ORDER
Whereas, the Mines and Minerals (Development and Regulation) Act, 1957
(hereinafter, ‘the Act’) was enacted to provide for development and regulation of
mines and minerals in the country.
And whereas, the said Act has been amended through theMines and
Minerals (Development and Regulation) Amendment Act, 2025 (hereinafter,
‘MMDR Amendment Act, 2025’) with effect from 01.09.2025.
And whereas, sub-section (7A) of Section 8A of the Act has been amended
through the MMDR Amendment Act, 2025, allowing the lease holders to sell any
quantity of mineral produced from the mine in a year after meeting the requirement
of its linked end use plant and on payment of additional amount specified in the
Sixth Schedule of the Act.
And whereas, as per the first proviso to sub-section (7A) of Section 8A of
the Act, as amended through the MMDR Amendment Act, 2025, the State
Governments have been empowered to permit sale of dumps which has been
stacked up to such date as may be specified by the Central Government in the
leased area on payment of additional amount specified in the Sixth Schedule of the
Act.
Now therefore, in exercise of the powers conferred by first proviso to sub-
section (7A) of Section 8A of the Act, as amended by the MMDR Amendment Act,
2025, the Central Government hereby specify that the dumps stacked in the leased
area up to the 31st day of August, 2025 may be permitted for sale by State
Government on payment of additional amount specified in the Sixth Schedulg.
