ग 2022 म ें प्रकाजित दकए गए थ,े जजसम ें ईन सभी व् यजययं स,े जजनके ईससे
प्रभाजवत होने की संभावना थी, ईस तारीख स,े जजसको ईक्त ऄजधसूचना को ऄतं र्ववष्ट करन े वाल े राजपत्र की प्रजतयां

और, ईक्त राजपत्र, जजसमें ईय ऄजधसूचना प्रकाजित की गइ थी, की प्रजतयां जनता को 11 माचग, 2022 को ईपलब्ध
करा दी गइ थी ;
और, ईक्त प्रारूप जनयमं के संबंध म ें जनता स े प्राप् त अिेपं और सुझावं पर केंद्रीय सरकार द्वारा सम्यक् रूप स े
जवचार कर जलया गया ह ै;
ऄत:, ऄब, केंद्रीय सरकार, मोटर यान ऄजधजनयम, 1988 (1988 का 59) की धारा 59 की ईपधारा (4) और धारा
64 के खंड (त) द्वारा प्रदत्त िजययं का प्रयोग करते हुए, जनम्नजलजखत जनयम बनाती ह,ै ऄथातग ् :--
1. संजिप् त नाम और प्रारंभ—(1) आन जनयमं का संजिप् त नाम मोटर यान (यान स्ट्रेपपग सुजवधा का रजजस्ट्रीकरण
और काय)ग संिोधन जनयम, 2022 ह ै ।
(2) ये राजपत्र म ें ईनके प्रकािन की तारीख को प्रवृत्त हंग े ।

2. मोटर यान (यान स्ट्रेपपग सजु वधा का रजजस्ट्रीकरण और काय)ग जनयम, 2021 (जजसे आसम ेंआसके पश्चात् ईय जनयम कहा
गया ह)ै के जनयम 3 के ईपजनयम (1) म,ें खंड (ग) के स्ट्थान पर, जनम्नजलजखत रखा जाएगा, ऄथागत्: --
“(ग) “जनिपे प्रमाणपत्र” स ेरजजस्ट् रीकृत यान स्ट् रेपपग सुजवधा द्वारा और जनरुपण के जलए ईय रजजस्ट् रीकृत यान स्ट् रेपपग सुजवधा
के जलए रजजस्ट् रीकृत स्ट् वामी स ेयान के जमा की मान् यता के जलए, जारी दकया गया प्रमाणपत्र ऄजभप्रेत ह;ै”।
3. ईय जनयमं के जनयम 4 म,ें--
(क) ईपजनयम (2) का लोप दकया जाएगा ;
(ख) ईपजनयम (3) म,ें “के साथ-साथ स्ट्थानीय पुजलस” िब्दं का लोप दकया जाएगा ।
4. ईय जनयमं के जनयम 5 के खंड (ज) म,ें--
(क) “औद्योजगक ित्रे ” िब्दं का लोप दकया जाएगा ;
(ख) ईपखडं (i) का लोप दकया जाएगा ।
5. ईय जनयमं के जनयम 6 के ईपजनयम (1) के खडं (ii) म,ें “जमा नब्ब े ददन” िब्दं का लोप दकया जाएगा ।
6. ईय जनयमं के जनयम 7 के ईपजनयम (5) म,ें “आस जनयम” िब्दं के पश्चात,् “और जनयम 6” िब्द और ऄकं ऄतं : स्ट्थाजपत
दकए जाएंग े।
7. ईय जनयमं के जनयम 10 के ईपजनयम (1) म,ें--
(क) अरंजभक पैरा म,ें “रजजस्ट्रीकृत स्ट्रैपर” िब्दं के स्ट्थान पर, “रजजस्ट्रीकृत यान स्ट्रैपपग सुजवधा” िब्द रख े जाएंग े;
(ख) खडं (ii) स े खंड (xxi) के स्ट्थान पर, जनम्नजलजखत खडं रखे जाएंगे, ऄथागत ् :--
“(i) रजजस्ट्रीकृत स्ट्वामी, रजजस्ट्रीकृत यान स्ट्रैपपग सुजवधा या जमा करने के जलए ऄजभजहत सग्रं ह केंद्र पर यान को जमा करने
और अगे जनरूपण के जलए, प्ररूप-2 के ऄनुसार वाहन पर जडजजटल रूप स ेअवेदन करेगा ।
(ii) रजजस्ट्रीकृत यान स्ट्रैपपग सजु वधा और ऄजभजहत सग्रं ह केंद्र, प्ररूप-2 म ें जडजजटल अवेदन करने म ेंनागररकं की सहायता के
जलए सुजवधा केंद्र के रूप म ें भी कायग करेंग े ।
(iii) रजजस्ट्रीकृत यान स्ट्रैपपग सजु वधा द्वारा सत्यापन के जलए, रजजस्ट्रीकृत स्ट्वामी द्वारा प्ररूप-2 के साथ जनम्नजलजखत दस्ट्तावेज
ऄपलोड दकए जाएगं ,े ऄथागत् :--
(क) स्ट्वामी की पहचान और ईसके पते का सबूत, जैसे पासपोट,ग वोटर काडग, अधार काड,ग पररचालन ऄनुज्ञजि या केंद्रीय
सरकार या राज्य सरकार द्वारा जारी ऄन्य सुसंगत पहचान काडग ;
(ख) यदद यान स्ट्वामी द्वारा प्रस्ट्तुत नहीं दकया जाता ह ैतो, प्ररूप- 2 के पैरा 5 के ऄनुसार लाग ू प्राजधकृत प्रजतजनजध के
जलए स्ट्टांप पेपर पर प्राजधकार पत्र ;
(ग) प्राजधकृत प्रजतजनजध (यदद लाग ू हो) की पहचान और ईसके पते का सबूत, जैसे पासपोट,ग वोटर काड,ग अधार काड,ग
पररचालन ऄनज्ञु जि या केंद्रीय सरकार या राज्य सरकार द्वारा जारी ऄन्य सुसंगत पहचान काडग ।
(iv) स्ट्वामी या ईसका प्राजधकृत प्रजतजनजध, रजजस्ट्रीकृत यान स्ट्रैपपग सुजवधा को रजजस्ट्रीकरण के मलू प्रमाणपत्र के साथ यान
प्रस्ट्तुत करेगा और प्ररूप-2क के ऄनुसार जडजजटल वचनबधं पर हस्ट्तािर करेगा ।
(v) रजजस्ट्रीकृत यान स्ट्रैपपग सजु वधा भी प्ररूप-2ख के ऄनुसार जडजजटल वचनबंध पर हस्ट्तािर करेगा ।
(vi) दकसी प्रवतगन ऄजभकरण द्वारा पररबद्ध यान, रजजस्ट्रीकृत यान स्ट्रैपपग सुजवधा को सौंपे जाएंगे, यदद वे यान स्ट्रैपपग के
जलए जनयम 8 म ेंईपबंजधत मानदंड को पूरा करते ह ैं।
(vii) रजजस्ट्रीकृत यान स्ट्रैपपग सुजवधा, स्ट्रैपपग के जलए प्रस्ट्तुत यानं के ऄजभलेख का वाहन पोटगल के माध्यम स े सत्यापन
करेगा, जजसम ें राष्ट्रीय ऄपराध ररकाडग ब्यरू ो द्वारा धाररत चोरी हुए वाहनं के डाटाबेस स े सत्यापन सजम्मजलत ह ै।
(viii) रजजस्ट्रीकृत यान स्ट्रैपपग सुजवधा, यान के जलए तय प्रजतफल का, पाने वाले के खाते म ेंदये चैक द्वारा या जडजजटल रूप स े
संदाय करेगा और ईसके जलए स्ट्वामी या ईसके प्राजधकृत प्रजतजनजध स े ऄजभलेख हते ु रसीद प्राि करेगा ।[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3
(ix) दकसी राज्य म ें स्ट्थाजपत रजजस्ट् रीकृत यान स्ट् रैपपग सुजवधा, स्ट्वामी या ईसके प्राजधकृत प्रजतजनजध की ईपजस्ट्थजत म ें
रजजस्ट्रीकरण प्रमाणपत्र को जवरूजपत या जछदद्रत करेगा और स्ट्र ैपपग के जलए वाहन की स्ट्वीकृजत के साक्ष्य म ेंरूप म,ें प्ररूप-2ग
के ऄनुसार, वाहन म ें जमा का जडजजटल रूप स े हस्ट्तािररत प्रमाणपत्र जारी करेगा ।
(x) दकसी राज्य म ें स्ट्थाजपत रजजस्ट्रीकृत यान स्ट्रैपपग सुजवधा, दकसी रजजस्ट् रीकरण प्राजधकरण की ऄजधकाररता के ऄधीन दकसी
भी राज्य या संघ राज्य िेत्रं म ेंरजजस्ट् रीकृत यानं को स्ट्वीकार और स्ट्रैप कर सकेगा ।
(xi) पूरी प्रदरया, दकसी भी यान रजजस्ट् रीकरण प्राजधकरण की ऄवजस्ट् थजत पर ध् यान ददए जबना, ऄजखल भारतीय अधार पर
वाहन के साथ सुचारू रूप स े जड़ु ी होगी ।
(xii) जनिेप प्रमाणपत्र, स्ट् वामी के जलए एक नया यान खरीदन ेके जलए, समय-समय पर घोजित प्रोत्साहन और फायदा प्राप् त
करने के जलए अवश्यक और पयागि दस्ट्तावेज होगा ईय प्रमाणपत्र की वैधता जारी दकए जाने की तारीख स े दो वि ग होगी।
(xiii) जनिेप प्रमाणपत्र, आलैक्र ोजनक रूप स े जवजनमय योग्य होगा ।
(xiv) जनिेप का ऄंतरण प्रमाणपत्र, प्रत्येक नए स्ट्वामी के जलए प्ररूप-2घ के ऄनुसार व्यावसाजयक मंच पर सृजजत दकया जाएगा
और जनिेप के प्रमाण पर, ईसका एक बार ईपयोग कर जलए जाने के बाद िेत्रीय पररवहन कायागलय या ईय प्रमाणपत्र के
धारक को लाभ प्रदान करन े वाले व्यवहारी द्वारा वाहन डाटाबेस म ें “जनरस्ट्त” का जचन्ह लगा ददया जाएगा ।
(xv) िेत्रीय पररवहन कायागलय या जनिेप प्रमाणपत्र के जवरुद्ध रय दकए गए नए यान को रजजस्ट्रीकृत करन े वाला व्यवहारी
जनिेप प्रमाणपत्र को जडजजटल रूप स े सत्याजपत और ऄजधप्रमाजणत करेगा ।
(xvi) रजजस्ट्रीकृत यान स्ट्रैपपग सुजवधा, जजस राज्य म ें यान का रजजस्ट्रीकरण हुअ ह,ै यान के रजजस्ट्रीकरण को जनरस्ट्त करान े
के जलए सड़क यातायात या िेत्रीय पररवहन कायागलय को यान स्ट्रैपपग के प्रमाणपत्र के साथ रजजस्ट्रीकरण (जवरूजपत या
जछदद्रत) के मलू प्रमाणपत्र के भौजतक पारेिण की प्रदकया असान बनाएगा ।
(xvii) रजजस्ट्रीकृत यान स्ट्रैपपग सुजवधा, जनयम 11 के ऄधीन जारी यान स्ट्रैपपग के प्रमाणपत्र के जारी होन े की तारीख स ेछह
मास की ऄवजध के जलए चेजसस के नंबर के कटे हुए टुकड़ं को सरु जित ऄजभरिा म ेंरखगे ा ।
(xviii) रजजस्ट्रीकृत यान स्ट्रैपपग सुजवधा, जनरीिण के दौरान ररकाडग और जांच के जलए दस साल की ऄवजध के जलए सभी
दस्ट्तावेजं की जडजजटल स्ट्कैन प्रजत को सुरजित रखगे ा ।
(xix) रजजस्ट्रीकृत यान स्ट्रैपपग सुजवधा यह सुजनजश्चत करेगा दक स्ट्रैप दकए गए यान के पररसंकटमय भागं को हटान े या
पुनचगरण या जनपटान, चलने वाले यानं की समाजि का पयागवरण ऄनुकूलन प्रबंधन के जलए केंद्रीय प्रदिू ण जनयंत्रण बोडग द्वारा
जारी ददिा जनदेिं के ऄनुसार दकया गया ह ै।
(xx) यानं को तब तक स्ट्रैप नहीं दकया जाएगा, जब तक ईंधन, तेल, जमावरोधी या ऄन्य गसै ं, तरल पदाथों को प्रमाजणत
मानक कंटेनरं म ेंसुखाया या एकजत्रत नहीं कर जलया जाता ह ै।
(xxi) स्ट्रैप यानं का जडजजटल रजजस्ट्टर प्ररूप-3 म ें सुरजित रखा जाएगा ।”।
8. ईय जनयमं के जनयम 11 म,ें ईपजनयम (1) के स्ट्थान पर, जनम्नजलजखत ईपजनयम रखा जाएगा, ऄथातग ्: --
“(1) अवश्यक जनरूपण के पश्चात्, रजजस्ट्रीकृत यान स्ट्रैपपग सुजवधा, प्ररूप-4 के ऄनुसार चेजसस को काटने के जडजजटल फोटो
सजहत यान के स्ट् रेपपग का जडजजटल प्रमाणपत्र जारी दकया जाएगा, जजससे वाहन डाटाबेस को ऄद्यतन दकया जा सके और यान
के ररकाडग को ऄद्यतन करन े के जलए राज्य सरकार या संघ राज्यिेत्र प्रिासन के सिम प्राजधकारी को सूजचत दकया जाएगा ।”।
9. ईय जनयमं के जनयम 13 म,ें--
(क) ईपजनयम (8) के खंड (ख) म,ें “छोटे-छोटे टुकड़े करना, कतगन, बेपलग” िब्दं का लोप दकया जाएगा ;
(ख) ईपजनयम (12) के स्ट्थान पर, जनम्नजलजखत ईपजनयम रखा जाएगा, ऄथागत ् :--

NOTIFICATION
New Delhi, the 13th September, 2022
G.S.R. 695(E).—Whereas, draft of the Motor Vehicles (Registration and Functions of Vehicle Scrapping
Facility Amendment) Rules, 2022 was published, as required under sub-section (1) of section 212 of the Motor
Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and
Highways number G.S.R. 192 (E), dated the 10th March, 2022 in the Gazette of India, Extraordinary, Part-II, Section
3, Sub-section (i) inviting objections and suggestions from all persons likely to be affected thereby before the expiry
of the period of thirty days from the date on which copies of the Official Gazette containing the said notification were
made available to public;
And, whereas, copies of the said Official Gazette in which the said notification was published, were made
available to the public on the 11th March, 2022;
And, whereas, the objections and suggestions received from the public in respect of the said draft rules have
been duly considered by the Central Government;
Now, therefore, in exercise of the powers conferred by sub-section (4) of section 59 and clause (p) of section
64 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules, namely:
—
1. Short title and commencement.— (1) These rules may be called the Motor Vehicles (Registration and Functions
of Vehicle Scrapping Facility) Amendment Rules, 2022.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Motor Vehicles (Registration and Functions of Vehicle Scrapping Facility) Rules, 2021, (hereinafter referred
as the said rules), in sub-rule (1) of rule 3, for clause (c), the following shall be substituted, namely: —[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 13
―(c) ―Certificate of Deposit‖ means the certificate issued by the Registered Vehicle Scrapping Facility to
recognise the submission of the vehicle from the registered owner to the said Registered Vehicle Scrapping Facility
for further treatment;‖.
3. In rule 4 of the said rules, —
(a) sub-rule (2) shall be omitted;
(b) in sub-rule (3), the words ―as well as with the local Police‖ shall be omitted.
4. In rule 5 of the said rules, in clause (h), —
(a) the words ―industrial zone‖ shall be omitted;
(b) sub-clause (i) shall be omitted.
5. In rule 6 of the said rules, in sub-rule (1), in clause (ii), the words ―, plus ninety days‖ shall be omitted.
6. In rule 7 of the said rules, in sub-rule (5), after the words ―under this rule‖, the words and figure ―and rule 6‖ shall
be inserted.
7. In rule 10 of the said rules, in sub-rule (1), —
(a) in the opening paragraph for the words ―Registered Scrapper‖, the words ―Registered Vehicle Scrapping Facility‖
shall be substituted;
(b) for clauses (i) to (xxi), the following clauses shall be substituted, namely: —
―(i) The registered owner shall apply digitally on Vahan as per Form-2 to the Registered Vehicle Scrapping
Facility or the designated Collection Centre for deposit and further treatment of the vehicle.
(ii) The Registered Vehicle Scrapping Facility and the designated Collection Centre shall also act as facilitation
centres to support citizens with digital application of Form-2;
(iii) The following documents shall be uploaded along with Form-2 by the registered owner for verification by the
Registered Vehicle Scrapping Facility, namely:—
(a) identity and address proof of the owner such as passport, voter card, Aadhar card, driving license or other
relevant identity card issued by the State Government or the Central Government;
(b) letter of authorisation on stamp paper for the authorised representative as per para 5 of Form-2,
applicable, if the vehicle is not to be submitted by the owner;
(c) identity and address proof of the authorized representative (if applicable) such as passport, voter card,
Aadhar card, driving license or other relevant identity card issued by the State Government or the Central
Government.
(iv) The owner or his authorised representative shall submit the vehicle along with the original certificate of
registration to the Registered Vehicle Scrapping Facility and sign a digital undertaking as per Form-2A.
(v) The Registered Vehicle Scrapping Facility shall also sign a digital undertaking as per Form-2B
(vi) Vehicles impounded by an enforcement agency shall be handed over to the Registered Vehicle Scrapping
Facility, if they meet the criteria for vehicle scrapping as provided under rule 8.
(vii) The Registered Vehicle Scrapping Facility shall verify the records of the vehicles produced for scrapping
through the Vahan portal including verification with the database of the stolen vehicles held by National Crime
Records Bureau.
(viii) The Registered Vehicle Scrapping Facility shall digitally remit or pay by an account payee cheque, the
agreed consideration for the vehicle and obtain a receipt for the same from the owner or his authorised
representative for record.
(ix) The Registered Vehicle Scrapping Facility shall deface or punch the certificate of registration in the presence
of the owner or his authorised representative and issue a digitally signed Certificate of Deposit in Vahan, as per
Form-2C, as evidence of acceptance of vehicle for scrapping.14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(x) The Registered Vehicle Scrapping Facility established in a State may accept and scrap the vehicles registered
in any of the State or Union territory under the jurisdiction of any Registration Authority.
(xi) The whole process shall be seamlessly linked with Vahan on all India basis irrespective of the location of any
vehicle registering authority.
(xii) The Certificate of Deposit shall be a necessary and sufficient document for the owner to avail incentives and
benefits for purchase of a new vehicle as may be declared from time to time and the validity of the said certificate
shall be two years from the date of issuance.
(xiii) The Certificate of Deposit shall be electronically tradeable.
(xiv) The transfer Certificate of Deposit shall be generated on the trading platform for each new owner as per
Form- 2D and the Certificate of Deposit once utilised shall be marked ―Cancelled‖ in the Vahan database by the
regional transport office or dealer providing the benefits to the bearer of the said certificate.
(xv) The regional transport office or dealer registering the new vehicle purchased against the Certificate of
Deposit shall verify and authenticate the Certificate of Deposit digitally.
(xvi) The Registered Vehicle Scrapping Facility shall facilitate the process of physical transmission of original
certificate of registration (defaced or punched) along with Certificate of Vehicle Scrapping to road transport or
regional transport office, in the State of registration of the vehicle, to get the vehicle registration cancelled.
(xvii) The Registered Vehicle Scrapping Facility shall have the cut piece of the chassis number in safe custody for
a period of six months from the date of issue of Certificate of Vehicle Scrapping, issued under rule 11.
(xviii) The Registered Vehicle Scrapping Facility shall maintain digital scanned copy of all documents for a
period of ten years for record and examination during inspection.
(xix) The Registered Vehicle Scrapping Facility shall ensure that removal or re-cycling or disposal of hazardous
parts of the scrapped vehicle is done as per the guidelines issued by the Central Pollution Control Board for
environmentally sound management of End-of-Life Vehicles and AIS-129.
(xx) Vehicles shall not be scrapped until the fuel, oil, antifreeze, and other gases, fluids are drained and collected
in certified standard containers.
(xxi) A digital register of vehicles scrapped shall be maintained in Form-3.‖.
8. In rule 11 of the said rules, for sub-rule (1), the following sub-rule shall be substituted, namely: —
―(1) The Registered Vehicle Scrapping Facility, after completing the necessary treatment, shall issue a digital
Certificate of Vehicle Scrapping, including a digital photograph of the cut out of the chassis, in Form-4 to update the
VAHAN Database and inform the competent authority of the State Government or Union territory Administration for
updating of records of the vehicle.‖.
9. In rule 13 of the said rules, —
(a) in sub-rule (8), in clause (b), the words ―shredding, shearing, bailing‖ shall be omitted;
(b) for sub-rule (12), the following sub-rule shall be substituted, namely: —
―(12) A Registered Vehicle Scrapping Facility may establish any collection centre at any other place, other than
the Scrapping Yard and, if collection Centre undertakes activities such as, depollution and dismantling, then, the
requirements applicable for a Registered Vehicle Scrapping Facility shall also be applicable to such Collection
Centre.‖.
10. In rule 14 of the said rules, in sub-rule (4), after the words ―Registered Scrapper‖, the words ―and the cost of said
audit and assessment shall be borne by the operator of such facility‖ shall be added.
