(xiv) तथा उपधारा (3) के साथ परित उपधारा (1) के तहत प्रित्त िजिर्ों का प्रर्ोग करते हुए, िारी करने का जवचार रखती ह,ै को पर्ाावरण (सरं क्षण) जनर्मावली 1986 के जनर्म 5 के उपजनर्म (3) के तहत् र्था अपेजक्षत तथा ऐसे िनसाधारण की िानकारी के जलए प्रकाजित दकर्ा िा रहा ह,ै जिनके उससे प्रभाजवत होन े की संभावना ह,ै और र्ह भी सूजचत दकर्ा िाता ह ै दक उि प्रारूप अजधसूचना पर, उस तारीख स,े जिस तारीख को इस अजधसूचना को अतं र्वाष्ट करने वाल े भारत के रािपत्र की प्रजतर्ा ं उि िनसाधारण को उपलब्ध करा िी िाती ह,ैं साि दिन की अवजध की समाजि पर र्ा उसके पश् चात ्जवचार दकर्ा िाएगा; ऐसा कोई भी व्यजि, िो इस प्रारूप रािगढ़, अलवर, बंसूर एवं मालाखेडा तहसीलों और िर्पुर जिला के िमवारामगढ़ तहसील म ेंपडता ह;ै और िहा ाँ दक, सररस्ट्का वन्द्र्िीव अभर्ारण्र् को रािस्ट्थान सरकार द्वारा अजधसूचना सं. एफ.39 (2) आरईवी.ए/54, तारीख 5 अगस्ट्त, 1958 के माध्र्म से अजधसूजचत दकर्ा गर्ा था, 492 वगा दकलोमीटर वन क्षत्रे संवेिनिील बाघ जनवास म ें और 52.23 वग ा दकलोमीटर रािस्ट्व भूजम क्षत्रे म ें आता ह ै और िमवारामगढ़ अभर्ारण्र्, िो सररस्ट्का बाघ ररज़व ा म ें पडता ह ै को रािस्ट्थान सरकार द्वारा अजधसूचना स.ं एफ 11(22) रािस्ट्थान – 8/78 तारीख 27 अगस्ट्त, 1982 के माध्र्म से अजधसूजचत दकर्ा गर्ा था भी आता ह।ै सररस्ट्का बाघ ररज़वा का संवेिनिील बाघ पर्ाावास को राज्र् सरकार द्वारा अजधसूचना सं.एफ 3(34) वन/2007 तारीख 28 दिसंबर, 2007 के तहत् अजधसूजचत दकर्ा गर्ा था िो क्षेत्रफल 881.11 वगा दकलोमीटर क्षेत्रफल म ें फैला हुआ ह।ै 332.23 वग ा दकलोमीटर का बफर क्षेत्र को अजधसूचना सं. एफ 3 (34) वन/ 2007 तारीख 6 िुलाई, 2012 द्वारा अजधसूजचत दकर्ा गर्ा था। िमवारामगढ़ अभर्ारण्र् का एक भाग सररस्ट्का बाघ ररज़व ा के बफर क्षत्रे म ें िाजमल ह।ै केन्द्र सरकार द्वारा िमवारामगढ़ अभर्ारण्र् के िेष भाग को अजधसूचना संख्र्ा का.आ. 6212 (अ), दिनांक 14 दिसम्बर, 2018 के द्वारा पाररजस्ट्थजतकी संवेिी िोन (ईएसिेड) घोजषत दकर्ा गर्ा ह।ै और िहा ाँ दक, सररस्ट्का अभर्ारण्र् और िमवारामगढ़ अभर्ारण्र् का एक भाग िो सररस्ट्का बाघ ररज़व ा के बफर क्षत्रे म ें आता ह,ै सजहत सररस्ट्का बाघ ररज़वा अपनी अद्भुत िैवजवजवधता और ऊबड खाबड क्षेत्र के कारण उष्णकरटबंधी, िुष्क पणापाती प्रिाजतर्ों, िुष्क कंटीली प्रिाजतर्ों और वनस्ट्पजत और िीविंतु की कई अन्द्र् प्रिाजतर्ों के जलए आश्रर् प्रिान करता ह;ै और र्ह अरावली पवात श्रेजणर्ों का एक अद्भुत जहस्ट्सा ह ैिो दक राज्र् वनों वाल े भागों म ें आता ह ै तथा िैवजवजवधता की िृजष्ट स े भी र्ह एक समृद्ध अभर्ारण्र् ह।ै र्हा ाँ लगभग स्ट्तनपाजर्र्ों की 20 प्रिाजतर्ााँ, सरीसृपों की 11 प्रिाजतर्ााँ, उभर्चरों की 2 प्रिाजतर्ााँ, पजक्षर्ों की 374 प्रिाजतर्ााँ और वनस्ट्पजतर्ों की 420 प्रिाजतर्ााँ अजभज्ञात हुई ह।ैं और िहा ाँ दक, सररस्ट्का बाघ ररज़वा के चारों ओर के संरजक्षत क्षत्रे को, जिसका जवस्ट्तार और सीमाए ं इस अजधसूचना के पैराग्राफ 1 म ें जवजनर्िाष्ट ह,ैं पाररजस्ट्थजतकी, पर्ाावरणीर् और िैव-जवजवधता की िजृ ष्ट स े पाररजस्ट्थजतकी संवेिी िोन के रूप म ें सुरजक्षत और संरजक्षत करना तथा उि पाररजस्ट्थजतकी संवेिी िोन म ें उद्योगों र्ा उद्योगों वगा के संचलन तथा कारोबार का प्रजतषेध करना आवश्र्क ह;ै अतः अब, केन्द्र सरकार, पर्ावा रण (संरक्षण) जनर्मावली, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परित पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (1) और उपधारा (2) के खडं (v) और खंड4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (xiv) एव ं उपधारा (3) के तहत प्रित्त िजिर्ों का प्रर्ोग करते हुए, रािस्ट्थान राज्र् के सररस्ट्का बाघ ररज़वा की सीमा के चारों ओर िून्द्र् स े 1.0 दकलोमीटर तक जवस्ट्ततृ क्षत्रे को सररस्ट्का बाघ ररज़वा के पाररजस्ट्थजतकी संवेिी िोन (जिसे एतजश्मन पश् चात ् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप म ेंअजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह,ै र्था:- 1. पाररजस्ट्थजतकी सवं िे ी िोन का जवस्ट्तार और सीमा.- (1) पाररजस्ट्थजतकी संवेिी िोन की जवस्ट्तार इन अभर्ारण्र्ों अथाात ् सररस्ट्का वन्द्र्िीव अभर्ारण्र् और िमवारामगढ़ वन्द्र्िीव अभर्ारण्र् स े िून्द्र् स े 24 दकलोमीटर तक जवस्ट्तृत ह।ै र्ह सररस्ट्का बाघ ररज़वा की सीमा स े िून्द्र् स े लेकर 1.0 दकलोमीटर तक जवस्ट्तृत ह।ै इस पाररजस्ट्थजतकी संवेिी िोन का क्षेत्रफल 87.73 वगा दकलोमीटर ह।ै दििा जवस्ट्तार सररस्ट्का अभर्ारण्र् और िमवारामगढ़ वन्द्र्िीव सररस्ट्का बाघ ररज़व ास े अभर्ारण्र् स े उत्तर ग्नक –IIख, अनलु ग्नक –IIग, अनलु ग्नक –IIघ और अनलु ग्नक –IIङ के रूप म ें सलं ग्न ह।ै (4) सररस्ट्का बाघ ररज़वा (सारणी-क) और इसके पाररजस्ट्थजतकी संवेिी िोन (सारणी-ख) के अक्षांिों और िेिातं रों को अनलु ग्नक –III म ेंििाार्ा गर्ा ह।ै (5) मख्ु र् हबंिओंु के भ-ू जनिेिाकं ों के साथ-साथ पाररजस्ट्थजतकी संवेिी िोन के अंतगात आने वाले ग्रामों की सूची अनलु ग्नक - IV के रूप म ेंसंलग्न ह।ै 2. पाररजस्ट्थजतकी सवं िे ी िोन की आचं जलक महार्ोिना.– (1) राज्र् सरकार अंजतम रूप से तैर्ार अजधसूचना के सरकारी रािपत्र म ें प्रकािन की तारीख से िो वषा की अवजध के भीतर इस पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए स्ट्थानीर् लोगों के साथ परामिा करके और राज्र् के सक्षम प्राजधकारी के अनुमोिनाथा इस अजधसूचना में दिए गए जनिेिों का पालन करत े हुए एक आंचजलक महार्ोिना तैर्ार करेगी। (2) राज्र् सरकार द्वारा इस पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना इस अजधसूचना म ें जवजनर्िाष् ट रीजत स े तथा प्रासंजगक केंरीर् और राज्र् जवजधर्ों के अनुरूप और राज्र् सरकार द्वारा िारी दििा जनिेिों, र्दि कोई हों, के अनुसार बनार्ी िाएगी। (3) इस आंचजलक महार्ोिना को उि र्ोिना म ें पाररजस्ट्थजतकी और पर्ाावरण संबंधी जवषर्ों को िाजमल करने के जलए राज्र् सरकार के जनम्नजलजखत जवभागों के परामि ास े तैर्ार दकर्ा िाएगा:-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 i. पर्ाावरण; ii. वन और वन्द्र्िीव; iii. कृजष; iv. रािस्ट्व; v. िहरी जवकास; vi. पर्ाटन; vii. ग्रामीण जवकास; viii. जसचांई और बाढ़ जनर्ंत्रण; ix. नगरपाजलका; x. पंचार्ती राि; xi. लोक जनमााण जवभाग; और xii. रािस्ट्थान राज्र् प्रिषू ण जनर्ंत्रण बोडा। (4) िब तक इस अजधसूचना म ें जवजनर्िाष्ट न हो, आंचजलक महार्ोिना म ें वतामान म ें अनमु ोदित भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई प्रजतबंध नहीं लगार्ा िाएगा तथा आचंजलक महार्ोिना म ें सभी अवसंरचनाओं और दक्रर्ाकलापों म ें सुधार करके उन्द्ह े अजधक कारगर और पाररजस्ट्थजतकी-अनुकूल बनान े की व्यवस्ट्था की िाएगी। (5) आंचजलक महार्ोिना म ें वनरजहत और अवक्रजमत क्षेत्रों के सुधार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भ-ू िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी एव ं पर्ाावरण के ऐसे अन्द्र् पहलओंु से संबंजधत प्रावधान दकर्े िार्ेंगे जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह।ै (6) आंचजलक महार्ोिना म ें सभी जवद्यमान पूिा स्ट् थलों, ग्रामों एव ं िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों एव ं दकस्ट् मों, कृजष क्षेत्रों, ऊपिाऊ भूजम, उद्यानों एव ं उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्द्र् िल जनकार्ों और सहार्क मानजचत्र के साथ जनधाारण दकर्ा िाएगा। र्ोिना को वतामान एव ं प्रस्ट्ताजवत भू-उपर्ोग की जविेषताओं का ब्र्ौरा िेन े वाले मानजचत्रों द्वारा समर्थात दकर्ा िाएगा। (7) आंचजलक महार्ोिना म ें पाररजस्ट्थजतकी संवेिी िोन म ें जवकासात्मक दक्रर्ाकलापों को जवजनर्जमत करन े के जलए प्रावधान दकर्े िार्ेंग े और सारणी म ें र्थासूचीबद्ध प्रजतजषद्ध और जवजनर्जमत दक्रर्ाकलापों का पालन दकर्ा िाएगा और इसम ें स्ट् थानीर् िनता की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-अनुकूल जवकास का भी सुजनिर् एव ं संवधना दकर्ा िाएगा। (8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी । (9) राज्र् सरकार द्वारा अनुमोदित आंचजलक महार्ोिना, जनगरानी सजमजत के जलए एक सिं भा िस्ट्तावेि का काम करेगी तादक वह इस अजधसूचना के उपबंधों के अनुसार जनगरानी के अपन े कताव्यों का जनवाहन कर सके। 3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्.- राज्र् सरकार इस अजधसूचना के उपबधं ों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, र्था:-6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (1) भ-ू उपर्ोग.– पाररजस्ट्थजतकी संवेिी िोन म ें वनों, बागवानी क्षेत्रों, कृजष क्षेत्रों, मनोरंिन के जलए जचजन्द्हत उद्यानों और खुले स्ट्थानों का बड े वाजणजज्र्क दक्रर्ाकलापों र्ा प्रमुख आवासीर् पररसरों र्ा औद्योजगक दक्रर्ाकलापों के जलए प्रर्ोग र्ा पररवतान दकर्े िान े की अनुमजत नहीं होगी: परंतु भाग (क), म ें जवजनर्िाष्ट प्रर्ोिन स े जभन्न अन्द्र् दकसी प्रर्ोिन के जलए पाररजस्ट्थजतकी संवेिी िोन के भीतर कृजष और अन्द्र् भूजम के पररवतना की अनमु जत जनगरानी सजमजत की जसफाररि पर और क्षेत्रीर् नगर र्ोिना अजधजनर्म तथा तत्समर् लागू केन्द्र/राज्र् सरकार के अन्द्र् जनर्मों एव ं जवजनर्मों के अधीन तथा इस अजधसूचना के उपबंधों के अनुसार सक्षम प्राजधकारी के पूवा अनुमोिन स े और स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् िरूरतों को पूरा करन े के जलए िी िा सकेगी, र्था:- (i) जवद्यमान सडकों को चौडा करना, उन्द्ह ेंसुिढ़ृ करना और नई सडकों का जनमााण करना; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का जनमााण और नवीकरण; (iii) प्रिषू ण उत्पन्न न करने वाल ेलघु उद्योग; (iv) कुटीर उद्योग सजहत ग्राम उद्योग; पाररजस्ट्थजतकी पर्ाटन म ें सहार्क सुजवधा भण्डार, और स्ट्थानीर् सुजवधाएं तथा गृह वास; और (v) बढ़ावा दिर् े गर्े और पैराग्राफ-4 म ें उजल्लजखत दक्रर्ाकलापः परंत ु र्ह भी दक क्षेत्रीर् िहरी जनर्ोिन अजधजनर्म तथा राज्र् सरकार के अन्द्र् जनर्मों एव ं जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन के जबना एव ं संजवधान के अनुच्छेि 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अंतगता अनुसूजचत िनिाजत और अन्द्र् परंपरागत वन जनवासी (वन अजधकारों की मान्द्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनपु ालन दकए जबना वाजणजज्र्क और औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम के प्रर्ोग की अनुमजत नहीं िी िार्ेगी: परंत ु र्ह भी दक पाररजस्ट्थ जतकी संवेिी िोन के अतं गता आने वाली भूजम के अजभलेखों म ें हुई दकसी त्रुरट को, जनगरानी सजमजत के जवचार प्राि करने के पिात,् राज्र् सरकार द्वारा प्रत्र्ेक मामले म ें एक बार सुधारा िा सकेगा और उि त्रुरट को सुधारने की सूचना केंरीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् को ि े िी िाएगी: परंत ु र्ह भी दक उपर्ुाि त्रुरट को सुधारन े म,ें इस उप-परै ा म ें र्था उपबंजधत के जसवार्, दकसी भी ििा म ें भू- उपर्ोग का पररवतान िाजमल नहीं होगा। अनप्रर्िु र्ा अनुत् पािक कृजष क्षेत्रों म ें वनीकरण तथा पर्ाावासों की बहाली के कार्ाकलापों स े पुन: वनीकरण दकए िाने के प्रर्ास दकए िाएगं े। (2) प्राकृजतक िल स्रोत.- सभी प्राकृजतक झरनों के िलग्रहण क्षेत्रों की पहचान की िाएगी और आंचजलक महार्ोिना म ें उनके संरक्षण और बहाली की र्ोिना सजम् मजलत की िाएगी और राज्र् सरकार द्वारा दििा-जनिेि इस तरह स े तैर्ार दकए िाएंगे दक उसम ें ऐसे क्षेत्रों में र्ा उसके पास जवकास दक्रर्ाकलापों िो ऐसे क्षेत्रों के जलए हाजनकारक ह,ैं को प्रजतबजन्द्धत दकर्ा िा सके। (3) पर्टा न.– (क) पाररजस्ट्थजतकी संवेिी िोन म ें सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा वतामान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन संबंधी पर्टा न महार्ोिना के अनुसार होगा। (ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना, राज्र् के पर्ाावरण और वन जवभागों के परामि ा से राज्र् के पर्ाटन जवभाग द्वारा बनार्ी िाएगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना का एक घटक होगी।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िार्ेगी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबंधी दक्रर्ाकलाप जनम्न ानुसार जवजनर्जमत दकए िाएंग,े अथाात:् - (i) संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनम ें स े िो भी अजधक जनकट हो, दकसी नर् ेहोटल र्ा ररिॉटा के जनमाणा की अनुमजत नहीं होगी। परंत ु र्ह, पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर की िरू ी स े परे पाररजस्ट्थजतकी संवेिी िोन की सीमा तक पूवा पररभाजषत और अभीजहत क्षेत्रों म ें पर्टा न महार्ोिना के अनुसार, नए होटलों और ररिॉटा के जनमााण का अनुमजत िी िा सकेगी; (ii) पाररजस्ट्थजतकी संवेिी िोन के अन्द्िर सभी नए पर्ाटन दक्रर्ा-कलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार, केन्द्र सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा िारी दििाजनिेिों तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेने वाल े राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्ाटन संबंधी दििाजनिेिों (समर्-समर् पर र्था सिं ोजधत) के अनुसार ही दकर्ा िा सकेगा; (iii) आंचजलक महार्ोिना का अनुमोिन होन े तक, पर्ाटन के जवकास और जवद्यमान पर्टा न दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजिष्ट संवीक्षा तथा जनगरानी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुमजत िी िा सकेगी और पाररजस्ट्थजतकी संवेिी िोन म ें दकसी नए होटल, ररिॉटा र्ा वाजणजज्र्क प्रजतष्ठान के जनमााण की अनुमजत नहीं होगी। (4) प्राकृजतक जवरासत.– पाररजस्ट्थजतकी संवेिी िोन के अंतगता आने वाल े बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैस े दक िीन पलू ररज़वा क्षत्रे , िैल संरचना, िल प्रपात, झरने, िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण मागा, उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा एव ं संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ें एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (5) मानव जनर्मता जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेिी िोन म ें भवनों, सरं चनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ें एक जवरासत सरं क्षण र्ोिना बनार्ी िाएगी। (6) ध्व जन प्रिषू ण.- पाररजस्ट्थजतकी संवेिी िोन म ें ध्वजन प्रिषू ण की रोकथाम और जनर्ंत्रण पर्ाावरण (संरक्षण) अजधजनर्म, 1986 के अंतगात आन े वाल े और समर्-समर् पर र्था संिोजधत ध्वजन प्रिषू ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 म ें जनधााररत उपबंधों के अनुसार दकर्ा िाएगा । (7) वार् ु प्रिषू ण.- पाररजस्ट्थजतकी संवेिी िोन म,ें वार् ु प्रिषू ण का जनवारण और जनर्ंत्रण, वार् ु (प्रिषू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के अनुसार दकर्ा िाएगा । (8) बजहस्राव का जनस्ट्सरण.- पाररजस्ट्थजतकी संवेिी िोन म ें िोजधत बजहस्राव का जनस्ट्सरण, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 और उसके अधीन बनाए गए जनर्मों के अंतगात आन े वाले पर्ाावरणीर् प्रिषू कों के जनस्ट्सरण के जलए सामान्द्र् मानकों के अनुसार और राज्र् सरकार के द्वारा बनाए गए जनर्म, िो भी अजधक किोर हो, के उपबंधों के अनुसार होगा। (9) िोस अपजिष्ट.- िोस अपजिष्टों का जनपटान जनम्नजलजखत रूप म ें होगा-- (i) पाररजस्ट्थजतकी संवेिी िोन में िोस अपजिष्ट का जनपटान समर्-समर् पर र्था संिोजधत िोस अपजिष्ट प्रबंधन जनर्म, 2016, िो भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना सं. का.आ. 1357(अ), दिनांक 8 अप्रलै , 2016 द्वारा प्रकाजित दकए गए थ,े के उपबंधों के अनसु ार दकर्ा िाएगा;8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ii) अकाबाजनक सामग्री का जनपटान पाररजस्ट्थजतकी संवेिी िोन के बाहर पहचान दकए गए स्ट् थल पर दकसी पर्ाावरणीर् स्ट्वीकृत रीजत म ेंहोगा; (iii) पाररजस्ट्थजतकी संवेिी िोन में िोस अपजिष्ट ों को िलाने र्ा भष्म ीकृत करने और कचरा स्ट्थल की स्ट्थापना करने की अनुमजत नहीं होगी; (iv) अकाबाजनक सामग्री को पाररजस्ट्थजतकी संवेिी िोन के बाहर अजभज्ञात गए स्ट्थलों पर पर्ाावरण की िजृ ष्ट से स्ट्वीकार् ा तरीके से जनपटार्ा िा सकता ह ै और पाररजस्ट्थजतकी संवेिी िोन में िोस कचरे को िलाने र्ा भष्म दकर्े िाने की अनुमजत नहीं िी िाएगी। (10) िवै जचदकत्सा अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की समर्–समर् पर र्था संिोजधत अजधसूचना सं.सा.का.जन 343 (अ), दिनांक 28 माच,ा 2016 के तहत प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (11) टलाजस्ट्टक अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन में टलाजस्ट्टक अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसचू ना सं.सा.का.जन 340 (अ), दिनांक 18 माचा, 2016 के तहत प्रकाजित टलाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबधं ो के अनुसार दकर्ा िाएगा। (12) जनमाणा और जवध्वसं अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन में जनमााण और जवध्वंस अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं.सा.का.जन 317 (अ), दिनांक 29 माचा, 2016 के तहत प्रकाजित संजनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित तथा समर्-समर् पर र्था संिोजधत ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (14) सडक-र्ातार्ात.- सडक-र्ातार्ात को पर्ाावास-अनुकूल तरीके स े जवजनर्जमत दकर्ा िाएगा और इस संबंध म ें आंचजलक महार्ोिना म ें जविषे उपबंध िाजमल दकए िाएंग।े आंचजलक महार्ोिना के तैर्ार होने और राज्र् सरकार के सक्षम प्राजधकारी स े अनुमोदित होने तक, जनगरानी सजमजत संगत अजधजनर्मों और उनके तहत बनाए गए जनर्मों एव ं जवजनर्मों के अनुसार सडक-र्ातार्ात के अनुपालन की जनगरानी करेगी। (15) वाहन िजनत प्रिषू ण.- वाहन िजनत प्रिषू ण की रोकथाम और जनर्ंत्रण लागू जवजधर्ों के अनुसार दकर्ा िाएगा। स्ट्वच्छतर ईंधन िैसे दक सीएनिी, एलपीिी, आदि के उपर्ोग के जलए प्रर्ास दकए िाएगं े। (16) औद्योजगक ईकाइर्ा.ं - (क) रािपत्र म ें इस अजधसूचना के प्रकािन पर र्ा उसके पिात पाररजस्ट्थजतकी संवेिी िोन के भीतर नए प्रिषू णकारी उद्योगों की स्ट्थापना की अनुमजत नहीं िी िाएगी। (ख) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 म ें िारी मागाििाक जसद्धान्द्तों म ें दिर्े गर्े उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना म ें इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर-प्रिषू णकारी उद्योगों की अनुमजत िी िार्गे ी। इसके अजतररि, गरै प्रिषू णकारी कुटीर उद्योगों को भी बढ़ावा दिर्ा िाएगा। (17) पहाडी ढलानों का सरं क्षण.- पहाडी ढलानों का संरक्षण जनम्नानुसार दकर्ा िाएगा:-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 (क) आंचजलक महार्ोिना म ें पहाडी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनम ें दकसी भी जनमााण की अनुमजत नहीं होगी; (ख) जिन ढलानों र्ा जवद्यमान खडी पहाडी ढलानों म ें अत्र्जधक भू-क्षरण होता ह ै उनम ें दकसी भी जनमााण की अनमु जत नहीं होगी । 4. पाररजस्ट्थजतकी सवं िे ी िोन म ेंप्रजतबजन्द्धत र्ा जवजनर्जमत दकए िान े वाल े दक्रर्ाकलापों की सचू ी- पाररजस्ट्थजतकी संवेिी िोन म ें सभी दक्रर्ाकलाप पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) के उपबंधों और उसके अधीन बने जनर्मों, जिसम ें तटीर् जवजनर्मन िोन (सीआरिडे ), 2011 एवं पर्ावा रणीर् प्रभाव आकलन अजधसूचना (ईआईए), 2006 िाजमल भी ह,ै सजहत वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्द्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53) व अन्द्र् लाग ू जनर्मों के उपबंधों तथा उनम ें दकए गए संिोधनों के अनुसार संचाजलत होंगे और नीच े िी गई सारणी म ें जवजनर्िाष्ट रीजत स े जवजनर्जमत होंगे, र्था:- सारणी क्रम स.ं दक्रर्ाकलाप रटटपणी (1) (2) (3) क. प्रजतजषद्ध दक्रर्ाकलाप 1. वाजणजज्र्क खनन, पत्थर उत्खनन और (क) पाररजस्ट्थजतकी संवेिी िोन के अंतगात सच में रहने वाले जनवाजसर्ों की अपघषाण इकाइर्ां । घरेलू आवश्र्कताओं, जिसमें मकानों के जनमााण र्ा मरम्मत के जलए धरती को खोिना भी सजम्मजलत ह,ै के जसवार् सभी प्रकार के नए और जवद्यमान खनन (लघु और वृहत खजनि), पत्थर उत्खनन और अपघषाण इकाइर्ां तत्काल प्रभाव से प्रजतबजन्द्धत होंगी; (ख) खनन कार्ा माननीर् सवोच्च न्द्र्ार्ालर् के दिनांक 04-08-2006 के टी.एन.गोिावमान जथरुमुलपाि बनाम र्ूओआई के मामले में डब्ल्र्ू.पी. (सी) संख्र्ा 202/1995 और दिनांक 21-04-2014 में 2012 के डब्ल्र्ू.पी. (सी) सं. 435 में गोवा फाउंडेिन बनाम र्ूओआई के मामले और 2022 के आईए सं. 131377 में टी.एन. गोिावमान जथरुमुलपाि बनाम भारत संघ के मामले म ें माननीर् सवोच्च न्द्र्ार्ालर् के आिेि, दिनांक 26-04-2023 के आिेि, के अनुसार दकर्ा िाएगा। 2. प्रिषू ण (िल, वार्ु, मृिा, ध्वजन, आदि) पाररजस्ट्थजतकी संवेिी िोन म ें कोई नर्ा उद्योग लगाने और वतामान प्रिषू णकारी उद्योगों का जवस्ट्तार करने की अनुमजत नहीं होगीः उत्पन्न करने वाले उद्योगों की स्ट्थापना । परन्द्तु र्ह दक केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी माग ा ििका जसद्धान्द्तों में उद्योगों के वगीकरण के अनुसार िब तक दक अजधसूचना में ऐसा जवजनर्िाष्ट न हों, पाररजस्ट्थजतकी संवेिी िोन के भीतर गैर- प्रिषू णकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गैर- प्रिषू णकारी कुटीर उद्यागों को बढ़ावा दिर्ा िाएगा। 3. बडी िल जवद्युत पररर्ोिनाओं की प्रजतबजन्द्धत। स्ट्थापना । 4. दकसी पररसंकटमर् पिाथा का प्रर्ोग र्ा प्रजतबजन्द्धत। उत्पािन र्ा प्रस्ट्संकरण ।10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 5. प्राकृजतक िल दकसी भी प्रकार के वाजणजज्र्क जनमााण की अनमु जत नहीं िी िार्ेगी: परंतु स्ट् थानीर् लोगों को पैराग्राफ 3 के उप पैराग्राफ (1) में सूचीबद्ध दक्रर्ाकलापों सजहत उनके उपर्ोग के जलए उनकी भूजम में स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को पूरा करने जलए जनमााण करने की अनुमजत भवन उपजवजधर्ों के अनुसार िी िा सकेगी: परन्द्तु ऐसे लघ ु उद्योगों, िो प्रिषू ण उत् पन्द् न नहीं करते ह,ैं से संबंजधत जनमााण से आग े आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंग े। 13. गैर प्रिषू णकारी लघु उद्योग। फरवरी, 2016 में केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा िारी समर्-समर् पर संिोजधत उद्योगों के वगीकरण के अनुसार गैर-प्रिषू णकारी उद्योग और अपररसंकटमर्, लघ ु और सेवा उद्योग, कृजष, पुष्प कृजष, उद्यान कृजष र्ा पाररजस्ट्थजतकी संवेिी िोन से िेिी सामग्री से उत्पािों को उत्पन्न करने वाले कृजष आधाररत उद्योग सक्षम square kilometer and is situated in the Thanagazi, Tehla, Rajgarh, Alwar, Bansur and Malakhera Tehsils of Alwar district and Jamwaramgarh tehsil of Jaipur district in the State of Rajasthan. AND WHEREAS, the Sariska Wildlife Sanctuary was notified by Government of Rajasthan vide notification no. f.39(2) Rev.A/54 dated 5th August, 1958 with an area of 492 square kilometer of forest area included in Critical Tiger Habitat and 52.23 square kilometer revenue land area and the Jamwaramgarh Sanctuary which is included in Sariska Tiger Reserve was notified by Government of Rajasthan vide notification no. f.11(19) Rev.8/01 dated 31th May 1982. The Critical Tiger Habitat of Sariska Tiger Reserve was notified by State Government vide notification no. F3(34) Forest/2007, dated 28th December, 2007 over an area of 881.11 square kilometers. The buffer area of 332.23 square kilometers was notified vide notification No. F3(34) forest/2007, dated 06th July, 2012. Part of Jamwaramgarh sanctuary is included in the buffer area of Sariska Tiger Reserve. Eco-sensitive Zone (ESZ) of the remaing part of Jamwaramgarh Sanctuary has been declared by the Central Government vide notification number S.O. 6212 (E), dated 14 December, 2018. AND WHEREAS, the other important species (butterfly, insects, reptiles etc) present in the area are Banded Krait (Bungarus fasciatus), Cobra (Naja naja), Common Krait (Bungarus caeruleus), Fresh water or Swamp Crocodile (Crocodylus palustris), Indian python (Python molurus), North Indian Flap shelled Turtle (Lissemys punctata punctata), Rat Snake (Ptyas mucosus), Russell’s Viper (Pipera russelli), Saw-scaked Viper (Echis carinatus), The Sesert Monitor Lizard (Varanus griseus), Indian Chameleon (Chameleon zeylanicus), etc. AND WHEREAS, the rare floral species in the area are Arjun (Terminalia arjuna), Gugal (Commiphora mukul), Bahera (Terminalia bellerica), Dhaora (Anogeissus latifolia), Bijasal (Pterocarpus marsupium), Kadam (Mitragyna parvifolia) and rare faunal species Caracal (Felis caracal), endangered floral species are Gugal (Commiphora mukul), Katha (Akcacia catechu) and endangered faunal species Tiger (Panthera tigiris), Leopard (Panthera pardus) and threatened floral species are Tendu (Dispyros melanoxylon), Karaya (Sterculia urens) and threatened faunal species Tiger (Panthera tigiris), Leopard (Panthera pardus).[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 41 AND WHEREAS, an endemic floral species in the area are Dhok (Anogeissus pendula), Salar (Boswellia serrata), Katha (Akcacia catechu), Dhak (Butea monosperma), Ber (Zizphus jujuba, Z. mauritiana), Churel (Holoptelia intergrifolia), Awanla (Embellica officinalis) and endemic faunal species in the area are Tiger (Panthera tigiris), Leopard (Panthera pardus), Hyena(Hyaene hyaena), Jungle cat (Felis chaus), Porcupine (Hystrix indica), Small Indian civet, Sambhar (Cervus uncolor), Chital (Axis axis), Wild Boar (Sus scrofa), etc.. AND WHEREAS, the tiger reserve is unique as it is a part of Aravalli hill ranges having one of the densest forests in state and is one of the richest sanctuaries from the point of biodiversity. Nearly 20 species of mammalian, 11 species of reptiles, 2 species of amphibians, 374 species of birds and 420 species of plants have been identified. AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of Sariska Tiger Reserve as Eco- sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to extent varying from zero to 1.0 km from around the boundary of Sariska Tiger Reserve, in the State of Rajasthan as Sariska Tiger Reserve Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: 1. Extent and Boundaries of Sariska Tiger Reserve Eco-Sensitive Zone- (1) The extent of Eco-Sensitive Zone varies from zero to 24 km from the Sanctuaries i.e. Sariska Wildlife Sanctuary and Jamwa Ramgarh Wildlife Sanctuary. It varies from zero to 1.0 km from the boundary of the Sariska Tiger Reserve. The area of Eco-Sensitive Zone is 87.73 square kilometers. (3) The map of Eco sensitive Zone is appended as Annexure IIA, Annexure IIB, Annexure IIC, Annexure IID and Annexure IIE. (4) The latitudes and longitudes of the Sariska Tiger Reserve (Table A) and its Eco-Sensitive Zone (Table B) is appended as Annexure III. (5) The list of villages falling within Eco-Sensitive Zone along with co-ordinates of prominent points is appended as Annexure IV. 2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the Competent authority in the State. (2) The Zonal Master Plan for the Eco-Sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.42 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan: i. Environment; ii. Forest and Wildlife; iii. Agriculture; iv. Revenue; v. Urban Development; vi. Tourism; vii. Rural Development; viii. Irrigation and Flood Control; ix. Municipal; x. Panchayati Raj; xi. Public Works Department; and xii. Rajasthan State Pollution Control Board. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table and also ensure and promote eco-friendly development for livelihood security of local communities. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents and for activities such as:- (i) Widening and strengthening of existing roads and construction of new roads; (ii) Construction and renovation of infrastructure and civic amenities; (iii) Small scale industries not causing pollution; (iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) Promoted activities given under para 4;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 43 Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution of India or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007); Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the respective State Governments, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forests and Climate Change; Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph; Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas. (2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Governments in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone; a) the Eco-Tourism Master Plan shall be prepared by State Department of Tourism in consultation with State Departments of Environment and Forests; b) the Tourism Master Plan shall form a component of the Zonal Master Plan; c) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-Sensitive Zone; d) The activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometer from the boundary of the protected area or upto the extent of the Eco-Sensitive Zone, whichever is nearer; Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco- education and eco-development; (iii) until the Zonal Master Plan is prepared and approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-Sensitive Zone area. (4) Natural heritage.-All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan. (6) Noise pollution. -Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986 and amendments thereto.44 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (7) Air pollution. -Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and Environment (Protection) Act, 1986 and the rules made there under these Acts.. (8) Discharge of effluents. - The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and Environment (Protection) Act, 1986 and the rules made there under these Acts.. (9) Solid wastes.- Disposal of solid wastes shall be as under:- (i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste Management Rules, 2016 published by the Government of India in the erstwhile Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 and as amended from time to time; (ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non- biodegradable components; (iii) the biodegradable material shall be recycled preferably through composting or vermiculture; (iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall he permitted in the Eco-sensitive Zone. (10) Bio-medical waste. – The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 343 (E), dated the 28th March, 2016 as amended from time to time. (11) Plastic waste management. - The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management. - The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste. - The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time. (14) Vehicular traffic. – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution. - Prevention and control of vehicular Pollution shall be adhered to in accordance with applicable laws. Efforts shall be made for use of cleaner fuel such as CNG, LPG, etc. (16) Industrial units. – a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone. b) Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted. (17) Protection of hill slopes. - The protection of hill slopes shall be as under: (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted. (b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 45 TABLE S No Activity Description (1) (2) (3) A. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016, as amended from time to time and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority. 14. Functions of the Monitoring Committee. – (1) The Monitoring Committee shall, based on the actual site-specific conditions scrutinise, the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, vide number S.O. 1553 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case maybe, for prior environmental clearances under the provisions of the said notification. (2) The activities not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests vide number S.O. 1533 (E), dated the 14th September, 2006 and falling in the Eco- sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (3) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (4) The Monitoring Committee may invite representative or expert from concerned Department, representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case to case basis. (5) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in pro-forma specified in Annexure-VI, appended to this notification. (6) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures: - The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8.
