अत:, अब केन्द रीय सरकार, मयार यान अजधजनयम, 1988 (1988 का 59) की धारा 137 के खंड (कक) द्वारा
प्रदत् त िजक्त यस का प्रययग करत े एए, केन्द रीय मयार यान जनयम, 1989 का और संियधन करन े के जलए जनम्न जलजखत जनयम
बनाती ह, अथागत ्:-
1. संजि् त नाम और प्रारंभ.- (1) इन जनयमस का संजि् त नाम केन्द रीय मयार यान (दसू रा संियधन) जनयम, 2022 ह ।
(2) इन जनयमस म ेंअन्द यथा उपबंजधत के जसवाय, ये राजपत्र में इनके प्रकािन की तारीख से प्रवृत् त हसग े।

2. केन्द रीय मयार यान जनयम, 1989 के जनयम 138 के उपजनयम (6) के पश् चात् जनम्न जलजखत उपजनयम अंत:स्ट्थ ाजपत दकए
जाएंगे :-
“(7) केन्द रीय मयार यान (दसू रा संियधन) जनयम, 2022 के प्रकािन की तारीख से एक वर्ग के पश् चात ् मयारसाइदकल
चालक कय नौ माह से चार वर् ग की आयु के बालक कय पीछे की सीा पर ले जात े समय जनम्न जलजखत सुरिापायस का पालन
सुजनजश् चत करना हयगा, अथागत्:-
(i) चार साल से कम उम्र के बालकस के जलए, बालक कय मयारसाइदकल के चालक से जयड़ने के जलए सफ्े ाी हानेस का
उपययग दकया जाएगा ।
स्ट् पष्ा ीकरण :- सेफ्ाी हानेस बालक द्वारा पहना जाने वाला एक वेस्ट् ा ह, जय सामाययजजत करने ययग् य हयगा, जजसमें वेस्ट् ा स े
जुडी परियस की एक जयडी और चालक द्वारा पहन े जाने वाल े ियल् डर लू् स हसगे द्य इस तरह, बच् चे का ऊपरी धड़, चालक
से सुरजित रूप स े जुड़ा हयगा । इसकी यही जविेर्ता ह जजसके द्वारा ध् यान रखा जाता ह वह यह ह दक परियस कय बजनयान
के पीछे से जयड़कर और परियस कय वेस्ट् ा के ऊपर से पार करता ह तादक दय बड़े क्रॉससग-ओवर लपू बन जाएं जय यात्री के
प रस के बीच से गुजरते ह ैंऔर बालक दपु जहया की सीा पर बठ जाता ह । भारतीय मानक ्य ूरय अजधजनयम, 2016 (2016
का 11) के अधीन भारतीय मानक ् यूरय द्वारा जवजनदेि जवजहत दकए जाने तक सेफ्ाी हानेस सजहत सुरिात् मक जगयर
जनम्न जलजखत आवश् यकतां कय पूरा करेगा :
सेफ्ाी हानेस के जवजनदेि
(क) हल् का वहन, समाययज्य , जलरयधक और राकाऊ ;
(ख) भारी नायलॉन/पयाग् त कुिसनग युक् त उच् च घनत् व फयम वाली मल् ाीदफलामेंा सामरी ;
(ग) 30 दकलय तक भार वहन करने की िमता के जलए जडजाइन दकया जाएगा ।

1080/बीएस ईएन 1078] का अनुपालन करता हय और उससे जसर पर दफा ब ठता हय या साइदकल हले मेा पहनना चाजहए
जब तक दक भारतीय मानक ्य ूरय अजधजनयम, 2016 (2016 का 11) के अधीन भारतीय मानक ् यूरय द्वारा जवजनदेि
जनधागररत नहीं दकए जाते ह ैं।
(iii) चार वर्ग तक के बालक कय पीछे जबठाने वाल े मयारसाइदकल की गजत 40 दकमी प्रजत घंाे स े अजधक नहीं हयनी
चाजहए।”।

NOTIFICATION
New Delhi, the 15th February, 2022
G.S.R. 126(E).—Whereas, the draft rules further to amend the Central Motor Vehicles Rules,1989
were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of
1988), vide notification of the Government of India in the Ministry of Road Transport and Highways,
number G.S.R. 758(E), dated the 21st October, 2021, in the Gazette of India, Extraordinary, Part II, Section
3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before
the expiry of the period of thirty days from the date on which copies of the Gazette notification containing
the draft rules were made available to the public;
And whereas, copies of the said Gazette notification were made available to the public on the
25th October, 2021;
AND whereas, the objections and suggestions received from the public in respect of the said draft
rules were considered by the Central Government;
Now, therefore, in exercise of the powers conferred by clause (aa) of section 137 of the Motor
Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to
amend the Central Motor Vehicles Rules, 1989, namely:-
1. Short title and commencement. – (1) These rules may be called the Central Motor Vehicles (Second
Amendment) Rules, 2022.
(2) Save as otherwise provided in these rules, they shall come into force on the date of their publication
in the Official Gazette.
2. In the Central Motor Vehicles Rules, 1989, in rule 138, after sub-rule (6), the following sub-rule shall be
inserted, namely: -
“(7) After one year from the date of publication of the Central Motor Vehicles (Second Amendment)
Rules, 2022, the driver of a motorcycle shall ensure the following safety measures while carrying a child
between the age of nine months and four years, on the vehicle as a pillion , namely: -
(i) For children below four years, Safety harness shall be used for attaching the child to the driver of the
motorcycle.
Explanation.- Safety harness is a vest to be worn by the child, which shall be adjustable, with a pair of
straps attached to the vest and forming shoulder loops to be worn by the driver. This way, the upper torso of
the child is securely attached to the driver. A feature by which this is achieved is by attaching the straps to
the back of the vest and crossing the straps over the vest so that two large crossing-over loops are formed4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
that pass between the legs of the passenger and child sits on the seat of the two-wheeler. The protective
gear including Safety harness shall meet the following requirements till such time the specifications are
prescribed by the Bureau of Indian Standards under the Bureau of Indian Standards Act, 2016 (11 of
2016):-
Specifications of Safety harness
(a) Light weight, adjustable, waterproof and durable;
(b) Heavy nylon/ multi-filament nylon material with high density foam with sufficient cushioning;
(c) Shall be designed to hold weight upto 30 kg.

(ii) Crash helmet: The driver shall ensure that the child pillion passenger aged between nine months and
four years must wear his own crash helmet which fits his head or wear bicycle helmet complying with
[ASTM 1447]/ [European (CEN)BS EN 1080/BS EN 1078] till such time that the specifications are
prescribed by the Bureau of Indian Standards under the Bureau of Indian Standards Act, 2016 (11 of 2016).
(iii) The speed of the motorcycle with the child upto age four years being carried as a pillion, shall not be
more than 40 kmph.”.
